Box 159 Crystal Bay, MN 55323 RE: BUILDING & ZONING CODE ISSUES AT 1251 BRIAR STREET Dear Ms. Roth &Mr. Quast: On 09-24-99 the City of Orono issued permit#11916 to you to construct a new home on the existing foundation at 1251 Briar Street in Orono. As of this date the project has not had final inspections and an occupancy permit has not been issued. It has also come to the City's attention that you have erected a fabric covered boat shelter on the property. Therefore the City must require you to arrange an inspection to see if there are any code issues to resolve on the house so that a certificate of occupancy can be granted. The City requires building permits for structures built on property, however a fabric covered boat shelter does not meet any building code requirements. Therefore, the boat shelter must be removed from the property. A deadline of August 29, 2005 has been established for removal of the boat shelter and for arranging a final inspection on your house. If this deadline is not met, the City may initiate legal action. If you have any questions, feel free to contact me at my office. Box 159 Crystal Bay, MN 55323 RE: Final inspection and boat issue Dear Mr. Quast, This letter is to confinn issues discussed at our meeting on August 29, 2005. Due to a change in building inspection staff your project was overlooked for a period of time. The building pei-mit was issued on September 24, 1999. The last inspection was on May 2, 2000. I don't know what your conversation was with the previous inspectar, but The City has always followed the requirements of the Building Code with respect to occupancy. A temporary certificate of occupancy can be issued if all the life safety items are completed. The following list of requirements are always required before anyone is allowed to occupy a residence. 1. Handrails are required on any stairs with 4 or more risers. The handrail must be between 34" to 38" off the nosing of the treads and provide an approved gripping surface. The rail must be continuous, the full length of the stairs, and shall terminate in a newel post or safety terminals (see attached handout). 2. Open sides of stairs over 30" offthe floor must be provided with a railing 34" to 38" high with 4" maximum spacing. 3. Smoke detectors are required in bedrooms, the hallway leading to bedroorns, and in the basement. The smolce detectors must be wired into the electrical system, have a battery back up, and must be tied together so that if one sounds they all sound. 4. An overflow tube must be provided at the water heater to within 18" of the floor. 5. A landing and stairs must be provided at the front door. The miniinum size is 3' x 3'. Due to the substandard setbacic to the street the maximum size is 4' x 4'. The stairs shall be minimum 8" maximum rise and 9"nlinimum run. Guard rails and handrails shall be as discussed earlier in tl�is letter. � 6. Provide gas valve in a readily accessible location at the cook top. 7. A final electrical inspection shall be provided by the state electrical inspector. 8. In revie��ing the file, I found that the plumbin� was never inspected. Therefore, you must provide a manometer test on the plumbing system which must be witnessed by a building inspection staff inember. As I previously stated these are all life safety items and must be completed as soon as possible, but no later that September 30, 2005. In regards to the boat shelter, an extension has been granted per your request until October l, 2005. If you have any questions please feel free to call me at my office.
