Alverson, County Auditor and Treasurer Deputy 13 Pkg ID 602868 Doc Name: Resolution Document Recording Fee Document Total Existing Certs 1314242 This cover sheet is now a permanent part of the recorded document. $46 .00 $46 .00 New Certs CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 9 Q] A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-350 (B) FILE NO. 09-3437 WHEREAS, Kent Richey and Susan Richey, husband and wife (hereinafter "the applicants") are the owners of the prope1iy located at 3105 Casco Point Road within the City of Orono (hereinafter the "City") and legally described as follows: Tract B, RLS no. 1311, Hennepin County, Minnesota (hereinafter the "prope1iy"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-350(B) to allow redevelopment of a lot with 59 feet in width at the OHWL and 65 feet in width at the 75-foot setback from the OHWL where 100 feet in width is nornrnlly required in order to construct a new residence. No,v, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application ,vas reviewed as Zoning File 09-3437. 2. The property is located in the LR-1 C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 21,780 square feet (0.5 acre) and a minimum lot ,vidth of 100 feet. 3. The City Council revie,ved this application at a public hearing held on December 14, 2009 and approved the lot width variance based on the following findings: a. The prope1iy contains 30,625 s.f. in area and has 59' in ,vidth at the OHWL and 65' in width at the 7 5' setback. b. The lot is substandard in width and a residence has existed on the property for many years. Page 1 of 4 CITY of ORONO RESOLUTION OF THE CITY CQUNCI L NO. 5 9 0 ] c. There is no additional land available to bring the lot width or lot area into confom1ity. d. The proposed residence meets the structural lot coverage limitation of 15%. e. The proposed residence complies with all lake yard, side yard, rear (street) yard, and average lakeshore setback and hardcover requirements. 4. The City Council has considered this application including the findings and recommendation of the Plaiming Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this prope1iy are peculiar to it and do not apply generally to other prope1iy in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring prope1iy; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial prope1iy right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-350 Subdivision B to allow redevelopment of a lot with 59 feet in ,vidth at the OHWL and 65 feet in width at the 75-foot setback from the OHWL where 100 feet in width is normally required in order to construct a new residence, subject to the following conditions: 1. Council approval is based on the survey and building plans submitted by the applicants and am1otated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the site plan which are not in conformity ,vith City codes will require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 128 s.f. or 2.5%. Hardcover in the 75-250' zone shall be limited to 3,234 s.f. or 25%; hardcover within the 250' -500' zone shall be limited to 3,807 s.f. or 30% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any future Page 2 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 9 Q ] requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concun-ent reduction in existing hardcover. 3. ADDITIONAL SURVEYS REQUIRED: a. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building pennit, stonnwater management, grading and drainage plans shall be submitted prior to the issuance of a Certificate of Occupancy for the residence. 4. The building plans submitted for building pennit will be reviewed to ensure compliance with the City's building height and number of stories regulations. 5. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their penneability as non-hardcover surfaces. 6. Required removals of existing structure and hardcover to be removed shall be completed prior to the footing inspection. 7. Authorities granted by this resolution run with the property not ,vith the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance ,vill expire on that date (January 11, 2011). 8. Violation of or non-compliance with any of the tem1s and conditions of this resolution shall constitute a violation of the zoning code, shall automatically tem1inate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned applicants have read, understand and hereby agree to the tenns of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
