McMillan stated in March of 2006, the Council expressed some concerns with the encroachment, which is
why there is now a question by the Council on why the applicant is currently proposing a six -foot
encroachment. ·
Gaffron stated if the retaining wall is located partially on Mr. Wagener's property and the applicant needs
to do some grading on the neighbor's property, it would be necessary for Mr. Wagener to agree to the
work on his property.
Mr. Wagener requested the applicant stake the area of the fill and the elevation. Wagener stated the wall
was done at the request of the City at the time he constructed a garage addition . Wagener inquired
whether some additiqnal screening would also be added.
Munson stated he is very interested in adding some screening.
McMillan inquired whether a requirement for screening should be included in the resolution .
Gaffron stated language could be incorporated in the resolution regarding the grading and fill as well as a
requirement for additional landscaping.
McMillan requested that the landscaping be worked out between the neighbors and not inc luded in the
resolution.
McMillan moved, Murphy seconded, to amerid the motion to include language in the resolution
regarding the placement of the fill to be a minimum of one foot below the height of the retaining
wall, with some fill being placed within five feet of the lot line and possibly extending onto the
adjoining property, subject to the approval of Mr. Wagener. VOTE: Ayes 4, Nays 0.

The Orono Planning Commission met on the above-mentioned date with the following members present:
Chair Cynthia Bremer , Commissioners David Ralm, Ralph Kempf, and Dick Kroeger. Representing Staff
were Planning Director Mike Gaffron, Planner Evelyn Turner, and Recorder Jackie Young . Council
Members Murphy and White were present.
Chair Bremer called the meeting to order at 6 : 10 p.m.
CONSENT
*1. 06-3244 RE-CREATIONS, INC., 3925 CHERRY AVENUE, VARIANCE, 6:10-6:11 P.M.
Bremer moved, Rahn seconded, to recommend approval of Application #06-3244, Re -Creations,
Inc., 3925 Cherry Avenue, granting of a lot area variance subject to the grading and site plans
being revised to address the issues outlined in the City Engineer's report, and further subject to the
understanding that no other variances will be granted for redevelopment of the property.
VOTE: Ayes 4, Nays 0.

2. 06-3225 875 WBW LLC, 875 WAYZATA BOULEY ARD, SUBDIVISION/RESIDENTIAL
PLANNED UNIT DEVELOPMENT/REZONING, 6:11-6:35 P.M.
Steve Johnston, WBW, LLC, was present.
Gaffron stated the applicant is requesting approval for a nine -unit residential development on this forn1er
New Horizons daycare site. The prope1ty is the subject of a Comprehensive Plan amendment to allo w
density o f approximately 1.4 units per dry buildable acre, where the cunent density maximum is 0.5 units
per acre.
Gaffron noted this application cannot be formally acted upon until the Metropolitan Council takes action
on the Comprehensive Plan Amendment allovving development of the site at urban densities. Propos ed
amendment language was approved by the City Council on August 28 and forwarded to the Metropolitan
Council on October 10 , 2006. The Metropolitan Council has not ye t taken action on the amendment,
pending receipt of comments from neighboring citie s and jurisdictions.
Staff brought the initial application to the Plannin g Commission in August as a concept plan to allo,v an
oppo1iu11ity to identify potential concerns, issues, and development parameters that the applicant should
address. The City Engineer also submitted comments in August. The applicant has submitted revi sed
plans responding to those comments. Gaffron noted the City of Long Lake has not yet recei ved an
agreement with the developer regarding sewer and water.
As of tonight , Staff has not had an opportunity to complete more than a brief r eview· of the revised plans
submitted on November l Y11

We have reviewed the survey for the proposed house at 3925 Cherry Avenue, dated 11-6-06. We have the
following comments with regards to engineering matters:
• The survey should show the existing driveway.
• Elevations should be provided for the top and bottom of the retaining wall. Engineered retaining wall
design and details should be submitted for review and approval for all walls over 4' in height.
• The plan should show how the driveway will tie into Cherry A venue. All associated grading and
drainage, including culverts, if necessary, should also be shown . In addition, the plan should show how
proper drainage will be maintained along Minnie A venue once the existing driveway is removed.
• More detailed grading information, such as proposed spot elevations, should be added to clearly indicate
the drainage patterns for the proposed driveway.
• Final plans should include erosion and sediment control details.

