Cheryl Kachenmeister, property mvner, was present .
Kelley stated he would like clarification on whether all of the plastic underlayment required to
be removed as part of a previous application has been removed .
Weinberger stated that the Resolution approved in 1993 required removal of portions of the plastic
underlayment, which has been removed . The Resolution before the City Council at this time
requires that the remainder of the plastic underlayment be removed .
Kelley moved, Sansevere seconded, to approve and adopt RESOLUTION NO. 4355,
3035 Casco Point Road, a Resolution Granting Variances to Permit Extension of Eaves
Located on One Side of the House, and Variances to Hardcover in the 75-250' setback,

Mayor Jabbour stated that a mayors' meeting is scheduled for Wednesday in which the Sheriff will
be addressing them regarding the issue of patrolling Lake Minnetonka and crime prevention.
Mayor Jabbour inquired on the progress of the Navarre Park.
Gappa stated that he presented a preliminary concept plan to the Parks Commission and that he
has discussed the issue of trails with the adjoining property owner, who has indicated she is in
support of this project. Gappa stated they are looking at purchasing play equipment similar to
what has been installed at Antoine Park.
Kelley commented that in his view there should be more support for improving the Navarre Park
before commencing with further work on this project.
Gappa stated that a public hearing was held regarding improvements to this park, but that the
Parks Commission has not gotten much input from the local residents.
Mayor Jabbour stated that there is the feeling among some of the Navarre residents that they are
not being listened to by the City Coun ._ .i and that it is a waste oftime to come to the meetings .
Jabbour stated that the interests of the Navarre residents should not be overlooked .

Application: The applicant has proposed to extend the eaves on one side of the home to
extend over a sidewalk alongside the house . The extension would be supported by posts, and be 30'
in length. It would not extend the full length of the house on that side, only long enough to cover
the sidewalk to the side entrance. The proposed remodeling would move the sidewalk up against
the house and under the extended eaves, and then using the remainder of the area for
landscaping/grass. The applicant seeks approval of a variance for side yard setback and for
hardcover coverage in the 75'-250' (reduced from existing) lak:eshore setback area.
This application requires the following variance approval:
1. Variance from Section 10.25, Subdivision 6 (B) : To permit a sideyard setback variance to
allow an additional 2' of roof overhang to cover a sidewalk.
2. Variance from Section 10.22. Subdivision 2 and Section 10.56, Subdivision 16 (L)(2): To
permit a hardcover variance to allow 6,221 s.f. (57 .6%) in the 75'-250' lak:eshore setback area
where 2,700 s.f. (25%) is allowed .

SECTION 10.56, SUBDIVISION 16 (L)(2)

WHEREAS, Tom B. Berthiaume (hereinafter "the applicant") is owner of the
property located at 3035 Casco Point Road within the City of Orono (hereinafter "City") and
legally described as follows:
All of Tract A, Registered Land Survey No. 394 except that part lying Northerly of the
following described line: Beginning at the Southeasterly corner of Tract B in said
Registered Land Survey; thence Southwesterly along a line drawn through a point on
the base line as shown on said Registered Land Survey, 80 feet Northwesterly from its
intersection with the Southeasterly line of said Tract A, to the shore of Lake
Minnetonka, and there terminating, files of Registrar of Titles, Hennepin County,
Minnesota (hereinafter "the property"); and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on September 20, 1999, at which times all persons desiring
to be heard concerning this application were given the opportunity to speak thereon; and
WHEREAS, the applicant has applied to the City for variances to Municipal
Zoning Code Section 10.25, Subdivision 6 (B) to permit extension of eaves located on one side
of the house; per Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to
allow 6,221 s.f. (57.6%) hardcover in the 75-250' lakeshore setback area where 6,293 s.f.
(58.27%) exists and 2,700 s.f. (25%) is allowed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:

