Item Description: proposal Regarding a Community Festival in Navarre
As the Council is aware, Mr. James Anderst, owner of the Narrows Saloon, has proposed a
community music festival to be held in the Navarre municipal parking lot. He has indicated the
proposal has the support of a number of the Navarre business owners. A group of Navarre business
owners has requested an opportunity to make a presentation to the City Council regarding a
community festival.
The Council has indicated that the key parameters within which it would consider a proposal for a
community festival are as follows:
1. Adequately address the concerns of all affected businesses.
2. Adequately address the concerns of all affected residents.
3. Insure adequate parking.
4. Include a fund-raising element that benefits the community.
COUNCIL ACTION REQUESTED:
Motion to provide direction to the business owners, and to staff, regarding the parameters within
which the Council would consider a proposal for a community festival.

A letter is attached from Lydia Kihm, Executive Director of Teens Alone, describing the services
provided by Teens Alone and requesting funding from the City. Teens Alone was invited by the
Orono School District's Healthy Communities/Healthy Youth collaborative to fill a need for a crisis
and counseling service for youth and parents. Teens Alone is in its second year of providing services
to the youth and parents of the Orono School District. Teens Alone is requesting annual funding of
$800.00 from the City oforono. Teens Alone is also requesting funding from the other cities served
by the Orono School District.
The Orono Police Department has indicated Teens Alone does provide a much needed service.
COUNCIL ACTION REQUESTED:
Motion regarding the provision of funding to Teens Alone in the amount of $800.00, and to adjust
the General Fond budget tv reflect the expenditure, if approved.

Last fail, Teens Alone began its second year serving youth (ages 10-18) and families living in the communities
of the Orono School District. Two years ago, representatives from your local Healthy Communities/Healthy
Youth Collaborative were committed to providing a crisis and counseling service for youth and parents and
invited Teens Alone to fill that need. Collaborative and school district personnel had heard of our successful
nine year history serving almost 3000 youth and 1000 parents living in the Eden Prairie, Hopkins, St. Louis
Park, and Wayzata school districts and asked to become part of our organization. As the Coliaborative's
donation decreases, we are asking the City of Orono to contribute to Teens Alone.
Mission
In its tenth year, Teens Alone serves youth (ages ten through eighteen) and their families who attend school
and/or reside within the Eden Prairie, Hopkins, Orono, St. Louis Park, and Wayzata school districts. Teens
Alone's mission is to:
provide free and immediate services including
crisis intervention, short term counseling, facilitation of safe shelter,
and community outreach to
west suburban teens and their families
in order to reduce conflict and reunite families
The Collaborative chose Teens Alone because:
1 services are free and confidential
1 counselors return calls within 24 hours, often the same day —year round
N we will meet with young people and parents at school or at home
N 95% of users of Teens Alone rate it good or excellent
The decision to have Teens Alone serve the Orono -Schools community has been positive. Although
geogrOraphically, your school district represents only 8% of our service area, 17% of Teens Alone's clients 1Uere from
the ono School District last year.
Need for the seruice
A 1994, a Teens Alone survey of west suburban 9-12 graders found that 90% of youth ran away at least once
since startingg middle school. A 1996 Search Institute survey of west suburban 7th-12th graders found that
more than 70% of youth spent two or more hours per day at home without an adult present. Unsupervised
youth are frequently influenced in their attitudes and bcha� ion by their peers and the media and are much
more likely to experiment with inappropriate adult behaviors. Alcohol use among west suburban youth is also
high with 84% of 12th graders reporting they attend drinking parties. Alcohol use is frequently a Source of teen
and family conflict.
Target Population
Teens Alone's target population is youth and their parents who live in the Orono School District and ore
e<perfencing family crisis or conflict and who may (or already are) at -risk of becoming nmaway, abandoned,
or homeless. Most west suburban referrals dre through the schools and the police. However, many young

people and adults call us directly. No one needs a "formal" referral
Last year, Teens Alone counselors:
• answered 425 crisis calls (more than 75 from the Orono School District)
• worked with 388 clients (from the Orono -area: 63 clients, 49 of whom were youth)
• facilitated safe shelter for 103 youth (18 from your area)
Teens Alone counselors also facilitated a "Make the Peace" and a Young Women's Group in the Orono
schools. Counselors also spoke to youth and parents about teen and parenting issues at the following local
functions: Orono Parent Workshops, Youth Leadership Classes, Orono Boy Scouts, Orono Gifted Class, and
the YMCA Orono Girls and Boys Retreat.
Cost of Including residents of the Orono School District to Teens Dlone
When the Collaborative came to Teens Alone during the fall of 1998, our staff and board had to determine the
effect the addition of your area would have on the organization. The outcome of that conversation was to hire
an additional full-time (school year) counselor. This brought the Teens Alone counseling staff to one full time
Program Supervisor, one full time counselor, and two full time (school year only) counselors. The Healthy
Kids•Healthy Community Collaborative agreed to pay the full cost of the first year and by the third year, pay
the same amount as the other four school districts, $3000. During this three year period, Teens Alone would
seek alternative sources of funding. Your local Collaborative is providing Teens Alone the following funding.

Currently, Teens Alone is funded by a wide variety of sources —including Hennepin Countv. municipalities,
corporations, foundations, and individuals (list attached). Acknowledging that your population is smaller
than some of our other communities, on behalf of the Teens Alone Board of Directors, we are asking the City `.
Orono to contribute $800 per year to support the Teens Alone program, already active in your community. For

Fund via the line item "Social Services." St. Louis Park provides funding to Teens Alone through its Police
Department budget.

Summary
Recently a young man from a local high school committed suicide. Two days later, the seventh graders were
scheduled to a weekend team/self-esteem bui'ding experience at a local camp. The young man's sister was
scheduled to attend. School personnel called Teens Alnne the day before the retreat asking for help to handle
possible emotional fallout from the tragedy. Teens Alone staff was at the camp Friday evening through
Saturday evening. Counselors played sports and team building games with the youth and had the opportunity
to meet with them on a casual basis Staff was there to help when several young people needed it. The schools'
Youth Development Coordinator said, "1 can't tell you what a relief it was to lwze your staff at camp this weekend.
Some kids had problems and Brenda was there to help. PC and Andre came out as well and their presence was very
reassuring fur me. As I expected, the kids got to the emotional hard stuff later in the evening. 1 am impressed with your
staff and grateful beyond words for your help this weekend."
Last winter, there was a well publicized case of a sex offender in another part of Teens Alone's service area.
The mother of the fourteen year old boy who had been molested had been in touch with a Teens Alone
counselor. She was reluctant to call the authorities but, with the counselor's reassurance and support, she
called the police and the offender is now in jail.
Parentfeedback:
When conducting the follow-up evaluation, the last question the evaluator asks both youth and parents is,
"What else would you like to tell the people at Teens Alone?
Parents said:
• "After meeting with them they told me we were using the right techniques and resources. It nats good to hats
that support. "
• "They followed up within 2 hours."
• 1 am very happy with the program and my daughter. Sim looked forward to talking to you guys.
• "Counselors gave me other options than what I had tried."
• "Just keep on doing the good work like helping its and the rest of the families."
• "She had a terrible problem with tardiness. We talked it over, we listened and we got it resolved. "
Youth said:
• "Me and my family are a lot more closer and me and my Dad were never very close bul now we do a lot of
things together and we are a lot more closer."
• "Thank you. I'm lad you have Teens Alone."
• "A good service if need help. They an. good listeners."
• "Teens Alone made me think about staying in school more."
• "Me and my parents are getting along a lot better now. "
And our favorite quote:
• "Teens Alone helped because I usually solved my problems with fight, fight, fight. And nou,1 think things
through before 1 throw a fit."
Daily, we hear from people who tell us the Teens Alone service makes a difference in thew community. We rely
on the financial support of our cities and police departments in order to continue to offer communities a fast,
free, and effective crisis and counseling service. We welcome the Orono community to Teens Alone and world

P.S. Since I wrote this letter in October, the OHS DECA group, using Teens Alone as its project, has helped its
significantly raise awareness of our service in the Orono School District. In fact, their project was so well
received, that they placed second place in the state DECA competition and are going to the national
competition in CaliF1 mia next month.

Who do you help?
Teens Alone helps youth (ages 10-18) and

How does it work?
Sometimes the youth's school will call and
tell us a young person needs to talk to one of
our counselors. Or, a youth may call us
directly. Many times, a parent calls us to
talk through some parenting challenges.

The City Council met on the above -mentioned date with the following members present:

Jim White arrived at 7 15 p.m., and Council Member Bob Sansevere was absent. Representing
City Staff were City Administrator Ron Moorse, City Attorney Tom Barrett, Planning Director

Kluth stated he would be present at tonight's meeting to answer any questions the Council may
have.
LAKE MINNETONKA CONSERVATION DISTRICT — Lili McMillan, Representative
McMillan addressed the City Council regarding the Lake Minnetonka Boat Use Study that has
recendv been completed by the LMCD. The study reflects that the average wmkend boat use
was 1,223, or one boat per 11 acres, with the average weekday use being 430 boats, or one boat
per 32 acres. McMillan noted rafting off of Big Island was included in this yeai s study.

