To approve the partial vacation of the 14' alley as originally
proposed by applicant subject to the findings and conditions set forth in
the copy of the resolution enclosed herewith. Two copies of the drainage
and utility easement have been enclosed for your execution. Please see
that the appropriate legal description describing the 10' drainage and
utility easement along the south and east side of the property is
completed. The vacation resolution will be filed as soon as the City is in
receipt of a fully executed drainage and utility easement to be filed
against the chain of title of the property.
If you desire certified copies of the official Council minutes, they
are available from the City Clerk after review and approval by the City
Council.

Barbara Fleischman was present.
Bernhardson provided a brief explanation of the Fleischman's
application, noting that the Planning Commission recommended
approval.
It was moved by Butler, seconded by Goetten, to adopt
Resolution #2982, granting a side and rear setback Variance to
construct a deck. All voted aye. Motion passed.

VACATION-RESOLUTION #2983
Jeff Johnson was present for the review of his application.
Bernhardson reviewed the information outlined in Jeanne
Mabusth's June 12, 1991 memo pertaining to this a~plication.
Mabusth added that there were no concerns raised by any of
the neighboring property owners . One of the owners did attend
the Public Hearing on this matter to question how the vacation
will impact her property. Mabus th also noted that the Park
Commission did not address this application, in terms of a future
bike trail, at their last meeting.
Jeff Johnson explained his reason for requesting the
Vacation. He stated that he would have either had to apply for a
Variance or a Vacation in order to construct a deck onto his
home. He believed the Vacation to be a more sensible approach.
Johnson stated that, in his opinion, the Vacated alley would not
provide a suitable area for a bike trail because of the wetlands
in the area. He commented that he would like to have Council act
on his application with as little delay as possible.
Mabusth noted that it is a policy of the City to have the
Park Commission review land that is the subject of a Vacation or
subdividing, prior to either occurring.
Mayor Peterson and Jabbour thought it would make sense to
have the entire alley vacated at once.
Mabus th explained that if such were the case, it would be
necessary for the City to approach each property owner to secure
any easements, and that could be a costly process.
Jabbour stated that it is not possible for anyone to walk or
ride through the alley area, and that he would prefer to see it
remain that way.

VARIANCE-RESOLUTION #2984
Elaine Pagonis was present.
Bernhardson reviewed the issues involved with Ms. Pagonis's
application for a hardcover Variance to construct two decks in
the 75-250 foot zone. He noted that the Planning Commission had
recommended approval of this application.
Gaffron referred Council to paragraph one under
"Conclusions, Order and Conditions" within the proposed
resolution. He asked if the paragraph should not be deleted in
light of recent Council action calling for more definition to an
ordinance amendment allowing the use of non-woven permeable
fabric.
Jabbour suggested omitting the paragraph entirely because
Council has not formally acted on the ordinance amendment
allowing the use of fabric. He suggested that Staff may wish to
advise Ms. Pagonis to put any landscaping projects involving the
use of non-woven fabric on hold until final Council action is
taken.
It was moved by Jabbour, seconded by Butler, to adopt
Resolution #2984, granting a hardcover Variance to construct two
decks within the 75-250 foot zone, as amended deleting paragraph
one on page three of six. All voted aye. Motion passed.

REQUEST FOR SINGLE ACCESS TO NEW BUILDING SITE
Curtis Green was present.
Bernhardson informed Council that Mr. Green is seeking
approval of an additional curb cut to access his property from
Watertown Road. He advised that neither the Planning Commission
nor the Park Commission have reviewed this request, as it
pertains strictly to a curb cut. He stated that the proposed
access to the property would encroach septic test sites, and
should Council vote to approve the request, it is Staff's
recommendation that it be subject to written verification that
alternate septic sites exist.
Butler noted that the final plat was approved based on a

Pertinent Ordinance -
Section 10.12 -Vacation of streets, alleys and public
grounds. The application involves the partial vacation of a
14' wide alley within the Crystal Bayview plat. The alley
is unimproved. There is no record of the City's making any
public use of the dedicated alley. As required by both the
Orono zoning code and State Statute, the hearing notice has
been published twice in the local official paper the weeks
of June 3rd and June 10th. As of this date, the City has
received no comments from adjacent neighbors notified within
the 350' radius of the subject property.

