� A RESOLUTION TO AMEND THE .
COIVIlVIERCIAL SITE PLAN APPROVAL PREVIOUSLY GRANTED
� VIA RESOLUTION NO. 2229
FILE NO. 1882
WHEREAS, pursuant to commercial site plan and building plan application file
� #958, the City Council adopted Resolution No. 2229 on July 27, 1987, granting a conditional
use permit per Municipal Code Section 10.40, Subdivision 4 (B), variances to Section 10.40,
Subdivision 6 (E) and a variance to Section 10.61, Subdivision�10 and approved a commercial
site plan and building plan application per Section 10.40, Subdivision 2 for the properry at 2420
Shadywood Road which is legally described as follows:

Unplatted 20 117 23: Commencing at a point in North line of Section 20 distance
1,761.42 feet East from North 1/4 comer thereof thence South at right angles to a point
• in Southerly line of County Road No. 15 thence East along said road line 49.58 feet
thence on a tangential curve to the left having a radius of 841.51 feet distance 265.42
� feet thence South 23 degrees 10 minutes West to center line of County Road No. 19
thence Northwesterly along said center line to North line of Govemment Lot 1 tYience
East to beginning except road Section 17 and 20; Hennepin County, Minnesota. .
� (hereinafter "property"); and � .
WHEREAS, Resolution No. 2229 approved a site plan referenced as drawing
number 85-018 revised 6/30/87, which plan indicated a fire lane across the front of the building,
such fire lane being approximately 14' in depth and 64' in width; and which fire lane was
required in Condition #3 of said resolution'to be posted as a "Fire Lane"; and
� � WHEREAS, said fire lane was never physically marked by striping or yellow
curbing but was posted with a single portable sign; and .
WHEREAS, due to increased activity at the site the City. directed the properry
owner, John O'Sullivan (hereinafter "the applicant"), to stripe the fire lane per the 1987
referenced plan, which resulted in the applicant filing application#1882, a request to amend the
commercial site plan review to eliminate the fire lane; and .

WHEREAS, on November 8, 1993 the applicant arid the City �agreed to an
amended plan for the location, dimensions, and delineation and permanent marking of a fire lane
at the front of the building.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, .
Minnesota that the commercial site plan approval granted in Resolution No. 2229 is hereby
amended as follows:
� 1. � The site plan referenced as "85-018 revised 6/30/87" is amended by eliminating
the 14' x 64' fire lane and replacing it with the fire lane plan attached to this
resolution as Exhibit A. � �
� 2. The fire lane shall be marked as follows:
a. The curb shall be painted yellow between the outer edges of the two
• doorways.
b. Signs shall be mounted adjacent to the outside of the doors, flush with the -
building and located approximately 3' in height, with arrows pointing
- towards the opposite door, and indicating "No Parking - Fire Lane".
� c. The existing portable sign shall continue to be placed on the pavement
midway between the two entrance doors.
. 3. Diagonal striping of the pavement will not be required, but the City reserves the
right to review this in the future if the Police Chief deems it necessary. �
4. Enforcement of the fire lane shall be per items 2, 3 and 4 of Police Chief Stephen •
Sullivan's memo to all officers dated 9/1/93, attached to this resolution as Exhibit
B.
5. All other requirements and conditions of Resolution No. 2229 shall remain in
effect. �

6. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by compliance with the above
conditions no later than January 1, 1994, or the special conditions of this .
resolution will expire on that date.
7. Violation of or non-compliance with any of the terms and conditions of this �
resolution shall constitute a violation of the Zorung Code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
8. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the chain of title of the
property.
Adopted by the Orono City Council on this 22nd day of November, 1993.

resolution. Therefore, it is a valid fire lane. This memo is
intended to clarify our policy.