McMillan reported 11 cities have now agreed to partirnate in the funding of the water patrol
for the next two years. McMillan stated the LMCD w,,, be drafting ajoint powers agreement
with Hennepin County regarding this venture, and will reevaluate this issue in a couple of years.
McMillan stated the LMCD is reviewing the situation at Fox Hill, which in the past has obtained
a variance to allow 13 boats to be docked in this area. McMillan stated they are now requesting
16 boat slips for the upcoming boating season. The LMCD will be reviewing this situation to
determine whether the lot needs to be developed in order to have a boat slip. McMillan stated the
City of Orono in the past had entered into an agreement for one boat per developed lot, or a
potential of 16 boats, which in her view appears to be an iron -clad agreement. McMillan stated
she would keep the Council apprised of this situation.
McMillan noted the LMCD passed a phosphorus -free resolution at their meeting last night to
ban the sale of phosphorus fertilizer in the metro area. McMillan stated a couple of cities on the
lake have already banned the use of phosphorus, but it is the opinion of the LMCD that a metro -
wide ban would be less confusing and more effective than each individual city passing their own
resolution.
McMillan stated it is her understanding that once phosphorus is in the lake, it is very difficult to
remove. One of the options to remove phosphorus is to dredge the lake, which is very time-
consuming and expensive, or to seal the bottom of the lake, which is not always very effective.
McMillan commented in order to protect the quality of the lakes in the area, the local residents
aced to become aware of the negative impact that phosphorus has on the water quality.
Moorse inquired whether the LMCD has discussed Coffee Channel and any long -teen solutions
as it relates to snovvmobiling. Moorse stated the City of Orono would like to protect the rights of
the homeowners and the snosvmobilers in this area. Moorse stated the suggestion of installing a
floating bridge in the channel was discussed. Moorse stated the City of Orono would like the
LMCD to address this issue.
kiabriel Jabbour indicated the City of Orono did discuss this issue three )ears ago with the
Sberifl's Department, who ruled out a floating bridge at Coffee Channel.

MAYOR/COUNCIL REPORT
Peterson reported a meeting has been scheduled for Friday with the Mavors, City Administrators,
and City Attorneys from Medina, Long lake, and Orono, along with Fire Chief Steve Persian to
discuss issues relating to the new fire station. P.nother meeting has been scheduled for April 90
with Don Beckeming, State of Minnesota, and a representative from Krause Anderson to
continue the discussion concerning the new fire station. Peterson stated hopefully after the April
9'^ meeting the issues will be resolved and the cities can proceed forward on the new fire station.
Flint inquired why Kelly and Jabbour, who arc on the committee, will not be attending these
meetings.
Peterson stated the meeting has been scheduled with the mayors and city administration, who will
report back to the other committee members and Council members. Peterson indicated the people
in attendance at tr.:se meetings will not be making any binding agreements relating to the fire
station. Peterson stated it is her understanding that former City Administrator Sweeney will not
be involved in these discussions after April V
Flint commented in his view the committee members should be able to attend these meetings in
order to maintain some continuity.
Peterson stated it was decided that a smaller group may be better at this stage, with the people in
attendance reporting back to the other parties.
White suggested that some minutes of the meetings be taken.
Nygard stated he would like to Team more about the concept of safety. districts and fire districts
and whether they would be helpful to the City of Orono.

Gabriel Jabbour, 985 Tonkawa Road, expressed conarrts that the price of the fire station is
not being monitored closely enough. Jabbour noted the original price of the fire station was
quoted as S 120.00 per square feet, but following his review of the plan submitted by the architect,
it appears the cost of the project is approximately $170.00 per foot. Jabbour urged the Council to
monitor the costs of the project more closely.
White stated typically in these types of projects a neutral expert will review the plans and
specifrc,rtions to insure that the prices being quoted are reasonable and fair. White stated they
also review the plans to determine whether the items being quoted are stock items or whether they
are special order items, which will increase the cost of the project. White stated normally a
person who has a financial stake in the project is not put in charge, and that type of situation
should be avoided.
Flint stated it makes sense for the designer and the architect to work together to help keep the
costs down. Flint suggested the idea of having an independent expert review the plans be
discussed at the upcoming meeting.
Mayor Peterson indicated she would bring up that idea on Friday.

CITY ADMINISTRATOR'S REPORT
(06) LONG LAID; FIRE STATION — RESOLUTION NO. 4638
Moorse stated at its March 12's mating, the Council discussed a number of issues related to the
design and funding of the Long Lake Fire Station, and directed Staff to draft a resolution
outlining the parameters of the City's participation in the building and funding of the new fire
station. Moorse stated those items have been incorporated into a resolution, which is before the
City Council tonight.
Mayor Peterson indicated she did read the resolution to the Mayor of Long Lake last night in
order to inform her of what the Orono City Council was intending to do.
Flint stated under Section 2.01, Item 4, it is his understanding the whole resolution is dependent
upon an agreement being reached by the Cities of Long Lake, Medina, and Orono regarding the
ownership of the fire station.
Mayor Peterson indicated that was her understanding as well.
Flint stated he does not have a problem with the resolution in light of that 6arification.

White suggested that some language regarding the funding from Mn/DOT also be included in the
resolution. White recommended the funds be deposited as soon as possible into an interest
hearing account.
Moorse stated it was his understanding, following the conclusion of the last fire station meeting,
that everyone was in agreement regarding the monies to be received from Mn/DOT. Mcorse
stated since that time there appears to be some misunderstanding relating to the funds; and if the
resolution spells out a certain percentage that Orono is to receive, the Long Lake City Council
may have some objection to that item.
Flint stated that item in his view relates to Item No. 4.
Jim Murphy, 30 Orono Orchard Road, stated the committee should do whatever it can to get the
2.48 million dollars from Mn(DOT, which was based on a number of factors. Murphy stated it
was his understanding that that agreement did not include a percentage breakdown to each city.
Murphy stated Mn/DOT entered into the agreement in a good faith effort in order to allow the
cities to receive the money as soon as possible, and it would be up to the cities to determine how
that money should be allocated. Murphy stated in his view taking a position regarding a
percentage breakdown should be avoided at this time.
Mcorse inquired whether it was White's suggestion that the money be put into an escrow account
until the three cities decide on how it should be allocated.
White stated that was his suggestion
Tom Barrett, City Attorney, recommended that type of language not be included in the resolution
unless the intact percentages am known and agreed upon.
Nygard commented in his view the three cities have managed to reach agreement on most of the
major points involving the new fire station. Nygard encouraged the committee members to
continue to move forward in a positive direction rather than focusing on the nega.ives.
Gabriel Jabbour stated it would be in the best interests of the communities to get the money as
soon as possible into an escrow account,
Mayor Jeterson indicated this item will be discussed at the meeting on Friday and that an
agreement will be reached on the allocation of the money in the near future.
Murphy encouraged the Council to continue to maintain the good will that has been established
between the two cities.
Mayor Peterson indicated that herself, Jim Murphy, Charles Kelley, and Gabriel Jabbour will
continue to serve on this committee.

escrow account.
Murphy encouraged the Mayor to proceed forward with the project and to reach agreement on the
ownership of the new fire station as soon as possible.
Mayor Peterson stated they are hoping to reach some kind of consensus by April 9'".
White stated if no agreement is reached in the near future, the City should consider passing a
resolution to proceed with Plan B.
Tom Barrett inquired whether the CourvA would like to see language included in the resolution to
the effect that the cities will work together to get the monies from Mn(DOT into an escrow
acwmnt as soor, as possible.
Flint suggested that language be ad•,ed to Item No. 4, which states that any funds received from

(08) PARK COMMISSION APPOINTMENT
Mayor Peterson noted three excellent candidates had applied for the vacancy on the Park
Commission, with only one candidate to be appointed to fill the three year tens. Peterson
requested a letter be sent to the other two candidates who applied thanking them for their interest
in serving on the Park Commission.
White noted the City Council attempts to maintain geographical representation throughout the
whole City on the Park Commission.
White moved, Flint seconded, to appoint J. Patrick Wolfe to serve a three-year term on the
Parks, Open Space, and Trails Commission expiring on December 31, 2003.

Nygard indicated he was in favor of appointing Paul Kerr to this position.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
This application was reviewed as Zoning File #2644.
The property is located in the LR-IC (1/2 acre) One Family Lakeshore
Residential Zoning District.
The Orono Planning Commission reviewed this application on February 15, 2001
and March 19, 2001 and recommended approval on a vote of 5 to 0 for
variances based upon the following findings and hardships:
A. The total hardcover on the property would be increased primarily due to
the longer driveway required to safely access the house. "everal
obstacles including a neighboring fence, tree and telephone pole block
much of the view to the street to the existing garage entrance. The
attached garage allows the vehicles to back out into the yard (but a paved
backup apron would make more sense) and approach the street at an
angle improving views to the street as well as allowing vehiclr- and
pedestrians traveling on Casco Point Road to more easily view entering
vehicles from the applicant's property.
B. The property as developed exceeds the allowed hardcover. A large 750
s.f. lakeside deck along the lakeside of the house would being removed

to reduce some hardcover closest to the lake. A 14' X 14' four season
porch would be constructed in its place. The four season porch would
be located 105' from the OHWL of Lake Minnetonka.
C. The properly was developed prior to the adoption of the zoning
ordinance. The house is approximately 10' from the side lot line at the
lakeside and is angled to a point where the house is only 2.85' from the
property line. A second story addition has been designed to leave the
front %: (lakeside) of the existing house to one story. Only the back '/2
(stint side) would have a second story. This concentrates the massing
of the structure further from the lakeshore, and eases the burden of the
views from adjacent residences towards the lakeshore.
D. The overall lot coverage by structures decreases by 9 s.f. Most of the
massing has been relocated from the lakeside of the residence to the
street side to allow for the larger garage. For a lot coverage variance to
be approved an actual hardship must be demonstrated to allow the
increase in structure. The Council has in many situations allowed a
property to replace the total existing structure when remodeling, but it is
uncommon to allow a net increase when already exceeding 15%
4. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
5. The City Council hay considered this application including the findings and
recommendations of the Planning Commission. reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.

Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision
16 (L) (2) to permit 3,710 s.f. (27.3%) hardcover in the 75-250' lakeshore setback; Municipal
Code Section 10.03, Subdivision 14 (C) to permit 2,961 s.f. (16.9%) lot coverage by structure;
Municipal Code Section 10.25, Subdivision 6 (B) to permit an encroachment into the side
setback 5' from the side property line for construction of a 24' X 26' attached garage, where
a 10' side setback is required and to permit the garage addition 27' from the front property line
where a 30' setback is required; and Section 10.25, Subdivision 6 (B): To permit an
encroachment into the side setback 2.64' from the side property line to permit the addition of
a second story above the existing residence within the required 10' side setback based on the
approved site plan is attached hereto as Exhibit B. subject to the following conditions:
Authorities granted by this variance run with the property not with the
applicants, but are permissive only and most be exercised by application for a
building permit within one year of the date of Council approval, or this variance
will expire on that date (April 9, 2002).
2. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
3. The undersigned applicants have read, understand and hereby agree to the terns
of this resolution and on behalf of themselves, their heirs, successors and

Weinberger stated the Planning Commission reviewed this application at their February 21'
meeting where it was tabled to allow the Applicants to make some revisions to [heir site plan

reduced the size of the garage from a 30' by 30' garage to a 24' by 25' structure to keep yithin the
emsting structural coverage on the property.
Weinberger stated the Applicants have relocated the garage five fat off the property line where
previously it was located two and a half feel off the property line. Weinberger stated a small
turnaround and backout area has been added for safety purposes to eliminate the need to back out
onto Casco Point Road.

Weinberger indicat<d the revised plan does take into account all of the Planning Commission's
recommendations. City Staff is recommending approval of the application.
Weinberger stated the Applicants have hired a new surveyor, who will be inspecting the property
later this week. Weinberger stated if the survey meets all of the hardcover requirements, the site
plan will proceed to the City Council.
Gary Marquardt inquired whether their application could proceed forward to the City Council
next week. Marquardt indicated they have been informed it will take approximately one week for
the survey to be completed.
Weinberger recommended one of the conditions of approval on this application be that a building
permit not be issued ut.61 City Staff has had an opportunity to review and approve the updated
survey.
Hawn inquired whether the retaining wall has been included in the hardcover calculations.
Marquardt commented they would prefer to do landscaping rather than construct a retaining wall.
At the present time a gradual slope exists in this area. Marquardt stated it was recommended they
show the retaining wall in the event it is needed.
Weinberger stated the retaining wall has not been included in the hardcover calculations.
Kluth inquired what amount of hardcover the retaining wall would consist of.
Weinberger stated in his opinion it would amount to approximately 20 square feet.
Hawn commented she would prefer that a retaining wall not be constructed.
Marquardt stated it is their intention at this time not to construct the retaining wall.
Smith inquired whether the plastic underlayment would be removed.
Marquardt indicated they arc willing to remove the plastic.

Bottenberg noted a small portion of the existing residence and approximately one-half of the new

addition. However, the main views of the lake for that house are to the east and are not affected.
Existing mature vegetation and the change in grade already act to limit the neighbors' views, so it

The Planning Commission voted 4 to 0 at the February 21 meeting to table the application to allow
the applicants to revise the site plan to reduce the structural coverage on site to not exceed the

The total hardcover on the property would be increased primarily due to the longer driveway
required to safely access the house. Several obstacles including a neighboring fence, tree and
telephone pole block much of the view to the street to the existing garage entrance. The
attached garage allows the vehicles to back out into the yard (but a paved backup apron
would make more sense) and approach the street at an angle improving views to the street
as well as allowing vehicles and pedestrians traveling on Casco Point Road to more easily
view entering vehicles from the applicant's property.
2. The property as developed exceeds the allowed hardcover. A large 750 s.f lakeside deck
along the lakeside of the house would being removed to reduce some hardcover closest to
the lake. A 14' X 14' four season porch would be constructed in its place. The four season
porch would be located 105' from the OHWL of Lake Minnetonka.

3. The property was developed prior to the adoption of the zoning ordinance. The house is
approximately 10' from the side lot line at the lakeside and is angled to a point where the
house is only 2.85' from the property line. A second ::ory addition has been designed to
leave the front''/2 (lakeside) of the existing house to one story. Only the back V. (street side)
would have a second story. This concentrates the massing of the structure further from the
lakeshore, and eases the burden of the views from adjacent residences towards the lakeshor_.
4. The overall lot coverage by structures decreases by 9 s.f. Mos; of the massing has been
relocated from the lakeside of the residence to the street side to allow for the larger garage.
For a lot coverage variance to be approved an actual hardship must be demonstrated to allow
the increase in structure: The Council has in many situations allowed a prope,'y to replace
the total existing structure when remodeling. but it is uncommon to allow a net increase
when already exceeding 15%,
Staff Recommendation
Staff can support the project to allow the garage to be relocated and provide for improved site lines
without the property owners having to request trees be removed to open site lines. Staff also
supports;." replacement of the structural coverage to the amount existing before remodeling.
Under that scenario the applicants could replace structure not to exceed 2,970 st on the lot. The
reduction in total structural coverage would allow the 24' X 26' two stall garage and not require any
other structural changes to the plan. The result is a net 75-250' hardcover increase from 3,490 s.f.
(27.3%) to approximately 3,980 s.f. (3 M), the majority of which is a result of added driveway. The
stated hardship for the increase is primarily safety of access to this busy portion ofCasco point Road.
The applicant has submitted a new site plan that is not on a Certificate of Survey. The applicants
have hired a new surveyor to complete the final drawing. Due to the time required for the new
surveyor to complete the project it was not completed in time to be submitted with this report to the
Planning Commission. A condition of approval should include the requirement the new survey be
submitted and reviewed by Staff prior to Council review.

Gaffron noted the Marquardt; are out of town and are unable to attend tonight's meeting.
Gaffron stated the Applicants are proposing to construct a second story addition above the
existing single story house within a required side yard along with the addition of a 30 by 30
foot attached garage to be located 2.85 feet from the side property line where 10 feet is required
and 21.76 feet from the front property line where 30 feet is required.
GafFron stated the residence is located on Casou Point Road, which is fairly narrow and rather
busy in this area.
The Applicants are proposing to add a second story to the existing house, which is a single story
residence with a basement. The existing house was construction prior to the adoption of the zoning
ordinance. The house is located approximately ten feel from the side lot line at the lakeside a.,d is
angled to a point where the house is only 2.85 feet from the property line. The second story has
been designed to leave the front one-half of the existing house at one story, with only the street side
having a second story. The proposed addition would result in a 267 square feet increase in lot
coverage. Gaffron noted the existing structural coverage is at 18.5 percent. The existing hardcover
is 29 percent and would be increased to 38 percent if this application is approved. The Applicants
are proposing to remove a large lakeside deck along the lakeside of the house in an effort to reduce
hardcover. A four season porch would be constructed in its place and would be located 105 feet
from the OHWL of Lake Minnetonka.
Gaffron stated the existing garage is located only 18 feet from Casco Point Road and faces
the road, which creates a potentially hazardous situation with vehicles backing out to the road

without the ability to view oncoming vehicles and pedestrians. The proposed attached garage
would allow the vehicles to back out into the yard and approach the street at an angle, which would
improve the views to the street as well as allowing vehicles traveling on Casty Point Road to more
easily view entering vehicles from the Applicant's property.
Staff is recommending that the proposed garage be made smaller due to the amount of lot coverage
being proposed on this site and located no closer than five feet from the lot line. Staff would be in
favor of allowing the garage to be relocated to provide for improved site lines. Staff suggests a
small area be provided as a tum-around. Staff would support equal replacement of the structural
coverage to the amount which currently exists before remodeling.
Hedblom, 2601 Casty Point Road, stated he is aware of the Applicants' plans to make these
modifications on their property, and in his view all the neighbors in the immediate area are in
support of the project. Hedblom commented in his opinion the changes being recommended by
Staff would be acceptable to the Applicants. Hedblom noted the improvements being proposed only
minimally impact his property.
Hedblom stated if possible, the Applicants would like to keep the size of the garage at what was
originally proposed, but would be willing to reduce the size of the garage if necessary.
Whelan, Contractor, stated they are proposing to construct the garage more in front of the house in
an effort to limit the amount of vehicle noise currently being experienced from Casco Point Road.
There were no public comments regarding this application.
Hawn commented any construction in the area of the property line would negatively impact the
pine trees in that area and may need to be removed.
Hedblom stated they are going to check into whether the pine trees would need to be removed as a
result of this project. Hedblom stated they are not opposed to removal of the trees and would be
willing to plant new trees following construction. Hedblom commented one of the trees has already

