FARVIEW NEIGHBORHOOD SANITARY SEWER PROJECT ASSESSMENT HEARING, Continued) Kellogg stated Fox Sh·eet is a county road and that road resh·ictions may not apply in this case. Kellogg stated in his opinion it is very unlikely the work would start any time in the next three weeks. Acting Mayor Murphy closed the public hearing at 7:23 p.m. PLANNING COMMISSION COMMENTS-RALPH KEMPF, REPRESENTATIVE Kempf congratulated David Rahn on his appointment to the Council and stated in his opinion the Planning Commission should be on the right track with the new commissioners. Kempf stated one of · the obstacles he experienced starting on the Planning Commission was the overwhelming amount of information that had to be reviewed prior to each meeting and that it would be helpful if each commissioner would be assigned a small specific number of applications that they would be able to thoroughly review and comment on at the meeting. Kempf stated it is his desire to try that approach at the next meeting. Kim Kang concurred that the number of applications that they review at each meeting can be overwhelming, especially if you are a new commissioner, but that reviewing a larger number of applic~tioris provides a broader exposure. McMillan congratulated Ralph Kempf on his appointment as c air of the Planning Commission. . . McMillan stated during her tenure on the Planning Commission she found that she had stronger opinions and thoughts on specific applications and that the other commissioners would feel stronger about other applications, which helps to provide a broad base for input. Bremer commented on the fine job that Kempf did at the March Planning Commission meeting and the fact that the cmmnissioners listen well to the comments made by the other commissioners. Murphy suggested the Planning Commission continue to work together in a collaborative process . PUBLIC COMMENTS None Acting Mayor Murphy commented he recently attended a Bloomington City Council meeting last week where the mayor held open the public comment section for 20 minutes. The property is located in the LR-lB, One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on January 16, 2007 and recommended approval of lot width and lot area variances based on the following findings: a. The applicants' property is 29,295 s.f. (0.67 acre) in area and has 84' in width at the ordinary high of Lake Minnetonka and 95' in width at the 75' lake setback. Page 1 of 4 b. No additional land is available for acquisition by the applicants to make the property conforming in area or width. c. The property is served with municipal sewer. A single family residence has existed on the property for many years. d. The applicants have proposed a home and hardcover to adequately serve the property within the 25% hardcover limitation within the 75' -250' zone. e. The applicants' proposed home will meet all LR-lB zone setback requirements. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission,. reports by City staff, comments by the applicants and the public, and the effect of the proposed variances and conditional use. permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and. <lo not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a new residence on a lot containing 29,295 s.f. or 0.67 acre in area and 84' in width at the ordinary high of Lake Minnetonka and 95' in width at the 75' lake setback where 43,560 s.f. or 1.0 acre in area and 140' in width are normally required, subject to the following conditions: 1. Council approval is based on the site plan and building plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan and building plans which are not in conformity with City codes will require further Planning Commission and City Council review. Page 2 of 4 2. Hardcover in the 0-75' zone shall not increase above the level of O s.f. or 0%. Hardcover in the 75-250' zone shall be limited to 4,902 s.f. or 25%, and hardcover within the 250' - 500' zone shall be limited to 894 s.f. or 30% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover above the limits previously stated or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Applicants shall remove all plastic orfabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (March 26, 2008). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. While significant portions of the lot have slopes just above or just below 30%, we have concluded that it is not a bluff situation. However, staff questions the need for the lower retaining wall. The two proposed boulder walls are each 4 feet in height. The lower wall does not appear to be necessary for slope stabilization for to help create a usable yard space; it merely creates an 8 foot terrace level. The applicant should address the need for this wall and the Planning Commission should consider whether screening is necessary. We have the following comments with regards to engineering matters: • It appears that a proposed 972 contour line is missing to the west of the proposed house. • All proposed contour lines should be labeled. • The plans should distinguish between existing and proposed retaining walis, and indicate if any existing retaining walls are to be removed. • The area to the north of the proposed house exceeds the maximum recommended slope of 3 :1. The grading plan should be revised in this area. • It appears that the proposed grading to the south of the house will direct runoff onto the adjacent lot to the south. This area should be regraded such that all runoff will be retained on the subject property. • The City should review the extents of tree removal that will be required on the site to accommodate the proposed plans. • Final plans should include erosion and sediment control details. The Parties desire to establish a driveway easement QVer Dongoske Parcel for the benefit of the Suisse Parcel, Piper Parcel and Schaible Parcel. · NOW THEREFORE, for good and valuable consideration, the receipt and adequacy of which is hereby mutually acknowledged, the Parties agree as follows: 1. Recitals are correct. The foregoing recitals are true and correct. 