ENERGY ENVELOPE CALCULATIONS
1473 BAY RIDGE ROAD
The enclosed energy envelope calculations are based on the composite of the existing home, the new
sun room and the new bedroom addition. The total project was recently presented to the Orono
Planning Commission and City Council, and received approval for side setback and hardcover
variances.
The bedroom/garage addition is sited where the existing septic tanks are located. Since the
neighborhood has unanimously petitioned for city sewer, we are hopeful that municipal sewer will
come soon. If not, we will put in a new onsite mound septic system (we would be obligated to do
so) and then proceed with the bedroom/garage addition. Therefore, it seems very appropriate to
analyze the entire project from an energy envelope standpoint. The entire envelope meets the code.
The total calculation shows an allowable envelope of 342.07 while the actual would be 338.47,
therefore more efficient than the code. If the bedroom addition is not included, the allowable
envelope would be 311.51 while the actual would be 316.63.

Sec.13.04 RIGHTS OF SLBJECTS OF DATA
Subdivision l. Type of data. The rights of individual on whom the data is stored or
to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or conf'idential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may,place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who
is the subject of stored private or public data on individuals shall be shown the data without any
charge to hun and, if he desires, shall be informed of the content and meaning of that data.
After an individual has been shown the private data and informed of its meaning, the data need
not be disclosed to him for six months thereafter unless a dispute or action pursuant to this
section is pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by the
individual subject of the data. The responsible authority may require the requesting person to
pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature of
the disagreement. The responsible authority shall within 30 days either: (a) conect the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that
he believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions
of the administrative procedure act relating to contested cases.

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS� 10.23, SUBDIVISION 6 (B), 10.22, SUBDIVISION 2,
AND 10.56, SUBDIVISION 16 (L)
FILE NO. 2084
WHEREAS, Thomas R. McCune (hereinafter "the applicant"j is the owner or
the property located at 1473 Bay Ridge Road within the City of Orono (hereinafter "the� City")
and legally described as follows:
Exhibit A attached (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a variance to Municipal
Zoning Code Section 10.23, Subdivision 6 (B) to permit the construction of a
garage/bedroom/bath addition to be located 10' from the side lot line where a 30' side setback
is normally required, and construction of a sunroom located 27' from the side lot line where
a 30' setback is normally required, and a variance to Sections 10.22, Subdivision 2 and 10.56,
Subdivision 16 (L) to allow 26.7% hardcover in the 75-250' zone where only 25% hardcover
is normally allowed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
l. This application was reviewed as Zoning File #2084.
2. The property is located in the LR-lA Single Family Lakeshore Residential
Zoning District.
3. The Orono Planning Commission reviewed this application on November 20,
1995 and recommended approval of the proposed variances based upon the
following findings:
A. The proposed side setback of 10' for the garage and 27' for the sunroom
instead of the required 30', is consistent with other development in the
neighborhood.

B. The new garage addition will result in the removal of the existing
detached garage which is located less than 3' from the south side lot line
where current standards for a detached garage would require a 10'
minimum setback, thereby eliminating this non-conforming structure.
C. The nroposed location of the garage/bedroom/bath addition in the
northerly half of the properly will minimize �he amount of driveway
hardcover in the 75-250' zone.
D. The proposed sunroom is over an existing deck and therefore constitutes
no new hardcover in the 75-250' zone. Further, the proposed sunroom
does not encroach on the average lakeshore setback, and its location 27'
from the lot line will have no impact on neighboring properties.
E. The increase in hardcover on the property from 23.9% to 26.7% is being
minimized by removal of a portion of the existing deck, as well as
removal of the detached garage and existing sidewalk. Hardcover in the
250-500' zone of 19.9% where 30% would be allowed also is a positive
aspect of the proposal.
F. Because the e�cisting septic system is located in the area of the proposed
garage/bedroom/bath addition, and because that septic system must remain
in use untiUunless municipal sewer is provided to the property, it is
appropriate that construction of this addition be delayed until such time
that sewer is available, while the sunroom addition will not be hindered
by the septic system location.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.