experienced storm damage and is not in very good shape.
Kluth indicated he would be reluctant to grant any increase to hardcover on this lot. Kluth inquired
whether the Applicants discussed the hardcover issue with City Staff. Kluth indicated the Planning
Commission has been very reluctant to grant any increases to hardcover in the past.
Hedblom noted the deck would be removed as part of this project. Hedblom stated the situation
with the garage in its present location is very dangerous and needs to be addressed. Hedblom noted
the present driveway is very short and relocation of the garage would allow safer access into the
property.
Kluth stated the issue he has with the garage is the proposed size due to the amount of hardcover
and structural coverage presently on the lot.
Hedblom commented in hi view the Applicants would be willing to reduce the size of the garage.
Hawn pointed out the Fanning Commission has taken a very strict policy on increasing structural
coverage, and if approval is granted on the current proposal, a precedent wo' •Id be set. Hawn noted
the amount of structural coverage already existing on the lot is in excess of the allowable amount.
Gaffron stated in order to meet t' e amount of existing structural coverage on the lot, the garage
would need to be reduced to 24' by 26'.
Mabusth in ..red whether the Applicants have given any consideration to removal of the boat
house.
Hedblom stated the Applicants would like to keep :he boathouse since it provides storage for their
dock materials and serves a useful purpose.
Hawn stated she would be in support of doing some improvements to the driveway. Hawn stated
the current proposal does not really allow for a turnaround and in her view should be modified
somewhat. Hawn inquired what hardcover would result if a turnaround were added

somewhat. Gaffron stated the Applicants are also proposing to remove some landscape plastic and
rock s part of this project. Gaffron stated the amount of hardcover resulting from the turnaround
would probably be betw,..m 50 to 100 square feet.
Hawn suggested that perhaps by moving the garage forward somewhat, the amount of driveway
could be reduced slightly.
Gaffron stated moving the garage forward would possibly result in a reduction of 50 to 100 square
feet of hardcover.
Moth indicated he would be like to see a revised plan showing the proposed changes prior to voting
on this application.
Gaffion stated the Planning Commission could review the revised plan at their March meeting.
Hedblom stated they would like to go before the City Council at their March meeting if possible.
Hawn commented the Applicants will need to submit a revised plan depicting the smaller sized
garage in its new location with a turnaround added so the Planning Commission will know exactly
the amount of hardcover and structural coverage being proposed. Hawn commented for safety
reasons she would be in support of some improvements being done to the garage and driveway
situation. Hawn indicated the Applicants will need to limit stmetuml coverage to the amount
currently existing, which is ! 7 percent.
Kluth stated he is opposed to the plan being presented tonight since it exceeds the existing
structural coverage.
Gaffron noted the Applicants would be required to extend the review period for this application
since the 120 days expire the 16" of March. Gaffron stated the City has a standard form that the
Applicants will need to sign extending the review period.

The Planning Commission recommended the arena and lam shall be subject to a restrictive covenant that
would limit the future use or expansion of the buildings. The covenant would include language that would
state no future subdivision of Lot 5 would be approved that would place the ban on a lot without a principal
residence. Additional conditions would limit the use of the barn and riding arena to the keeping and raising

A variance would be required for the lot width of Lot 2. Lot 2 fronts on a cul de sac and does not meet the
minimum 300' lot width for properties in the RR -I A zoning district. The City has approved variances at the
time of subdivision for lots that do front on a cul de sac and demonstrate a suitable building site and have
dimensions similar to surrounding properties.
Surrounding Properties
The property is located in the RR- I A(5 acre zoning district). The Comprehensive Plan and the Zoning Code
intent for properties in the zoning district is to provide a combination of low density residential development
and limited agricultural activity. The lot is surrounded by properties that are developed as low density
residential developments and small horse farms.
Right -of -Wry Dedication
Watertown Road is a City owned right-of-way. The property was platted to the center of the street.
Subdivision Code requires the land shown as Watertown Road shall be dedicated to the City. The portion
of the property dedicated is not considered as lot area.
The easterly 33' of the property shall be dedicated for right-of-way purposes for Orchard Park Road.
PLANNING CI iMMISSION RECOMMENDATION
The Planning Commission voted 5 to 0 to recommend approval of the subdivision request and variances to
permit the riding arena and barn to remain on Lot 5 and for Lot 2 to be considered a RECORD LOT with a
lot width of 220' where 300' is required.
Additionally, the Planning Commission did approve of allowing the principal buildings to remain on Lots
5 and 6. Both residences were constructed prior to the adoption of the zoning ordinance. The house on Lot

A RESOLUTION APPROVING PRELIMINARY
PLAT FOR PROPERTIES LOCATED AT
4100 WATERTOWN ROAD AND 505ORCHARD
PARK ROAD

WHEREAS, Craig Alshouse, on behalf of CPV Development Company, LLC.,
(hereinafter the "subdivider") has an interest in the properties located at 4100 Watertown Road and
505 Orchard Pat k Road, and has filed an application with the City of Orono (hereinafter "the City")
requesttg a six lot plat for property legally described as:
Attached hereto as "Exhibit A"
(hereir•Rer "the property"); and
WHERE-•S, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. set. and the City of Orono's Zoning and Subdivision Codes, the Orono
Planning Commission hold a public hearing on Marca 19, 2001 at which time all persons
desiring to be heard concerning this application were given the opportunity to speak thereon;
and
WHEREAS, at their regular meeting held on April 9, 2001 the Orono City
Council considered the subdivision application of the subdivider noting the following findings
of fact:
FINDINGS
The property is located within the RR -IA Single Family Rural Residential
Zoning District requiring a minimum of five acres dry buildable land within each
newly created lot, and a minimum of two acres contiguous for the individual
building sites and drainfield sites.
2. The property contains a total of 37.06 acres of land.

3. The proposed plat consists of six residential lots each meeting the minimum lot
size requirement as established for the RR -IA (5 acre) zoning district.
4. Lots 1, 3, 4, 5 and 6 each meets or exceeds the 300' minimum lot width
requirement for properties in the RR -IA zoning district.
5. Lot 2 has a lot width of approximately 220' requiring a variance to the 300'
required width at the structure setback. The City of Orono has approved
variances for lots that front on a cull de sac at the time of subdivision when the
lot can demonstrate a suitable building site and have dimensions similar to other
surrounding lots.
6. The property is located in the RR -IA (5 acre zoning district). The
Comprehensive Plan and the Zoning Code intent for properties in the zoning
district is to provide a combination of low density residential development and
limited agricultural activity. The lot is surrounded by properties that are
developed as low den<ity residential developments and small horse farms.
7. There are two residences on the property. One is the existing primary residence
and a second residence is located at 505 Orchard Park Road. The Orchard Park
lot was purchased and combined in 1996 by the current owners. The pri.Tary
residence, shown on proposed Lot 5 is located approximately 50' from the front
property line. A variance shall be approved with the final plat that would allow
the building to remain on the property. The house located on proposed Lot 6
is located over the front property line. A variance shall be approved that would
allow the structure to remain on the property.
Several variance3 and conditional use permits have been granted to permit
additions to the residence on proposed Lot 5. Said variances shall be released
from the entire property to not appear on titles of any newly crat:d lots.
9. In Deceml,er of 1985 the City Council adopted Resolution No. 1994 for
variances and a Conditional Use Perm;t to allow ihr keeping of domestic
animals for commercial purposes and to allow the continued use of the property
for a public riding stable based on conditions that the total employees hired by
the applicants to assist in the commercial horse operation shall not exceed five

full and part time employees, except for special events to be approved by the
Council. The riding lessons are to be provided by members of the property
owner's family. One additional important condition was the City shall review
the Conditional Use Permit annually, however annual reviews had not been
necessary. The approvals granted by the CUP shall be released from the title
as the use does not carry to the new properties.
10. The keeping of domestic animals for non-commercial purposes is a permitted use
including horses for the use of the occupants of the premises. A minimum of
one acre in aggregate, exclusive of one acre for the principal building, must be
available for each animal unit, except as hereinafter set forth.
11. A minimum of two acres of open pasture must be available .or a single horse
and one additional acre must be available for each additional horse. When the
horses are kept stabled and do not require pasture for feed purposes, the
minimum pasture requirement may be adjusted at the discretion of the Council.
Such minimum pasture acreage shall not include low lying lands unusable for
pasture or grazing. Any person keeping such animals must comply with the
provisions of the City Code.
12. The use of an accessory building for keeping animals for non-commercial
purposes is a permitted use provided it is for the non-commercial use of the
property owner or resident and meets the available area standards outlined in the
paragraph above (Section 10.20, Subdivision 3 (M). Further, no such structure
shall be located less than 150 feet from the nearest adjacent residence and no
closer than 75 feet from the nearest lot line.
13. The use of accessory buildings or land for the storage or rearing of animals not
owned by the property owner or resident requires a cuAitional use permit.
Further, no such structure shall be located less than 150 feet t.om the nearest lot
Iran.
14. To permit the bam and riding arena to remain on the property variances shall
be approved that would allow the non -conforming structures on a 7.3 acre lot.
The riding arena and barn were originally built before standards were established
regarding the size and number of oversized 7ccessory building allowed on an

individual property. The riding arena was built on a lot similar in size to the
lot that would remain after subdivision. Maintaining, but not expanding, the
barn and riding arena would contribute to the rural character of the property. The
following variances are required to permit the buildings to remain on the
property following the final plat:
A. To permit two oversized accessory buildings on one lot where one is
allowed.
B. To permit two oversized accessory buildings larger than the 3,000 s.f.
maximum allowed for oversized accessory structures.
C. To permit 14,497 s.f. for all accessory buildings where 6,000 s.f. is
allowed.
15. City protected wetlands were those identified by the City in 1974 and appear on
the City's Welland Inventory Overlay Maps and are subject to the provisions in
Section 10.55, in addition to WCA regulations. The protected wetlands are
protected at the time of subdivision by the developer by granting of a
"Conservation and Flowage Easement" and further s identified as "Drainage
Easements on the official plat mylars. Section 10.55, ..bdivision 15 defines the
minimum lot area requirements shall be interpreted to not allow protected areas
as pan of that lot area. City protected wetland areas within the regulatory
boundary are not credited toward dry buildable area for zoning purposes.
16. Watertown Road and Orchard Park Road are maintained by the City of Orono.
Subdivision Code requires the land shown as Watertown Road and Orchard Park
shall he dedicated to the City. Land to be dedicated to the public for right of
way purposes is shown on the preliminary plat drawing dated 3/28/01.
17. A 12' trail easement is proposed along the property lines between Lots 1, 4 and
6. The intent of the trail iE to provide for a future path to allow property
owners within the development to access Lot 5. There is a future potential the
barn and riding arena would be used by the owners of Lots 1-4 and Lot 6. The
trail would allow access for those property owners to Lot S.
18. A 50' pasture easement, in favor of .-ot 5 is proposed over the south 50' of Lot
6.