2. Grant of Easement over Dongoske Parcel. Dongoske hereby grants arid conveys to Suisse, Pipers and Schaibles a non-exclusive easement for ingress, egress and driveway purposes (and for no other purpose) over, upon and across that portion of Dongoske Parcel described as follows: The Westerly Half of Cherry Avenue vacated lying Northerly of the Easterly extension of a line hereinafter referred to as "Line A" drawn ~esterly from the 2 midpoint of the Easterly line of Lot 7, Block 5, Crystal Bay View through the midpoint of the Westerly line of said Lot 7, and Southerly of a line drawn from the Northeast corner of Lot 5, Block 5, Crystal Bay View, Easterly to the Northwest corner of Lot 6, Block 4, Crystal Bay View. (the "Easement Area"). 3. Usage, Maintenance and Repair. Suisse agrees to keep the Easement Area in good condition and shall be solely responsible for all maintenance, upkeep and repair of the Easement Area, including by not limited to removal of all ice and snow from the driveway in the Easement Area, and any maintenance, upkeep or repairs of the driveway in the Easement Area which may be required by law, ordinance or other governmental regulation. All costs and expenses for the maintenance, upkeep and repairs of the driveway in the Easement Area shall be the sole responsibility of Suisse. Maintenance, upkeep and repair of the driveway in the Easement Area shall be limited to the Easement Area and shall not include entry into the Dongoske Parcel. The driveway in the Easement Area shall not be expanded westerly into the Easement Area, except that Dongoske reserves the right to add one or more driveway from the Dongoske Parcel to the driveway in the Easement Area, and Suisse may, in its discretion, resurface the driveway in the Easement Area. 4. Insurance and Indemnity. Suisse shall cause Dongoske to be listed as an additional insured on Suisse's liability insurance for liability related to the use of the Easement Area as contemplated by this Agreement, and Suisse shall provide proof of the insurance to Dongoske upon request. Suisse shall indemnify, defend and hold Dongoske harmless from any injury, death or damage to any person, thing or entity as a result of Suisse's or Suisse's employees, agents, contractors, guests or invitees use of the driveway and/or Easement Area. 5. Binding Effect. The benefits and obligations of the easement created by this agreement shall be non-exclusive and run with the land, and shall be binding upon and inure to the benefit of the Parties, their respective heirs, representatives, successors, devisees, invitees and assigns and all future owners and encumbrancers of the various parcels. The easement and rights created under this Agreement are appurtenant to the respective parcels and may not be transferred, assigned or encumbered except as appurtenances to the respective parcels. 6. Enforcement Provisions and Remedies. Any claim, dispute, or cause of action arising out of or relating to a violation of a term or provision of this Agreement that cannot be settled between the Parties shall be brought in a court of appropriate jurisdiction in Hennepin County, Minnesota. The prevailing party to any action or suit pertaining to or arising out of this Agreement shall be entitled to recover costs and disbursements and reasonable hourly attorney fees. This enforcement provision shall be in addition to any other remedies available in law, equity or both. · 7. Governing Law. This Agreement shall be construed and governed by the laws of the State of Minnesota. 8. Prior Agreements. The existing lot area and lot width do not meet the LR-1 B district requirements therefore variances are required. Lot Area & Lot Width Variance The applicant's lot has between 84'and 95' in width and 29,295 s.f. or 0.67 acre in area where the LR-1 B requirement is 1.0 acre and 140' in width. Variances are required in order to build a new residence on the property. The applicant has proposed a 2,443 s.f. home which meets hardcover requirements, the zoning district setbacks and the structural coverage limits. Bluff Analysis/Retaining Walls Staff has conducted an analysis of the slope to determine whether it meets the criteria to be a bluff. While significant portions of the lot have slopes just above or just below 30%, we have concluded that it is not a bluff situation. However, staff questions the need for the lower retaining wall. The two proposed boulder walls are each 4 feet in height. The lower wall does not appear to be necessary for slope stabilization for to help create a usable yard space; it merely creates an 8 foot terrace level. The applicant should address the need for this wall and the Planning Commission should consider whether screening is necessary. Late in the review of this application it was brought to Staff's attention that there may be an issue regarding legal access to the property. The applicant has been directed to provide legal documentation showing legal ingress and egress to their property over the neighboring lots in order for the application to move on to Council. While this is an issue that must be resolved prior to Council review, Staff does not see reason to hold the application up at the Planning Commission level. The applicant has proposed a 2,443 s.f. home which meets hardcover requirements, the zoning district setbacks and the structural coverage limits. 