HomeMy WebLinkAbout#06-3244 Expired Resolution 5545CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. _ __.5.,_,5__..4 ..,.....5 - A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE Section 78-350 FILE No. 06-3244 WHEREAS, Re-Creations, Inc, a Minnesota Corporation, (hereinafter "Owner") is the owner of the propeliy located at 3925 Cherry Avenue within the City of Orono (hereinafter "City") and legally described as: Lots 1, 2 and the east 10 feet of Lot 21, Hickory Hill He1mepin County, Minnesota (hereinafter "the property"); and \-VHEREAS, the Owner has made application to the City for a lot area variance to Municipal Zoning Code Section 78-350 to allow construction of a house on a lot that is 0.39 acre when 0.5 acre is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Conunission held a public hearing on November 20, 2006, at which times all persons desiring to be heard concerning this application were given the opp01iunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Mi1mesota: FINDINGS 1. This application was reviewed as Zoning File #06-3244 2. The prope1iy is located in the LR-lC zoning district, where 0 .5 acre acre is the minimum lot area and 100 feet is the minimum lot width. The property is approximately 0.39 acre in area and 119 feet in width . 3. The Plaiming Commission reviewed this application on November 20, 2006 and on a vote of 4 -0 recommended approval of the vari ance, based on the following findings : a. The lot was created before there were subdi v ision regulations. Page 1 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 5 4 5 b. Prior to last year a house had existed on the property since 1958. c. There is no adjacent prope1iy the applicant could acquire to enlarge the lot. d. There are numerous similarly sized lots with similarly sized houses in the immediate vicinity of this property so the proposed house would not be out of character with the sunounding area. 4. The City Council has considered this application including the findings and recommendation of the Pla1ming Conunission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. ' 5. The City Council finds that the conditions existing on this prope1iy are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the owner, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a house on a lot that is 0.39 acre when 0.5 acre is required, subject to the following conditions: 1. Council approval is based on the site and house plans submitted by the Owner and am1otated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to these plans may require further Plaiming Commission and City Council review. 2. Authorities granted by this resolution run with the property not with the owner, but are permissive only and must be exercised by obtaining a building pe1111it Page 2 of 4 CITY of ORONO RESOLUTION OF THE f l v4cf UNCIL NO. for the new construction before November 27, 2007 or the variance will expire on that date. 3. Violation of or non-compliance with any of the teims and conditions of this resolution shall constitute a violation of the zoning code, shall automatically te1minate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Owner has read, understood and hereby agrees to the terms of this resolution and on behalf of its successors and assigns, hereby agree to the recording of this resolution in the chain of title of the propetiy.
