The following draft is what I would propose to immediately put into a letter or email to Alness' and their builder, surveyor and attorney: On August 1 St I met with Sta.cy Alness and Dean Johnson to review their latest building plan, at their request,to confirm they were headed in the right direction. Dean provided what he described as an incomplete plan set, still a work in progress. Their goal and intent was/is to make the upper floor of the garage wing meet the definition of a half-story. We reviewed the definition of half story. By Orono Code defuution: Half sto�y means the uppermost floor of a building in which (i)the intersection of the exterior wall and the roof is not more than three feet above the floor elevation, and (ii)not more than 60 percent of the floor area within the exterior walls of the uppermost floor exceeds five feet in height as measured from the floor to the rafters. Floors exceeding these parameters sha11 be deemed a full story. The last page of that plan set shows three cross-sections through the garage wing of the house. See Attachment A- I have labeled the cross sections"left", "middle", and"right"for easy reference. - The left cross-section is based on the original plans that clearly exceed the half story requirements because the exterior wall intersects the roof at a point approximately 8 feet above the floor, and 100% of the floor area measured from the floor to the rafters exceeds five feet in height. - The middle cross section correctly shows the exterior wall intersecting the roof at(approximately-not dimensioned) 3 feet above the floor. However, with the proposed 12/12 roof pitch,more than 60% of the floor area has a height exceeding 5 feet as measured from the floor to the rafters. In order have no more than 60% of the floor area exceeding five feet in height as measured from the floor to the rafters, it was agreed that the most likely solution was to decrease the roof pitch. We agreed that the middle cross section was clearly on the right track and needed some refinement in order to be considered as a half-story. - The right cross section proposed to use a 5-foot wall truss. That point is not defined by the underside or any other part of a roof overhang. It must be defined by the extended line of the outer surface of the exterior wall and the upper surface of the roof. - The point at which the interior height is measured, is from the floor to the rafters. It is not measured to some point along the lower edge of a scissor truss or some other internal structural member that is lower than the rafters. - The area between the bottom of the rafters and the floor that has a height of more than 5 feet, cannot exceed 60%of the floor area, in order for the condition to be met. An analysis of the house wing has also been completed (see separate attachment). I have briefly reviewed the updated survey which came in yesterday(Tuesday August 12) and it shows the house wing being lowered 2.0 feet into the ground with the main floor now being at elev. 949.2'. In order to determine whether dropping it 2 feet accomplished the goal, I used an iterative process that dropped it in 1-foot increments until it reached the 50%exposed standard. My calculations indicate that the main floor would have to be lowered to elev. 948.7' in order for the lower level to be defined as a basement. The definition of building height states that "A�tificially raising the grade adjacent to the foundation of a structure (by filling or by a combination of filling and retaining walls) above the suprounding natural terrain shall not be allowed as a method for converting a defined story to a defined basement, �egardless of any other benefits to the properry of such action. Finished grade that increases more than one foot fpom existing ground level shall be considered as artificiallv raisinF the Frade."Mark Gronberg had suggested that raising the height of finished grade around the foundation by no more than one foot above the existing grade could be used as a method to make the height work if the house needed to go more than 2 feet into the ground. I agreed, and then fully expected that the grading plan would show some filling around the foundation. However,the submitted grading plan does the opposite—it excavates along the foundation to create drainage swales, and therefore doesn't accomplish anything. The other option Dean had offered was to use 18"trusses instead of 24" trusses for the main floor. The downside of that is the need for an additional step down in the interior stairway system. The house wing revisions supplied to date have not accomplished the goal of making the house wing lower level a basement. Soren — I have not completed the staff report on this, and I'm not sure whether it makes any sense to bring it back to the PC next Monday. As it stands right now, the applicants have not submitted a plan that works. Bottom Line—All of this has been submitted too late for the applicants to react to my analysis in time for Monday's PC meeting. I am not in the office Friday and tomorrow is already totally filled up with other stuff. My staff report at this point z . y � 't►u,ill �e short and sweet: 1) They haven't yet successfully addressed the stories issues. 