A RESOLUTION GRANTING PRELIl��TARY + �APPROVAL OF A CLASS III SUBDIVISION � FOR THE RUSSELL LUND ESTATE - FILE NO. 1818 WHEREAS, Tres Lund and Dario Anselmo authorized representatives of the Russell Lund Estate on March 26, 1993, filed a formal subdivision application with the City for approval of a two lot residential plat of properry legally described as: Lots 1, 2 and 3, Block 1, Vasa Park, Hennepin County, Minnesota (hereinafter "the ProPertS,��)� and ; WI�REAS, after due published and mailed notice in accordance with Minnesota. Statutes 462.358 et. seq. and the City of Orono's Zoning and Flatting Codes, the Orono • Planning Commission held a public hearing on April 19, 1993, at which time all persons desiring to be heard concerning this application were given the opporiunity to speak thereon; and WHEREAS, at their regular meeting held on May 10, 1993, the Orono City Council considered the subdivision application of the Russell T. Lund Estate, noting the �� following findings of fact: � 1. The properry is located within the LR-1B Single Family Lakeshore Residential Zoning District requiring a minunum of one acre of buildable land within each newly created lot. � 2. The property contains a total of 6.3 acres all of which is considered dry buildable. 3: The proposed plat contains two lots each exceeding the 1 acre minunum lot area requirements. Lot A proposed at 3.03 acres. Lot B proposed at 3.27 acres. 4. Lot A is 305' measured in a straight line at the shoreline and 290' at the 75' setback area where 140' lot width is required. 5. ESH setback area where I40' width is required. 6. Each lot shall retain a separate access at County Road 135 or Tonkawa Road. New access to serve Lot A must be approved by Hennepin County, Department of Transportation. 7. Proposed Lot B, the developed lot, has an excess of hardcover within the 0-75' and 250-500' setback area. The Planning Commission recommended approval of the excess hardcover within the proposed lot based on the following findings: A. To require a lot line readjustment to include over a one-half acre of area within the 250-500' setback area, would result in Lot A's future residence being developed closer to the lake. B. If proposed house on Lot A is to be constructed closer to the lake, the • City would be encouraging a variance to the average lakeshore setback. C. The Lot B at 3.27 acre has a total of 16.6% hardcover. Hardcover within the 75-250' setback area is at 4.68% where 25% is allowed. D. 5.73% hardcover exists within the 0-75' setback area. A major part of _ the hardcover consists of a portion of a concrete and asphalt ramp that was installed years ago with the development of the property. The ramp � provides access to the lakeshore. Applicants have agreed to remove asphalt portion of the ramp and to reinstall with an access structure that conforms to current shoreland standards. NOW, THEREFORE, BE IT RESOLVED, that based upon either one or more of the fmdings noted above, the City Council of the City of Orono hereby approves the preliminary plat for the Russell Lund Estate at 905 Tonkawa Road per the survey dated June 12, � 1992, revised March 25, 1993, by Mark S. Gronberg of Coffin and Gronberg, Inc., subject to � the following conditions: ' 1. 'Prior to fmal approval applicants shall file a vacation application for the 20' sewer easement that encroaches within Lot A. • � Page 2 of 4 � . The following structures shall be removed prior to final plat approval; • A. Shed on proposed shared lot line. B. Antenna towers and base to be removed. Antenna base located within kennel shall be allowed to remain as long as anchor bolts are removed to level of existing paved kennel floor. 3. Satellite dishes and other items stored on undeveloped lot to be removed prior to final plat approval. . � 4. Prior to final plat approval applicants shall provide a plan for access structure to lakeshore. Said structure shall replace existing asphalt ramp within 0-75' and 75- 250' setback area. • The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regulazly scheduled Council meeting on the second and fourth Mondays of the month: 1. Record plat drawings in the form of two (2) mylar copies and one (1) copy � reduced to 1" = 200'. Drawing to include: A. Lot lines platted per preliminary survey by Mark S. Gronberg dated June 12, 1992, revised March 25, 1993. B. Dedication of "drainage and utility easements" 10' wide along all . perimeter properry lines and 5' each side of intemal property lines. C. Naming of plat. 2. L.egal documents required: A. Title opinion addressed to the City. The applicants must provide certified copies of all recorded easements currently affecting the property. , 3. Fees to be paid: Total due: $375.00* A. Final plat fee = $175.00 B. Legal review and filing fee = $200.00 *The two lot subdivision shall be referred to the City Assessor for the determination of the fair market value so that a park dedication fee can be determined. Applicants will be advised as soon as the fee has been determined.
