We have reviewed the as-built grading plan for the new home at 3382 Bayside Road. The plan is dated 12-
20-11. We have the following comments with regards to engineering matters:
• The as-built plan and grading is acceptable from the city's engineering standpoint.
• We recommend that the Minnehaha Creek Watershed District review the streambank stabilization
work that was completed under their permit.

certificate of occupancy prior to the project being complete. As a result, a $10,000 escrow

Recitais
1. A building permit application has been fiied for construction of a new residence and a stream
bank stabilization project located at 3382 Bayside Road, the {"Subject Property"), legally described as attached as
"Exhibit A° Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the appiication and incur costs associated with said review
only if the Owner establishes an escrow to ensure reirnbursement to the City of its costs.
NOW THEREFORE,THE PARTI�S AGREE AS FOLLOWS:
9. DEPOSIT OF ESCROW FUNDS. Gontemporaneousiy with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. Ali accrued interest. if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for ali out-of-pocket costs the City has incurred (inciuding planning, engineering, in excess of $500, or legai
consuitant review) or wil! incur in reviewing the plan. Eiigibfe expenses shail be consistent wiEh expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that#he wark is completed in
accordance with the Starrnwater Polfution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial secunty may also be used by the City to eliminate any hazardous conditions assoc+ated with the
wark and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legai consultant review) associated with building permit 20'i0-00733 if compliance w'tth the
approved building permit is not accampfished.
3. MONTHLY BILLIIVG. As the City receives consultant biils for incurred casts, the City will in turn
send a bil( to the Owners. Owners shall bs responsible for payment to the City within 30 days of the Owners'
receipt of biil.
4. DISBURSEMENT FROM ESCROW ACCOUNT. {n the evenf that the Owners do not make payment
to the City within the#imeframe outiined in#3 above, shall issue a Stop Work Order until the flwners pay a!I exp2nses
invoiced pursuant fa #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the Ci#y has incurred.
5. CLOSING ESGROW. The Balance on deposit in the escrow, if any, si�all be returned to the
Owners when the review has been campieted and written notification is received from the Owners requesting the
tunds.
6. CERTIFY UNPAID CHARGES. If the project is abandaned by C?wners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balancs to the
subject property pursuant to Minn. Stat. §§415.p1 and 366.012.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants the
following: a variance to Orono Municipal Zoning Code Section 78-305(B) to allow
redevelopment of 3382 Bayside Road which consists of four separate tax parcels totaling 34,400
square feet in area where 87,120 square feet in area is required; a variance from Section 78-305
(B) allowing structure 48' from Crestview Avenue where a 50' setback is normally required and
11' from the north side lot line where a 30' setback is normally required; a variance to Section
78-1279 (1) to allow the home 60' from the OHWL of Stubbs Bay Creek where a 75' setback is
normally required; a variance from Section 78-1288 to allow 6.57% hardcover within the 0-75'
creek setback where 0% is normally allowed and to allow 33.3% hardcover within the 75'-250'
setback from the creek where 25% hardcover is normally allowed; and a conditional use permit
pursuant to Section 78-966 to conduct grading to stabilize the creek bank within 7�' of the
OHWL of Stubbs Bay Creek where grading is typically not permitted in order to allow
construction of a new home on the property and the installation of a footbridge crossing the
creek, subj ect to the following conditions:

"the Plans") submitted by the Applicants and annotated by City staff, attached to this
Resolution as Exhibits A, B and C. Any amendments to the Plans which are not in
conformity with City codes will require further Planning Commission and City Council
review.
2. Hardcover in the 0-75' zone shall not increase above the level of 1,357 s.f. or 6.57%.
Hardcover in the 75-250' zone shall be limited to 4,995 s.f. or 36.33% per the proposed
plan and hardcover allowance summary as depicted on Exhibit D. Applicants are advised
that any future requests to increase hardcover or change the nature of existinJapproved
hardcover shall require City approval, and increases in hardcover will not likely be
approved without concurrent reduction in existing hardcover.
3. The Applicants should provide evidence that the proposed footbridge has been
approved/permitted by the Minnehaha Creek Watershed District, the Minnesota
Department of Natural Resources and/or Army Corps of Engineers if necessary.
4. The decking on the proposed footbridge shall be no less than 50% permeable.
5. The following tax parcels shall be combined-into one tax parcel prior to-the issuance of a
building permit for the Property: OS-117-23-14-0034, OS-117-23-14-0035, 0�-117-23-14-
0036 and OS-117-23-14-0037.