5. The City Council fmds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
properly right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance
to Municipal Zoning Code Section 10.23 Subdivision 6 (B) to allow a side setback of 10' for
the garage/bedroom/bath addition and a side setback of 27' for the sunroom addition, where 30'
side setbacks are normally required, and grants a variance to Sections 10.22, Subdivision 2 and
10.56, Subdivision 16 (L) to allow hardcover in the 75-250' lakeshore setback zone at 26.7%
where only 25% hardcover is normally allowed, subject to the following conditions:
l. Hardcover in the 75-250' zone shall not exceed 5,425 s.f. or 26.7% per the
hardcover schedule and diagram attached to this resolution as Exhibit B. All
hardcover to be removed in the existing deck area shall be removed prior to
footing inspection for the new sunroom. Occupancy of the new
garage/bedroom/bath addition shall not occur until the existing detached garage,
blacktop driveway and sidewalk have been removed. Applicant is advised that
any future proposals for hardcover in the 75-250' zone will require a variance
application, and might be approved only in conjunction with concurrent removals
of existing hardcover, resulting in no hardcover increase. The standard 30%
hardcover allowance in the 250-500' zone shall be reduced by the 350 s.f.
overage in the 75-250' zone.
2. The new driveway to be located along the north lot line shall be constructed no
closer than 5' from the north lot line to allow for snow storage, etc.

3. A permit for the garage/bedroom/bath addition shall not be issued by the City
until such time that municipal sewer is available for connection to the property
or until such time that a new conforming septic system has been installed.
4. A canstruction permit for the sunroom shall not be issued until one of the
follawin� occurs:
a. Applicant executes a "Septic Sysiem Upgrade Agreement and provides
��
the required Letter of Credit to ensure that the septic system will be
upgraded in a timely manner absent the installation of municipal sewer;
or
b. The City Council has ordered the installation of municipal sewer to serve
the property; or
c. A new conforming septic system has been installed on the property.
5 e Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit �-ithin one year of the date of Council approval, or this variance will
expire on that date (December 11, 1996).
6. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
7. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby a�rees to the recording of this resolution in the Chain of Title of the
property.

successors and assigns, (hereinafter called "Property Owner").
�TNESSETH:
WHEREAS, the Property Owner is the owner of certain property and has made
application to the City of Orono for� a�building permit to construct improvements on such real
property legally described on E�ibrt A attached hereto and made a part hereof (the "Property");
and
WHEREAS, the septic system serving the property has been determined by the City
to be non-conforming; and
WHEREAS, the Orono Municipal Zoning Code Section 10.�6, Subdivision 17 (C)
requires that a non-conforming sewage treatment system as defined in Section 12.30 and located
��
within the Shoreland Overlay District must be upgraded and made conforming, at a minimum, at
any time a permit or variance of any type is required ior any i.-nprovement on, or use of, `u��
property. Further, the non-conforming sewage treatment system provisions of Section 12.30 shall
apply to all shoreland areas"; and
WHEREAS, the Property is within the Shoreland Overlay District; and
WHEREAS, the Property Owner desires to obtain a permit for improvements to the
Prooerty at this time but due to weather constraints cannot complete the required septic system
upgrade until the 1996 construction year; and �`7`�

WHEREAS, the City Council is currently considering whether installation of
municipal �sewer is appropriate for the neighborhood which includes the Property, but has not at this
time determined whether municipal sewer will be provided to the neighborhood or to the Property.
NOW, THEREFORE, in consideration of the premises and of the mutual promises
and conditions hereinafter contained; it is hereby agreed as follows:
1. Propertv Improvements: In accordance with the policies and ordinances of the City, the
following described private improvements are proposed to be constructed by the Property
Owner or his/her contractor, who has applied to the Ciiy for a building pernut for said
private property improvements (the "Properry Improvements"):
a. Interior remodeling.
b. Sunroom addition. �

2. Issuance of Buildin� Permit for Propertv Im�rovements_ The City agrees to issue a building
permit for the Property Improvements at this time, subject to conformance with all current
City standards and ordinances ior ali applicabie work.
3. SeQtic Svstem Up r� ade_ In accordance with the ordinances and requirements of the City,
the Property Owner hereby agrees to complete the required upgrade of the septic system no
later than July 31, 1996 (the "Completion Date").

4. Septic Svstem U�arade Installation: The design location, construction, installation and
materials for septic system upgrade shall be in accordance with plans and specifications to
be approved by the City prior to installation (the "Septic Improvements").
5. Automatic E}ctension and Reconsideration: The Property Owner may request that the City
Council reconsider the terms of this agreement if, thirty (30) days prior to the Completion
Date, the City Council has made no decision whether municipal sewer will be provided to
the neighborhood and property.
A. Automatic e�ension. If the City Council has not by thirty (30) days prior to the
Completion Date made a decision whether municipal sewer will be provided to the
neighborhood and the property, the Completion Date will be automatically extended
to July 31, 1997 (the "Extended Completion Date") upon receipt prior to July 31,
1996 ot a one year eatension of the ' ' discussed in Item o below.

