Application Summary:
The applicant is requesting lot area, lot width variances and a conditional use permit for land
alterations within the 0-75' zone in order to removal of the lake yard deck and restoration of the area
with plantings. Applicant's plan will meet hardcover and structure limits.
Planning Commission Recommendation
On June 19, 2006, Planning Commission voted 5 -0 to recommend approval of the lot area and lot
width variances and the conditional use permit to restore the lake yard area in the location of the deck
removal.

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 78-330 AND A CONDITIONAL USE PERIT
PURSUANT TO ZONING CODE SECTIONS 78-1250 AND 78-1286

WHEREAS, Glenn David Solie and Nancy Marie Solie, husband and wife
(hereinafter "the applicants") are the owners of the property located at 1430 Cherry Place within
the City of Orono (hereinafter the "City") and legally described as follows:
Lots 4 and 5, Block 4, Crystal Bay View according to the plat on file and of
record in the Office of the County Recorder, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a new
residence on a lot containing 24,084 s.f. or 0.55 acre in area and 95' in width where 43,560 s.f. or
1.0 acre in area and 140' in width are normally required; and
WHEREAS, the applicants have made application to the City of Orono for a
conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-1250 and 78-1286
in order to conduct minimal land alterations within the 0-75' zone in conjunction with the
removal of a lake-yard deck and restoration following removal.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 06-3183.
2. The property is located in the LR-1B, One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 1.0 acre and a minimum lot width
of 140'.

3. The Planning Commission reviewed this application at public hearings held on
May 15, 2006 and on June 19, 2006 and recommended approval of variances
based on the following findings:
a. The applicants' property is 24,084 s.f. (0.55 acre) in area and has 95' of lot
width.
b. No additional land is available for acquisition by the applicants to make the
property conforming in area or width.
c. The property is served with municipal sewer. A single family residence has
existed on the property for many years.
d. The applicants have proposed a home and hardcover to adequately serve the
property within the 25% hardcover limitation within the 75' -250' zone.
e. The applicants' proposed home will meet all LR-1B zone setback
requirements.
4. The Planning Commission reviewed this application at public hearings held on
May 15, 2006 and on June 19, 2006 and recommended approval of the
conditional use permit based on the following findings:
a. City Code 78..:1282 allows for the installation of stairs, lifts and landings in
place of major topographic alterations on steep slopes.
b. The proposed changes to the stair system and wall result in a reduction in
hardcover from 7.6% to 5.7%.
c. The proposed 5.7% hardcover is allowed pursuant to City Code 12-1282.
d. The applicants have provided a restoration plan for the deck removal meeting
the goals and intent of the Zoning Code and the Orono Community
Management Plan.
5. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variances and
conditional use permit on the health, safety and welfare of the community.

6. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono. City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a new
residence on a lot containing 24,084 s.f. or 0.55 acre in area and 95' in width where 43,560 s.f. or
1.0 acre in area and 140' in width are normally required and a conditional use permit in order to
conduct minimal land alterations within the 0-75' zone in conjunction with the removal of a
lake-yard deck and restoration following removal, subject to the following conditions:
1. Council approval is based on the site plan and building plans submitted by the applicants
and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments
to the site plan and building plans which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 434 s.f. or 5.7%.
Hardcover in the 75-250' zone shall be limited to 4,088 s.f. or 25% per the proposed plan
and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that
any future requests to increase hardcover above 25% or change the nature of
existing/approved hardcover shall require City approval, and increases in hardcover will
not likely be approved without concurrent reduction in existing hardcover.
3. Applicants shall remove all plastic or fabric liner material from the decorative landscape
beds on the property to ensure their permeability as non-hardcover surfaces.
4. Required removals of the deck structure shall be completed by the footing inspection for
the new home. The restoration of the area of the deck removal and installation of plant
materials shall be completed prior to the issuance of a certificate of occupancy if not
sooner. The restoration plan is attached as Exhibit B.

5. Authorities granted by this resolution run with the property not with the applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (June 26, 2007).
6. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.
Adopted by the Orono City Council on the 26th day of June, 2006.