FINDINGS
1. This application was reviewed as Zoning File #2520.
2. The property is located in the LR-lC, Zoning District where .5 acres or 21,780
s.f. is the minimum lot area. The property consists of .56 acres or 24,130
s.f.
3. The Planning Commission reviewed this application on September 20, 1999 and
recommended approval on a vote of 6 to O.
4. The Planning Commission made the following findings of fact:
A The roof line would be extended approximately 2 feet.
B. The sidewalk is currently located under the roof line and creates a
hazardous situation when roof runoff occurs.
C. All landscape plastic will be removed upon completion of the addition.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety
and welfare of the community.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit
extension of eaves located on one side of house and per Section 10.22, Subdivision 2 and
Section 10.56, Subdivision 16 (L) (2) to allow 6,221 s.f. (57.6%) hardcover in the 75-250'
lakeshore setback area. Approval was subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicant attached
to this resolution as Exhibit A Any amendments to the site plan and/or
hardcover may require further Planning Commission and City Council review.
2. Underlain plastic shall be completely removed from the property.
3. Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (September 27, 2000).
4. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
5. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the chain of title of the
property.

Application: To allow a roof overhang to encroach on the sideyard setback.
STAFF SUMMARY
The applicant has requested a variance to permit an extension of the eaves on one side of the
home to extend over a sidewalk alongside the house. The extension would be supported by posts,
and be 30' in length. It would not extend the full length of the house on that side, only long enough
to cover the sidewalk to the side entrance . Currently there is 4' wide rock and plastic area, a 4'
sidewalk, and then 2' of grass to the property line, where a fence is located'. The proposed
remodeling would move the sidewalk up against the house and under the extended eaves, and then
using the remainder of the area for landscaping/grass.
The eaves currently on the house are 3 feet deep, and the proposed addition would make the
eaves 5' in depth. The eaves would be supported by 4 posts . The stairs to the side door would be
shifted to be located entirely under the proposed eaves. A diagram submitted by the applicant is
included to show a before & after situation. This site, with the addition, will have a structural
coverage of approximately 12%.
The applicant received a variance in 1993 to permit the construction of a 2-story addition,
as well as an addition to the existing deck. Hardcover approved at that time allowed for 6,293 s.f.
(58.27%) in the 75-250' zone, which is what the applicant is currently at. The proposed additions
and changes will reduce the hardcover to 6,221 s.f. (57.6%).

Issues
1. The applicant received a variance in 1993 for a two-story addition to the home, as well as an
addition to the deck. The approval required the removal of all plastic underlay within
landscaping areas, which the survey indicates was to be done in several areas. The diagram
submitted by the applicant indicates that rock and plastic is located between the existing
sidewalk and the house.
STAFF RECOMMENDATION

Tom Bertiaume, Applicant, was present.
Weinberger stated the Applicant is requesting a variance to permit an extension of the eaves on one
s ide of the home to extend over a sidewalk alongside the house . The existing eaves on the house
extend three feet, with the proposed addition making the eaves five feet wide . The Applicants .
are requesting to relocate the walkway closer to the residence and extend the roof line to allow for
a covered walkway to the residence .
Weinberger stated that a variance to hardcover would also be needed to allow for hardcover within
the 75-250' lakeshore setback. The existing hardcover would be reduced by .5 percent to 57.6
percent. Weinberger indicated that the Applicant has voluntarily removed a majority of the rock
and plastic underlayment, which was a condition of a previously approved application in 1993.
Berthiaume stated he has no comment regarding his application.
Hawn inquired whether this application has been discussed with his neighbors .
Berthiaume remarked that his neighbors are in favor of the application.
Lindquist indicated he does not have a problem with this application.
Smith inquired whether all the plastic underlayment has been removed.
Weinberger stated that removal of the plastic underlayment has been removed .
Nygard commented that he did view some plastic underlayment under the rock.
Berthiaume stated that a substantial portion of the rock and plastic underlayment were removed in
accordance with his previous application.
Lindquist suggested that removal of all the plast ic underlayment be a condition of the motion.
Hawn commented to her understanding the rock and plastic would be removed as part of the
construction of the walkway and placement of soo.
Berthiaume stated that was a correct understanding .
There were no public comments .
Stoddard moved, Smith seconded, to recommend approval of Application #2520,

