Please get out to this site. Downey will argue that this is the
only location for the garage to insure neighbor's continued privacy
and view of the lake. Staff ca> >ot see how moving the garage 10'
closer to the road will interfere with neighbor's privacy or
block view of Carmans Bay. if the garage doors were to face onto
the street, the gravel area would be needed to provide for a much
needed turnaround.
Staff recommendation:
You must require at least tha 3' side setback. If you are convinced
the doors can face onto street, require at least a portion of the
gravel area to remain as turnaround. To be consistent, staff must
recommend that the doors faca away from road.

Mr. Douglas Flint was present representing the VARIANCE
Home Builders of Wayzata application for a 3545 Ivy Place
variance at 3545 Ivy Place. Skip .Iewett of 4706
3545 Ivy Place was also present. Home Builders of
Wayzata
Staff reviewed Resolution 1762 for Mr. Klint
noting that Council approved this resolution that
abated all special assassments for Lots 184 and
part of Lot 185 and declared the subject property
unbuildable.
Rovegno advised Klint that there may have been
additional Council direction to the applicant at
the time of the earlier review but that this was not
apparent in t.e review of the many axhibits included
in this current application. The applicant has
presented sufficient evidence that he has ex,.austed
every possible means of obtaining Tract V but that
Council would be the best body to relate to the
implications of that earlier review and the new
finding that Tract V will remain a vacant lot.
Rovegno moved. Goetten seconded, to deny the
variance request of Home Builders of Wayzata for
3545 Ivy Place, for the following reasons:
1. Lot is severely substandard in width and area.
2. Excessive hardcover variance in consideration of
area excluded with traveled portion of the road.
3. Substandard lakishore width.
4. Knowledge on the part of the current owner of
all of these limitations prior to purchase of
property.

for a variance for Charles Downey, 2665 Casco Point 2665 Casco Point Rd.

that if he were to relocate the new
garage as staff suggested, that he would lose the
use of his entire backyard and that his neighbor's
rear view of the lake would be ruined.
Staff, once again, advised both applicant and
Planning Commission that locating the detached
garage 10' off the right of way with garage doors
facing away from th^ street providing adequate
turnaround on the property is consisten* with
previous Council policy. The only time Council has
waived from this request way in cases involving
properties served by deadenu roads or on cul de sac

Rovegno noted for the record that this is meroly 'VARIANCE

development.
Downey stated that his neighbor, Hartwell, was l
allowed to rebuild his garage with a substandard
street setback and doors facing onto road.
Mabusth noted that this was a case of an add -on
stall to an existing garage. Downey stated that
his neighbor built an entirely new garage with all
existing substandard setbacks.
Mabusth noted for the record that had she been made
aware at the tine of construction, the owner would
have been advised of the need for a new zoning
review.
McDonald moved, Rovegno seconded, to approve the
request of Charles Downey, 2665 Casco Point Road,
for a variance, based on the following findings:
1. Consistent with surrounding pattern of development
2. Reduce hardcover
IN 3. No additional land available
4. Owner would lose entire backyard
Such approval is subject to the following conditions:
1. Side setback must be at least 3' from the
property line.
2. Street/front setback approved at same setback
line as existing garage 20.81.
3. Doors may face out to street.

The Planning Commission voted unanimously to recommend approval of the

Mr. Downey was present to discuss his variance
application. Discussion included hardcover
and turnaround in addition to the placement of
the garage.
Acting Mayor Butler moved, Hurr seronded, to
approve Charles Downey's, 2665 Casco Point Road,
hardcover and street, front, and side setback
variances to permit the construction of 3 new
detached garage as follows:
1. H3rdcover variance for additional hardcover
of 31 or 260 sq. ft.
2. A side setback of 1.8'.
3. Front/street setback to be determined by
staff. Building Inspector has confirmed a
setback of 3' from oak tree.

City Engineer Cook reviewed with the City Council
the bid tabulations for the 82-1 and 82-2
improvement projects stating that Nodland
Associates were the low bidder for the sewer and
water project and that Valley Paving is the low
bidder for the street project. Engineer Cook

for the sewer and water project.

sale for the October 25, 1982 Council meeting.

Zoning Administrator Mil, rah requested the City
Council to g ive her direction concerning the need
to extend the letter of :redit with a deadline
date of November 1, 1982, that assures the
connection of the existing Olson residence to
City sewer for the Tonka Lake Properties at 1340
Baldur Park Road. Mabusth advised the
developer's representative, John Nord, tha'_ she
would discuss this matter with the City Council
and that Mr. Nord need not be in attendance.
Mabusth explained that there may be a need to
acquire utility easements thrnuoh Lots 17, 18,
and 19 and that the developer could not be certai.c
of obtaining such easements to mee' t1.a November
1, 1982 deadline date.
Acting Mayor Butler moved, Frahm seconded, to
direct staff to advise Tonka Lake Properties of
the need to submit a new 1^tter of credit.
