ZONING ADMINISTRATOR'S REPORT: 11222 JAN WAYE 1885 CONCORDIA STREET AFTER THE FACT CONDITIONAL USE PERMIT RESOLUTION 12433 TODD WATERS ASCO POINT ROAD Applicant Phyllis Waye was present for this matter. City Administrator Bernhardson stated this application is an after-the-fact conditional use permit for installation of various items to retain a fairly steep bank after the July 23rd storm. The restoration consists mainly of large boulders set into the landscape plus rip-rap. Mrs. Waye requested that the completion date be changed due to the fact that some of the materials are not av a i 1 ab 1 e at th i s t i me and because of the complexity of the work. It was moved by Councilmember Sime, seconded by Mayor Grabek to adopt Resolution #2433 amending Item #7 to read, resotration shall be completed by a date to be determined by staff. Motion, Ayes 5, Nays 0. RE ST TO AMEND COUNCIL DIRECTIVE OF RESOLUTION 12292 Mr. Waters was present for this matter. City Administrator Bernhardson stated this is a request by Mr. Waters to erect a retaining wall to maintain a walkout without having to go back and raise the house and redo the basement wall in order to eliminate the walkout. The retaining wall would be out from the foundation wall 8 feet and out as far as the original house line. This was tabled at the last Council meeting on a 4-1 vote. Related to this matter is Item #14 on tonight's agenda, which is the feasibility report of the storm water ponding. There were three options presented by Engineer Cook. The iirst option was the re­ installation of the current 8 inch pipe. This would necessitate an overflow put in across an abutting property owners yard. Option 2 is the installation of 10 inch pipe, the overflow could be put in, but it was not mandatory. Option 3 is the installation of an 18 inch pipe, which would necessitate no overflow. 7 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD MAY 23, 1988 11129 TODD WATERS CONTINUED fl262 CURT HAGFORS Mr. Waters stated he would prefer to do the work privately. He stated the original pipe was an 8 inch pipe which ran under the original old house and does not feel an 8 inch pipe will be adequate. Waters asked if the City would provide the engineering for the project and the property owners would take care of the project. He also requested an extension of time from June 15 to July 15. Mayor Grabek stated he felt the Council would be amiss to pay for the engineering of this project and was not in favor of extending the deadline date. Mr. Dennis stated that the ponding area was decreased because of a larger house being built but other factors such as the houses to the north have increased hardcover. He stated he will have to go to Court and put a restraining order on the Waters' property. He stated he has spent a lot of money to raise his house up 2 feet and the water keeps rising. It was moved by Mayor Grabek to have the property owner return the property to its original condition. Motion failed for lack of a second. Administrator Bernhardson stated that in the original resolution Waters was to put back the 8 inch pipe. Most of the restoration is near the house, but within the 0-75' zone, the Council may consider a 10 or 18 inch pipe and whether it is done privately or publicly. It was moved by Mayor Grabek to table this time. Motion failed for lack of a second. It was moved by Councilmember Sime, seconded by Councilmember Goetten to approve the regrading, allowing the retaining wall 8 feet from the house along the lakeside, the installation of a 10 inch drain pipe at the expense of Mr. Waters and grant an extension of time to July 15, 1988 for complete restoration. Motion, Ayes 4, Nays 1. Mayor Grabek voted nay. 1412 BALDOR PARK ROAD REQUEST FOR AMENDMENTS TO PREVIOUS VARIANCE APPROVAL Mr. Hagfors was present for this matter. Administrator Berhnardson reviewed this application for Council. 3iace his previous appearance before 8 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD MAY 9, 1988 PUBLIC COMMENTS CONTINUED In reference to a report that the Orono Police are investigating the shooting of a dog, Mr. Hollander felt that the Police Dept. has not followed up on his missing cat which he believes his neighbors are involved in. Mayor Grabek directed Chief Kilbo to provide a written response to Mr. Hollander on this matter. ~ ADMINISTRATOR'S (~TODD WATERS 3061 CASCO POINT ROAD FINAL SITE PLAN REPORT: City Administrator Bernhardson explained the status of the required restoration of the lakeshore property at 3061 Casco Point Road. Applicant has submitted a final restoration site plan per Council direction, however applicant requests reconsideration by Council regarding the fill adjacent to the house. He noted that the storm sewer study project is pending a signed agreement from the applicant regarding the costs of the study, which is anticipated to be resolved in the next few days. Todd Waters was present for this matter and explained proposed final site plan. He noted the proposed hardcover trade-off of a pre-existing double retaining wall (which served as a window box) into two separate retaining walls, one of which in a different location. Regarding the fill adjacent to the house, if this is required the house would need to be raised 4-6" which may cause structural damage to the house, therefore, asks for reconsideration of requiring the fill and approval of the alternative site plan as proposed. City Engineer Cook concurred that placing the fill adjacent to the house would require the house to be raised in order to put in the concrete wall, which presents the potential for structural damage to the house. Councilmember Goetten asked City Engineer Cook when the storm sewer study will be done, and voiced concern on how the applicants proposed amendment, if approved, would impact the drainage in the study. City Engineer Cook stated that the study should be completed in two weeks. He stated to some extent the proposal will impact the drainage. 