The home addition is proposed to replace an existing elevated deck. The applicant's proposal results in 157 square feet less hardcover than what currently exists . However, because the property exceeds the Tier I limitation of 25 percent and because the proposal involves new structural hardcover, a hardcover variance is required in order to reduce the level from 34.2 percent to 33.6 percent as proposed. At the November meeting, the Planning Commission voted 5 to O in favor of the variances for the addition. A resolution has been drafted for the City Council's consideration. McMillan indicated she is fine with the application. Mike Sharratt, the applicant, stated the issue is that there was significant frost heave on the deck and porch. This resulted in the entire structure being lifted over a foot. The porch and deck have settled a little during the spring but that there is still an issue with the structure. The property owners have decided to remove the porch and deck and replace it with a more permanent structure. Sharratt stated during the design process, he tried to make sure that the improvements would result in a better situation than what existed prior to his client purchasing the house by reducing hardcover and structural coverage. Jay Hulbert, Applicant, was present. Curtis stated this property is located in the LR-1 C zoning district , which requires a structural setback of 10 feet from the side property line . The applicant is requesting a side setback variance to permit a portion of the proposed addition to be situated as closed as 8.5 feet from the south property line. The home addition is proposed to replace an existing upper level deck. The property line angles away from the home as it nears the lake. Therefore, only approximately 15 feet of the 40-foot addition requires a setback variance to maintain consistency with the southern line of the existing home. The applicant 's proposal results in hardcover over what is existing . However, because the property currently exceeds the Tier One 25 percent limitation and because the proposal involves new structural hardcover consisting of a stairway, a variance is required to reduce the hardcover level from 34.26 percent to 33.65 percent. The lakeward portion of the existing deck encroaches up to three feet into the side setback and the applicant is proposing to correct this nonconformity with the addition. Currently at 34.26 percent the property does exceed the hardcover limitation. The applicant's plan provides for a 157 square foot reduction in hardcover. Staff finds that the applicant proposes to use the subject property in a reasonable manner. The proposed addition to the home located 8.5 feet from the side lot line does not expand the existing nonconforming setback of the existing home and does not appear to alter the essential character of the neighborhood. The narrow nature of the subject property creates a practical difficulty for the property owner. Page 14 of 23 MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, November 17, 2014 7:00 o'clock p.m. Upon review of the survey, the proposed new stair accessing the yard off of the addition appears to encroach up to one foot into the 75-foot lake setback. This stair should be redesigned so that it does not create a new nonconformity. Planning Staff recommends approval of a side setback variance to allow an 8.5 foot setback for an addition to the existing home over an existing structural deck; and a Tier 1 hardcover variance in conjunction with the construction of the addition and a new stair off of the home resulting in a reduction in hardcover from 34.26 percent to 33.6 percent subject to the following conditions: 1. The proposed new stair off of the addition should be revised to meet the 75-foot setback; 2. Hardcover shall not exceed 33.6 percent; and 3. Compliance with the City Engineer's requirements. Landgraver asked if the hardcover would remain at 34.26 percent if the Planning Commission recommends denial of the variance. Curtis indicated it would. Jay Hulbert, Applicant, stated he would like to first thank Melanie Curtis for her excellent work on his application. Hulbert stated this past winter they experienced a frost heave under the existing footings of the deck, which requires replacement of the deck. Hulbert stated they have an existing structure that is nonconforming and that they would like to relocate that square footage to a conforming area of the property. Hulbert stated they also do not want to increase the hardcover percentages but actually decrease it. Hulbert stated in order to do that, it requires a variance. Landgraver asked if they could shorten the stair wall. Hulbert indicated he does not believe that would be a problem. Chair Leskinen opened the public hearing at 8:14 p.m. There were no public comments regarding this application. Chair Leskinen closed the public hearing at 8:14 p.m. Leskinen stated she is not opposed to the application. A RESOLUTION GRANTING VARIANCES FROM ORONO MUNICIPAL CODE SECTIONS 78-350 and 78-1700 FILE NO. 14-3698 Council Exhibit A WHEREAS, Jay S. Hulbert Trust, (hereinafter the "Owner") is the owner of the property located at 3035 Casco Point Road within the City of Orono (hereinafter "City") and legally described as: All of Tract A, Registered Land Survey No. 394, Hennepin County, Minnesota, except that part lying Northerly of the following described line: Beginning at the Southeasterly corner of Tract B in said registered Land Survey; thence Southwesterly along a line drawn through a point on the Base line shown on said Registered Land Survey 80 feet Northwesterly from its intersection with the Southeasterly line of said Tract A to the shore of Lake Minnetonka and there terminating (hereinafter "the Property"); and WHEREAS, Jay S. Hulbert, the trustee of the Jay S. Hulbert Trust (hereinafter the "Applicant") on behalf of the Owner the Applicant has made application to the City for a variance from Orono City Code Section 78-350 which requires a 10-foot side setback to permit construction of an addition to the existing home over an existing deck 8.5 feet from the side property line; and WHEREAS, the Applicant has made application to the City for a variance from Orono City Code Section 78-1700 to permit 7,948.6 square feet (33.6%) hardcover on the property where 5,915.5 square feet or 25% hardcover permitted and 8,106.2 square feet (34.2%) currently exists in conjunction with construction of the proposed addition and stair; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on November 17, 2014, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #14-3698. 