, ' A RESOLUTION REQUESTING AN 'AMENDMENT TO LEGISLATION •
RELATED- TO �THE FUNDING OF THE LMCD
WHEREAS, pending legislation, (HF443 Article 6, Section 1) ,
would eliminate a limitation on cities related to funding of the
Lake Minnetonka Conservation District (LMCD) , and
wHEREAS, the City o�f�,Orono�is aware that the specific language
of the legislation appears on 'the surface to have the sole effect
of removing a limitation on the levying authority of the cities,
and
WHEREAS, the City o€ �Orono believes that in actual application
� the language of the present statute has been considered as a limit
upon the LMCD' s ability. to raise mone�r, and
� WHEREAS, without a specified limit on municipal funding for
the LMCD, the LMCD may appear to have unrestricted spending
authority and unrestricted access to the cities' taxing authority
without any direct accountability, and
WHEREAS, the City of Orono believes � there is currently �
considerable debate and public concern regarding the LMCD and �its �
functioning, and �
WHEREAS, Orono believes it is undesirable at the present time
to make any changes to the LMCD enabling legislation without the
opportunity for the LMCD member cities to consider and review those
changes in Tight of their effect, both direct and indirect, upon
the operation of the LMCD; � and their effects, both direct and
. indirect, upon the LMCD member cities, and'upon Lake Minnetonka.
NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council
does hereby oppose the legislation referred to above, and does also
request that the city' s legislative representatives use their best
efforts to remove this legislatiori from consideration, during the
current legislative session. . -
