A RESOLDTION GItANTING
VARIANCES TO
IriUNICIPAL ZONING CODE
SECTION 10.24, SDBDIVISION 5 (B) AND
SSCTION 10.22, SDBDIVISION 2
FILE #1767
WHER$AS, George and Theresa Bloom (hereinafter "the
applicants") are owners of the property located at 1374 Rest Point
Road within the City of Orono (hereinafter "City") and legally
described as follows:
Lot 1, Block l , Rest Point, Hennepin County, Minnesota
(hereinafter "the property"); and
WH$REAS, the applicants have applied to the City for a
variance to Municipal Zoning Code Section 10.22, Subdivision 2 to
• allow construction of a detached garage that will result in an
increase of 107.5 s.f. or .5� hardcover within the 75-250' setback
area with total hardcover now proposed at 6 , 066 s.f. or 32.2�
hardcover where 5,958.5 s.f. or 31.6� exists and where only 25g is
allowed; and Section 10.24, Subdivision 5 (B) seeks approval of a 33'
street setback for the garage where a 35' setback is required
resulting in a 2' or 5.7$ setback variance.
NOW, THEREFORE, BS IT RLSOLVED by the City Council of Orono,
Minnesota:
FINDINGS �
l. This application was reviewed as Zoning File #1767.
2. The property is located in the LR-1B Single Family Lakeshore
Residential Zoning District requiring 1 acre or 43,560 s.f.
in area. The property consists of .66 acres or 28,850 s.f.
3. The Orono City Council reviewed this application on November
' 9, 1992 and recommended approval of the proposed variances
based upon the following findings:
a) The property is served by munacipal sewer. '
b) One-third of the total area of this property is located
• within the 0-75' setback area.

c) The existing drainage pattern of the property provides
for positive drainage to the lake over extensive
grassed yard areas.
d) The proposed improvement of the property will also
result in a decrease in hardcover within the 0-75'
setback area, reduced from 11.7$ to 10�.
e) The current residence does not have a garage nor a
basement area to provide additional storage area.
f) The proposed street setback for the detached garage
will prevent the cutting into of the existing root
system of a group of trees well over 100 years old
located in the east yard area.
• 4. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to
other property in this zoning district; that granting the
variance would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to �
preserve a substantial property right of the applicants; and
would be in keeping with the spirit and intent of the Zoning
� Code and Comprehensive Plan of the City.
5. The City Council has considered this application including
the findings and recommendations, reports by City staff,
comments by the applicants and the effect of the proposed
variances on the health, safety and welfare of the
community.
CONCLIISIONS, ORDER AND CONDITIONS
Based upon one or more of the findings noted above, the
Orono City Council hereby grants variances to Municipal Zoning Code
Section 10.22, Subdivision 2 and Section 10.24, Subdivision 5 (B) that
would permit the construction of a detached garage to the location
within the street yard of the property subject to the following
conditions:

l. Applicants shall remove all hardcover improvements as shown
on Page 6 of this resolution. All removals shall be
completed prior to the footing inspection for the proposed
garage.
2. Upon application for a building permit, applicants shall
provide detail or cross section for section of retaining
wall at 4' height.
3 . Authorities granted by this resolution run with the property
not with the applicants, but are permissive only and must be
exercised by application for a building permit within one
year of the date of Council approval, or this variance will
expire on that date (November 23, 1993).
4. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
• granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby
agree to the terms of this resolution and on behalf of
� themselves, their heirs, successors and assigns, hereby
agree to the recording of this resolution in the chain of
title of the property.
Adopted by the Orono City Council on this 23rd day of
November, 1992.