2. The Property is located in the LR-1 C zoning district, where 0.5 acres is the Page 1 of 5 minimum lot area and 100 feet is the minimum lot width. 3. The Planning Commission reviewed this application on November 17, 2014, the Planning Commission voted on a motion to approve the requested variances on a 5 to O vote conditioned upon the following: a. The proposed new stair off of the addition should be revised to meet the 75-foot setback; b. Hardcover shall not exceed 33.6%; and c. Compliance with the City Engineer's requirements. 4. On November 17, 2014, the Planning Commission's actions were based on the following findings. a. The Property has approximately 23,662 square feet (0.54 acre) acre in area and has 79 feet in width at the OHWL and 70 feet at the 75-foot setback. b. The Property is located in Tier 1 of Orono's Stormwater Quality Overlay District and is limited to 25% hardcover based on gross lot area. c. The Applicants' proposal results in.a reduction in existing hardcover by 157 square feet. d. The additions to the home are proposed to be constructed over the existing deck footprint. The addition will improve an existing encroachment into the setback for the most lakeward portion of the home. e. The proposed addition is not out of character with the neighborhood and will meet the lake and average lakeshore setbacks. f. The variance to allow construction over the existing home within the 10 foot side setback will alleviate a practical difficulty inherent to the Property's width and not created by the Applicant. g. The Applicant's request to construct the addition partially within the side setback will not alter the essential character of the neighborhood and will result in minimal negative impact on adjacent properties. h. The Applicant's request is in harmony with the purpose and intent of Page 2 of 5 the ordinance. i. The Applicants' proposal is consistent with the comprehensive plan. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the Applicant and the public, and the effect of the proposed variances on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 6. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicant, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants the following: 1) a variance from Orono City Code Section 78-350 to permit construction of an addition 8.5 feet from the side property line; and 2) a variance from Orono City Code Section 78-1700 to allow 7,948.5 square feet or 33.6% hardcover on the Property where 25% is allowed and 34.2% currently exists in conjunction with construction of the addition and stairs on the Property. Subject to the conditions listed below: a) Council approval is based on the survey and building plans submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A & 8. Any amendments to these plans may require further Planning Commission and City Council review. b) Hardcover shall not increase above 33.6% and structural coverage may not increase above the existing level (13%) per the approved plans. Any changes to the plans or the Property which result in an increase in hardcover or structure above the approved level will require further Planning Commission and City Council review and a new variance request. Page 3 of 5 c) The additions will be reviewed at the time of the building permit application and shall comply with the City's height and number of stories calculations. d) Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A framing inspection must be completed within one year ofthe date of Council approval, or the variances will expire on that date (December 8, 2015). e) Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. f) The undersigned Applicant has read, understands and hereby agrees to the terms of this resolution and on behalf of their heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property. The applicant is requesting a variance to allow maintenance of an existing 8.5 foot setback from the side lot line in order to convert an upper level deck area into living space, requiring a setback variance. The applicant is proposing to move the most lakeward side portion of the addition 3 feet further from the side lot line than the existing deck. The lakeward portion of the existing deck encroaches up to 3 feet into the side setback; the applicant is proposing to correct this nonconformity with the addition. Hardcover Variance Currently at 34.26%, the property exceeds the 25% hardcover level permitted on a Tier 1 property. Due to the shape and configuration of the lot the length of driveway needed just to drive to the parking and turn around area for the home accounts for approximately 2,400 square feet of hardcover or 10% of the allowed hardcover. The applicant's plan provides for a 157 square foot reduction in hardcover. If not for the new structural hardcover (new stairs from the addition) staff would be able to approve the plan with the reduction administratively according to City Code Section 78-71 which provides for the relocation of nonstructural nonconforming hardcover. Practical Difficulties Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend FILE# 14-3698 13 Nov 2014 Page 4 of 4 approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Staff finds that the applicant proposes to use the subject property in a reasonable manner. The proposed addition to the home located 8.5-feet from the side lot line does not expand the existing nonconforming setback of the existing home and does not appear to alter the essential character of the neighborhood. The narrow nature of the subject property creates a practical difficulty for the property owner. Please refer to the aerial photos and the site photos attached as Exhibits F and G. The proposed new stair accessing the yard off of the addition appears to encroach up to one foot into the 75-foot lake setback. This stair should be redesigned so that it doesn't create a new nonconformity. Issues for Consideration 1. Does the Planning Commission find that that the property owner proposes to use the subject property in a reasonable manner which is not permitted by an official control? Is the side setback proposed reasonable? 