I wanted to make sure that you received the revised information requested about our grading plan. I was not sure
if Tim sent it directly to you, so it is attached to be safe.
I am not sure what else Tom is looking for with the 0-75' plan? If his recommendation is to just remove the deck
nothing more should be needed (option 1 ). We are not touching anything that exists, so why is he asking for
proposed wall types, stairway replacement information, etc? We are just planting natural grass were the deck was
per our last submission. It is that simple as we do not want to disturb anything in the 0-75'. If you need more
information I am going to have my landscape architect contact Tom directly to make sure we are meeting his
requirements.

Monday, May 15, 2006

The Orono Planning Commission met on the above-mentioned date with the following members
present: Chair David Rahn, Commissioners Ralph Kempf, Roland Jurgens, Dick Kroeger, and Cynthia
Bremer. Representing Staff were Planning Director Mike Gaffron, Planners Melanie Curtis and Evelyn
Turner, and Recorder Jackie Young. Council Member Bob Sansevere was present.
Chair Rahn called the meeting to order at 6:00 p.m.
NEW BUSINESS
1. #06-3183 PAUL THOMAS HOMES FOR GLENN SOLIE, 1430 CHERRY PLACE,
VARIAN CE, 6:01 -6:15 P.M.
Paul Vogstrom and Glenn Solie, Applicant, were present.
Curtis stated the applicant is requesting lot area, lot width variances and a conditional use permit for
land alterations within the 0-75' zone in order to construct a new single-family home . The conditional
use permit is to regrade the yard, reorient the steps, and remove a deck. The City Engineer has reviewed
the original plans and has provided a recommendation that this application be tabled to allow for more
detailed plans to be submitted .
Curtis indicated there are some unresolved issues regarding the height of the structure that the Planning
Commission may wish to address. Staff recommends tabling the application to allow for more detailed
information to be submitted.
Rahn inquired what the issue is with the height of the structure.
Curtis stated it is due to the number of stories of the proposed residence as well as the way the house is
placed on the lot.
Vogstrom stated his understanding is as long as less than 15 percent exposed, it would not be considered
an extra story. Vogstrom indicated the retaining walls could be moved closer to the building, which
would lessen the exposure on the basement. Vogstrom inquired from where the height is measured.
Curtis stated the highest adjacent grade of the building or ten feet above the lowest.
Vogstrom indicated his plan shows 35 feet and that his understanding is it would be measured ten feet
above that.
Curtis sated the number of stories was more the issue than the height of the structure.
Gaffron stated the applicant is allowed 30 feet of height starting at the highest existing grade touching
the house, and if that is higher than ten feet above the lowest grade against the house, they go to

the average of the highest gable. Gaffron stated less than 50 percent of the foundation was covered at
least six feet by existing grade around the perimeter of the house. Gaffron indicated the trend in the last
few years is people will not meet the 50 percent around the house and will instead put a retaining wall
five feet outside the foundation. Gaffron stated the City has not accepted that type of design since City
Code does not allow for topographical changes when determining height.
Rahn inquired whether there is only one side elevation that has been provided.
Vogstrom indicated there is only one.
Rahn commented from that elevation it appears to taper from a lookout to a walkout and that he would
like to see accurate floor elevations. Rahn inquired where the floor elevation of the proposed house
lines up with the existing house.
Vogstrom stated it is approximately 18 inches higher than the existing basement due to the sloped
driveway and the steepness of the grade. Vogstrom indicated they are attempting to work with the land
to create a driveway that is not quite as steep as what currently exists.
Solie stated the current house is a one-story with a walkout and that the proposed house is two stories
from the front.
Rahn indicated he does not have a problem with the lot area variance and recommended the applicant
speak with Staff regarding the height of the structure.
Jurgens stated the grading in his view would not work.
Kempf stated he does not understand the grading plan and questioned why the grade could not flow out
to the edge of the lot. Kempf stated it appears that the house next door is approximately three feet
higher than this house and questioned the need for retaining walls.
Rahn opened the public hearing at 6: 12 p.m.
There were no public comments regarding this application.
Rahn closed the public hearing at 6: 12 p.m.
Jurgens moved, Kempf seconded, to table Application #06-3183, Paul Thomas Homes for Glenn
Solie, 1430 Cherry Place, to allow the applicant time to revise his plans and to submit adequate