A VARIANCE TO
MUNICIPAL ZONING CODE

WHEREAS, Re-Creations, Inc, a Minnesota Corporation, (hereinafter
"Owner") is the owner of the property located at 3925 Cherry Avenue within the City of
Orono (hereinafter "City") and legally described as: Lots 1, 2 and the east 10 feet of Lot 21,
Hickory Hill Hennepin County, Minnesota (hereinafter "the property"); and
WHEREAS, the Owner has made application to the City for a lot area
variance to Municipal Zoning Code Section 78-350 to allow construction of a house on a lot
that is 0.39 acre when 0.5 acre is required; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on November 20, 2006, at which times all persons desiring
to be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #06-3244
2. The property is located in the LR-IC zoning district, where 0.5 acre acre is the
minimum lot area and 100 feet is the minimum lot width. The property is
approximately 0.39 acre in area and 119 feet in width.
3. The Planning Commission reviewed this application on November 20, 2006
and on a vote of 4 -0 recommended approval of the variance, based on the
following findings:
a. The lot was created before there were subdivision regulations.

b. Prior to last year a house had existed on the property since 1958.
c. There is no adjacent property the applicant could acquire to enlarge the
lot.
d. There are numerous similarly sized lots with similarly sized houses in
the immediate vicinity of this property so the proposed house would
not be out of character with the surrounding area.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the owner, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to Orono
Municipal Zoning Code Section 78-350 to allow construction of a house on a lot that is 0.39
acre when 0.5 acre is required, subject to the following conditions:
1. Council approval is based on the site and house plans submitted by the Owner
and annotated by City staff, attached to this Resolution as Exhibits A. and B.
Any amendments to these plans may require further Planning Commission and
City Council review.
2. Authorities granted by this resolution run with the property not with the owner,
but are permissive only and must be exercised by obtaining a building permit

for the new construction before November 27, 2007 or the variance will expire
on that date.
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned Owner has read, understood and hereby agreesto the terms of
this resolution and on behalf of its successors and assigns, hereby agree to the
recording of this resolution in the chain of title of the property.

Background
This property is actually two lots and part of a third lot in the Hickory Hills addition, which
was platted before there were subdivision regulations in Orono. The previous house on the
property (built in 1958) was demolished last year.
The property drops about 14 feet from the northwest comer to the southeast comer. The
proposed house would face Cherry Place ( as did the previous house). It would be two stories
with an attached two-car garage and a basement under the entire structure. It would be a

walkout on the south side (opposite Cherry Avenue). Fill would wrap around the east side of
the house from Cherry A venue, reducing the amount of exposed basement wall. Access
would be from Cherry Avenue (near the top of the slope) with the garage doors facing the
west lot line.

Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the effect of the proposed
variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions,
light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding
area. The Planning Commission shall consider recommending approval for variances from the literal
provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship
because of circumstances unique to the individual property under consideration, and shall recommend
approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the
Orono Zoning Code.
Staff finds that grounds exist to grant the lot width and area variances, based on the following
findings:
1. The lot was created before there were subdivision regulations.
2. Prior to last year a house had existed on the property since 1958.

4. There are numerous lots with houses in the immediate vicinity of this property that

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to
be stored shall be as set forth in this section.
Subd. 2. Information_ required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and (d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in the
individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored data on individuals, and whether
it is classified as public, private or confidential. Upon his further request, an individual who is
the subject of stored private or public data on individuals shall be shown the data without any
charge to him and, if he desires, shall be informed of the content and meaning of that data.
After an individual has been shown the private data and informed of its meaning, the data need
not be disclosed to him for six months thereafter unless a dispute or action pursuant to this
section is pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by the
individual subject of the data. The responsible authority may require the requesting person to
pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature of
the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that he
believes the data to be correct. Data in dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of
the administrative procedure act relating to contested cases.