19. The proposed private road to be constructed ' , Outlot A is 950' in length. This
length is allowed for roads ending in a cul-de-sac. The platted Outlot A cul-de-
sac (109) and road (50') meet established standards for width in the Subdivision
Ordinance.
20. Private residential str.. is serving four units are required minimum paved width
of 24' and the cul-de-sac is to be paved with a 40' radius. Construction
standards are established in the Subdivision Ordinance in Section 11.33,
Subdivision 4.
21. Lots IA require access to the new private road to be constructed in Outlot A.
Lot 5 has had a direct access to Watertown Road. Lot 6 has access to Orchard
Park Road. A Homeowner's Association will be responsible for maintenance of
the private road, horse trail, and stormwater management facilities and pond.
22. The City Engineer has reviewed the stormwater management plan and has
conceptually approved the plan and location uf stormwater facilities.
11. The City On -Site Systems Manager has approved the septir design and has
determined each lot demonstrates a primary and ihetnate site in a location to
meet all required setbacks.
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of
the findings noted a'oove, the City Council of the City of Orono hereby approves the
preliminary plat application and conditional use permit for CPV Development Company, LLC.
be approved per preliminary plat drawings by Martin P. Campion, a registered engineer of Otto
Associates Engineers and Land Surveyors, Inc., revised date 3/28/01, attached as Exhibit B,
subje� to the following conditions:
The final plat drawing shall indicate the property lines as depicted on the
preliminary plat drawing noted above.
2. Setbacks shall be shown on a revised site plan to be submitted with the final
plat.

(Private Road)
3. The private road, to be ecratructed within Outlot A, shall be developed to City
requirements (Section 11.33, Solid. 4) for private roads serving 4 units. Code
requires a 50' platted right-of-way, and the minimum paved width of the street
to be 24'. The cul-de-sac shall be platted 50' in radius with a minimum paved
radius of 40'
4. The private road will be constructed with rural sections, subject to review and
approval by the City Engineer.
5. Private road construction shall be subject to a Developers Agreement to be
executed between the City and the developer. Private road construction can
begin as soon as the engineering plans for the road as well as stotmwater
management plans have been approved by the City, the Developers Agreement
has been executed, and the final plat has been recorded with Hennepin County.
6. The private road shall be privately owned and maintained per the appropriate
access easement/maintenance documents to be executed by the developer. The
developer s!WI create a homeowners association for such ownership and
maintenance.
7. No building permits will be issued until the private road base work and all
stormwater management improvements have been completed by the developer
and approved by the City.
S. The developer shall grant to the C'tty an underlying Road and Utilities Easement
for Outlot A.
(Landscaping)
9. Subdivider shall plamlevard trees along the private road per the requirements
of Section 11.60, ! i. 2.
(Stormwater Management Plan/Wetlands)
10. Subdivider shall construct stotmwater management improvements generally as
shown on the Preliminary Grading, Drainage and Erosion Control Plan dated

2/ 16/01 subject to any revisions of said plan as may be required by the City
Engineer. A final Grading, Drainage & Erosion Control Plan must be approved
by the City Engineer prior to final plat approval. Subdivider shall grant drainage
and utility easements over the stormwater pond located on Lot 1.
11. Subdivider is hereby advised that the City will not grant final plat approval until
the MCWD has approved all grading and drainage improvements on the
property.
12. Subdivider shall grant Flowage and Conservation Easements over City protected
wetlands and show the wetlands as a 'drainage easement' on the plat.
13. Standard Drainage and Utility Easements shall be dedicated on the final plat 5'
along interior property lines and 10' along exterior property lines and Outlet A.
(Bams and Riding Arena)
14. Variances shall be approved to permit the barn and riding arena on the property.
15. Subdivider and property owner shall enter into a restrictive covenant that limits
the use of the bam and riding arena to uses accessory to a "horse farm". The
covenant shall restrict any non horse fans related commercial/private use and not
permit any expansion to the use or structure of the buildings.
16. Commercial use, including boarding of horses not owned by the occupants of the
property and/or commercial use of the riding arena shall not be permitted
without conditional use permit approval by the City Council.
17. The remaining accessory buildings located on Lots 1-4 and Outlot A shall be
removed prior to the issuance of building permits as accessory builuings are not
permitted on lots without a principal structure.

19. Subdivider is hereby advised that preliminary subdivision approval will expire
one year firm the date of Council preliminary plat approval. Should the
subdivider fail to complete the filing of the final plat application within the year
deadline, it shall be necessary for the subdivider to file a new preliminary
subdivision app.ication with the City.
Final Plat Submittals:
The followirg list of final submittals must be submitted to the Zoning Administrator two
weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of
the month. These submittals are as follows:
I. Record plat drawings in the form of two (2) mylar copies (one copy for the
City's records and one for filing with Hennepin County) and one (I) copy
reducea to I" = 200'. Drawing to include:
a. Lot lines platted per preliminary sury ; by Martin P. Campion of Otto
Associates Engineers and Land Surveyors, Inc. dated March 28, 2001.
b. Dedication of drainage and utility easements 10' wide along the exterior

f. Signed and executed "Declaration of Private Road Easement and

trail.
h. Signed and executed easement agreement for 50' pasture area within Lot
6 for use by Lot 5.
i. Signed and executed restrictive covenant document limiting the use of the
barn and riding arena on Lot 5.

C. Park Dedication Fee shall be determined by the City Assessor based on
the fair market value of the undeveloped land at the time of preliminary
plat approval. The subdivider shall be advised as soon as Assessors
report has been filed with City. Park dedication fee shall be based on
8% of the fair market value of land within the plat.

minimum lot size. The proposed lots all consist of a minimum of five acres. Weinberger
noted Lot 6 has a total of five acres but less than five acres is dry buildable and mould require a
rearrangement to increase the lot area to five acres. Staff does not feel that granting a variance to
the dry buildable lot area is an option and recommends the Applicant pursue revising the lots
somewhat in order to comply with the five acre dry buildable requirement.
Weinberger stated in December of 1985, the City Council adopted a resolution which allows the
keeping of domestic animals for commercial purposes and to allow the continued use of the
property for a public riding stable based on certain conditions. This proposed development is
surrounded by properties that have been developed as low density midential and small horse
farms.
The two oversized accessory buildings that arc located on the property consist of a pole shed or
arena consisting of 10,267 square feet and a barn consisting of 4,230 square feet. In all "R••
Districts, no accessory building shall exceed 1,000 square feet of footprint area unless a variance
is granted. Weinberger stated a variance would be required to permit two oversized accessory
buildings on one lot where one is allowed. A second variance would be needed to permit two
oversized accessory buildings larger than the 3,000 square feet maximum allowed for oversized

accessory structures. The Applicant has indicated they would like to maintain the two oversized
accessory structures at ;he present time. The other accessory buildings located on the property
would be removed to accommodate the road and building sites.
Weinberger stated the keeping of domestic animals for non-commercial purposes is a permitted
use, including horses for the use of the occupants of the premises. A minimum of one acre in
aggregate, exclusive of one acre for the principal building, must be available for each animal unit
unless oth,�vise permitted. The use of an accessory building for keeping animals for non-
commercial purposes is a permitted use provided it is for the non-commercial use of the property
owner or resident and meets the available area standards. In addition, no such ;tincture shall be
located less than 150 feet from the nearest adjacent residence and no closer than 75 feet from the
nearest lot line.
Weinberger stated use of the accessory buildings or land for the storage or rearing of animals not
owned by the property owner or resident would require a conditional use permit.
Weinberger indicated Lot 2 would also require a variance to lot width since this lot is located at
the end of a cul-de-sac and is 200' wide at the stricture setback. P 300' width is required.
Weinberger indicated the Council has routinely approved variances for lot width for lots fronting
on a cul-de-sac that demonstrate a suitable building site and a lot similar in dimension to lots
surrounding the property.
City Staff can recommend conceptual approve of the plan subject to each lot meeting the
minimum standards for to area and further :object to the ten conditions outlined on page six of
the Planner's Report dated March 13. 2001.
Hawn inquired whether the Park Commission has reviewed this application.
Weinberger stated the Park Commission has had an opportunity to review the application and is
recommending a park dedication fee be paid in lieu of a land donation.
Alshouse commented he is attempting to develop this property in the right way by being

a responsible and good steward of the land. Alshouse stated they have redrawn the lot lines in
order to meet the requirements of the City. Alshouse stated they are open for questions of the
Planning Commission.
These were no public comments regarding this application.
Hawn stated she has a concern regarding Lot 5, which has the two oversized accessory structures
located on it. Hawn inquired how much land behind the barn would be acceptable as pasture land.
Alshouse stated there currently is pasture north of the arena.
Smith noted the City requires one acre per horse, and inquired how many horses would be boarded
in the been and whether there would be sufficient pasture available.
Alshouse stated he expects the number of horses to be housed in the barn to be less than what the
property owners have had in the past. Alshouse stated he feels the future owner of this property
will comply with the City's ordinances, which would allow five to six horses used on the amount
of land available. Alshouse stated one option available to the owner of Lot 5, if he should wish to
board additional horses, would be to purchase Lot 4, which consists of five acres, or Lot 6, which
also consists of approximately five acres. Alshouse stated they are not requesting a variance to
board any horses in addition to what the City's ordinances currently allow.
Weinberger stated the conditional use permit does allow riding lessons and boarding of bon" at
the present time.
Kluth commented the future owner of this property could utilize the oversized accessory structures
for a different use.
Smith commented the buildings could be utilized for the storage of boats.
Kluth inquired whether the conditional use permit restricts the use of these buildings to just
horses.