2. Does the Planning Commission find that the variances, if granted, will not alter the essential character of the neighborhood? 3. Does the Commission find it necessary to impose conditions in order to mitigate the impacts created by the granting of the requested variances? 4. Are there any other issues or concerns with this application? The exact conditions of this property are unique to this property, and have some similar aspects of adjoining property, i.e., lots of non-conforming widths, road frontages, sizes, etc., yet lot specifics are uniquely differing to those adjacent properties. 9. "The conditions do not apply generally to other land or structures in the district in which said land is located." The exact conditions do not apply generally to other land and structures in the District. Hardship Statement: Physical and practical difficulties for reuse of this unique piece of property exist relative to present day zoning ordinance requirements. This property would not be a permitted subdivision under the current zoning ordinance and meet all of its requirements, resulting in characteristics that allow hardships to exist. Combine this with a property configuration, including length and narrowness, which generates additional non-conformities related to hardcover of structures. Existing deck removed is nonconforming in that it is outside or encroaching into the south side yard setback. 2. Existing conforming structural coverage and proposed coverage is at 14.1 and 14.0% respectively with 15% allowed. 3. Existing site hardcover is presently at 34.26%, and the proposed hardcover is proposed at 33.6% for an overall hardcover reduction. 4. Only with the granting of this variance request, the Hulbert's are willing to remove an existing deck 75 SF permanent deck at the shoreline in the 0-75' lakeshore setback. 98 PRACTICAL DIFFICULTIES DOCUMENTATION FORM* This form is a required submittal for ALL variance applications. An application will not be considered complete or placed on any meeting agendas until this form is complete and submitted to the City. Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that practical difficulties be demonstrated in order for a variance to be granted. The difficulties must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order for an application to be heard by the Planning Commission and City Council practical difficulties having merit must be demonstrated. HOW DO I PROVE A PRACTICAL DIFFICULTY? This form has 12 points outlining the basis City staff uses to determine if practical difficulties exist and how the variance will affect the surrounding community. To prove practical difficulties, address all the relevant points listed below and answer them as clearly as possible. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation. If you leave something out it will not be considered. Please address each of the twelve practical difficulties criteria as they relate to the request, if they do not apply, write NIA in the space provided: 1. "The property owner proposes to use the property in a reasonable manner not permitted by the Zoning Chapter." 2. "The plight of the landowner is due to circumstances unique to his property not created by the landowner." 3. "The variance, if granted, will not alter the essential character of the locality." 4. "Economic considerations alone do not constitute practical difficulties if reasonable use for the property exists under the terms of the Zoning Chapter." 5. "Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth sheltered construction as defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this Chapter." 6. "The Board of Appeals and Adjustments or the Council may not permit as a variance any use that is not allowed under this Chapter for property in the zone where the affected person's land is located." Access to data by individual. Upon request to a responsible authority or designee, an individual shall be informed whether the individual is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge and, if desired, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority or designee shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority or designee may require the requesting person to pay the actual costs of making and certifying the copies. The responsible authority or designee shall comply immediately, if possible, with any request made pursuant to this subdivision, or within ten days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. Subd. 4. Procedure when data is not accurate or complete. (a) An individual subject of the data may contest the accuracy or completeness of public or private data. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (1) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (2) notify the individual that the authority believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provIsIons of the Administrative Procedure Act relating to contested cases. Upon receipt of an appeal by an individual, the commissioner shall, before issuing the order and notice of the contested case hearing required by chapter 14, try to resolve the dispute through education, conference, conciliation, or persuasion. If the parties consent, the commissioner may refer to the matter to medication. Following these efforts, the commissioner shall dismiss the appeal or issue the order and notice of hearing. (b) Data on individuals that have been successfully challenged by an individual must be completed, corrected, or destroyed by a government entity without regard to the requirements of section 138.17.
