A RESOLUTION TO AMEND THE STUBBS BAY
SAIVITARY SEWER ASSESSMENT ROLL -
REDUCTION OF PRINCIPAL AMOUNT OF ASSESSMENT
FOR PROPERTY LOCATED AT 85 CYGNET PLACE
WHEREAS, on July Z7, 1992 the Orono City Council adopted Resolution#3145
to adopt the Stubbs Bay Sanitary Sewer Assessment Roll; and
. WHEREAS, Grego.ry J. Ehalt is owner of the properry legally described as Lot
3, Block 1, Swan Lake Addition, Hennepin County, Minnesota; also described as PINS O4-117-
23-22-0009 (hereinafter "the property"); and
WHEREAS, the assessment roll adopted in Resolution #3145 set the principal
amount of the assessment for the property at $18,880.00; and �
• WHEREAS the ro e is a vacant lot located ad'acent to and owned in

common with Mr. Ehalt's homestead properry at 105 Cygnet Place; and
WHEREAS, Orono Municipal Zoning Code Section 10:03, Subdivision 6 (B),
states "the separation by the transfer or sale of non-conforming undeveloped lots not served by
public sanitary sewer, aligned in a contiguous arrangement, undivided by public or private road �
or road easement and under same or common ownership is not permitted without Council
approval"; and
WHEREAS, adherence to said Section 10.03, Subdivision 6 (B) has in the past
resulted in Ciry Council denial of buildabiliry of substandard (non-conforming) common
ownership lots in the unsewered zone; and
WHEREAS, the property is 1.1 acre in area in the RR-1B Rural Residential
Zoning District which requires a minimum lot size of 2.0 acres, and the property prior to the ,
Stubbs Bay Sewer Project was not served with municipal sewer, and therefore was subject to
Section 10.03, Subdivision 6 (B); and - i

� WHEREAS, without municipal sewer, the lot was considered by the City as not
buildable, and provision of municipal sewer service to the property would most likely result in
the lot becoming buildable with only a lot area variance required; and
;
" �WHEREAS, Mr. Ehalt formally appealed the assessment amount through the
� legally prescribed method, claiming that the lot is similar in size and character with other
{� developed lots in the neigflborhood and that the City likely would have granted the necessary
variances as it had in the past for other substandard lots in the neighborhood, if Mr. Ehalt had
made such an application to the City in the past; and

WI�REAS, Mr. Ehalt further claimed that as a result of sewer availability the
properry would not gain $18,880.00 in value; and
WHEREAS, the City and Mr. Ehalt agreed that a reduction of the assessment to
� $14,000.00 would be acceptable. �

'; NOW THEREFORE BE IT RESOLVED, that the Stubbs Bay Sanitary Sewer
� Assessment Roll is hereby amended to revise the principal assessment amount from $18,880.00
� to $14,000.00. . .