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application
will not be considered complete or placed on any meeting agendas until this form is
complete and submitted to the City.
Minnesota State Statutes Section 394.27, Subdivision 7 requires that a hardship be
demonstrated in order for a variance to be granted. The hardship must be unique to the
property as variances run with the land and not the land owner. Personal and economic
situations are not considered valid hardships. In order for an application to be heard by
the Planning Commission and City Council a hardship having merit must be
demonstrated.
HOW DO I PROVE A HARDSHIP?
This form has 12 points outlining the basis City staff uses to determine if a hardship
exists and how the variance will affect the surrounding community. To prove a hardship,
address all the relevant points listed below and answer them as clearly as possible.
Since you are requesting the code exception, you have the burden of proving that the
variance is justified. The information the City receives is what is used in determining a
denial or approval recommendation. If you leave something out it will not be considered.

We hav e reviewed the surv ey for the proposed house at 3925 Cherry Avenue, dated 11-6-06. We have the
following comments with regards to engineering matters:
• The survey should show the existing driveway .
• Elevations should be provided for the top and bottom of the retaining wall. Engineered retaining wall
design and details should be submitted for review and approval for all walls ov er 4 ' in height.
• The plan should show how the driveway will tie into Cherry A v enue. All associated grading and
drainage, including cul v erts , if necessary , should also be shown . In addition , the plan should show how
proper drainage w ill be maintained along Minnie Av enue once the existing driveway is removed.
• More detailed grading information, such as proposed spot elevations, should be added to clearly indicate
the drainage patterns for the proposed driveway.
• Final plans should include erosion and sediment control details.

SUBJECT: Zoning Application #06-.4347
The City of Orono is required to notify you within fifteen ( I 5) business days as to the status of your application for a Lot
Area Variance for property located at 3925 Cherry Avenue. Below is a list of items the City of Orono is requesting to
complete our review:
. 1. Scaled elevation drawings and floor plans of the proposed residenc~ that match the grading plan and the site
plan, both full size and reduced sets.
In addition we noted the following items that need correction :
1. The lowest level does not meet the definition of basement and thus the house is three full stories . Houses are
limited to two stories plus a half story. (See the definitions section of the zoning code for a definition of half
story.) The current definition of basement is "a story the floor of which is more than six feet below existing grade
for more than 50 percent of its perimeter." The proposed basement floor elevation is 952 .3 . Six feet above would
be 958.3. Even after making allowance for the depression remaining from the old house , no part of the basement
floor would be six feet below this elevation from existing grades. A code change is proposed that would change
the definition of basement to measure six feet down from the floor above . The survey does not indicate the
elevation of the first floor. If it were 962.3 then 50 percent of the perimeter of the basement floor would have to
be below the existing 956 .3 . The basement is still a story under that definition but it comes closer. You may use
the proposed definition but the request could not be considered by the Planning Commission until the change has
been approved by the City Council. That could occur as early as November 13 but there is no guarantee .
Enclosed is a sketch that shows how we would adjust exiting grade where the old house was .
2. Drainage from the driveway and yard to the front of the hous e should be directed to the east portion of the lot
rather than to Cherry A venue .
Application # 06-4347 is incomplete. If you wish to proceed with your application plea se submit the items and corrections
requested above by November 6 to remain on the November 20 , 2006 Planning Commission agenda . Please call me at

Parkway on Monday, November 20, 2006 , beginning at 6:00 p.111. on the matter of reviewing the

zoning district, requests rezoning of the property to RPUD Residential Planned Unit
Development, and requests RPUD site plan and preliminary plat approval for a 9-unit

John Hollander, 200 Hollander Road, RR-1B zoning district, requests a fence height
variance to allow the existing fence to be increased to 56 inches high when the maximum
is 42 inches. (This is the same height as the fence was when it was first constructed.)
City of Orono, proposes an amendment of the Orono Community Management Plan
(Comprehensive Plan) with regards to the property at the northwest quadrant of the
Willow Drive/Highway 12 intersection, known as PINS #33-118-23 11-0060, legally
described as Outlot A, Stone bay, owned by Dahlstrom Development LLC, and currently
zoned RR-1 B One-Family Rural Residential district. The proposed amendment would re
guide this commercially-guided property to allow for primarily office uses with only
minimal retail uses.
All persons wishing to be heard are encouraged to attend this meeting. This is not a final agenda and is
subject to change prior to the hearing. Written comments are accepted and should be submitted to the
City of Orono by November 15, 2006 if possible. Plans or proposals are available for review in the City
Offices and all interested persons are encouraged to contact the City for further information. For an