3 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD MAY 9, 1988 11129 WATERS CONTINUED Councilmember Goetten felt that this matter should be tabled until the May 23rd Council meeting pending the completion of the study. Mayor Grabek asked if this matter is in litigation? Mr. Waters stated that he has decided not to legally pursue the matter and wants to solve the matter between the Council, staff, and himself as soon as possible. Mayor Grabek stated that he felt applicant should be required to fill in the dirt and alter the foundation because of what was done to the lakeshore. Councilmember Sime felt that Mr. Waters has tried everything he can to rectify his mistake and would be a tremendous hardship to raise the house, therefore, feels that the proposal is a reasonable compromise following the intent of restoring the land as it was. He would be in favor of Mr. Waters' proposal. It was Councilmember Callahan's understanding that the proposal is in the area of where the catch basin is likely to be and also felt the study should be done prior to taking action. It was moved by Councilmember Sime, seconded by Councilmember Callahan, to table Application #1129 until the May 23, 1988 Council meeting. Motion, Ayes 4, Nays 1. Mayor Grabek voted nay. Because applicant planned to replace the existing foundation, Planning Commission recommended that the house be moved back to make it more conforming. Mr. & Mrs. Todd Waters were present for this matter. Mr. Waters clarified to staff and Council that they proposed to move the existing house to another location in Mound, and build an entirely new house. He outlined the three issues: 1. Hardcover variance in the 0-75': the existing house consists of 7 .1 % hardcover in the 0-7 5', proposal consists of 5.5% hardcover in the 0-75', a reduction of what currently exists. He noted that because of the the downhill slope, if the house were moved back any further, they would lose their view of the lake. 2. Average Lakeshore setback variance which is more restricted because of one of the adjacent houses sits relatively far back from the lakeshore. 3. In order to properly locate the new house they must relocate the sewer line at their expense, and the costs and feasibility of that reloaction are a factor in the proposed house location. Councilmember Goetten felt that variance requests for an existing structure is a different issue than considering variances for a complete new structure, where the new structure could conform. Mr. Waters stated that the house was basically custom designed to fit the lot and to take advantage of the best lake views. Mayor Grabek stated that he felt the City was gaining because there will be less encroachment with the new house than what currently exists, and that by rights applicant could re-build on existing foundation. Councilmember Sime concurred with Mayor Grabek. It was moved by Councilmernber Sime, seconded by Mayor Grabek, to adopt Resolution #2172 approving the variances as proposed. Motion, Ayes 4, Nays 1. Since applicant is going to put a new foundation under existing house, Planning Commission recommended approval subject to moving the house eastward 8 1 so the 8' deck will be no closer to the lake than the existing house, and will result in no hardcover increase but will likely decrease to 5.5% in the 0-75' zone. There will, then, be a slight increase to 33.1% in the 75-250', which drains mainly to the east away from the lake. Planning Commission also found that the visual encroachment caused by the structure in the average setback area is not significant given the existing vegetation and sight lines. Planning Commission recommended approval as follows: 1. Move house back 8 1 so that there is no additional encroachment towards lakeshore in 0-75' zone. 2. Maximum 0-75' hardcover allowed 7.1%. 3. Maximum 75-250' hardcover allowed 33.1%. 4. Sewer line to be relocated by applicant subject to City approval of plans and installation. 