Application Summary: The applicant is requesting lot area, lot width variances and a
conditional use permit for land alterations within the 0-75' zone in order to construct a
new single family home.
Staff Recommendation: Planning Staff recommends approval of the lot width and lot
area variances. The applicant must submit a revised, detailed landscape and construction
plan for the work proposed in the 0-75' zone. However, due to the unresolved issues
detailed in the "Issues for Consideration" staff recommends that the application be tabled.
Pertinent Zoning Ordinance Sections
Sec. 78-1. Definitions.
Building height means the vertical distance between the highest adjoining ground
level at the building or ten feet above the lowest ground level, whichever is lower, and
the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost
point on a round or other arch-type roof, or the median height of the highest gable of a
pitched or hipped roof. Topographic changes which elevate the adjoining ground level
above the existing terrain shall not be considered in determining building height. For a
pitched or hipped roof situation, regardless whether the highest living space in a building
is a half-story or full story, if the highest living space contains windows (excluding
skylights) the upper measuring point for defining building height shall be the median
height of the top of the highest window and the highest peak of the roof.
Half story means the uppermost floor of a building in which (i) the intersection of
the exterior wall and the roof is not more than three feet above the floor elevation, and (ii)
not more than 60 percent of the floor area within the exterior walls of the uppermost floor
exceeds five feet in height as measured from the floor to the rafters. Floors exceeding
these parameters shall be deemed a full story.

2000 International Building Code Definition:
Story Above Grade. Any story having its finished floor surface entirely above grade,
except that a basement shall be considered as a story above grade where the finished
surface of the floor above the basement is:
1. More than 6 feet (1829 mm) above grade plane.
2. More than 6 feet (1829 mm) above the finished ground level for more than 50
percent of the total building perimeter.
3. More than 12 feet (3658 mm) above the finished ground level at any point.
However, going back to our building height definition, the Code says " ... Topographic
changes which elevate the adjoining ground level above the existing terrain shall not be
considered in determining building height ... " therefore the City's functional definition
for determining a story has been that the lower portion of a building is considered as a
basement (and not a story) when at least 50% of the lowest portion's perimeter is covered
(by natural grade or fill) to a height of at least 6 feet above the lowest floor. The
perimeter of the lower level does not include portions of the house or garage that do not
have a lower level but are merely "unexcavated". We have been rejecting proposals that
artificially raise the grade adjacent to the foundation in order to create the 6 feet of
required coverage, because this would result in homes that are on "plateaus" and not in
context with the neighborhood nor meeting the intent of the height ordinances.
Sec. 78-330. Area, height, lot width and yard requirements.
(a) Height. No structure or building in the LR-lB district shall exceed 2 1/2
stories and shall not exceed 30 feet in height except as provided in section 78-1366.
(b) Lots. The following minimum requirements shall be observed:

Sec. 78-966.
Land Alteration; Prohibited. It is unlawful for any person to build, alter or repair any
seawall, retaining wall or otherwise change the grade or shore of lakeshore property
without a conditional use permit issued by the Council.
Sec. 78-1250. Conditional uses.
Conditional uses allowable within shoreland areas shall be subject to the review and
approval procedures and criteria and conditions for review of conditional uses established
in this chapter. The following additional evaluation criteria and conditions apply within
the shoreland overlay district:
l. Evaluation criteria. A thorough evaluation of the water body and the topographic,
vegetation and soils conditions on the site must be made to ensure:
a) The prevention of soil erosion or the possible pollution of public waters, both
during and after construction;
b) The visibility of structures and other facilities as viewed from public waters is
limited;
c) The site is adequate for water supply and on-site sewage treatment; and
d) The types, uses and numbers of watercraft that the project will generate are

compatible in relation to the suitability of public waters to safely accommodate
these watercraft.
Sec. 78-1282. Stairways, lifts and landings.
Stairways and lifts are the preferred alternative to major topographic alterations for
achieving access up and down bluffs and steep slopes to shore areas.
Sec. 78-1286. Topographic alterations/grading and filling.
(b.) Grading, filling or excavating of more than ten cubic yards is prohibited within 75
feet of the ordinary high water level of the public waters enumerated in section 78-1217.
Grading, filling or excavating of ten cubic yards or less shall require city staff review and
permit and be subject to other pertinent sections of this chapter.
Sec. 78-1288. Hard cover limitations.
(a) No hard cover or impervious surface shall be placed, located or
constructed within 75 feet of the ordinary high water level of any lake or tributary, except
for stairways, lifts, landings and lockboxes as regulated elsewhere in this Code.
(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than
25 percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no
greater than 30 percent hardcover. Between 500 feet and 1,000 feet of the OHWL there
shall be no greater than 3 5 percent hardcover.

