VOTE: Ayes 5, Nays 0. 7. #12-3574 DALE GUSTAFSON WITH GUSTAFSON DESIGN, INC., ON BEHALF OF CHRIS P AINOUE, 1430 CHERRY PLACE -CONDITIONAL USE PERMIT AND VARIAN CE -RESOLUTION NO. 6173 Rahn stated his questions relating to this application are more procedural and asked if the applicant had to pay two fees, one for the conditional use permit and one for the hardcover variance. Curtis indicated it was a total of $700 for both items. Rahn noted a stairway is allowed hardcover in that zone and asked why it requires a variance. Curtis stated the Code only allows for minimal hardcover to access the lake and not a meandering staircase. Rahn asked why Staff recommends approval of that staircase if it creates more hardcover than a straight path. Curtis indicated they would still require the landings and that Staff feels there would be more opportunity to screen the stairway than a straight stairway down the slope . The amount of grading would also be less invasive as well and would not require a conditional use permit. Rahn stated he did not see in the report where it addresses the width of the stairs. Curtis indicated the survey reflects the width of the stairway. Rahn asked whether a variance would be required if a homeowner has a lakesid.e stairway they would like to replace with the same square footage. Curtis indicated it would not require a variance. Rahn asked whether a variance would be required if they decided to add a lockbox at 20 square feet. Curtis indicated it would not require a variance . Rahn commented he also wanted to ensure that the applicants were not being charged two $700 fees prior to approving the application . Curtis stated the Staff has done an analysis and there is a breakdown of what the City incurs to process v arious applications . Rahn asked if a conditional use permit request should be on the same application as a variance application. Curtis indicated there is a different notification requirement for each of these applications and they need to be kept separate. Rahn asked if a variance application was completed . Curtis stated to her knowledge they hav e a variance application on file . Due to the size, shape and orientation of the property, the applicants are requesting lot area, lot width, and side street setback variances in order to construct the proposed 1,580 square foot home . The Planning Commission held the public hearing for this application prior to the adoption of the new hardcover regulations. At that time a 75 -250 foot zone hardcover variance to allow 37 percent hardcover was being requested . Using the gross lot area, the proposed hardcover is at 24.2 percent. The applicants ' hardcover now conforms to the revised hardcover regulations for a Tier I lot. At the Planning Commission it was discovered that there was a discrepancy in the applicant's survey and the architect 's plans . The Planning Commission voted 7-0 , based on the architect 's plans , to approve a motion recommending the following: 1. The existing turf will be mostly removed and replanted with plants and shrubs. A portion of the turf walkway will remain. The lake access stair is allowed hardcover within the Oto 75' zone however the new stair configuration will increase hardcover by 44 square feet (4.69% proposed)and must be reviewed and approved as a variance; a CUP is also necessary due to the earth movement proposed within the Oto 75' zone. Planning Commission Recommendation On September 17, 2012 the Planning Commission voted 6 to 0 on the consent agenda to recommend approval. Planning Staff Recommendation The City's engineer has reviewed and approved the proposed plans. Planning Staff recommends approval of the CUP for the minimal grading work within the Oto 75 foot zone as well as a hardcover variance to allow the reconstruction and reorientation of the lake access stair resulting in 4.69% hardcover in the Oto 75' zone. COUNCIL ACTION REQUESTED Council should adopt or amend the attached draft approval resolution. A RESOLUTION GRANTING A CONDITIONAL USE PERMIT AND HARDCOVER VARIANCE PER MUNICIPAL ZONING CODE SECTIONS 78-1282, 78-1283, 78-1286 and 78-1288 FILE NO. 12-3574 WHEREAS, Christopher David Patnode, a single person (hereinafter "the Applicant") is the owner of the property loc.ated at 1430 Cherry Place within the City of Orono (hereinafter the "City") and legally described as follows: Lots 4 and 5, Block 4, Crystal Bay View, Hennepin County, Mi.nnesota. (hereinafter the "Property"); and WHEREAS, the Applicant has made application to the City ofOrono for a conditional use permit to conduct I.and alteration .activities within 75 feet of Lake Minnetonka per Orono Municipal Zoning Code Sections 7878-1282, 78-1283, and 78- 1286 to allow for construction of a new lake access stair; and WHEREAS, the Applicant has made application to the City of Orono for a variance from Municipal Zoning Code Section 78-1288 to allow 354 square feet of hardcover within the 0-75' zone where O square feet of hardcover is allowed and 310 square feet currently exists to ~llow reconfiguration and reconstruction of the existing lake access stair. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 12-357 4. 