Review of Application -
Please review Exhibit G. The application fails to note the
reason for the filing of the vacation petition. In reviewing the
survey, applicant's building envelope is intersected by the 14'
alley. Any attempt to add improvements to the rear or south side
of the house would require setback variances to a rear lot line
defined a 1 ong the north side of the 14' a 11 ey and not to the more
southern portions of the land holdings of the applicant. These
parcels are all legally combined as one homestead. By vacating
the alley, applicant's rear lot line would now be to the most
southern lot line.
Staff has reviewed the partial vacation petition with the
Public Works Director. He notes that at a limited 14' width, the
City has no plans to install a public roadway. The alley does
not provide access to an existing residence (review Exhibit F).
He recommends the vacation and asks that drainage and utility
easements be provided over the vacated portion of the alley.
Gerhardson notes that municipal water will be provided to this
area and that the dedicated alley may serve as suitable area for
the location of future water lines.

Staff has reviewed the pattern of ownership (review Exhibit
F). Staff can confirm that none of the existing residence
achieve access via the alley. Two of the developed properties
own parcels to the north and south of the alley which includes
the subject property. Other lots defined on the key show
separately owned undeveloped lots owned in common ownership that
are located both to the north and south side. As already noted
above, we have received no comments from interested property
owners who wish to join in the vacation. Review Exhibit E, there
is an extensive retention area designated as a wetland area on
the map (review Exhibit E), major portions of which are currently
owned by the City of Orono. The central location of the wetlands
would also place severe limitations on the installation of a
through road within the alley.
City staff had originally considered a total vacation of the
alley until the Public Works Director had expressed an interest
in obtaining easements over the alley for future water lines.
Gerhardson has also asked that the potential vacation be reviewed
by the Park Commission to determine if the area is suitable for a
bike trail. The application will be reviewed by the Park
Commission at their meeting in July (July 2nd). If the Park
Commission finds that the area is suitable for bike trail
development, the City will ask for bike trail easements over the
vacated alley.
Options of Action -
1. Approval based on one or more of the findings noted below.
OR
Approval would be subject to applicant granting drainage and
utility easements over the vacated portion of the 14' alley.
It should be noted that applicant will receive only 7' of
the vacated right-of-way within the west 50 1 of the vacated
alley. Review Exhibit F, the City of Orono will receive the
remaining 7' of vacated right-of-way.
Review of the findings that would support the vacation:
a. Width of right-of-way would not support development
of roadway.
b. Location of designated wetland within right-of-way
of alley.
c. Based on pattern of development and current
ownership there is no use of right-of-way for access
purposes.
d. Public interest can be achieved with the granting
of necessary easements.
2. Denial. Based on certain findings noted above that suggest
a public use or interest in the undeveloped or unused right
of-way.

Additional Comments and Planning Commission Recommendation -
The applicant questioned staff's recommendation to obtain
drainage and utility easements over the vacated alley in addition
to the request for a potential bike trail easement. The
applicant noted the location of an extensive wetland to the
immediate west that would require extensive filling if such a
trail were to be constructed.
As of this writing, the Park Commission has not met to
review the proposed vacation application. Staff will present
their findings at your July 8th meeting.
The City Engineer and staff met out on the site and
concurred that if water lines were to be extended to serve the
area along Cherry Avenue that the east/west route would be Cherry
Avenue as opposed to the 14' alley. The City Engineer has
recommended that 10' drainage and utility easements be granted
along the newly defined south lot line (Exhibit H) and along the
east side of the property to provide for a loop system for the
water lines. By relocating the drainage and utility easements to
south lot line of the property, we would eliminate any additional
restrictions on building envelope.
Staff has drafted the vacation resolution incorporating the
necessary findings from the staff memo on Page 2. The City
Engineer's recommendation has been incorporated in the resolution
as a condition of approval. The resolution may be further
amended upon the final action of the Park Commission concerning
the need for a bike trail easement.