Lot Area & Lot Width Variances
The applicant's lot has 95' in width and 24,084 s.f. or 0.55 acre in area where the LR-lB
requirement is 1.0 acre and 140' in width. Variances are required in order to build a new
residence on the property. The applicant has proposed a 2,429 s.f. home which meets
hardcover requirements, the zoning district setbacks and the structural coverage limits.
Conditional Use Permit Analysis
City Engineer, Tom Kellogg, has reviewed the original plan and has provided staff with
a recommendation (the letter is attached as Exhibit F). A thorough evaluation of the
applicant's proposal is still required, as of the printing of this report the City Engineer
has required more detailed information in order to continue the evaluation of the water

Issues for Consideration
1. The home as proposed has a walk-out level and a sub-basement below the walk-out
level. While the home meets the 30' height limitation, we have reviewed the plans
with respect to the number of stories and it appears that the proposed retaining walls
and the sub-basement are an attempt to achieve the third story. What is the Planning
Commission's interpretation of the City's building height definition (listed above)
and the definition of "story above grade" with respect to this plan?
2. What are the impacts of the retaining walls when viewed from the adjacent property?
Should an extensive screening plan be incorporated?
3. The plans for the 0-75' zone will need to be revised in order for Tom Kellogg to do a
complete review. Prior to that happening, does the Planning Commission feel that
there are changes that should be incorporated?
4. As the vegetation matures will the walls be screened from views year round?
5. Are there any other issues or concerns with this application?
Hardship Statement
Applicant has completed the Hardship Documentation Form attached as Exhibit B, and
should be asked for additional testimony regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in
the surrounding area. The Planning Commission shall consider recommending approval for variances
from the literal provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under consideration, and
shall recommend approval only when it is demonstrated that such actions will be in keeping with the
spirit and intent of the Orono Zoning Code.
Staff Recommendation
Planning Staff recommends approval of the lot width and lot area variances. The
applicant must submit a revised, detailed landscape and construction plan for the work
proposed in the 0-75' zone. However, due to the unresolved issues detailed in the "Issues
for Consideration" staff recommends that the application be tabled.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City.
Minnesota State Statutes Section 394.27, Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted. The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships . In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated .
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community . To prove a hardship,

We have reviewed the survey for the proposed home construction at 1430 Cherry Place dated 4-17-06 .
We have the following preliminary comments with regards to engineering matters:
• Additional retaining wall elevation information should be submitted to review the height. If
retaining walls are greater than 4 feet in height or the separation between tiered walls is less that
two times the height, a signed engineered drawing will be required.
• As we discussed on our site visit a few weeks back w e recommend that the existing deck and
steps between the deck and existing stairway to the lake be removed . Last Wednesday y ou sent
me an email indicating the applicant may be considering additional changes to the stairway and
shoreline area. If this is correct more detailed scaleable plans should be submitted showing
erosion and sediment controls , planting and restoration information , stair locations and materials ,

Enclosed you will find the Restoration Plan in response to your request to remove our
deck in our 0-75' zone. Unfortunately as you will notice the deck is the only thing in our
0-75' that I would consider to still be in "good" condition. It also apparently was also the
main focus for the design of the existing stair system that leads directly to it.
We have decided that if we are going to take on the unplanned expense of removing the
deck with a Restoration Plan that we should correct all of the issues in our 0-75' zone.
Our intent is to comply with all the City of Orono's requirements and stabilize the hill for
the environment.
Below you will find a list of details of what we have decided to address along with an
explanation (I have included numbered pictures to aid in viewing these issues):
1) Existing stair/deck design -Stairs were designed to flow up to the deck
2) Existing stairs and railing should be replaced
3) Picture of existing stairs -Runoff under stairs is eroding and washing into the lake
4) Top view of all hardcover to be removed (deck, existing stairs and planters)
5) Lake view of existing stump, retaining wall and planter
6) Pictures of existing stairs -They are in need of replacement
7) Top view of existing deck/stair design
8) Existing stump to be removed will require retaining wall (Letter to Matt Boltermann at
the City of Orono is enclosed)

Thank you for taking the time earlier this week to check on and confirm that our Maple
tree is a potential hazard due to cracks and age. This tree is located about 10 feet off the
shoreline.
Per our conversation, this letter is to update you that we have decided to remove this tree.
As we discussed it would be impossible to replace with the same size (Existing is about 4
Feet in Diameter), so we will be replacing with a decent sized tree (2-3 inch) that will be
of similar kind in the spring at the following address.

