Recitals 1. A zoning application and a building permit application ("applications") have been filed for 3105 Casco Point Road the ("Subject Property"), legally described as Tract B, Registered Land Survey No. 1311, Hennepin County, Minnesota. 2. Owner requests the City to review the applications. 3. The City will commence its review of the applications and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owner shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the project. Eligible expenses shall be consistent with expenses the Owner would be responsible for under a land use application and a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with Zoning Application 09-3437 & Building Permit #2009-00860 if compliance is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without further approval of the Owner to reimburse the City for Eligible expenses the City has incurred. The City shall notify the Owner the Owner of such draw and the nature of the expense for which the reimbursement is being made. If the Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional sums as directed by the City, or the City shall discontinue review and post a Stop Work Order. 4. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owner when the review has been completed and written notification is received from the Owner requesting the funds. 5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn. White asked if th pplicant would be willing to remove those if the City ever de ined they need that piece of land . Schoenzeit noted they ar willing to provide an easement in the back in e hange for using that portion of the right-of-way, and that in is view there is enough land there to ace odate the geothermal wells and the utilities. Murphy stated the idea of allowing eothermal wells within a · ht-of-w ay could po ssibly set a precedent, which is one concern . Murphy comm ded the applicant fo clesigning a house that fits on this lot but that the applicant would be taking a risk at someday he ay need to relocate the geothermal wells if they are located in the right-of-way . McMillan concurred that it would be precedent ng and that she would hate to see the applicant have to relocate the wells at some point in the future. Millan indicated she is okay with the resolution but that she is not in favor of the applicant using e rign of-way even at his own risk. Schoenzeit stated on the other side the drop -off they woul ike to put in some terraced retaining walls to slow the water down to help re uce the erosion and asked whe er that would be acceptable. Kellogg stated normally the~ o not allow structures to be located wif ·n the right-of-way but that he would be willing to sit do with the applicant to discuss their options . Curtis stated the applicants have applied for a lot width variance in order to construct a new residence on an existing lot at 3105 Casco Point Road. A residence has ex isted on the property for a number of years . The applicants ha ve submitted all the required information necessary for a lot width variance review and are requesting that the Council waive the review of the Planning Commission and hold the public hearing tonight. The proposed residence will meet all of the other setbacks, hardcover and lot coverage requirements of the LR-1 C district. The size of the house proposed is consistent with the immediate neighborhood and fits into the lot appropriately . Planning Staff recommends approval of the lot width variance as requested. Staff would also recommend that the Council discuss how to handle lot width and lot area variances for existing l ots of record at an upcoming work session . McMillan moved, Bremer seconded, to waive the review by the Planning Commission and to hold the public hearing at tonight's City Council meeting. Murphy asked why they wo uld want to waive the public hearing at the Planning Commission level. White noted the applicant would like to obtain his building permit in the very near future given the weather and that this is a fairly simple application . McMillan noted there is still an opportunity for public comments on this application. VOTE: Ayes 5, Nays 0. Mayor White opened the public hearing at 9:02 p .m. There were no public comments regarding this application. Mayor White closed the public hearing at 9:02 p.m. Sonnek stated they would like to start digging at the end of December rather than the end of February , which was the reason for the request to waive the review by the P lanning Commission . Sonnek stated they have removed the retaining wall and one of the French ditches , which would help alleviate the water issues. They also plan to construct a shovel bit curb, which will help carry the water down . McMillan moved, Murphy seconded, to direct Staff to draft an approval resolution for Application #09-3437, Kent and Susan Richey, 3105 Casco Point Road . VOTE: Ayes 5, Nays 0. Richey asked whether he can proceed forward with the work now based on the motion . Mattick stated formal approval is given in the resolution and that it is his understanding a building permit would not be issued until the resolution has been signed. Franchot stated as long as there is agreement among all the council members , he would not be opposed to the applicant starting work prior to the ex ecution of the resolution . White moved, Franchot seconded, to authorize Staff to issue the building permit based on the language contained in Stafrs report, with the formal resolution being approved at the January 11 th City Council meeting. Mattick noted the variance needs to be recorded against the property. VOTE: Ayes 3, Nays 2, McMillan and Murphy Opposed. Hardcover in the 0-75' zone shall not increase above the level of 128 s.f. or 2.5%. Hardcover in the 75-250' zone shall be limited to 3,234 s.f. or 25%; hardcover within the 250' -500' zone shall be limited to 3,807 s.f. or 30% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, December 14, 2009 6:30 o'clock p.m. 10. #09-3437 KENT AND SUSAN RICHEY, 3105 CASCO POINT ROAD -PUBLIC HEARING -VARIAN CE Kent Richey, Applicant, was present along with John Sonnek of Charles Cudd DeNovo. Council Exhibit C Curtis stated the applicants have applied for a lot width variance in order to construct a new residence on an existing lot at 3105 Casco Point Road. A residence has existed on the property for a number of years. The applicants have submitted all the required information necessary for a lot width variance review and are requesting that the Council waive the review of the Planning Commission and hold the public hearing tonight. The Council may waive Planning Commission review with a unanimous vote. The property consists of 30,625 square feet, which exceeds the acreage requirement. The proposed residence will meet all of the other setbacks, hardcover and lot coverage requirements of the LR-IC district. The size of the house proposed is consistent with the immediate neighborhood and fits into the lot appropriately. Planning Staff recommends approval of the lot width variance as.requested. Staff would also recommend that the Council discuss how to handle lot width and lot area variances for existing lots of record at an upcoming work session. Murphy asked why they would want to waive the public hearing at the Planning Commission level. White noted the applicant would like to obtain his building permit in the very near future given the weather and that this is a {ai~ly simple application. Mayor White closed the public hearing at 9:02 p.m. Sonnek stated they would like to start digging at the end of December rather than the end of February, which was the reason for the request to waive the review by the Planning Commission. Sonnek stated they have removed the retaining wall and one of the French ditches, which would help alleviate the water issues. They also plan to construct a shovel bit curb, which will help carry the water down. The City is willing to commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owner shall deposit $), $0&. ~ P with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will incur in meeting with the Owner, reviewing the plans, and preparing agenda packet material for City Council review of application # ()4 -3Y.'3l . Eligible expenses shall be consistent with expenses the Owner would be responsible foruriEer a zoning an subdivision application. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without further approval of the Owner to reimburse the City for eligible expenses the City has incurred. The City shall notify the Owner of such draw and the nature of the expense for which the reimbursement is being made. If the Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional sums as directed by the City, or the City shall discontinue all review. 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owner when the review has been completed. 6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn.