2 Bluff Analysis/Retaining Walls FILE #06-3247 5 January 2007 Page 3 of3 Staff has conducted an analysis of the slope to determine whether it meets the criteria to be a bluff. While significant portions of the lot have slopes just above or just below 30%, we have concluded that it is not a bluff situation. However, staff questions the need for the lower retaining wall. The two proposed boulder walls are each 4 feet in height. The lower wall does not appear to be necessary for slope stabilization for to help create a usable yard space; it merely creates an 8 foot terrace level. The applicant should address the need for this wall and the Planning Commission should consider whether screening is necessary. Hardship Statement Applicant has completed the Hardship Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Hardship Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect 011 values of property in the surrounding area. Late in the review of this application it was brought to Staffs attention that there was an issue regarding legal access to the property. The applicant has been directed to provide legal documentation showing legal ingress and egress to their property over the neighboring lots in order for the application to move on to Council. While this is an issue that must be resolved prior to Council review, Staff does not see reason to hold the application up at the Planning Commission level. Issues for Consideration 1. An application will not be considered complete or placed on any meeting agendas until this form is complete and submitted to the City. Minnesota State Statutes Section 394.27, Subdivision 7 requires that a hardship be demonstrated in order for a variance to be granted. The hardship must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid hardships. We have the following comments with regards to engineering matters: • It appears that a proposed 972 contour line is missing to the west of the proposed house. • All proposed contour lines should be labeled. • The plans should distinguish between existing and proposed retaining walls, and indicate if any existing retaining walls are to be removed . • The area to the north of the proposed house exceeds the maximum recommended slope of 3: 1. The grading plan should be revised in this area. • It appears that the proposed grading to the south of the house will direct runoff onto the adjacent lot to the south. This area should be regraded such that all runoff will be retained on the subject property . • The City should review the extents of tree removal that will be required on the site to accommodate the proposed plans. • Final plans should include erosion and sediment control details. Our initial review of your application indicates there are a number of issues with the proposed new home which must be resolved before our review can continue and the application can be forwarded to the Planning Commission. These include: Exceeds Allowed Maximum Building Height. 1. City ordinances limit structures to 2 ½ stories. The proposed residence is defined as 3 stories because less than the required minimum 50% of the foundation perimeter has a basement floor level that is 6 feet below pre-existing grade. Only 29% of your foundation perimeter has basement floor at least 6' below existing grade. This might be resolved by lowering the house deeper into the topography, but this has a variety of other ramifications. (See attached sketch #1) 2. City ordinances limit building height to 30', measured based on pre-existing grade abutting the proposed foundation; the lower point for height determination is existing grade at the high side or l O' above the low side, whichever is lower. The upper measuring point is the average height of the highest gable. Your proposed residence has a defined height of 33.l feet, 3.1 feet higher than the limit. The lower measuring point is defined as elevation 971.5'. The average of the highest gable is 1004.6'. The difference is the defined height, which is 33.1 feet. (See attached sketch #2). This might be partially resolved by a combination of lowering the house deeper into the topography, reducing the roof pitches, reducing ceiling heights, etc. Variances for defined height exceeding 30' and number of stories exceeding 2 ½ are viliually never granted and will not receive staff support. We have not yet completed a slope cross-sectional analysis to determine whether a bluff exists, but there are slopes in the range of 30% or more within the footprint of the proposed home and downslope from it. If a bluff exists at the side, the bluff impact zone is 20' from the top of the bluff, and the structure setback from the top of bluff is 30'. Grading Plan. No proposed grading plan was submitted. You must submit a completed grading plan which shows existing (the existing contours should be shown extending 50' past the property boundaries) and proposed contours, all proposed retaining walls, and the cut/fill balance must be calculated. No finished slopes which exceed 3: 1 are allowed. Grading is not allowed within 5' of property boundaries. Drainage must be directed so as not to impact surrounding prope1ties. No piped drainage may outlet nearer than 75' to the shoreline. House Elevations Depictions Must Match the Grading Plan. The house elevation plans submitted suggest that the grade will be flat around three sides of the house with an 8' retaining wall drop to a flat lower walkout level. In reality, the site does not lend itself to such a plan without major fill and grading changes and/or retaining walls. The house elevation views must reflect the proposed grading plan. Carriage House: Guest House Advisory. Although the carriage house has no bathroom shown on the plans, it does have a water heater furnace and closets, as well as access to the bonus room separated from the garage stalls; all of which suggest a potential future intent to convert this to a guest house. Please be advised that the provision of a toilet, bathtub or shower in an accessory building requires a conditional use permit; use as a guest house requires a conditional use permit; and the size of this property does not qualify for either of these conditional uses under City ordinances.