The property owners would like to rebuild a new home on the property. In conjunction
with the new home construction a new stair system and lake yard alterations are

residence on the property. The applicant has proposed a 2,429 s.f. home which meets
hardcover requirements, the zoning district setbacks and the structural coverage limits.
Conditional Use Permit Analysis
City Engineer, Tom Kellogg, has reviewed the revised proposal and has provided staff
with a recommendation (the letter is attached as Exhibit D).
Issues for Consideration
1. What are the visual impacts of the "wing walls" when viewed from the lake? Can
they be seen from the lake? Should a screening plan be incorporated? The wing
walls will be 3 '-4' high at the house and taper to 0' about 10' -12' from the house.
2. The plans for the 0-75' zone will need to be revised in order for Tom Kellogg to do a
complete review. Prior to that happening, does the Planning Commission feel that
there are changes that should be incorporated?
3. As the proposed vegetation matures will the property look as "natural" as it does
today or will it appear manicured?
4. Are there any other issues or concerns with this application?
Staff Recommendation
Planning Staff recommends approval of the lot width and lot area variances, and the
conditional use permit for the lakeshore land alterations and stair in conjunction with the
City engineer's recommendations.

Paul Vogstrom and Glenn Solie, Applicant, were present.
Curtis stated the applicant is requesting lot area, lot width vari.ances ~~daqo~ditfonal use permit for land
alterations within the 0-75' zone in order to construct a new·sin,gle-familYhom~. The conditional use permit is
to regrade the yard, reorient the steps, and remove a deck. The City Engineer has reviewed tl:l,~ original plans
and has provided a recommendation that this application be tal>ledto allow for more detailed plans to be
submitted.
Curtis indicated there are some unresolved issues regardingthehe,ight of the structurethat the Planning
Commission may wish to address. Staff recommendstablingthe application to allow for more detailed
information to be submitted.
Rahn inquired what the issue is with thfheight of the sn,,a~ture.

Curtis stated it is due to the numberofstories of the proposedresicience as well as the way the house is placed
on the lot.
Vogstrom stated ,his u.nde:i:'standing is as long as less than 15 percent exposed, it would not be considered an
extra story. Vogstrom indicated~e feta,ining walls could be moved closer to the building, which would lessen
the exposure on the basement. V ogstrdm inquired from where the height is measured.
Curtis stated the highest adjacent grade of the building or ten feet above the lowest.
Vogstrom indicated his plan shows 35 feet and that his understanding is it would be measured ten feet above
that.
Curtis sated the number of stories was more the issue than the height of the structure.
Gaffron stated the applicant is allowed 30 feet of height starting at the highest existing grade touching the
house, and if that is higher than ten feet above the lowest grade against the house, they go to
the average of the highest gable. Gaffron stated less than 50 percent of the foundation was covered at least six
feet by existing grade around the perimeter of the house. Gaffron indicated the trend in the last few years is
people will not meet the 50 percent around the house and will instead put a retaining wall five feet outside the
foundation. Gaffron stated the City has not accepted that type of design since City Code does not allow for
topographical changes when determining height.
Rahn inquired whether there is only one side elevation that has been provided.
Vogstrom indicated there is only one.
Rahn commented from that elevation it appears to taper from ~ lookout to a walkout and that he would like to
see accurate floor elevations. Rahn inquired where the floor.~Jevatio11ofthe proposed house lines up with the
existing house.
V ogstrom stated it is approximately 18 inches higher than the e2'isting b~e#ient due to the sloped driveway and
the steepness of the grade. Vogstrom indicated they are attempting to work with the land to create a driveway
that is not quite as steep as what currently exists:
Solie stated the current house is a one-story with a walkout and that t~e"proposed house is two stories from the
front.
Rahn indicated he does not have a problemwith the lot area variance and recommended the applicant speak
with Staff regarding the height oftlje ~cttire.
Jurgens stated the gradin,g in his view would notwo.rk.
Kempf stated h~ does not understand,.the gradingi,lan and questioned why the grade could not flow out to the
edge of the Jot. Kempf stated it appears that the house next door is approximately three feet higher than this
house and questioned the need for retaining walls.
Rahn opened th,e public hearing at 6: 12 p,m.
There were no public comments regarding this application.