2) They have lowered the peak height to 982' which is about 2 feet lower than the original plan, leaving the peak 3.5 feet above the Meerkins-Weiler walkout patio and 5.9 feet below their main floor deck. 3) We reject the neighbor's attorney's notion that the Alness patio is structural coverage by virtue of being adjacent to a single house wall. 4) We reject neighbor's attorney's interpretation of our bluff ordinance—the site does not contain a bluff. 5) Staff recommends that PC recommend denial of the height (number of stories) variance that is still needed. PC should make a recommendation with regards to the average setback variance— does the reduced peak height mitigate the neighbor's view issues regarding a new home extending past the average setback line? Lets discuss how we/I should proceed, given the circumstances. Could give applicants the option of removing from agenda, but may make the most sense to just go to PC as is... The survey appears to conform to the intent of the approved plan. An inspector should conduct a site visit and confirm the following: a. The survey accurately depicts conditions on the ground. b. The site is stabilized to the point the any remaining erosion control can be removed. 2. As of this Tuesday it appears that there is still fill in the wetland across from the home. I wanted to check in and see how we are doing clearing up the remaining questions you have on the survey. Attached are two aerial pictures that show the two retaining walls. The first stone wall ran about half way from the road to the SW corner of the house. It was ground level and went up to approximately 6 foot high. The second retaining wall was a railroad tie wall that was on or nearly on the property line and went 4 feet above the stone wall. It went ran the entire length of the house along the west side to the NW corner of the house. Attached are a couple more pictures of the walls at each end of the house. I don't have any pictures of the wall next to the house because it was over grown and very difficult to walk along that area because of debris from the previous home owner that used that area as a dump. Finally, attached is the approval letter from Mike and Katie Schroeder. You can also contact Mike or Katie Schroeder with any questions. They can answer any questions about the existence of two retaining walls along their property line prior to the construction. They will also let you know how pleased they are with the clean up and upgrades that I have done to the property line area to clean up the old mess. The As-built survey shows proposed grades and contours. An As-built should depict as-built/existing elevations and grades as all proposed work should be complete at the point the As-built is prepared. No"proposed" contours or improvements should be shown. 2. The As-built spot elevations should be extrapolated into contours per the City Survey requirements (attached). 3. The contour lines and the elevations listed for the retaining walls do not make sense together. As depicted the retaining walls do not appear to be retaining any soil. 4. It appears a retaining wall was constructed onto the neighboring property on the south west side of the property. Was permission granted by the neighboring property owner? If so, a copy of said permission should be provided to the City to be included in the street file. 5. Retaining walls are not allowed within 5 feet of a property boundary without a variance and conditional use permit. There was no CUP/Variance approved to permit the wall in question. The wall should be removed and the property graded as proposed, or an after-the-fact Variance and CUP application should be submitted. The after- the-fact fee is 2x $700 application fee. 6. Resolution 6546 granted CUP and variance approvals regarding the fill below the 100-year floodplain elevation of 931.5'. Based on the as-built wall elevations on the east side of the house it appears you have exceeded the approved fill amounts. Please re-calculate and provide the as-built cut and fill quantities below 931.5'elevation contour and show the cut and filled areas. Also, provide as-built 1/2 foot contours between the middle of the home and the eastern lakeshore for our verification. The swale created to mitigate the floodplain filling should be evident in the topography. 7. The as-built hardcover should be calculated on the City's hardcover form (attached). 8. As of July 25th, there was a pile of soil deposited in the city ROW and wetland area directly opposite the house (west side of the road). This must be removed. There are a number of issues to resolve. Please contact me if you have specific questions. At this time the project is not complete/in compliance with the approved plan. The final certificate of occupancy cannot be issued until all the issues are resolved.