Joe Haus, Applicant, was present.
Weinberger stated the Applicant is requesting a conditional use pennit to construct a garage with
living space above as a guest house on the property. This lot is located within the RR-1 B, One
Family Rural Residential District, consisting of over six acres in a two acre zoning district. The
Applicant is proposing to remove the existing residence and ,construct a new home on the site.
The guest house will be utilized by the Applicant as a residence during the demolition and the
construction of the new residence.
Weinberger stated the proposed location of the guest house is an accord with the objectives of
the Zoning Chapter and the purposes of the district in which the site is located and the
City's Comprehensive Municipal Plan.
City Staff is recommending approval of the conditional use pennit to permit the construction of a
guest house, but the Applicant should be aware that a new conditional use pennit will need to be
approved upon completion of the new residence. Weinberger noted that the existing septic
system is designed to accommodate a three bedroom house, with a new septic system being
required upon completion of the new residence due to the fact that the size of the guest house is
three bedrooms . ·
Haus stated the garage located at the top of the property is not in very good shape and would
probably be removed, along with an old quinset hut located on the property, which eventually be
removed.
Smith inquired whether those buildings would be removed .
Haus stated they would be removed .
Smith inquired whether the guest house would meet the requirements for a conditional use permit
upon completion of the new residence.
Weinberger stated that this proposal does meet the requirements for a conditional use pennit.
Following completion of the new residence, the septic system would need to be updated.
Haus stated he would like to finish the guest house prior to removal of the existing residence .
Hawn stated the Applicant should be aware that the guest house should not be rented out in the
future .
Haus indicated he understands that condition .
Lindquist indicated he does not have a problem with this application.

SignatureSec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or
to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
( c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and ( d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in
the individual income tax or property tax refund instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored. data on individuals, and
whether it is classified as public, private or confidential. Upon his further request, an
individual who is the subject of stored private or public data on individuals shall be shown the
data without any charge to him and, if he desires, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning,
the data need not be disclosed to him for six months thereafter unless a dispute or action
pursuant to this section is pending or additional data on the individual has been collected or
created. The responsible authority shall provide copies of the private or public data upon
request by the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature
of the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that
he believes the data to be correct. Data in. dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the
provisions of the administrative procedure act relating to contested cases.

HARDCOVER ORDINANCE -In 1975, the Orono City Council adopted an ordinance
limiting the percentage of lot area that can be covered with impervious surface ("hardcover")
such as roofs, driveways, sidewalks, etc. on properties located within 1,000 feet of a lake.
Studies have shown that sediments, oils, and debris carried into the lake from highly urbanized
areas have a detrimental impact on the quality of water in the lake. The intent of Orono's
ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or
vegetated yard areas before entering the lake.

0-75 0%
75-250' 25%
250-500' 30%
500-1000' 35%
Hardcover includes:
-Roofs
-Sidewalks
-Paved or gravel driveways
-Patios & decks (includes slatted decks)
-Tops of retaining walls & rock walls
-Decorative landscape areas underlain by plastic sheeting or fabric
-Any other surface that does not allow direct absorption of rainfall into
the ground
INSTRUCTIONS FOR COMPLETING HARDCOVER CALCULATION WORKSHEET
1. Circle which setback zone (0-75', 75-250', etc.) the calculation is for.
2. For each item of hardcover within that zone, enter the length and width,. and multiply
to get square footage (s.f.).
3. Add up all the square footages to get total square footage of hardcover.
4. Divide by the total area of property within the zone and multiply by 100 to get
percentage of hardcover in the zone.
5. If changes in hardcover are proposed, you should do a "before" worksheet and "after
worksheet. If either results . in percentages greater than those allowed, contact City staff
before proceeding with your project planning!