Jurgens moved, Kempf seconded, to table Application #06-3183, Paul Thomas Homes for Glenn Solie,
1430 Cherry Place, to allow the applicant time to revise his plans and to submit adequate floor elevations.

Dear Melanie:
We have reviewed the survey and planting plans for the proposed home construction at 1430 Cherry Place
dated 6-1-06. We have the following preliminary comments with regards to engineering matters:
• . The submittal included two sketches for improvements to the shoreline. As a condition of this
application the existing deck within the 0-75 foot setback was to be removed. Option 2 calls for
the removal of the deck and all stairs to the lake and replacing them with a single stairway to the
lake along with associated retaining walls. This option will require extensive grading within the
0-75 foot setba_ck and is therefore not recommended . Option 1 shows the removal of the deck and
stairway connection to the main stairway to the lake. This option will qisturb significantly less of
the slope in the 0-75 foot setback and we recommend that this option be developed into more
detailed plans. The plans should include details as to proposed wall types and heights , existing
and proposed contours , stairway replacement information, detailed restoration information and a
detailed erosion and sediment control plan. The revised plans should be prepared by a landscape
designer or landscape architect and should be submitted in a scaleable format.
• The proposed grading plan on the lakeside of the home will encroach into the 0-75 .foot setback
and should be revised so that no grading is necessary in the setback. Specifically, the 956 contour
should be pulled northerly so that a maximum slope of 3H to 1 V can be maintained between the
956 1.:ontour and the 0-75 foot setback.

The City of Orono is has received your recent survey revisions for application #06-3183 for property located at 1430
Cherry Place . The following items must be submitted or revised in order for your application to be considered complete and
for the plan review to continue, following his review the City Engineer may have additional comments and may require
additional revisions:
1. The grading plan on the survey shows grading within the 75' setback from the OHWL, please revise . What is the
purpose for this grading? City Code requires a conditional use permit for any grading within the 0'-75' zone and
unnecessary grading is strongly discouraged .
2. The grading plan shows grading within 5' of a property boundary. City Code does not allow grading or filling
within 5' of a property line unless for the creation of a drainage swale, please revise.
3 . The elevation drawings show a lower level, lakeside garage door. The grading plan does not account for the door
in this location, please revise.
4. It appears that the grading along the north property line directs all of the drainage into the north wall of the home.
The grading should be revised.
5. There is an existing stair system, including a deck, within the 0-75' zone . Although City Code allows for a lake
access stair, the deck is not permitted hardcover and must be removed . Additionally, according to a Hennepin
County aerial photo there appears to be additional retaining wall and a building near the lake please revise the
survey to show all structures and hardcover.
6. The drainage arrows shown on the survey do not appear to match the proposed contours, please revise.
7. Define the drainage break in the driveway apron.
8. There are 2: 1 side slopes shown in some locations, please revise to slopes no greater than 3: 1.
9 . Show how the drainageway south of the house will be protected from erosion .
Application #06-3183 remains incomplete . If you wish to proceed with your application please submit the items requested
above by noon on Friday, April 7th in order to remain on the April 17 th Planning Commission agenda . Please call me at

