Y ���� og�G ESYi A RESOLUTION GRANTING PRELIMINARY APPROVAL OF THE PLAT OF � �r WOODHII.L RIDGE SECOND ADDITION /� � - FILE NO. 1803 WHEREAS, Woodhill Country Club, a non-profit corporation, (hereinafter the "applicant") on January 22, 1993, filed a formal subdivision application with the City for approval of a residential subdivision creating one residential lot. The property is legally described in Exhibit A, attached (hereinafter the "property"); and � WHEREA5, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's Zoning and Platting Codes, the Orono Planning Commission held a public heari.ng on February 16, 1993, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and • WHEREAS, at their regular meeting held on March 8, 1993, the Orono City Council considered the subdivision application of the applicant, noting the following findings of fact: . 1. The properry is located within the RR-1B Single Family Rural Residential Zoning District requiring a minirnum of two acres of contiguous dry buildable land within each newly created lot. 2. The property contains a total of approximately 17.34 acres. The proposed residential lot meets the required dry contiguous land area of 2 acres. Outlot A equals 1.49 acres and will now serve as a private road outlot. Outlot B equals 6.57 acres and has been set aside for either future residential development or use by the Woodhill Country Club. Outlot C at 6.83 acres contains approximately 3 acre wetland and is not proposed for residential use. Outlot D at 1.45 acres is unbuildable and can be sold to an adjacent properry owner for,legal combination. 3. In a memo dated March 13, 1990 by Michael P. Gaffron, Gaffron conf'irms septic testing provided by S &T Testing confums that there is suitable area for both the . principal and alternate on-site septic systems on the properry. • Page 1 of 5 , ro�soos w�o�000 , • � O� . � , CITY of ORONO . '. � Lot 1 has been found to satisfy all rural standards of the RR-1B Zoning District. � 5. Outlot A has been created for the sole purpose of access and is designated as a � private road. The access road shall to serve the Prudden, McNellis and Lot 1, � Block 1 Woodhill Ridge Second Addition. Applicant shall develop covenants � , with the other bene�tting property owners not included within plat foz the � maintenance and upkeep of the road and drainage improvements within the roadway. . 6. Outlots B and C have been created to define remauung portions of properiy for , � future use. Applicant shall be responsible for the maintenance of these areas and . any future use of these outlots will require City review and approval. NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby approves the preluninary • plat of Woodhill Ridge Second Addition per the survey dated February 12, 1990 revised January 20, 1993 by Thomas S. Bergquist of Sathre-Bergquist, Inc., subject to the following conditions: 1. Applicant shall install a private road wifhin Outlot A. The City Engineer shall work with applicant to determine the best design standard for specific areas of existing roadbed. Applicant's engineer shall provide engineering plans for road . � improvement, such plans to be approved by the City Engineer before construction . . � can begin. Applicant shall provide a developer's agreement and letter of credit to be written in. an amount based on 150% of the valuation of the road ' improvements/construction. If road is not completed prior to final plat approval, � � the,current driveway can seive as access during period of new construction on Lot 1, Block 1, Woodhill Ridge. A building pernut for new construction cannot � be issued by City until the plat has received final approval of the City, � , 2. No grade cuts 50' downhill from septic sites on Lot 1 shall be permitted; no � ��grade cuts 20' laterally at a level equal to septic site locations shall be permitted; , � no structures or driveways shall be located within the defined setback areas. Applicant to grant Conservation and Flowage Easement over wetland areas to be shown as drainage easements in Outlot C. The following list of fmal submittals must be subnutted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of � the month: � . 1. Record plat drawings in the form of two (2) mylar copies and one (1) copy reduced to 1" = 200'. Drawing to include: A. Lot lines platted per preliminary survey by Thomas S. Bergquist of � Sathre-Bergquist, Inc. dated February 12, 1990, revised January 20, 1993. � B. Dedication of "drainage and utility easements" 10' wide along all • perimeter properry lines. C. Designation and dedication of a drainage easement over wetlands and . drainage ways within Outlot C. 2. Legal documents required: A. � Title opinion addressed to the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. C. Signed and executed Conservation and Flowage Easement over the wetlands/drainage ways within Outlot C. Please review sample drainage easement enclosed for use. D. Signed and executed developer's agreement and letter of credit for � installation of private road (see attached forms). Signed and executed access road and utility easement over Outlot A (see attached). F. Final draft of an executed copy of private covenants suitable for filing dealing with the ownership/maintenance of road. 3. Fees to be paid: A. Final plat fee = $175.00 B. Legal review and filing fees = $200.00 C. Park dedication. Upon preliminary approval the plat shall be referred to Rolf Erickson, the City Assessor, to determine the fair market value of 8% of the land being developed that would have been conveyed to the • City for park purposes. Applicant will be advised as soon as Mr. . Erickson has submitted his findings. Adopted by the City Council of the City of Orono, Minnesota at a regular meeting ° held this 8th day of March, 1993.