Weinberger stated it does not, but that the City's other ordinances would prohibit other types of
uses for these accessory structures. Weinberger stated the property owner would be able to store
items in the sheds but would not be able to lease the space for the storing of boats and other things
legally. Weinberger stated the storage of boats for money would constitute a commercial use.
Muth inquired whether the lot containing the two oversized accessory buildings was still being
considered as a commons area.
Alshouse stated they did initially look at that concept, but ran into a number of problems.
Alshouse stated the owner of that lot would be forced to take care of everyone else's horses under
that concept, which was not feasible.
Kluth stated he would be in favor of continuing the present use of the two structures.
Mabusth stated commercial use of the structures would need to be limited in her view.
Alshouse stated he would like the future owner of this lot to have the right to continue to utilize
the barn for the housing of horses as currently allowed.
Hawn commented the only reason she can see for maintaining the two oversized accessory
structures would be to continue the tradition of horse farms in Orono. Haan stated in her view the
Planning Commission needs to restrict the future use of these structures. Hawn inquired whether
the Planning Commission could put a time limit on the life on these buildings where they would
neert to be removed within a certain period of time if a conditional use permit is not applied for.
Gaffron stated the City has allowed accessory buildings to remain on a vacant lot for a short
period of time until the principal structure is constructed.
Haan stated she has concerns that someone with a business w,,l buy the prope¢v and attempt to
run a commercial business out of these structures.
Alshouse stated he does not have a problem with restricting these buildings for the use of
livestock. Alshouse stated the new property owner would need to meet Orono's ordinances for
whatever use he intends for the structures.

Kluth stated a restrictive covens.., could be placed on the land.
Alshouse stated he would be agreeable to a restrictive covenant on the land restricting the bams
for livestock use or some other use that is permitted under Orono's ordinances.
Smith commented in her view the Planning Commission cannot say the buildings need to be
removed in one to two years simply because the structures are not being used. Smith stated the
new property owner could elect not to use the structures and leave them empty, with a future buyer
electing five or ten years from now to utilize them for the housing of animals.
Hawn stated in her view if the buildings are to be used at all, they should be restricted to livestock.
Smith stated if the future owner decides to use the buildings for a commercial use, they would be
required to appear before the Planning Commission.
Alshouse stated in his opinion the Planning Commission has the power in the future to restrict the
use of these structures.
Hawn inquired whether the Applicant would be willing to work with the City Attorney in order to
come up with some acceptable language restricting the use of these structures to livestock.
Alshouse stated he would be aP'ecable to that.
Kluth stated the restrictive covenant could be added as an additions; condition of approval Kluth
stated the original conditional use permit was probably granted - 'he buildings were located
on a large parcel of land.
Alshouse indicated the house with the two oversized accessory structures was originally located
on seven acres of land at the time the conditional use permit was granted.
Weinberger stated one of the accessory structures was constructed in approximately 1970.
Mabusth commented a variance would be required if the property owner wished to house
additional horses in excess of what the ordinances allow. Mabusth stated there appears to be a
pathway that currently exists.

Weinberger stated the areas used for traveling purposes would be deducted from the buildable area
of the lot. Weinberger stated they are considering locating the pathway along the property lines.
Weinberger indicated these trails would not be heavily used and would principally be a dirt path
for use by the horses. Weinberger stated Staff is aware that there will be a trail easement in the
future, but at this time the exact location of the trail has not been determined.
Hawn inquired whether the discussion by the Planning Commission has prompted any public
comments regarding this application.
Greg Kellenberger, 4045 Watertown Road, stated the neighbors in this area have been allowed the
use of the indoor arena in the past and they would be in support of having these buildings remain.
Kellenberger stated, if possible, they would like to continue to utilize the indoor riding arena.
Anita Lang, 615 Orchard Park Road, commented the road at the present time is in poor condition
and inquired whether it would be improved with this development.
Gaffron stared a full cloverleaf intersection will be constructed at the intersection of Highway 6
and Highway 12. Gaffron indicated the intersection with Orchard Park and Highway 6 is located
further west than the clover' caf. Gaffron stated the four proposed lots are expected to add
approximately ten cars per day to the amount of traffic on Orchard Park Read, which is fairly
insignificant for this road. Gaffron stated he is not able to address the condition of Orchard Park
Road at this time and would need to discuss whether any possible improvements for Orchard Park
Road are scheduled in the near future w;th the Public Works Department.
Hares requested that Lang be apprised of what improvements, if any, are being planned for this
road. Hawn commented in her opinion Orchard Park Road will become busier, not necessarily as
a result of this development, but due to the ner Highway 12 corridor and that the concerns of the
resident are valid.
Mabusth inquired whether the Applicant has a problem with the neighbors continuing to use the

indoor riding arena.
Alshouse stated it would be up to the new property owners.
Hawn inquired how many of the other accessory structures will be removed
Alshouse stated they are planning to remove six to eight of the other buildings.
Hawn stated one of the structures lies within the roadway, which is not being proposed to be
removed.
Gaffron slated that issue will need to be addressed.
Alshouse stated he does intend to remove the structures on Lots I through 4.
Mabusth commented there will be a principal structure remaining on Lots 5 and 6.
Haan stated she would like to see the structure ]mated within the right-of-way removed since this
is a new development.
Alshouse stated the structure is now in the right-of-way because the rightof-way has been moved.
Gaffron stated in the past the City at the time a principal structure is removed and an accessory
structure is to remain on the property, the City requires that any non -conforming accessory
structures be made conforming. Gaffron stated he is not aware of any situation where a principal
structure has been ]mated in the right-of-way.
Hawn encouraged the Applicant to consider removing the structure.
Kluth stated he would like some direction fron• the City Council on how to proceed in the future

Bottenberg stated a conditional use permit is required because this lot is considered a "through"
lot By Zoning Code definition, a `through" lot is a lot which has a pair of opposite lot lines
abutting two substantially parallel streets and which is not a comer lot. On a through lot, both
street lines shall be front lines for applying the Zoning Chapter. The lot abuts streets on three
sides. Although the Zoning Code definition of'thmugh lot" appears to exclude comer lots, this

The proposed 6lot subdivision requires the use of on -site sewage treatment systems. Soil borings
a ul percolation tests were performed by Otto Associates to identify primary and alternate drainfield
sites on each lot. Lot 5 has an existing drainfield designed for 5 bedrooms. The other five lots have
enough area for a five bedroom drainfield on both the primary and alternate sites. The information
provided indicates that all drainfield sites meet all Orono and Minnesota 7080 standards for design
and location.

The applicant has requested a Class III subdivision of property located at 4100 Watertown Road.
The property consists of approximately 37 acres of which approximately 2 acres is classified as
Orono Wetlands and appear on the City Wetland Maps. Proposed is a 6lot residential development.
4 lots would be served by a private road shown on the preliminary plat as Oudot A. Proposed Lot
5 is shown at 9A acres and contains a house, horse bam and riding arena and has direct access to
Watertown Road. Proposed Lot 6 has a house located on the front property line and has access to
Orchard Park Road. There has been no decision made on the future of the house on Lot 6.
Lot History
In December of 1985 the City Council adopted Resolution No.1894 for variances and a Conditional
Use Permit to allow the keeping of domestic animals for commercial purposes and to allow the
continued use of the property for a public riding stable based on conditions that the total employees
hired by the applicants to assist in the commercial horse operation shall not exceed five full and part
time employees, except for special events to be approved by the Council. The riding lessons are to
be provided by members of the applicant's family. One additional important condition was the City
shall review the Conditional Use Permit annually, however annual reviews had not been necessary.
The approvals granted by the CUP shall be released from the title as the use does nut tarty to the new
properties.
There are two residences on the property one primary residence and a second residence that is
located at 505 Orchard Park. The lot was purchased and combined in 1996.
Several variances and conditional use permits have been granted to permit additions to the residence
on proposed Lot 5. Said variances shall be released from the entire property to not appear on titles
of any newly created lots.

Lot 6 has 5 acres of total area but less than 5 acres is dry buildable. Under this lot
arrangement a variance to lot area is required. The applicant will consider a possible lot line
arrangement to increase the lot area to 5 acres. The applicant has made an honest effort to
create conforming lots. Staff is bringing the application forward for Planning Commission for
review for hvo reasons. First a public hearing has been scheduled and all property owners
within 350' have been notified, and second, Staff did not specifically inform the applicant that
protected wetlands are not considered as part of lot area to constitute the 5 acre minimum lot
size.
The applicant has not, as of the date of this memo, submitted a revision to the plan. Options
will be discussed at the meeting on Monday. In Staff's opinion, granting a variance to the dry
buildable lot area requirement is not an option, and to do so as part of a standard plat would
be precedent setting.
Surrounding Properties
The property is located in the RR -IA (5 acre zoning district). The Comprehensive Plan and the
Zoning Code intent for properties in the zoning district is to provide a combination of low density
residential development and limited agricultural activity. The lot is surrounded by properties thzt
are developed as low density residential developments and small horse farms.