CITY OF ORONO -NOTICE
The Orono Planning Commission will hold a public hearing in
the Council Chambers at 1275 South Brown Road at 8:00 p.m. on
Monday, June 17, 1991 to consider the vacation of a portion of a
dedicated right-of-way legally described as follows:
That portion of a 14' platted alley that abuts the south
line of Lot 3 and the west half of Lot 2: Block 7, Crystal
Bay View, Hennepin County, Minnesota (the South half of
Section 08, Township 117, Range 23).
All persons wishing to be heard will appear at this time.
The meeting starts at 7:00 p.m. Written comments are solicited.
Plans are available for review in the City offices by
appointment.

In accordance with M.S. 15.165, "Rights of subjects of data",
we would like to inform you that your request for a permit or
license from the City of Orono or any of its departments may
require you to furnish certain private or confidential inform
ation. ..
You are notified that:
1. The information you furnish will be used to determine
your qualification for the permit or license requested.
2. You may refuse to supply data, but refusal may require
that the City deny the permit or license.
3. The information may be shared with other local, state
or· federal agencies to the extent necessary to process
the permit or license.
4. If your requested permit or license reqires council
action to approve, some information may become public.
5. You have certian rights under M.S. 15:165 to review
private data on yourself.
6. Your full name, and date of birth are required to process
this application or permit.

RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individuals on whom the data is
stored or to be stored shall be as set forth in this section.
Subd. 2. Iriformation required to be given individual. An. individual asked to
· supply private or confidential data concerning himself shall be informed of: (a) the
purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may refuse or is legally
required to supply the requested data; (c) any known consequence arising from his
supplying or refusing to supply private or confidential data; and (d) the identity of
other persons or entities authorized by state or federal law to receive the data. This.
requirement shall not apply when an individual is asked to supply investigative data,
pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue mav place the notice reauired under this
subdivision in the individual income tax or orooertv tax rerund instructions instead or
on those !orms.
Subd. 3. . Aeeess to data by individual. Upon request to a responsible
authority, an individual shall be informed whether he is the subject of stored data on
individuals, and whether it is classified as public, private or confidential. Upon his
further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge to him and, if he_ desires, shall
Se informed of the content and meaning of that data. After an individual hes been
shown the private data and informed of its meaning, the data need not be disclosed to
him for six months thereafter unless a dispute or action pursuant to this section is
pending or additional data on the individual hes been collected or created. The
responsible authority shall provide copies of the private or public data upon request by
the individual subject of the data. The responsible authority may require the
requesting person to pay the actual c~sts of making, certifying, and compiling the
copies.
The responsible authority shall comply immediately, if possible, with any request
made pursuant to this subdivision, or within five days of the date of the request,
excluding Saturdays, Sundays and legal holidays, if · immediate compliance is not
possible. If he cannot comply with the request within that time, he shall so inform the
individual, and may have an additional five days within which to comply with the
request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not aeeurate or complete. An individual may
contest the accuracy or completeness ·of public or private data concerning himself. To
exercise this right, an individual shall notify in writing the responsible authority
describing the nature of the disagreement. The responsible authority shall within 30
days either: (a) correct the data found to be inaccurate or incomplete and attempt to
notify past recipients of inaccurate or incomplete data, including recipients named by
the individual; or (b) notify the individual that he believes the data to be correct.
Data in dispute shall be disclosed only if the individual's statement of disagreement is
included with the disclosed data.
. The determination of the responsible authority may be appealed pursuant to the
provisions '?f the administrative procedure act relating to contested cases. . ·
