The proposed addition consists of a second story to the existing dwelling. The neighbor's house to the south is presently located about 20' from this comeon property line. This property is sewered. Indications on the sketch are that the addition would he S' higher than the existing house. The Commission recommended approval of the variances required for the proposed addition to the non -conforming residence based on the sketch provided, the addition is S' higher than present ridge line and does not extend beyond present extremities of the house. MINUTES OF A PLANNING CUMISSION MEETING HELD SUMMER 7, 1976 - PAGE S Mr. Niichel submitted a revised subdivision proposal to the ROBERT NIICI1EL Planning Commission. This revised proposal includes a new 317S SIXTH AVF?JUEN N. access to this subdivision which meets with the approve -f SUBDIVISION ;PRELIN1IR,1RY) Hennepin County. The Planning Commission felt this was a great improvement. Pesek moved, Hannah seconded, to approve this preliminary plan based on the new access approval of the County and a conservation easement on marshland and landlocked dry land on east edge of Lot 4. Motion - Ayes (7), Nays (0). The Steward's are requesting a variance to build an addition to their existing hone. They submitted a letter from their neighbor to the east stating that they had no objection to this variance. Pesek moved, Guthrie seconded, that this application become an action item and the variance be granted as submitted due to the fact that there would be no encroach- ment to the east lot line as the steep grade to the east would eliminate the possibility of any future building by this neighbor. Motion - Ayes (7) , Nays (0) . Mr. Beno was present and explained that Nis. Allen of the Hennepin. County Welfare Department was in attendance and had to leave. He also explained that he and his wife have provided emergency shelter care to over 150 children most of which have been teenage girls. The Beno's have three children of their own and provide shelter for four foster children. They have four bedrooms in their have to accomo- date these children. They are more than willing to have the Planning Commission inspect their hare. The Planning Commission felt that the neighboring residents should be given the opporturuty to express their views on this matter and that a public hearing should be held. Mr. Beno was quite insistent upon quicker action. IIe mentioned that a mother and her baby needed a home. After some discussion Van Nest moved, Pesek seconded, to schedule a public hearing for October 4, 1976, at 7:30 p.m. and that staff get legal opinion from City Attorney for the September 20, 1976, meeting. Staff would re rt legal direction at that time and, if necessary, the public hearing could be cancelled and action taken at the September 20 meeting. Motion - Ayes (7), Nays (0). Mr. & Mrs. Farley were present. They are requesting a variance to build an addition to their existing home. This is a work session item and Planning Commission requested that the Farley's submit a side elevation plan for the September 20, 1976, meeting. The Zoning Administrator, informed the Farley':- that he would need this sketch in one week. The Nelson's are requesting approval to replace their existing garage which is badly in need of repair. itDonald moved, Hannah seconded, to recommend approval to replace the existing garage based on the fact that the new structure would be located at the same setback points and any other location for this garage would require more fill. Also, this new garage would be a great improvement to the property as the existing structure is badly in need of repair. Motion - Ayes (8), Nays (0). The Olson's were present. They are requesting approval for an addition to an existing non -conforming situation. Pesek moved, Hake seconded, to approve this variance based or the fact that the proposed addition to the existing residence would meet all setback requirements and the Olson's have sufficient lot area. Motion - Ayes (8), ?Jays (0) . Council previously approved a 15' variance (0133) so an addition could be made to the existing dwelling. Mr. Jansen needs an additional 2' width for his kitchen reducing the side yard setback from the originally approved 1S' to 131. Dunlap moved, Pesek seconded, to recommend approval of this variance to a 13' side yard setback so the Jansen's could build the addition as originally designed but had mis- cUlculated on the dimensions. Henry Muhich, Building i Zoning Administrator, %MCD DOCK REGULATIONS informed the City Council that Mayor Searles made a report on the LMCD dock regulations and policies at the Council meeting of September 13, 1976. The amain question on this item is in regard to Orono's viewpoint on extending the moratorium on dock length variances which expires January 1, 1977. The Council referred the item to the Planning Commission for review and recommendations. (Continued)