Orono Wetland Policies and Standards
City protected wetlands were those identified by the City in 1974 and appear on the City's Wetland
Inventory Overlay Maps and are subject to the provisions in Section 10.55, in addition to WCA
regulations. The protected wetlands are protected at the time of subdivision by the developer by
growing of a "Conservation and Flowage Easement" and further are identified as "Drainage
Easements on the official plat mylars. Section 10.55, Subdivision 15 defines the minimum lot area
requirements shall be interpreted to not allow protected areas as pan of that lot area. City protected
wetland areas within the regulatory boundary shall not be credited toward dry buildable area for
zoning purposes.
Wetland basins not identified in the Wetland Inventory Overlay Maps but which are delineated under
WCA methods and/or appear on the National Wetland Inventory (NWI) are subject to WCA
regulation, which falls under the jurisdiction of the Minnehaha Creek Watershed District (MC WD).
Those areas are not subject to the 26 setback or required for protection by a Conservation and
Flowage Easement, and are allowed as credit towards dry buildable area for zoning purposes. The
City will require a protective covenant filed in the chain of title of the affected property, as an
advisory to property owners that a wetland subject to WCA regulations exists.
Stables and Barns
The keeping of domestic animals for non-commercial purposes is a permitted use including horses
for the use of the occupants of the premises. A minimum of one acre in aggregate, exclusive of one
acre for the principal building, must be available for each animal unit, except as hereinafter set forth.
A minimum of two acres of open pasture must be available for a single horse and one additional acre
must be available for each additional horse. When the horses are kept stabled and do not require
pasture for feed purposes, the minimum pasture requirement may be adjusted at the discretion of the
Council. Such minimum pasture acreage shall not include low lying lands lusable for pasture or
grazing. Any person keeping such animals must comply with the provisions of the City Code.
The use of an accessory building for keeping animals for non-commercial purposes is a permitted
use provided it is for the non-commercial use of the property owner or resident and meets the

available area standards outlined in the paragraph above (Section 10.20, Subdivision 3 (M). Further,

property owner or resident requires a conditional use permit. Further, no such structure shall be
located less than 150 feet from the nearest lot line. Applicants should be asked to identify their
intended uses for the buildings on Lot 5.
Right -of -Way Dedication
Watertown Road is a City owned right-of-way. The property was platted to the center of the street.
Subdivision Code requires the land shown as Watertown Road shall be dedicated to the City. The
portion of the property dedicated is not considered as lot area.
The easterly 33' of the property shall be dedicated for right-of-way purposes for Orchard Park Road.

Issues for Discussion
Lot 5 contains the two oversized accessory structures requiring variances to permit two
oversized accessory buildings on one lot, to permit two oversized accessory buildings larger
than the 3,000 s.f., and to permit 14,497 st for all accessory buildings where 6,000 s.f. is
allowed. Is it the position of the Planning Commission the arena and barn are compatible
with the use on the property and warrant variances on a smaller lot, where they currently
exist on a 37 acre site? The bam has been on the property for many years. The riding arena
was constructed in the early 1970s. At the time of the arena construction the lot was about
7-8 acres in size. Over the past 3 decades property owners have been purchasing adjacent
land and combining to this property.
2. If future property owners wish to use the property for commercial purposes it appears the
Conditional Use Permit, adopted by Resolution No.1894, would no longer be valid since the
property will be reduced in size.
3. The Comprehensive Plan recognizes the rural character of the land in the 5 acre district.
Losing horse farms hss contributed to a change to character of this part of the City. Does
allowing one smaller lot to contain these individual buildings maintain some of that
character?

Staff Recommendation:
Staff can recommend conceptual approval of the plan subject to each lot must meet the minimum
standards for lot area, most notably proposed Lot 6, and subject to the following conditions.
1. The proposed lot layout would not change significantly from the layout dated 2/13/01.
2. The ponding, grading, and drainage calculations submitted shall be conceptually approved
by the City Engineer prior to City Council review.
3. Standard Drainage and Utility Easements shall be dedicated on the final plat 5'alonginterior
property lines and 10' along exterior property lines.
4. Welland and stormwater management areas shall be dedicated on the final plat as "drainage
easements".
5. A homeowners association shall be created for the maintenance of the private road located
within Outlot A.

WHEREAS, Frank Rokesh (hereinafter "the applicant") is the
owner of the property located at 4100 Watertown Road within the City
of Orono (hereinafter "City") and legally described as follows:
The West 316.50 feet of the South 1088.1 feet of the West 1/2 of
the South 27.50 acres of the West 1/2 of the East 1/2 of the
Northeast 1/4 of Section 31, Township 118, Range 23 lying North
(of the center line) of the Minneapolis and Watertown Road,
(hereinafter "property")I and
WHEREAS, the applicant has made application for a variance
to permit the keeping of domestic animals for commercial purposes per
Section 2.0.227, Subdivision 4 (A) and a conditional use permit to
permit the continued use of applicant's property for the boarding of
horses, rental of horses and instruction in the riding of horses per
Municipal Zoning Code Section 10.20, Subdivision 3 (F).
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #994.
2. The property is located in the RR-lA Rural Residential Zoning
District.
3. The property contains approximately 35 acres in area.
4. .The Orono Planning Commission reviewed this application on I
November 18, 1985, and recommended approval of the proposed
variance to allow the keeping of domestic animals for commercial
purposes per Zoning Code Section 10.27, Subdivision 4 (A), and
recommended approval of a conditional use permit to permit the
continued use of applicant's property for public riding stable
use based on the following findings:
A) Applicant's principal residence is located on a 35 acre
site.
B) No other variances are sought to performance section of
Section 10.27, Subdivision 4 (A) - keeping of domestic
animals.

C) The proposed level of use is compatible with surrounding
5 acre "hobby farm" neighborhood.
D) The property has been used as proposed in this review
for over 15 years and has not resulted in any harm to the
publics' safety or welfare.
5. The City Council finds that the conditions existing on t71is
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance
would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring properties;
would not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the appli-
cant; and would be in keeping with the spirit and intent of the
zoning Code and Comprehensive Plan of the City.
6. The City Council finds that granting a conditional use permit
to allow a public riding stable will not be detrimental to the
health, safety or general welfare of the public, would not ad-
versely affect light, air nor pose a fire hazard or other danger
to neighbcriLq properties, nor will it depreciate surrounding
property values and that the proposed level of use of the
property will be in keeping with the intent and objectives of the
Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City
Council hereby grants a variance to Municipal Zoning Code Section
10.27, Subdivision 4 (A) to allow the keeping of domestic animals for
commercial purposes and per Section 10.20, Subdivision 3 (P) grants a
conditional use permit to permit the continued use of applicant's
property for public riding stable use subject to the following
conditions:
1. The total number of full a;:d part time employees hired by the
applicants to assist in the commercial horse operation shall not
exceed the level of 5 employees except for special events at
which large assembly permitting process shall establish level of
temporary employees.
2. Riding lessons are to be provided by members of applicant's
family.
3. Horses maintained on property shall not exceed the number
allowed per Section 10.27 Subdivision 4 (A).
4. Applicant shall renew conditional use permit annually until
Council specifies otherwise.

5. Authorities granted by the conditional use permit run with
the property not with the owner and are permissive only.
6. Violation of or non-compliance with any of the terms and
conditions of this resolution shall constitute a violation of the
zoning code, shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
7. The undersigned applicant has read, understood and. hereby
agrees to the terms of this resolution and on behalf of himself,
his heirs, successors and assigns, hereby agrees to the recording
of this resolution in the chain of title of the property.

During the 30day time period for prepayment of the Fox Ridge Sewer project assessment without
interest, the properties at 5 & 15 Brown Road South were being considered as a possible site for
the relocation of the Long Lake Fire Station. The property owners did not want to prepay their
assessment because of the uncertainty of the fire station relocation, so City staff informed them
that they could wait until the fire station site was resolved before making ally assessment
prepayments. These properties are now no longer being considered for a possible fire station site.
The assessments for these properties have been certified to Hennepin County and are now payable
with the 2001 property taxes. One of the property owners is interested in prepaying the assessment
without any interest. In the interest of fairness to these two property owners, City staff is
recommending that a new 30-day time frame for prepayment of the entire assessment without
interest be provided. If the assessment is prepaid during this time period, the City will request
that Hennepin County remove this assessment from the property. If prepayment is not received,
the assessment will remain in place as is. This option should be provided to both properties that
were impacted by the possible fire station relocation. Approval of the attached resolution is
recommended.

