(5 . #05-3i35 ALLEN MUNSON, 3165 NORTH SHORE DRIVE, Continued) McMillan stated in March of 2006, the Council expressed some concerns with the encroachment, which is why there is now a question by the Council on why the applicant is currently proposing a six -foot encroachment. · Gaffron stated if the retaining wall is located partially on Mr. Wagener's property and the applicant needs to do some grading on the neighbor's property, it would be necessary for Mr. Wagener to agree to the work on his property. Mr. Wagener requested the applicant stake the area of the fill and the elevation. Wagener stated the wall was done at the request of the City at the time he constructed a garage addition . Wagener inquired whether some additiqnal screening would also be added. Munson stated he is very interested in adding some screening. McMillan inquired whether a requirement for screening should be included in the resolution . Gaffron stated language could be incorporated in the resolution regarding the grading and fill as well as a requirement for additional landscaping. McMillan requested that the landscaping be worked out between the neighbors and not inc luded in the resolution. McMillan moved, Murphy seconded, to amerid the motion to include language in the resolution regarding the placement of the fill to be a minimum of one foot below the height of the retaining wall, with some fill being placed within five feet of the lot line and possibly extending onto the adjoining property, subject to the approval of Mr. Wagener. Representing Staff were Planning Director Mike Gaffron, Planner Evelyn Turner, and Recorder Jackie Young . Council Members Murphy and White were present. Bremer moved, Rahn seconded, to recommend approval of Application #06-3244, Re -Creations, Inc., 3925 Cherry Avenue, granting of a lot area variance subject to the grading and site plans being revised to address the issues outlined in the City Engineer's report, and further subject to the understanding that no other variances will be granted for redevelopment of the property. Gaffron stated the applicant is requesting approval for a nine -unit residential development on this forn1er New Horizons daycare site. The prope1ty is the subject of a Comprehensive Plan amendment to allo w density o f approximately 1.4 units per dry buildable acre, where the cunent density maximum is 0.5 units per acre. Gaffron noted this application cannot be formally acted upon until the Metropolitan Council takes action on the Comprehensive Plan Amendment allovving development of the site at urban densities. Propos ed amendment language was approved by the City Council on August 28 and forwarded to the Metropolitan Council on October 10 , 2006. The Metropolitan Council has not ye t taken action on the amendment, pending receipt of comments from neighboring citie s and jurisdictions. Staff brought the initial application to the Plannin g Commission in August as a concept plan to allo,v an oppo1iu11ity to identify potential concerns, issues, and development parameters that the applicant should address. The City Engineer also submitted comments in August. The applicant has submitted revi sed plans responding to those comments. Gaffron noted the City of Long Lake has not yet recei ved an agreement with the developer regarding sewer and water. All associated grading and drainage, including culverts, if necessary, should also be shown . A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE Section 78-350 FILE No. 06-3244 WHEREAS, Re-Creations, Inc, a Minnesota Corporation, (hereinafter "Owner") is the owner of the property located at 3925 Cherry Avenue within the City of Orono (hereinafter "City") and legally described as: Lots 1, 2 and the east 10 feet of Lot 21, Hickory Hill Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the Owner has made application to the City for a lot area variance to Municipal Zoning Code Section 78-350 to allow construction of a house on a lot that is 0.39 acre when 0.5 acre is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on November 20, 2006, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #06-3244 2. The property is located in the LR-IC zoning district, where 0.5 acre acre is the minimum lot area and 100 feet is the minimum lot width. The property is approximately 0.39 acre in area and 119 feet in width. 3. The Planning Commission reviewed this application on November 20, 2006 and on a vote of 4 -0 recommended approval of the variance, based on the following findings: a. The lot was created before there were subdivision regulations. Page 1 of 4 b. Prior to last year a house had existed on the property since 1958. c. There is no adjacent property the applicant could acquire to enlarge the lot. d. There are numerous similarly sized lots with similarly sized houses in the immediate vicinity of this property so the proposed house would not be out of character with the surrounding area. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the owner, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a house on a lot that is 0.39 acre when 0.5 acre is required, subject to the following conditions: 1. Council approval is based on the site and house plans submitted by the Owner and annotated by City staff, attached to this Resolution as Exhibits A. and B. Any amendments to these plans may require further Planning Commission and City Council review. 2. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be exercised by obtaining a building permit Page 2 of 4 for the new construction before November 27, 2007 or the variance will expire on that date. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Owner has read, understood and hereby agreesto the terms of this resolution and on behalf of its successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. City Engineer's Report Background This property is actually two lots and part of a third lot in the Hickory Hills addition, which was platted before there were subdivision regulations in Orono. The previous house on the property (built in 1958) was demolished last year. The property drops about 14 feet from the northwest comer to the southeast comer. The proposed house would face Cherry Place ( as did the previous house). It would be two stories with an attached two-car garage and a basement under the entire structure. It would be a FILE #06-3244 November 20, 2006 Page 2 of 3 walkout on the south side (opposite Cherry Avenue). Fill would wrap around the east side of the house from Cherry A venue, reducing the amount of exposed basement wall. Access would be from Cherry Avenue (near the top of the slope) with the garage doors facing the west lot line. Hardship Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. The proposed basement floor elevation is 952 .3 . Six feet above would be 958.3. A code change is proposed that would change the definition of basement to measure six feet down from the floor above . The survey does not indicate the elevation of the first floor. If it were 962.3 then 50 percent of the perimeter of the basement floor would have to be below the existing 956 .3 . The basement is still a story under that definition but it comes closer. You may use the proposed definition but the request could not be considered by the Planning Commission until the change has been approved by the City Council.
