Dear Mr. Bowers:
After several unsuccessful attempts to reach you by phone, I felt it would he
better to contact you by letter.
After reviewing your application requesting approval for a ripran pemnit and
a variance to repair an existing retaining wall, 1 discovered that all the
necessary material had not been submitted.
In order to process your application, we do need a sketch from you indicating
the view from the lake. In order to avoid any delavc, please see to it that
we receive this as soon as possible.

Variance and Riprap
Mr. Bowers is requesting approval to repair an existing retaining wall. This
consists of replacing existing concrete walls with untreated tinker. This
would require a variance as the wall is less than 75' from the shoreline.
.Although the plans submitted are quite good, they do not show an elevation view
from the lake so we can't visualize the height of the proposed retaining wall.
I haw, sent him a letter requesting this data.
From what I found on the site, I would like to suggest we suggest the removal of
the existing concrete slab (hardcover within 75' of the lake). I think we should
have more confirmation that the proposal does not include any filling or grading.
The riprap request appears to be an improvement. It is a continuation of the
neighbor's shoreline riprap. It would protect the shoreline from further erosion.
Although the data submitted is not complete, I will he introducing the proposal
to the Planning Commission m February 22, 1977, When I receive the necessary
data I will forward copies to our engineer for review and comments.
We can trea this as a work session item.

The Zoning Administrator submitted final plat. Final plat is VAN FECKIiOUT BUILDING
the same as the preliminary. Subdivision consists of eight ODRPORATION
2-acre parcels with a private road. 400 OLD CRYSTAL BAY ROAD
SUBDIVISION (FINAL)
Hannah moved, Pesek seconded, to recommend approval of the (0176)
final mylar subject to the following:
(1) Drainage plan and easements approved by City Engineer.
(2) Approval of City Attorney.
(3) Park Dedication Fen.
(4) Underlying easement on road.
(5) Utility easement along road.
Motion - Ayes (5), Nays (0).
The Planning Commission took action on the following work
session items.
Mr. Bowers was present and submitted plan to the Planning

The Planning Commission was concerned about the existing

concrete slab and suggested that the applicant have it
removed. Mr. Bowen stated that he would be willing to
remove this slab if the work involved is not too expensive.

consider removing concrete slab. Also recommended approval
of riprap request subject to approval of the City Engineer
and applicant obtaining approval of all other agencies as

title opinion submitted to the City and combina-
tion of Lot 12 6 13. Motion, Ayes (5) - Nays (0).
Henry Muhich, buildinq 6 Zoning Administrator,
stated that Mr. Kermit LaQuey, 190 Cygnet Place,
first obtained a lot area and width variance
approval for this lot on April 22, 1975.
Council renewed this approval on February 9, 1976,
He has currently submitted a third application
for renewal of these same variances. I am
enclosing copies of the last renewal application,
plat map, Planning Commission and Council minutes
and my reports regarding the first two proposals.
The status of the property has not changed. The
conditions today are the same as they existed
in 1975 when the first application was submitted.

Although I have not as yet received any Flans
for the proposed project, I will be introducing
it to you at the Planning Commission meeting of
February 22, 1977.
The notations on the enclosed plat map do not
give a true picture of the property. Upon
checking the site, the contour of the land left
me with some questions as to whether any filling
or grading were being considered.
I have sent him a letter requesting plans. When
I receive the necessary data, I will forward a
copy to our engineer for review and comments.

Dear Mr. Muhich:
We have reviewed the application of J.K. Bowers, 2905
Casco Point Road and Robert Nelson, 4109 Highwood Road, and
have the following comments.
2905 Casco Point Road
Mr. Bowers proposes replacing a badly deteriorated
concrete block wall with a timber wall. His plan shows the
timber wall to be five feet high with the top of the wall
approximately 11 feet above lake level. He also proposes to
place rip -rap as erosion protection on 60 feet of shoreline.
The lots either side of him have existing rip -rap on the
shoreline.
We feel the proposed improvements would improve the
appearance of the property and will protect the lake from
erosion, particularly if the existing wall fails.
We concur with your recommendations in your memorandum
of February 17, that the existing concrete slab be removed
to conform with the hardcover regulations and that no
filling or grading, other than a very minimum of backfill,
which will be required behind the retaining wall will be
permitted.

Purpose: Shoreline Rip -Rap
Dear Mr. Bowers:
At its meeting on April 21, 1977 the Board of Managers of
the Minnehaha Creek Watershed District reviewed the subject
permit application.
It approved the permit as requested with the following
conditions:
1. Work shall blend with adjacent properties and con-
form with the Minnehaha Creek Watershed District
Guidelines enclosed herewith.
2. Work shall also conform with requirements of the
City of Orono, the Minnesota Department of Natural
Resources and the Lake Minnetonka Conservation District.
Permits are valid for one year.
Please contact us at 473-4224 when the project is about to
commence so an inspector may view the work in progress.
