1 1 = 8 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO.8 IL A RESOLUTION GRANTING A CONDITIONAL USE PERMIT PER MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVISION 19 AND A VARIANCE TO SECTION 10.55, SUBDIVISION 8 FILE NO. 1807 WHEREAS, Susan Marie Sumey (hereinafter the "applicant") is the owner of the property located at 1330 Cherry Place within the City of Orono (hereinafter "City") and legally described as: Lots 1 and 2, Block 11, Saga Hills Revised according to the recorded plat thereof, Hennepin County, Minnesota (hereinafter "property"); and WHEREAS, per Section 10.03, Subdivision 19 the applicant has made application for a conditional use permit to permit land alterations in excess of 100 cubic yards and a variance per Section 10.55, Subdivision 8 as proposed land alterations are located within the lakeshore protected area where no such alterations are allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1807.. 2. The property is located in the LR-lB Lakeshore Residential Zoning District requiring one acre in area. The property consists of 27,930 s.f. or .64 acres. 3. The Orono Planning Commission reviewed the application on April 19, 1993 and recommended unanimous approval of the proposed conditional use permit and variance as set forth above and based approval on the following findings and hardships: a. Scouring action of waves along west bank of North Arm. Severe erosion will eventually impact mature tree and structural improvements within lakeshore yard if condition is not remedied. The proposed land alterations within the lakeshore yard will not result in additional hardcover. All land alterations will be above the 929.4 elevation. 4. The Council finds that granting a conditional use permit to allow the land alterations as set forth in the amended plan will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring properties; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.55, Subdivision 8 to allow land alterations within the lakeshore protected area and grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 9 as the land alterations involve land movements in excess of 100 cubic yards. Silt fence must be installed along the perimeter of the shoreline prior to any construction to protect the lake from erosion. 2. Applicant shall file for the legal combination of Lots 1 and 2. This must be completed before the City staff can issue a land alteration permit. Applicant's contractor must obtain a land alteration permit before the work can begin. 3. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be exercised by application for a land alteration permit within one year of the date of Council approval or this variance/conditional use permit will expire on that date (May 10, 1994). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agree to the terms of this resolution and on behalf of herself, her heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. Mabusth explained this application involves major filling and grading in the iakeshore yard to eliminate a severe erosion problem, and to save a 2+ Inch diameter elm tree. She noted the applicant has submitted an amended proposal addressing all of staff's concerns and requests. She said there is no need for further review by other agencies. Sumey presented photos showing the rip rap was in existence. Bellows commended her for quickly resolving issues brought up by staff. Mabusth added this form of restoration is excellent. Mabusth explained the applicant seeks approval of a conditional use permit for a second story guest apartment over an attached garage that has existed for years. Because of the extensive remodeling and because of the kitchen in the guest apartment, the applicant was required to file the application. There is a breezeway that connects the residence to a garage. The breezeway area does not connect directly to a stairs that takes you to the upper level apartment. Access is through a separate door at the exterior of the garage. The fact that this did not meet the requirement of an internal access concerned the Planning Commission. But they also noted the breezeway does not have a permanent foundation, and there is adequate area to support a guest house unit on the property. Jabbour and Goetten disagreed with the Planning Commission's findings. Goetten stated to have a guest house the property must have the ability to be divided and the guest house survive on its own. Mabusth stated the property meets only the area standards for such. Mabusth, Building & Zoning Administrator Date: May 4, 1993 Subject: #1807 Susan Marie Sumey, 1330 Cherry Place Conditional Use/Variance - Resolution Additional Exhibits J - Applicant's Addendum K - Amended Land Alteration Plan Brief Review of Application The application involves major land alterations within the lakeshore yard involving filling and grading activities to restore and prevent further erosion of the steep lakeshore bank. The original restoration plan was reviewed by the City Engineer, Exhibit G. The original plan lacked a substructure needed to support and sustain the layers of geo-grid fabric. The amended plan, Exhibit K, has been reviewed by Gustafson and found to meet all of the installation criteria set forth by the manufacturer and as recommended by the City Engineer. The restoration project will involve no hardcover within the lakeshore yard as all the fabric and support structure will be covered with earth. Lots 1 and 2 have not been legally combined. The applicant has agreed to legally combine the two parcels. The resolution has included the required legal combination as a condition of approval. Planning