A RESOLUTION GRANTING AV ARIAN CE TO MUNICIPAL ZONING CODE SECTION 78-330 FILE NO.10-3463 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO· -----;,,51-'9~3-,.,6r- A RESOLUTION GRANTING AV ARIAN CE TO MUNICIPAL ZONING CODE SECTION 78-330 FILE NO. 10-3463 WHEREAS, Kevin Ray Shultz and Mandy Rae Shultz, husband and wife (hereinafter "the applicants") are the owners of the property located at 3980 Cherry Avenue within the City of Orono (hereinafter the "City") and legally described as follows: Attached as Exhibit A, (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow redevelopment on a lot 0.5 acre in area where 1.0 acre is n01mally required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on May 17, 2010 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 10-3463. 2. The property is located in the LR-lB One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on May 17, 2010 and recommended approval of variance based on the following findings: Page 1 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 9 3 6 a. The property contains 22,012 s.f. (0.5 acre) in area and has 143.6 feet in width along Cheny A venue. b. Sanitary sewer is available. There are two existing public sanitary sewer stubs available; one in North Arm Drive and one in Che1Ty Avenue. c. There is no additional land available to bring the lot area into conformity. d. The hardcover requested conforms to hardcover limitations. The proposed residence meets the strnctural lot coverage limitation of 15%. e. The proposed strncture complies with the front, side yard and rear yard setback requirements. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, repo1is by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring propeiiy; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow development on a lot 0.50 acre in area where 1.0 acre is normally required in order to constrnct a new residence, subject to the following conditions: 1. Council approval is based on the site plan/survey and building plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit B & C. Any amendments to the site plan which are not in confom1ity with City codes will require further Planning Commission and City Council review. Page 2 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 9 3 6 2. No hardcover variances are granted. 3. ADDITIONAL SURVEYS REQUIRED: a. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building pe1mit, stormwater management, grading and drainage plans shall be submitted prior to the issuance of a Certificate of Occupancy for the residence. 4. The building plans submitted for building permit will be reviewed to ensure compliance with the City's building height and number of stories regulations. 5. Authorities granted by this resolution run with the property not with the applicants, but are pe1missive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (May 24, 2011). 6. Violation of or non-compliance with any of the tem1s and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the prope1iy.