2. The Property is located in the LR -1 B, Zoning District which requires a minimum lot area of 1.0 dry acres and a minimum lot width of 140 feet. 3. The Planning Commission reviewed this application at a public hearing held on September 17, 2012 and recommended approval of the conditional use permit and hardcover variance based on the following findings: Page 1 of 4 Council Exhibit A a. The lot is 0.55 acre in area and has 100 feet in width at the OHWL and at the 75' setback. b. The lot is provided with City sewer. c. The Applicant's existing staircase is in disrepair. d. The Applicant has submitted a meandering stone stair plan with landings which has been reviewed by the City Engineer. e. The Applicant's plan indicates that along the staircase the slope will be planted with vegetation which will aid in screening the stair when viewed from the lake. f. The Applicant's request will alleviate a practical difficulty inherent to the Property and not created by the Applicants. g. The Applicant's request will not alter the essential character of the neighborhood and will re~ult in minim.al negative impact on adjacent properties. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicant and the public, and the effect of the proposed variance and conditional use permit on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit to conduct land alteration activities within 75 feet of Lake Minnetonka including a lak~ access stair per Orono Municipal Zoning Code Sections 78- 1282, 78-1283, and 78-1286 in order to reconstruct the lake access stair; hereby grants a variance to Orono Municipal Zoning Code Section 78-1288 to allow reconfiguration of the stair system within the 0-,75' zone; subject to the following conditions: 1. Council approval is based on the survey and stair plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to the plans which are not in conformity with City codes will require further Planning Commission and City Council review. Page 2 of 4 2. Hardcover shall not increase above the existing and approved levels as follows: 354 s.f. of hardcover (4.69%) within the 0-75' zone. Applicant is advised that any requests to increase hardcover beyond the allowable limits established in the City Code shall require City approval, and will not likely be approved. 3. Following City Council approval the Applicant must apply for and receive an administrative zoning permit for the land alteration activity/lake access stair on the lake slope. 4. A general planting plan including species, sizes and locations shall be submitted for the administrative zoning permit review. This plan shall be submitted and approved by the City prior to the closing of the escrow account. 5. Authorities granted by this resolution run with the Property not with the Applicant, but are permissive only and must be exercised by obtaining a zoning permit for the land alteration/lake access stair within one year of the date of Council approval, or the approvals wil.l expire on that date (October 8, 2013). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted here.in, and shall be punishable as a misdemeanor. 7. The undersigned Applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of the Applicants and the Applicant's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property. (4.69%) No Change The applicant's proposed plan increases hardcover within the 0-75' zone by 44 square feet over the existing level; resulting in 4.69% hardcover where 4.11% currently exists. The increase is the result of the new configuration. Conditional Use Permit Earth movement which exceeds 10 cubic yards within 75 feet of the lake requires a conditional use permit (CUP). Although the applicant's grading activity appears very minimal it triggers the need for a CUP review. The City Engineer will review the plans from a stability and safety perspective at the time of the administrative zoning permit for the grading activity. The public hearing should address any additional non-engineering related concerns regarding erosion prevention or stabilization of slope, natural re-vegetation and appearance from the lake, excess hardcover and impacts to adjacent properties. City Code section 78-1286 offers guidance for reviewing this type of CUP. • Alterations must be designed and conducted in a manner that ensures only the smallest amount of bare ground is exposed for the shortest time possible. Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a permanent vegetation cover must be established as soon as possible. Comment: The proposal will be reviewed to assure limited exposure of bare soil and establishment of stabilizing vegetation. • Methods to minimize soil erosion and to trap sediments before they reach any surface water feature must be used. Altered areas must be stabilized to acceptable erosion control standards consistent with the field office technical guides of the local soil and water conservation districts and the United States Soil Conservation Service. Comment: The City requires the applicant to have an erosion control plan and collects an FILE #12-3574 11 September 2012 Page 3 of 4 escrow security to assure the applicant and contractor will maintain erosion control protection throughout the duration of the project. • Fill or excavated material must not be placed in a manner that creates an unstable slope. Plans to place fill or excavated material on steep slopes must be reviewed by the city engineer for continued slope stability and must not create finished slopes of 30 percent or greater. Comment: The city engineer will review the plans to assure protection of the slope as well as the lake. • Fill or excavated material must not be placed in bluff impact zones. Any alterations below the ordinary high water level of public waters must first be authorized by the commissioner of the department of natural resources under Minn. Stat.§ 103G.245. Comment: Alterations below the OHWL or within a bluff impact zone are not proposed. • Alterations of topography must only be allowed if they are accessory to permitted or conditional uses and do not adversely affect adjacent or nearby property. Comment: Topographic alterations are not proposed. • Placement of natural rock riprap, including associated grading of the shoreline and placement of a filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical, the landward extent of the riprap is within ten feet of the ordinary high water level, and the height of the riprap above the ordinary high water level does not exceed three feet. A riprap permit shall be obtained per the requirements of section 78-969. NA • Excavations where the intended purpose is connection to a public water, such as boat slips, canals, lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the elevation or the ordinary high water level are subject to approval of the department of natural resources and other agencies with concurrent jurisdiction. NA Practical Difficulties Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Staff finds the applicant has demonstrated practical difficulties specific to the topography of the lot and in the orientation and condition of the existing staircase. Staff supports granting the 0- 75' zone hardcover variance and a CUP to allow construction of the new stairway to the lake. Issues for Consideration FILE #12-3574 11 September 2012 Page 4 of 4 1. Does the Planning Commission find that that the property owner proposes to use the property in a reasonable manner which is not permitted by an official control? 2. Does the Planning Commission find that the variances, if granted, will not alter the essential character of the neighborhood? 3. Does the Commission find it necessary to impose conditions in order to mitigate the impacts created by the granting of the requested variances? 4. Does the Commission find there are additional conditions which should be placed upon the CUP approval? 5. Are there any other issues or concerns with this application? The CUP request made as I understood it was reflective of the installation/replacement of lake access stairs and the associated walls shown on the survey . We voiced our concern at the time of application submittal that your site plan and the survey didn't correlate . As we have indicated in prior correspondence and conversations the certificate of survey is the plan we reference to conduct our review ; the rain garden shown on the attached was not shown on the proposed survey only the site plan and therefore not part of planning staff's review . With the existing slopes of the embankment, are they planning on doing any regarding? How are they planning on maintaining this area? • There appears to be a retaining wall by the upper portions of the steps, but the survey does not reflect a retaining wall. The survey needs to show this along with the top and bottom elevations. If the wall exceeds 4' in height or if a tiered wall is not separated by 2x the higher wall, then they will need to be engineered by a registered professional engineer. • The grading plan shows significant grading/ planting in this area which could disturb a significant amount of dirt . The applicant should prov ide dirt work calculations showing how much area is being disturbed and how much dirt work is being used . The increase is the result of the new configuration. Conditional Use Permit Earth movement which exceeds 10 cubic yards within 75 feet of the lake requires a conditional use permit (CUP). Although the applicant's grading activity appears very minimal it triggers the need for a CUP review. The City Engineer will review the plans from a stability and safety perspective at the time of the permit for the grading activity. This public hearing should address any additional non­ engineering related concerns. The City Code offers guidance for reviewing this type of CUP. The conditions have been outlined within the staff report and the planning commission should specifically address any areas of concern. Staff finds the applicant has demonstrated practical difficulties specific to the topography of the lot and in the orientation and condition of the existing staircase. Staff supports granting the 0- 75' zone hardcover variance and a CUP to allow construction of the new stairway to the lake.