A RESOLUTION TO AMEND THE
INTEREST RATE AND DATE APPLIED TO THE
FOX RIDGE AREA SANITARY SEWER
ASSESSMENT ROLL, AS ESTABLISHED BY RESOLUTION NO.4493
WHEREAS, the City Council of Orono, Minnesota established the interest rate at
9.00%, and the effective interest date as July 10, 2000, on the assessments for the improvement of
sanitary sewer in the Fox Ridge area by passage of Resolution No. 4493; and
WHEREAS, the City Council ofOrono, Minnesota revised the interest rate to 6.25%
and changed the effective interest date to October 9, 2000 on the assessments for the improvement
of sanitary sewer in the Fox Ridge area by passage of Resolution No. 4538; and
WHEREAS, properties located at 5 Brown Road South and 15 Brown Road South
were included in the project assessments; and
WHEREAS, during the 30 day time frame for prepayment of the assessments without
interest, these two properties .ere being considered as a possible site for the relocated Long Lake
fire station; and
WHEREAS, because of the possible acquisition of these two properties for the Long
Lake fire station, the property owners did not want to prepay the assessment during the allowed 30
day time frame; and
WHEREAS, these two properties are not now being considered as a site for the
relocated Long Lake fire station and will remain in residential use; and
WHEREAS, the property owners have requested that they have the ability to prepay
the project assessments without interest; and
WHEREAS, the assessment has already been certified to the County Auditor and
upon receipt of the assessment prepayment the City will request that the County Auditor remove the
project assessment from the subject property; and
WHEREAS, ifprepayment ofthe entire assessment is not received by the City within
the revised 30 day prepayment period, the assessment will remain against the property.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of Orono,
Minnesota:
1. Such assessment shall be payable in equal annual installments extending over a
period of 15 years, the first of the installment to be payable on or before the first Monday in
January 2001. and shall bear interest at the rate of 6.25% per annum from October 9, 2000.
To the first installment shal I be added interest on the entire assessment from October 9, 2000
until December 31, 2001. To each subsequent installment when due shall be added interest
for one year on all unpaid installments.
2. The owner of any property so assessed may pay the whole assessment on such
property, with interest charged to the date of payment, to the City Treasurer, except that no
interest shall be charged if the entire assessment is paid within thirty (30) days of April 10,
2001, and he may, at any time thereafter, pay to the City Treasurer the entire amount of the
assessment remaining unpaid, with interest accrued to December 31 of the year in which
such payment is made. Such payment must be made before November 15, or interest will
be charged through December 31 of the next succeeding year.
3. Partial prepayment is allowed in accordance with Ordinance No. 160, Second Series,
adopted May 12, 1997.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property tax lists of the County. Such assessments
shall be collected and paid over in the same manner as other municipal taxes.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held April 9, 2001.

their families who live in the Eden
Prairie, Hopkins, Orono, St. Louis Park,
and Wayzata school districts.
How does it work?
Sometimes the youth's school will call and
tell us a young person needs to talk to one of
our counselors. Or, a youth may call us
directly. Many times, a parent calls us to
talk through some parenting challenges.
It's easy to use Teens Alone's free and
confidential services.

What does Teens Alone do?
Teens Alone has two primary goals:
• to help families stay together.
• to help young people stay in school.
Experience shows that families have the
most success when Teens Alone becomes
involved earlier, rather than later, in teen
and family conflict.
Counselors believe that most families
already have the tools they need to solve
their problems, because they have
successfully solved problems in the past.
Teens Alone counselors are here to listen
and help mediate.

Council approval of seasonal employees for the Golf Course is required. We are proposing a ,ay
range of $7.02 to $7.90 per hour for this season. New employees earn $7.04 per hour for the
first year. Returning employees earn more each year until the maximum rate is reached. This is
an increase of 3.25% over the 2000 season hourly rates.
Attached you will find a survey of hourly golf course pay rates from the Minnesota Professional
Golf Managers Association (MPGMA). The most common pay range in the s•irvey is $7.00 to
$8.99 per hour with six responses. The Orono Golf course pay rates are on the lower end of this
range. The next most common range is $9.00 to $10.99 per hour with three responses. The total
range is from $5.00 to more than $15.00 per hour.
Last year, there was a lot of turnover of long term older employees and many of the positions
were filled with younger employees. For many years mo•it of the employees were retired
workers that returned every year to work. This is beginning to change, and we are seeing more
employee turnover which makes training and scheduling employees difficult. To encourage
employees to return for the second year, the pay rate increase is larger from the first to the second
year than for the other years. This year the majority of the employees are second year returning
employees. We are also having difficulty finding employers willing to work longer hours each
week, so the second year returning 6-month employee is at a higher rate than the other second year
returning employees.
Seasonal employees are hired under two different provisions of the PERA rules. Two employees
will be hired under the 6-month rule which allows unlimited earnings for a 6-month maximum
time period. These are the main employees with the majority of the hours during the season.
The remainder of the employees work fewer hours and will be hired under the PERA maximum
earnings provision which!irnits earnings to $425 per month without any restrictions on the number
of months worked.

The 2001 Capital Outlay budget included $93,000 for the replacement of an existing large snow
plow truck. This truck is a 1989 model with approximately 120,000 miles, and is in poor condition,
and will be sold at the County auction. The City has four large plow trucks and the long range plan
is to purchase a snow plow truck every three years. This results in a 12-year turnaround for each
truck. The next snow plow truck will be purchased in 2004. The new truck and equipment will be
bought through the State of Minnesota Cooperative Purchasing Program. A Sterling Truck, formerly
Ford Trucks, will be purchased. The intent is to have all of our snow plow necks the same brand.
We have had very good success with our previous Ford and Sterling Trucks.

Asphalt Compactor
An asphalt compactor is needed to be used in conjunction with our asphalt patch truck. Before the
recent purchase of the patch truck, we were using dump trucks for patching and rolling over the
patches for compaction. This was very inefficient and results in poor quality patches. The purchase
,:fa ct ipacter wall allow for efficient use of the patch truck and higher quality patches. This item
should have been included with the patch truck purchase, but was left out of the budget. The budget
forth - at.; plow truck purchase was $93,000 and the actual truck cost is $82.505. We are requesting
the use of $2,130 of the s surplus for the purchase of an asphalt compactor
We have tested several different brands of compactors and the best model is a "Wacker" brand
compactor. This is the same brand as our dirt compactor, and we have been very satisfied with the
performance of this piece of equipment. Wacker is an industry standard brand of equipment with
easy availability of parts and service which is an important consideration as compactors can be a
high maintenance piece of equipment.

Installation of a Streetlight at the County Road 6lfownline Road Intersection
The residents along Townline Road have requested installation of a streetlight at the intersection of
Towline Road and County Road 6 as this intersection is being used more frequently since the recent
closure of the Highway 12/fownline Road intersection. At night it is very difficult to see the
intersection which forces turning vehicles to slow down on County Road 6 when looking for the
intersection. Recent studies have shown a 15 to 1 payback ratio in reduced accidents from the
installation of streetlights at high speed rural intersections. Streetlights improve visibility and alert
drivers to the presence of an intersection. The installation of streetlights is one of the most cost
effective safety improvements that can be provided at rural intersections along higher speed roads.
Wright/ Hennepin Electric Cooperative will install and maintain a streetlight at this intersection for
an installation cost of $200 and a flat monthly fee of $8.40. The City's current monthly cost for street
and parking lot lighting and traffic signals is approximately S1,100.
Our staff recommendation is to approve the installation of a streetlight the county Road 6/ Townline
Road intersection.

Donated to the City at 3580 Wayzata Boulevard
A substantial portion of the property at 3580 Wayzata Boulevard has been farmed for a number of
years. The lease agreement that was in place with the former owner allowed the property to be
farmed rent-free. The benefit to the property owner was that the area that was fanned was well -
maintained.
The City has not developed a plan for the use of the property, and will not open it as a park until after
MaIDOT acquires a substantial portion of the property as right-of-way for the Highway 12 project.
The portion of the property that has been farmed is shown on the attached map. A substantial
portion of the farmed property will be taken as right -of --way by Mn/DOT. Continuing the
agricultural use may be a good interim use until a plan is developed for the park use of the property.
COUNCIL ACTION REQUESTED:
Motion regarding leasing a portion of the property at 3580 Wayzata Boulevard for agricultural use.

Dear Mr. Nybeck;
The Orono City Council is requesting that the Lake Minnetonka Conservation District begin the
process to study and implement possible options for safe winter a, cess through the Coffee
Channel between Crystal and West Arm Bays on Lake Minnetonka. This channel is one of the
most heavily used channels on the lake, in all seasons, as it provides one of only twn links
between the upper and lower areas of Lake Minnetonka. During the winter months, there is
substantial snowmobile traffic through this channel because of the close proximity of a gasoline
statior hat is accessible to snowmobiles.
This channel has a long history of being extremely hazardous for snowmobile use because of
highly variable and poor quality ice conditions. At times there is open water in the channel, and
this results in snowmobiles traveling through the channel at high rates of speed to skip across the
open water. Also, throughout much of the winter the ice can be very thin resulting in
snowmobiles breaking through the ice. There have been numerous incidents every year of
snowmobiles going through the ice in the channel. Several years ago, a snowmobiler was
seriously injured when he crashed into the channel wall while traveling at a high rate of speed in
an attempt to skip over the open water.
Our understanding is that several years ago there were some discussions regarding the possibility
of installing a temporary bridge through the channel to provide for safe snowmobile access. The
City of Orono is requesting that the issue of winter access through the Coffee Channel be
studied further by the Lake Minnetonka Conservation District. The unsafe conditions in this
channel are having substantial impacts to the City of Orono As snowmobilers use overland routes
to avoid the dangerous channel crossing.

This is a regional issue which is greater than individual cities can be responsible for or solve. It
could be most effectively dealt with by regional agencies such as the Lake Minnetonka
Conservation District (LMCD) in cooperation with other agencies such as the Hennepin County
Water Patrol and local snowmobile associations that also have a stake in this issue. The main
purpose of the LMCD is to provide for a regional approach to issues effecting Lake Minnetonka.
Therefore, the LMCD appears to be the logical agency to spearhead a cooperative effort to find a
solution to this problem. The City of Orono would also like to be involved in working with the
LMCD and other interested parties to find a mutually agreeable solution for this problem.
