The walkway area will be reduced. The excavation for the new garage into the steep bank will require a retaining wall along the east, north, and south side of the garage. The pruposed concrete slab will not create a hardcover problem; although, the proposed level of use is right now at the allowed hardcover limit of 2490 sq. ft. We will require a firewall for the north wall because the proposed building is only 3' from the lot line. The Planning Commission reviewed the possibility of relocating the garage with doors facing to the north with access achieved via the unimproved public alley. Staff advised that because of the topography/ steep bank, this would require the erection of a retaining wall within the unimproved public alley and we could not allow or recommend approval. The Planning Commission voted to recommend -i�._:roval of the street and side yard variance application of Kevin Rolf to -i<rmit the construction of a detached 24' X 24' garage based on the followinq findings: 1. Mayor Butler moved, Councilman Frahm seconded to a norove, for the record, to adiust the Comprehensive Sewer Plan numbers to be consistent with both the '71-1 assessments and with the total Medina -Long Lake agreed upon capacity. Motion, Ayes (7) - Nays (0). to Mr. lames Dongoske, 875 Forest Arms Lane, was 4824060 City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 1474 Granting Variances to Municipal Zoning Code Section 34.552 - File 730 Whereas, Kevin Rolf is the owner (hereafter "owner") of property ' ocated within the City of Orono (hereafter "City") at 2700 Casco Faint Road legally described as Let 14, Block 3, Casco Heights (hereafter "property"); and Whereas, the owner has applied to the City for variances to municipal zoning code section 34.552 to allow construction of a detached garage 20 feet from the front/street property line, instead of the required 30 feet and 3 feet from the side/north property line instead of the required 10 feet. Minnesota: Now, Therefore Be It Resolved by the City Council of ')rono, Findings 1. This application was reviewed as zoning file no. 730. 2. The property is located in the LR-IC Single Family Lakeshore Residential zoning district. 3. The proposed garage is to be no larger than 24' X 241. 4. The Orono Planning Commission reviewed this application on March 21, 1983, and recommended approval of the variance as requested based upon the following findings: a) To place the proposed st ucture at the 10' setback would require extensive land alteration of the steep front yard bank. b) The degree of slope increases is you move to the rear/east of the property. c) The existing garage is located .5' from the front/street property line; the 20' street setback of the proposed garage will provide safer access. d) The proposed variance application does not require any other variances to the muni(:ipa1 zoning code. City of OR,ONO RESOLUTION OF THE CITY COUNCIL NO. T► City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the owner and other interested persons, and the effect of the proposed variance on the health, safety and welfare of the community. 1;. The City Council finds that the conditions existing on this property are peculiar to it and Flo not apply generally to other property in this zoning district: that granting the variance would not adversely effect traffic conditions, light, air nor pose a Eire hazard or other danger to neighboring property; would not merely serve as a convenience to the owner, but is necessary to alleviate ademonstrable hardship or difficulty; is necessary to preserve a substantial property right of the owner; and would be in keeping with the spirit and intent of the zoning code and comprehensive plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to section 34.51,12 to allow construction of a detached garage 201 feet from the front/street property line and 3 feet From the side/north property line, subject to the following conditions: 1.. The new construction will involve extensive alteration of the steepbank, owner must grade so to direct all surface drainage to the front/street side of the lot. 2. Applicant is ri aced on notice that if future improvements on the property involve additional hardcover that existing hardcover must be remove' "o match the new hardcover proposed for the property. 3. No other variances are granted or permitted for this structure and this structure may never be used as an addi, ional residential unit on the property. 4. Authorities granted by this variance run with the property not with the owner, but are permissive only -ind must be exerciseu by application for a building permit within one year of the lute of Council approval, or this variance will expire on that date (April 11, 1984). 5.
