No.24992 m o >< 0 a: C: C' ~ ;::; (') -· )>- A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 78-330 FILE NO. 10-3463 Council Exhibit B WHEREAS, Kevin Ray Shultz and Mandy Rae Schultz, husband and wife (hereinafter "the applicants") are the owners of the property located at 3980 Cherry A venue within the City of Orono (hereinafter the "City"}an.d legally described as follows: Attached as Exhibit A, (hereinafter the "property"); and WHEREAS, the applic~ts have made application to the City of Orono for a variance to Orono Municipal Zoning C()de Section 78-330 (B) to allow redevelopment on a lot 0.5 acre in area where 1.0 acre is normally required; and WHE~:AS; after due published notice and mailed notice in accordance with Minnesota Statutes '111<1. the o;ono, Minnesota, City Code, the Orono Planning Commission held a public hearing on MayJ7, 2010 atwhich times all persons desiring to be heard concerning this application were given tli~bpportunity to speak thereon. NOW, 'fHEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: . FINDINGS 1. This application ~as reviewed as Zoning File 10-3463. 2. The prop~X!Y i~lQcated in the LR-lB One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140". · 3. The Planning Commission reviewed this application at a public hearing held on May 17, 2010 and recommended approval of variance based on the following findings: Page 1 of 4 4. 5. a. The property contains 22,012 s.f. (0.5 acre) in area and has 143.6 feet in width along Cherry A venue. b. Sanitary sewer is available. There are two existing public sanitary sewer stubs available; one in North Arm Drive and one in Cherry Avenue. c. There is no additional land available to bring the lot area into conformity. d. The hardcover requested conforms .to hardcover limitations. The proposed residence meets the structural lot coverage limitation of 15%. e. The proposed structure complies with the front, side yard and rear yard setback requirements. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfareofthe community. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally tp other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a ~011venience to the.·. applicants, but is necessary to alleviate a demonstrable hardship .or difficulty; is· necessary to preserve a substantial property right of the applicants; apd would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon OJJ.e or more .. of the above findings, the Orono City Council hereby grants a variance to Orono Municipal.Zoning Code Section 78-330 (B) to allow development on a lot 0.50 acre in area where · LO .:tcre is normally required in order to construct a new residence, subject to the following conditions: 1. Council approval is based on the site plan/survey and building plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit B & C. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. Page 2 of 4 2. No hardcover variances are granted. 3. ADDITIONAL SURVEYS REQUIRED: a. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building permit, stormwater management, grading and drainage plans shall be submitted prior to the issuance of a Certificate of Occupancy for the residence. 4. The building plans submitted for buildiligpermit will be reviewed to ensure compliance with the City's building height and number of stories regulations. 5. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and mu§t be. exercised by obtaining a building permit for the new construction within one year cff the date of Council approval, or the variance will expire on that date (May 24, 2011 ). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation .of the zonipg code, shall automatically terminate any authority granted herein/and shall be punishable as a misdemeanor. 7. Minnesota State Statutes Section 394.27, Subdivision 7 requires that a hardship be demonstrated in order for a variance to be granted. The plan is dated 4-2-10. We have the following comments with regards to engineering matters: • The proposed contours should tie into the existing contours. There are several existing contours that are not tied into the proposed contours. • The maximum acceptable grade of 3:1 is exceeded northwest of the proposed home. • The plans should show top and bottom wall elevations for all retaining walls. • Engineered design and details should be submitted for review and approval for all retaining walls over four in height, and for all tiered walls with a separation of less than two times the wall height. • More information should be provided for the proposed sewer service. These details should be provided to public works for review. • Although the grading plan adequately addresses the emergency overflow for the backyard, we do not recommend maintaining the existing closed drainage basin. • This ex isting low area should be investigated to determine if it is a wetland. • This project will disturb more than 100 CY of material. Sediment and erosion control information meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. There were no water marks on trees. The vegetation was mostly removed but the trees that remained near the depression were sugar maple which are found in upland. Typically this type of depression would be wetland, however the drainage area to the site is small so it is not receiving and holding water for long enough to take on wetland characteristics.
