A RESOLUTION VACATING
- A DRAINAGE AND UTILITY EASEMENT
OVER LOT 2, BLOCK 1, ECKSTROM ADDITION AND
� OVER LOT 4, BLOCK 1, PHILLIPS WOODLAND TERRACE,
FILE NO. #1872
• WHEREAS, the City of Orono is a municipal corporation organized and existing under
the laws of the State of Minnesota; and
WHEREAS, on August 27,1993, Paul R. Phillips and Orono Woodlands Inc., a
Minnesota non-profit Corporation filed a petition with the Ciry of Orono requesting the vacation
of drainage and utiliry easements originally dedicated in the plats of Eckstrom Addition and
� Phillips Woodland Terrace legally described as follows: �
• the existing drainage and utility easements over Lot 2, Block 1, Eckstrom Addition and
over Lot 4, Block 1, Phillips Woodland Terrace, as dedicated in the respective plat
. thereof, Hennepin County, Minnesota; and
. WI�REAS, after due published and posted notice, a public hearing was held before
�, the Planning Commission on September 20, 1993, regardin� said vacation and all interested
persons were given an opportunity to be heard; and
WI�REAS, after due standing and consideration, the Planning Commission
recommended unanimous approval of the proposed vacation and the Council of the City of
Orono finds that said vacation as proposed is in keeping with the public interest'and in
consideration of the following:
�. 1. A current plat of a lot line rearrangement involving both properties finds it
� necessary to vacate the original dedicated drainage and utility easements and rededication
of new easements to conform with newly defined lot line.
2. Portion of the existing drainage and utility easements�would intersect a future
drainfield site serving one of the properties.

3. Portions of the dedicated drainage and utiliry easements as it currently exists
would serve no public purpose. � ,
�NOW, THEREFORE BE IT RESOLVED, that the petition of Paul R. Phillips and
Orono Woodlands Inc., is hereby granted by the Council of the City of Orono and that the
drainage and utility easements legally described above are hereby vacated. The granting of the
petition is subject to the condition that upon vacation applicant shall rededicate drainage and
� utility easements within the plat of the lot line rearrange as follows:
10' along the perimeter of the lot lines and 5' along the shared lot line.
Adopted by the Orono City Council of the City of Minnesota, a regular meeting held on
September 27, 1993.
