O57zi A RESOLUTION GRANTING PRELIMINARY APPROVAL OF AMENDMENT #3 OF THE ORONO 2008-2030 COMMUNITY MANAGEMENT PLAN: 480 RUSSELL AVENUE — MUSA FILE #15-3791 WHEREAS, the City of Orono (hereinafter "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, in September 2010 the Orono City Council adopted the 2008-2030 Orono Community Management Plan (hereinafter "CMP" or "the Comprehensive Plan") to provide for the orderly development of the City, in compliance with the Metropolitan Land Planning Act of 1976 and Minnesota Statutes Chapters 462 and 473; and WHEREAS, an integral element of the 2008-2030 CMP is the Comprehensive Sewer Policy Plan, which identifies areas of the City as being within the Metropolitan Urban Service Area (MUSA) in which connections to the metropolitan sewer system are allowed; and WHEREAS, the property at 480 Russell Avenue within the City of Orono contains a single family residence structure constructed in 1939 and is approximately 1.8 acres in area. The property is zoned RR -1B Rural Residential, 2 -acre minimum lot size and currently has a non-compliant septic system; and WHEREAS, the property is located along Russell Avenue in which a lateral of the Orono municipal sewer system was installed in 1980 to serve the Minnetonka Bluffs neighborhood. The property is not currently within the Metropolitan Urban Service Area (MUSA), but is directly across Russell Avenue from the Minnetonka Bluffs neighborhood which is within the MUSA; and WHEREAS, when the municipal sewer was installed in the Minnetonka Bluffs neighborhood in 1980, the property owner requested to be exempted from the project due to the lot size and the expectation that future sewage treatment needs could be met via on-site systems; and WHEREAS, due to changes in state and local regulations regarding the use of on-site sewage treatment systems over the ensuing 35 years, it has been determined that suitable sites for replacement septic systems do not exist on the property; and Page 1 of 2 RESOLUTION OF THE CITY COUNCIL WHEREAS, the property owner has formally requested that the property be incorporated into the ML SA to allow for connection to the municipal sewer system; and WHEREAS, in light of the above noted facts the Orono Planning Commission pursuant to published and written notice held a public hearing on November 16, 2015 and on a vote of 6-0 recommended that the property at 480 Russell Avenue be added to the MUSA; and WHEREAS, Metropolitan Council staff have confirmed that this property can be added to the MUSA through an administratively -approved amendment to the CMP. The amendment is exempt from the 60 -day comment period by adjacent jurisdictions because it is less than 40 acres in area, it does not change any Metropolitan Growth Forecasts, and is further from adjacent jurisdictions than the City's standard notification distance; and WHEREAS, based on staff calculations, inclusion of the property in the MUSA will not drop Orono's density calculation below the 3.0 units per acre threshold; and NOW, THEREFORE, BE IT RESOLVED that the Orono City Council conditionally approves an amendment of the 2008-2030 Community 'Management Plan to include 480 Russell Avenue in the Metropolitan Urban Service Area subject to Metropolitan Council review and approval, and directs City staff to prepare such an amendment and submit it to the Metropolitan Council for review and approval.