B. Im�act of decision to provide sewer. In the event that the City Counci pnor to the
Completion Date (or prior to the E�ctended Completion Date) makes a decision to
provide municipal sewer with an expected sewer construction start within two years
of the Completion Date (or Extended Completion Date), the Septic Improvements
clause of this agreement shall be declared null and void and the City shall
immediately release the performance deposit. However, if the expected sewer
construction start is more than two years after the Completion Date (or Extended
Completion Date), the City Council shall determine whether or to what e�ctent Septic
Improvements shall be required and shall establish a required Completion Date if
necessary.
C. In the event the City Council prior to the Completion Date (or prior to the Extended
Completion Date) determines that municipal sewer will not be provided to the
neighborhood or the property in the foreseeable future, the Property Owner shall
complete the Septic Improvements by the Completion Date (or E�ctended Completion
Date) unless granted an extension by the City Council.
6. Performance Deposit: ror the purposes of assuring to �,'�e Cit�y that t�he Septic Imp:overner_ts
will be completed according to the terms of this agreement, the Property Owner has
provided to the City at;the time of the execution of this agreement a performance deposit
in a form satisfactory to the City providing that the City is able to draw upon such
performance deposit in its sole discretion to complete the Septic Improvements if the
Properry Owner fails to satisfactorily complete the work prior to the Completion Date. The
amount of the performance deposit shall not be reduced before substantial completion of the
Septic Improvements. The term of the performance deposit shall be a period of one year.
City shall provide a release of the performance deposit to Property Owner and the
appropriate fmancial institution upon acceptance of the Septic Improvements.

7. Bindin� Effect: The terms and provisions hereof shall be binding upon and inure to the
benefit of the heirs, representatives, successors and assigns of the parties hereto and shall
be binding deemed covenants r�n_ning with the land. References herein to Property Owner,
if there be more than one, shall mean each and alI of them. This ab eement shall be
executed by the Property Owner and City and shall be placed of record so as to give notice
hereof to subsequent purchasers and encumbrancers of all or any part of the properry, and
all recording fees, if any, shall be paid by the Property O��ner.
8. Notices: Whenever in this agreement, it shall be required or permitted that notice or
demand be given or served by either party to this agreement to or on the other party, such
notice or demand shall be delivered personally or mailed by United States certified mail
(return receipt requested) to the addresses set forth below. Such notice or demand shall be
deemed timely given when delivered personally or when deposited in the mail in accordance
�vith the above.

9. Disclaimer bv Citv: It is understood and agreed that the City, the City Council, and the
agents and employees of the City shall not be personally liable or responsible in any manner
to the Property Owner or the Property Owner's contractors, subcontractors, materialmen,
laborers, or any other person, firm or corporation, for any debt, claim, demand, damages,
actions, or causes of action of any kind or character, arising out of or by reason of the
execution of this agreement or the performance and completion of the Septic Improvements.
10. Hold Harmless and Indemnification: The Property Owner shall indemnify and hold hannless
the City, the City Council, and the agents and employees of the City from and against all
claims, damages, losses a: expcnses, includir.D attorne� fees, whicr t�he Cit��, City Coun�il
and agents and employees of the City may suffer or for which it may be held liable, arising
out of or resulting from the assertion against them of any claims, debts or obligations in
consequence of the performance of this agreement by the Properry Owner, its employees,
agents or subcontractors, whether or not caused in part by a party indemnified hereunder.
11. Remedv for Default: Default by the Property Owner of any of the terms of this agreement
shall automatically result in the suspension or withholding of all permits, licenses, occupancy
certificates or other authorizations issued by the City in connection with the Property, and
may, at City's sole discretion, give rise to a draw upon the performance deposit by City to
remedy such default_

A. The Property Owner hereby grants to the City, its agents and its employees, the ri�ht
to enter on the Property for the specific purpose of constructing or completing the
Septic Improvements should the Property Owner not complete those Septic
Improvements by the Completion Date.
B. The remedies afforded to the City under this Section shall be in addition to any other
remedies which the City may be entitled by law or equity or other agreement.