Commission Recommendation The Planning Commission recommended unanimous approval of the amended land alteration proposal. The enclosed approval resolution has been drafted per the findings and conditions of the Planning Commission approval. Application involves the regrading and filling of lakeshore bank to prevent further erosion. Section 10.55, Subd. 8 - Variance is required as no land alterations are allowed within the 0-75' lakeshore protected area. Section 10.22, Subd. 2 A. Major portions of the lower areas have washed downhill to lake. A 24" ehn at the top of the bank will be lost if repairs are not made. In the early '80's the neighbor to the immediate west applied for similar alterations of bank based on similar erosion problems. Both the DNR and MCWD have been asked to review the proposal to determine if permits will be necessary. The DNR will not require a permit review as long as all alterations are above the 929.4. As alterations are proposed between the 930 and 931.5, an MCWD permit will be required. Applicant has been advised of the need to file a permit application. The repair of the bank consists of cutting and filling and the installing of a geogrid fabric in tiered layers and all will be covered over with earth. The enclosed improvement will not result in any hardcover. Please review Exhibit G. Shawn Gustafson has advised that he has contacted the Miragrid manufacturer. In reviewing the proposed plan for installation, the manufacturer concurred with the City Engineer that the proposed use of the miragrid would not be adequate to sustain the bank and that additional anchors and support system would be necessary. The engineer has recommended the following additions and changes in the current proposal: 1. Fill soil must be of a granular material not clay. 2. Fill soil should be compacted no greater than at 6" lifts to minimum specified density of 95 %. 3. Miragrid needs to be anchored to soil bank and suggest use of duckbill anchors set into soil bank and tied to a series of pipes or bars laid parallel to shoreline. Miragrid could then be attached or wrapped around these pipes and anchored to side slope. 4. Seeding with Crown Vetch or other quick spreading plant with good root base. Possible use of permanent turf restoration such as miramat. Gustafson advises proposed American Excelsior Biodegradable turf is temporary and will not prevent future erosion unless adequate vegetation is restored. 5. Rip rap to prevent undermining of restored bank. 6. Silt fence installed along shoreline prior to construction. Zoning File #1807 April 12, 1993 Page 3 Staff has contacted the applicant to review some of the concerns expressed in Engineer's report. Ms. Sumey advises that rip rapping exists at the shoreline except that it has been covered up by the eroding bank. The City Engineer shall inspect the rip rap once it is uncovered. It is imperative that applicant's contractors not cover existing rip rap until a evaluation is made by the City. Staff realizes that the additional improvements to the original plan will result in major increases in cost. Rip rap may be upgraded at a later stage but based on potential of scouring from wave action, the bank restoration may be completely undermined if functional rip rap is not a part of the original improvement. Issues for Consideration 1. Proposed land alterations within the lakeshore yard will not result in additional hardcover. Hardcover excesses exist within the 0-75' and 75-250' setback. Will applicant be asked to reduce hardcover? 2. If members find the current proposal objectional, what other methods are available for applicant to pursue to preserve her lakeshore yard. Engelhardt e-- r----- —7- PR 793 We have reviewed the proposed shoreline restoration proposal for Susan Sumey's property at 1330 Cherry Place in Section 8. The property is adjacent to the North Arm of Lake Minnetonka and has a severely eroded soil bank along the shoreline. The proposed restoration is not acceptable from an engineering standpoint, and we recommended the following modifications. Silt fence must be installed along the perimeter of the shoreline prior to any construction to protect the lake from erosion. The fill soil should be a granular material. Clay soil is not recommended for this type of application. The fill soil should be compacted in no greater than 6 inch lifts to a minimum specified density of 95% of the standard proctor density. The proposed fill and Miragrid is proposed to be installed up to the existing failure plane, as shown on the detail. There is nothing shown to anchor the Miragrid into the existing soil bank. We believe that future problems are likely at the same failure plane as before. We recommend using a system of duckbill anchors that are set into the existing soil bank and tied to a series of pipes or bars laid parallel to the shoreline. The Miragrid could then be attached or wrapped around these pipes to anchor it to the side slope. The proposed American Excelsior Biodegradable turf reinforcement is a temporary turf restoration and will not prevent future erosion unless an adequate vegetation and root base has been established. Maintenance of the 1:1 slopes will not be possible. We recommend seeding the slopes with a low maintenance vegetation such as Crown Vetch. The Crown Vetch is a spreading plant with a low profile and good root base. There are several permanent turf restoration products available such as Miramat which will further increase the stability of the surface. Orientation of the reinforcement is of extreme importance since geogrids vary in strength with roll direction.
