Per our telephone conversation of a few minutes ago, please be advised of the following:
1. The new gargage addition will have a full gutter system all the way around the structure. Those gutters will tie
in to, and be seamlessly connected to the existing gutter system which goes all the way around the house. We
will be using the existing down spouts from the existing gutter system to carry rain water from the roof to the
ground. For the new garage area, the two down spouts that will be taking water flow are the ones currently
located on the north and south sides of the current garage. The downspout on the south side drains into the
roughly 8 1/2 feet of side yard between our house and Scott's, and the one on the north side had drained into
what was a brick patio. As part of this garage addition, we have already removed the brick patio, and the area
that was brick will now be a vegetable/flower garden, so that down spout will now drain into this garden.
2. We were not planning to change the topgraphy or slope on the south side of the house. That is the area which
is currently mostly concrete. We have already removed most of this concrete, so absorbtion of rainfall into the
ground on this side of the house should in fact be increased, as it will now not be flowing down a fairly steep
concrete walkway. We are going to add plantings on this south side of the house next spring once the snow
melts, but have not picked out the exact type of plants yet, and will probably let the experts at either Otten Bros or
Bachman's do that for us. By the time the construction is done this fall it will be too late to plant.
I will print out and bring over later this afternoon a annotated survey for the south side of the house that shows the
anticipated location of the soil erosion fencing during the construction process, and on that same expanded
survey I will add in arrows showing existing water flow. The direction of water flow should not change once the
new garage is in. As noted much earlier in this process, the entire area to be covered by the new garage is
already hard cover, and thus the new garage is not creating any additional water flow to be absorbed by the
remaining lawn, flowers, etc than is already the case.

While closing out permit project files, I noticed that we have not received an as-built survey or
hardcover calculations for the garage addition at 1513 Bay Ridge Road. A requirement for
closing out the permit and refunding the $2,500 currently held in escrow is submittal of an as-
built survey and hardcover calculations.
In order to being the process for the release of the escrow funds, please submit an as-built
survey and hardcover calculations which reflects all improvements to the property. Attached is
a copy of our survey requirements and hardcover information and calculations sheets. Please
note, the snow must be melted enough for the surveyor to accurately document existing
topography. Upon our engineers review and approval of the as-built survey, we can then
process the escrow refund.

BUILDING PERMIT ESCROW AGREEMENT
Land Use Application#11-3516 and Building Permit#2011-01180
AGREEMENT made this 1,3 day of �b� , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Robert Snvder and Pamela Snvder ("Owners").
Recitals
1. A land use application and building permit application have been filed for a garage addition
located at 1513 Bay Ridge Road the ("Subject Property"), legally described as Tract H and Tract K, Registered
Land Survey No. 192, Hennepin County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with Land Use Application #11-3516 and Building Permit
#2011-01180 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject roperty pursuant to Minn. Stat. §§415.01 and 366.012.

Applicant when the review has been completed.

Recitals
1. A land use application and building permit application have been filed for a garage addition
located at 1513 Bay Ridge Road the ("Subject Property"), legally described as Tract H and Tract K, Registered
Land Survey No. 192, Hennepin County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with Land Use Application #11-3516 and Building Permit
#2011-01180 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.

While closing out permit project files, I noticed that we have not received an as-built survey or
hardcover calculations for the garage addition at 1513 Bay Ridge Road. A requirement for
closing out the permit and refunding the $2,500 currently held in escrow is submittal of an as-
built survey and hardcover calculations.
In order to being the process for the release of the escrow funds, please submit an as-built
survey and hardcover calculations which reflects all improvements to the property. Attached is
a copy of our survey requirements and hardcover information and calculations sheets. Please
note, the snow must be melted enough for the surveyor to accurately document existing
topography. Upon our engineers review and approval of the as-built survey, we can then
process the escrow refund.
