I have absolutely no objection to his building a new garage in
the location, he specified. We have discussed this in detail
and everything appears to be satisfactory.

Hardcover allowed = 3432 sf or 30%
Proposed hardcover = 324tsf house = 1040 sf

The applicant requests setback variances to rebuild a two car
garage (24 x 22) in place of the existing single car + car port
structure. There is a negligable increase in hardcover produced
by the proposed structure over the existing. The rear setback
is improved with new location. Staff will ask that both the side
and rear walls of the new structure be fire walls. The location
of the accessory structures on the abutting properties will
necessitate this special construeion.
The applicant has received approval from neighbors on both sides -
note not the property owner to the rear but then the encroachment
is improved by 2'.

Staff Recommendation
To approve the rear and side yard setback variances requested
by Todd Robideau to permit construction of a 29' x 22' garage
subject to the following conditions:
1 - Applicant apply for a demolition permit to tear down
original structure at time he applies for building permit.
2 - Fire walls must be constructed forrear and side (south)
walls of garage.

with the residential development of the surrounding
neighborhood.
4 - The property has been assessed for 1 sewer unit and
sewer is available.
5 - The development of the property will not endanger
the public health, safety and welfare.

1 - All proposed structures on the site must meet the
setbacks of the LR-19 zoning district.
2 - Access to the site will be via Rest Point Lane -
the access location must be approved by the Public
Works Coordinator.
3 - Development of the site will be limited to the
hardcover regulations of the City - property is
location within the 75-250' setback area allowing
25% hardcover or 6818 sf.
4 - If garage structure remains it must be converted
to storage shed or an other accessory structure
permitted in residential district - it cannot
function as garage since access will be via Rest
Point Lane.
5 - Prior to issuance of a building permit, the owner
must submit proof of combinationof Lot 14 and Part of
Lot 15.
6 - Payment of the following fees with building permit:

is improved with new location. Staff will ask that both the side
and rear walls of the new Structure be fire walls. In variance
applications dealing with less than 10' setbacks for structures
in densly populated areas, staff continues to ask for fire walls
constructed for sides affected by encroachment.
The applicant has received approval from neighbors on both sides -
note not the property owner to the rear but then the encroachment
is improved by 2'. The lot to the rear is larger and does not
contain structures close to the property line.

Gibbs' application and to hold a special Council
meeting at the Gibbs property on Friday, July
6, 1982 at 9:00 A F'. , in case of rain, the meeting
will be held Tue. 'ay, July 20, 1982 at 9:00 A. M.
to view the access. Motion, Ayes (4) - Nays (0) .

Mr. Carlson, Mrs. Ellis, and Mr. Reese were

Mayor Van Nest moved, Hurr seconded, to appruve
the variance request of Jerome Carlson, 2701
Kelly Avenue, per the Planning Commission
recommendations, subject to the curb -cut being
on Walter's Port Lane only; a permit to be issued
for moving the present house to Spring Park.
Hardship is due to the topography of the area.

variance request of Larry Langhans, 1366 Rest
Point Road, per the Planning Commission
recommendations, subject to new building site in
the rear have no riparian rights to Lake
Minnetonka. Motion, Ayes (4) - Mays (0)

City Council the request for a variance of Todd

Frahm moved, Adams seconded, to approve the
variance request of Todd Robideau, 2794 Casco
Point Road, per the Planning Commission
recommendations. Motion, Ayes (4) - Nays (0).
The City Council received for information the
letter from the State of Minnesota Waste
Management Board concerning hazardous wastes
dated June 29,1982.
The City Council received for information the
Solid waste Resource Recovery and Disposal
Advisory Committee letter from Donald Brauer
regarding re -activating the committee dated
July 2, 1982.
City Engineer Cook informed the City Council that
the low bidder on the Navarre Water Tower
painting bid was L.P. Gas Supply Corporation.
The L.P. Gas Supply Corporation had informed the
City Engineer that they had an error in their bid
and have requested that they be released of their
responsibility of painting the water tower;
there was a 5% bid bond. L.P. Gas has agreed to
paint the iron removal tank at no cost to the
City. City Engineer Cook stated thet Allied
Painting and Renovating Company � s the next
lowest bidder in the amount of $28,500.
Mayor Van Nest moved, Frahm seconded, to award to
the second lowest qualified bidder, Allied
Painting and Renovating Company the contract for
painting the Navarre water tower in the amou.it of
$28,500. Motion, Ayes (4) - Nays (0).
Mayor Van Nest moved, Frahm second. ., to release
L. P. Gas Supply Corporation from their bid, and
to adopt a resolution approving a contract with
L. P. Gas Supply Corporation to paint the iron
removal tank for the Navarre water tower, to
provide a performance bond, and that the City
return the bid bond. Motion, Ayes (4) - Nays
(0).