zoning district, requests a front yard setback variance in order to construct a porch
addition to the front of the existing home.
Bruce Schmitt on behalf of William Ulrich, 2280 French Creek Circle, RR-lB zoning
district, requests a variance from the 150' lake setback in order to construct a garage and
home addition located completely within the 150' lake setback.
Paul Thomas Homes on behalf of Glenn Solie, 1430 Cherry Place, LR-1B zoning
district, requests lot width and lot area variances to permit construction of a new
residence on an existing lot 0.55 acre in area where 1.0 acre is normally required and a
width of l 00' where 140' is normally required. Additionally, a conditional use permit is
requested to conduct minor land alterations and grading within 75' of the shoreline to
install a new lake access stairway.
Paul Thomas Homes, 2695 Casco Point Road, LR-1 C zoning district, requests lot width
and lot area variances to permit construction of a new residence on an existing lot 0.4
acre in area where 0.5 acre is normally required and a width of 60' where l 00' is
normally required and a hardcover variance within the 75'-250' zone to exceed the 25%
level that is normally allowed.
Patrick Buckner, 2100 Shadywood Road, LR-lC zoning district, requests a lot width
variance to permit construction of a new residence on an existing lot 59' in width at the
shoreline and 68' in width at the 75' setback line where 100' is normally required .
Thomas H. Parker, 1348 Rest Point Circle, LR-1B zoning district, requests lot width
and lot area variances in order to construct a new residence on a property 13,703 s.f.
(0.31 acre) in area and 70' at the OHWL and 65' at the 75' setback where 43,560 s.f. (1.0
acre) in area and 140' in width are required. A 75' -250' hardcover variance is also
requested in order to have 38.7% hardcover where 25% is normally allowed in
conjunction with the construction of a new home.
Ben Dunlap of Streeter & Associates on behalf of the Minnetonka Center for the Atis,
2240 North Shore Drive, RR-I B zoning district requests a conditional use permit
amendment in order to construct a new I 6'6"x32'5" open sided building which will
house the outdoor kilns . A variance is also requested as the proposed kiln building will
be located streetward of the main building.
Chad Lindbloom, 2690 Rainey Road, RR-lB zoning district, requests a side street
setback variance to allow construction of an addition to an existing residence and a
detached accessory structure , both to be located nearer the side street lot line than the 50'
setback normally required.

Concept Landscaping on behalf of JoAnn Jundt, 1400 Bracketts Point Road, LR-IA
zoning district, requests a hardcover variance to have 179 square feet of hardcover in the
0-75 foot zone where 171.5 was allowed by a previous variance and no hardcover is
normally allowed to permit replacement of the existing wood lake access steps with
stone steps. A conditional use permit for land alteration within the 0-75 foot lakeshore
setback zone is also requested.
Ken and LoriJean Anderson, 4224 Forest Lake Drive, LR-1 B zoning district, request
variances to allow 32.6 % hardcover in the 0-75 foot zone where 39.9 % currently exists
and no hardcover is normally allowed, to allow 42% hardcover where 43% currently
exists and 25% is normally al lowed, to al low structural lot coverage of27 .1 % where 28%
now exists and 15% is normally allowed, to allow a structure 25 feet from Forest Lake
when a 75 foot setback is required, and to allow the garage to have a five foot setback
from the side property line when a ten foot setback is required. The purpose of these
variances is to allow a second story to be added to the existing structure and the garage
enlarged to three stalls.
Rick and Julie Krieger, 355 Stubbs Bay Road North, RR-1 A zoning district, request a
conditional use permit to allow plumbing consisting of toilet, lavatory and shower in an
accessory building.
Ryan Companies US, Inc., 430 & 450 Old Crystal Bay Road and 2725 & 2765
Wayzata Boulevard, I -Industrial zoning district, requests approval ofa preliminary plat
of four industrial lots, Commercial Site Plan Review for three office-warehouse
buildings; a conditional use permit for outdoor storage; and a conditional use permit for
use of alternative fa;:ade materials.
Landscaping Plus on behalf of Wendy McLaughlin, 1180 Phillips Drive, RR-1B zoning
district, requests a conditional use permit for land alterations within a protected wetland.
Steven Webster and Kent Larson, 500 & 540 Orono Orchard Road South, RR-1B
zoning district, request a subdivision of a lot line rearrangement to allow for a new
driveway access to Orono Orchard Road for the 540 property; also proposed is a vacation
of the 12-footwide alley located within Block 13, Minnetonka Bluffs, from Dickenson
Street to Fox Street.

