A RESOLUTION APPROVING THE PLANNED RESIDENTIAL DEVELOPMENT AND PLAT OF FLEMING TRAIL FILE NO. 1691 & 1702 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a Planned Residential Development and subdivision of a plat by the City of Long Lake, a municipal corporation, (hereinafter "the subdivider"); and • WHEREAS, on December 9, 1991 the.City conceptually approved a conditional use permit, Resolution No. 3051, for a Planned Residential Development of 13 single family detached residential units witYun the RR-1B Residential Zoning District requiring a minimum of 26 acres; the properry consists of 24.5 acres. The area variance was approved per the 26 fmdings set forth in that same resolution. The proposed development plan for the property was � found to satisfy all pertinent standards of Section 10.20, Subdivision 3 (H) of the Planned Residential Development ordinance. Approval of the conditional use permit is based on the subdivider agreeing to execute development covenants to govem the future development of the properry at the time the property is detached and annexed by the City of Long Lake; and WHEREAS, on April 22, 1993, the Metropolitan Council approved the City of Orono's application of a third amendment of the Community Management Plan; and � � � � WHEREAS, on May 24, 1993, the Orono Ciry Council approved Resolution No. , approving Comprehensive Plan Amendment No. 3 that would realign the Metropolitan � Urban Service Area (hereinafter "MUSA") within the City. The subdivider's properry would now be included within the MUSA and may be served from existing Metropolitan Waste Control Commission's facilities located within the properry; and • Page 1 of 4 . ror�so�a�ao�w � O� O :. CITY of ORONO • � ;��=� RESOLUTION OF THE CITY COUNCIL `� �^ � �� �, No. 3 � a �. � y � '��� ' 4�G k'ESHO WHEREAS, the City of Orono and subdivider have executed the Declaration of Covenants that shall be kept at both the administrative of�ces of the City of Orono and the City of Long Lake. The covenants provide special limitations and guidelines for the development and future use of the properties; and WI�REAS, fee ownership of Outlots A and B shall remain with the Ciry of Long Lake. The outlots have been used as area credit for 13 unit density of cunent subdivision and can never be used as area credit for a future subdivision within the City of Lorig Lake; and VVH�REAS, the subdivision of a Planned Residential Development has been found to meet all pertinent standards of the subdivision regulations of the City, fmding that each lot is of a size and configuration that will allow its use as a single family residence to be fully developed without the need of any variances; and � � � WHEREAS, the subdivider has completed all requirements of the platting • regulations of the City, including: 1. Completion of all the requirements of Resolution No. 3051 that granted preliminary approval of the subdivision and conceptual approval of the Planned Residential Development.. 2. Dedication on the plat of drainage and utiliry easements. 3. Dedication on the plat of right-of-way for public streets and roads shown as Orono Orchard Road North, Fleming Trail and Fleming Circle. 4. Execution of a flowage and conservation easement providing for limitations on the use of wetlands and/or drainageways described therein and shown on the plat as drainage easements. 5. Payment to the City for the legal review and filing of the plat, easements and covenants in the amount of $150.00. 6. ' 1. Outlot A shall be set aside as area credit for the 13 unit Planned Residential Development. Any future alteration of the creek or former lagoon site, now wetlands, shall be approved by the appropriate state agencies and local watershed district. 2. Outlot B shall continue to provide access to the MWCC lift station and may provide future pedestrian access to the north via existing railroad viaduct. � 3. Final annexation of this property shall not alter the municipal boundaries as they currently exist to Orono Orchard Road. • . 4. The City of Long Lake shall complete the vacation of the drainage and utility . easment that intersects Lots 1 and 2, Block 2, Fleming Trail prior to the development of the property and in accordance with the needs of the Metro Waste Control Commission. 5. The City of Long Lake shall assume all responsibility for seeing that future development of the property shall conform to the special standards set forth in the Declaration of Covenants. 6. Prior to the installation of the required storm water facilities and road improvements, the City of Long Lake shall complete all requirements of the Department of Natural Resources and Mimiehaha Creek Watershed Dislrict's permits. � 7.