5. Average lakeshore setback variance approved. MINUTES OF THE PLANNING COMMISSION MEETING HELD APRIL 20, 1987 11126 GEHRMAN CONTINUED Robert Gehrman was present for this matter and stated that the proposed location of the deck would be less obtrusive to neighbors than if relocated on the southwest. No one was present from the public regarding this matter and the public hearing was closed. It was moved by Taylor, seconded by Chairmain Kelley, to recommend approval of the side setback variance as proposed subject to applicant put on notice that no additional variances will be granted on the west side. Assistant Zoning Administrator Gaffron explained applicants requests for variances involved in demolishing the existing residence and build a new residence expanding the existing foundation. Variances requested as follows: a) Hardcover 0-75' - existing= 7.1% proposed= 12.3% (variance of 12.3%) b) Hardcover 75-250' - existing= 28.1% proposed= 30.4% (variance of 5.4%) c) Lake setback - existing= 50' proposed= 54' (variance of 21') Additions in 0-75' zone consist solely of deck. Average lakeshore setback encroachment of existing house is about 46'. The proposed porch also has about 46' encroachment, but would result in about a 10 degree reduction in views from the southerly property house that is back about 160' from the lakeshore. Applicant is also requesting to relocate sewer line that currenly bisects the property. The Public Works Coordinator and City Engineer have reviewed the proposed relocation and both agree that it is feasible to relocate line. The work will be done privately at applicant's expense. Planning Commission suggested that the entire house be moved back 8' (the most it could possibly be moved back due to topography) which would reduce amount of 0-75' hardcover to 5.5%. Applicant's propoerty is located in the S­ acre district requiring 50' side setback. Staff suggested the possibility of locating the deck on the southwest corner in order to reduce variance request. Motion, Ayes 6, Nays 0. 11131 GUENTHER NOELTING 1060 TONKAWA ROAD CONDITIONAL USE PERMIT/VARIANCE PUBLIC HEARING 10:29-10:31 The Affidavit of Publication and Certificate of Mailing was noted. Present for this matter were Guenther and Gertrud Noelting and their agent, Neil Weber. Zoning Administrator Mabusth noted a petition signed by many of the neighbors in support of the application. She further explained that the applicants installed a permanent dock with pilings in 1984 which was destroyed with ice break up of last season. The Noeltings wish to build a new permanent dock that is anchored or tied into the adjacent lake bank. The process of ins ta 1 ling the three 24' length ties into the bank requires excavation within 75 feet of the lakeshore. The code requires a conditional use permit/variance permit for such a dock. Johnson voiced concern with proper erosion controls due to the extensive excavation. Discussion: The Public Works Coordinator and City Engineer have reviewed the proposed relocation of the sewer line that currently bisects the property They both agree that it is feasible to relocate the line. The applicant would have to provide the City with full engineering designs for approval and "as-built" drawings upon completion. The work would be done privately at the applicant's expense. Applicant would need to obtain a temporary construction easement from the neighbor to the south, and would likewise have to provide to the City a 20' permanent access and utility easement centered on the new pipe location. Zoning File #1129 April 14, 1987 Page 2 of 2 The proposed addition more than doubles the size of the existing house, with removal and relocation of extensive portions of the driveway, for a net 75-250 1 increase from 28.1% up to 30.4% hardcover. I would note that most of that hardcover drains to the east away from the lake. The approximate drainage break is shown on the survey (Exhibit F). In the 0- 75' zone, the existing hardcover consists mostly of the existing house, and there is a good potential to direct roof run-off from the entire house towards the rear. The proposed deck in the 0-75' zone will not cause any view encroachment, especially if it is kept at ground level, but is considered as hardcover that likely will drain toward the lake, although this is in a relatively flat plateau so that run-off rates will be slowed. Applicant should address the need for this deck and present any hardships that justify its approval. The view lines from the neighboring house to the south would be encroached upon by about 10° (see Exhibit F), mainly because that house sits relatively far back from the lakeshore. That 10° area also is currently partially screened by existing trees. The neighboring owners are aware of the proposal but have not commented as of this writing. Staff Recommendation: Staff feels that the increase in 75-250' hardcover from 28.1% to 30.4% is not a major problem because virtually all of the 75-250' zone drains away from the lake. The 0-75' deck addition is harder to justify given the drainage toward the lake and given previous Council denials or only partial approvals of similar requests in this case, the only justification is the location of the existing house. The average lakeshore setback variance should logically be reviewed not in terms of feet of encroachment past the average setback line, but in terms of actual encroachment on neighboring views, given the intent of that ordinance. Is the view encroachment significant? Your recommendation for approval or denial of all or parts of the request should include the hardships or lack of hardships that support your recommendation.