Staff Recommendation: Planning Staff recommends approval of the lot width
and lot area variances. The applicant must submit a revised, detailed landscape
/I and construction plan for the work proposed in the 0-75' zone. However, due to
the unresolved issues detailed in the "Issues for Consideration" staff
recommends that the application be tabled.
Conditional Use Permit Analysis
City Engineer, Tom Kellogg, has reviewed the original plan and has provided
staff with a recommendation (the letter is attached as Exhibit F). A thorough
evaluation of the applicant's proposal is still required, as of the printing of this
report the City Engineer has required more detailed information in order to
continue his evaluation.
Issues for Consideration
1. The home as proposed has a walk-out level and a sub-basement below the
walk-out level. While the home meets the 30' height limitation, we have
reviewed the plans with respect to the number of stories and it appears that
the proposed retaining walls and the sub-basement are an attempt to achieve
the third story. What is the Planning Commission's interpretation of the City's
building height definition (listed above) and the definition of "story above
grade" with respect to this plan?
2. What are the impacts of the retaining walls when viewed from the adjacent
property? Should an extensive screening plan be incorporated?
3. The plans for the 0-75' zone will need to be revised in order for Tom Kellogg
to do a complete review. Prior to that happening, does the Planning
Commission feel that there are changes that should be incorporated?
4. As the vegetation matures will the walls be screened from views year round?
5. Are there any other issues or concerns with this application?

for the applicant to resolve issues with the number of stories for the proposed
home and to submit detailed plans for the repair of the stairs and removal of the
deck in the lake yard.
The applicant is requesting lot area, lot width variances and a conditional use
permit for minimal grading within the 0-75' zone in order to construct a new single
family home and repair lake access stairs and remove a lake yard deck.
Staff Recommendation: Planning Staff recommends approval of the lot width

Dear Melanie:
We have reviewed the survey and planting plans for the proposed home construction: at 1430 Cherry Place
dated 6-1-06. We have the following preliminary comments with regards to engineering matters:
• The submittal included two sketches for improvements to the shoreline: As a condition of this
application the existing deck within the 0-75 foot setback was to he removed. Option 2 calls for
the removal of the deck and all stairs to the lake and replacing them with a single stairway to the
lake along with associated retaining walls. This option will require extensive grading within the
· .0-75:foot setha_ck and is therefore not recommended. Option 1 shows the removal of the deck and
stairway connection to the main sta,irway to the lake. This option will disturb significantly less of
the slope in the 0-75 foot setback and we recommend that this option be developed into more
detailed plans: The plans should include details as to proposed wall types and heights, existing
and proposed contours, stairway replacement information, detailed restoration information and a
detailed eros10n and sediment controlplan. The revised plans should be prepared by a landscape
designer or landscape architect and should be submitted in a scaleable format.
• The proposed grading plan on the lakeside of the home will encroach into the 0-75 foot setback
and should be revised so that no grading is necessary in the setback Specifically, the 956 contour
should be pulled northerly so that a maximum slope of 3H to .1 V can be maintained between the
956 contour and the 0-75 foot setback .

process. When can this be initiated?

before we would officially move in. What is the process to get this approved?

restoration plan. I hired Garden Market and Landscape out of St. Boni as a Landscape Architect, so I hope
that I have the detail that you are expecting.
1) Revised Survey -We addressed all of the elevation issues that were brought to our attention at the last
planning commission meeting. Most of the boulder walls were removed and we used the original natural
grade of the lot to accommodate a 2 story walk out. We utilized small bolder wing walls on the SE and NE
corners similar to what exists today (they are both less than four feet in height). It also addresses your
request for the details on the sump pump/draining for sport court along with erosion/sediment control
elevations.
2) Elevation Drawings -New elevation drawings that detail all elevation/grading changes associated with
the survey.
3) 0-75' -I provided two plans (for your feedback/selection). The first restoration plan is just to remove our
deck,grade and plant wild grass were the deck was. The other plan is to do a complete 0-75' restoration
that includes removing deck, replacing stairs, fixing retaining walls, removing stump. etc. We decided that it
does not make sense to disturb our 0-75' twice, so we want to do as little as possible disturb or fix it
everything correctly the first time (IE: It was recommended that we leave the retaining wall alone because it
still has a couple years of life left). We are not going to spend all of the time and money to replace our
stairs and then rip them back out again to fix the retaining wall in a couple of years. Both plans include
elevation drawings along with detailed plant descriptions.

average lakeshore setback variance in order to construct an in-ground pool ahead

owner of the property at 875 Wayzata Boulevard West, requests a
Comprehensive Plan amendment to reguide the property from Rural Residential
use (1 unit per 2 acres) to Urban Residential use (2 units per acre) to allow for a
12-unit townhome development.
Robert Shiff on behalf of Temple Israel, 645 Tonkawa Road, LR-lB zoning
district, requests a conditional use pennit in order to conduct land alterations to
