Sec.13.04 RIGHTS OF SUBJECTS OF DATA •
Subd. 1. Type of data. The righu of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An individual asked[o supply priva[e or co�dential data concerning himself
shall be informed of: (a)the purpose and intended use of the requested data within the collecting state age�cy,political subdivision,or statewide
system;(b)whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or
refusing to supply private or confidenrial data;and(d)the identiry of other persons or entiries authorized by state or federal law to receive the data.
This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law
enforcement officer.
The commissioner of revenue mav nlace the notice reauired under this subdivision in the individual income tax or oronertv tax refund
instructions instead of oa those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the
subject of stored data on individuals,and whether it is dassified as public,private or confidenaal. Upon his further request,an individual who
is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires,shall be informed
of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this secdon is pending or additional data on the individual has been
collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data.
T'iie responsible authoriry may require the requesting person to pay the actual cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with
the request within that[ime,he shall so inform the individual,and may have an additional five days within which ro comply with the request,
excluding Saturdays, Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or
private data concerning himself. To exercise this right,an individual shall notify in writing the responsible authority describing the nature of the
disagreement. The responsible authority shall within 30 days either. (a)conect the data found to be inaccurate or incomplete and attempt ro nodfy
past recipients of inaccurate or incomplete data,including recipiencs named by the individual;or(b)notify the individual that he believes the data
to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The deterniic�adon of the responsible authoriry may be appealed pursuant to the provisions of the admuustradve procedure act relating
to contested cases.

I have a 2 car garage setting just offBayside Road that is half buried in the bank.
Over the years frost has heaved the floor and walls in and out to the point the
garage needs to be replaced. I would like to move the garage about 4-5'to the
east and put a stepped stone wall around the west and north of the new garage so
it essentially is not underground but on a slab. Could you grant a permit for that
work. It's my plan to have Don Ahlstrom be the contractor for this work and he is
familiar with the concept.

garage is inside the 50' set back and in front of the principle structure. Hard cover on the
property is not a problem from earlier work I've had done. I will be requesting a variance for the
reasons listed on the attached. Could you tell me how I apply for a variance and if this project
would be given consideration.

2. Present location has never been a problem from a safety or esthetics standpoint.
3. Neighbors will approve a variance and in fact share dock across the street haviing
egress and ingress rights across my property in their property titles. They use the
driveway to park.
4. Plan would be to build essentially the same size garage that would look like the one
existing.
5. To put the garage anywhere else on the property would create an eyesore as it could not
be made to blend in to the present home.

Your plan to construct a new two stall garage in the front street yard adjacent to Bayside Road
would not only require variance setback approvals but also a conditional use permit. The lot
is considered a through lot and to install an accessory structure on such a lot requires
conditional use permit approval.
I would suggest that you arrange to meet with a member of the Zoning staff so that we may
review the requirements for filing the land use application. The deadline for the October 21,
1996 meeting of the Planning Commission is September 27, 1996 (Friday before Noon). I
recommend that we meet as soon as possible to discuss the review process and information
needed to complete your application submittal.
Please contact my office at your earliest convenience so that we can arrange for a meeting to
discuss the filing of the application.
