Application Summary:
The applicants are requesting lake setback, side yard setback, average lakeshore setback and
hardcover variances to allow a grade level deck within 28 feet of the lake on their property. A grade
level, lakeshore deck previously existed on the property in the same location. It is estimated to have
been constructed sometime in the 1980s. There was no record of a permit issued for the deck in the
property file. In 2009, the property owners removed the deck and constructed a new, slightly different
deck in its place. Upon notification of the requirement for variance approval the property owners
chose to revert back to the previous deck configuration rather than what was constructed in 2009.
The Planning Commission reviewed the request and suggested revisions. The applicants have
revised their request to conform to the Planning Commission recommendation (below).
Planning Commission Recommendation
At their February meeting, the Planning Commission voted 5 -0 to approve the variances provided
the applicants revised their proposal to a deck no larger than was existing previously and the deck
being centered on the property to allow for some setback from the side property lines.
Planning Staff Recommendation
Staff recommends approval of the variances per the attached Resolution.

WHEREAS, Clifford Swenson and Barbara Swenson, husband and wife
(hereinafter "the applicants") are the owners of the property located at 2965 Casco Point Road
within the City of Orono (hereinafter the "City") and legally described as follows:
Tract A, Registered Land Survey No. 1470, files of the Registrar of Titles,
Hennepin County, Minnesota (hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Sections 78-1279 (1) and 78-1279 (6) in order to
allow construction of a grade level deck 28 feet from the OHWL of Lake Minnetonka and ahead
of the average lakeshore setback line; and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1288 to allow construction of a grade
level deck, resulting in 328 ~quare feet of hardcover within the 0-75 foot setback zone where 112
square feet (lake 1;1ccess stair) is normally allowed; and
WHEREAS, the applicants have made application to the City of Orono for a
variance to. Orono Municipal Zoning Code Section 78-1405(6) to allow a grade level deck to
encroach into the required 10 foot side yard. The grade level deck is proposed to have a 4 foot
setback from each side lot line where a 10 foot setback is normally required.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 10-3446 . .,

2. The property is located in the LR-IC Single Family Lakeshore Residential Zoning
District which requires a minimum lot area of 0.5 acre and a minimum lot width
of 100'.
3. The Planning Commission reviewed this application at a public hearing held on
February 16, 2010 and recommended approval of variances based on the
following findings:
a. The property contains 21,240 s.f. in area and has 20 feet in width at the
OHWL and 26 feet in width at the 75' setback.
b. The lot is substandard in widtli and a residence has existed on the property for
many years. There is no additional land available to bring the lot width into
conformity.
c. The narrowness ofthe property at the Jake presents an additional challenge to
meeting the 10 foot side setback requirement.
d. The hardcover variance level as requested is due to the narrowness of the
propertyat the lake.
e. A lake access stair is necessary due to the grade of the property at the
lakeshore.
f. The grade l~vel deck will not adversely impact views of the lake enjoyed by
neighboring property owners.
4. The City Council has co11sidered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property right of the

applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Orono Municipal Zoning Code Sections 78-1279 (1) and 78-1279 (6) in order to
allow construction of a grade level deck 28 feet from the OHWL of Lake Minnetonka and ahead
of the average lakeshore setback line; and a variance to Orono Municipal Zoning Code Section
78-1288 to allow construction of a grade level deck, resulting in 328 square feet of hardcover
within the 0-75 foot setback zone where 112 square feet (lake access stair) is normally allowed;
and a variance to Orono Municipal Zoning Code Section 78-1405( 6) to· allow a grade level deck
to have a 4 foot setback from each side lot line where a 10 foot setback is normally required,
subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and annotated by
City staff, attached to this Resolution .as Exhibit A. Any amendments to the site plan
which are not in conformity with City codes will require further Planning Commission
and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the level of 328 s.f. or 19% per the
proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants
are advised that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in hardcover will
nqt}ikelybe approved without concurrent reduction in existing hardcover.
3. An as-built survey yerifying .compliance with the variance approval and the building
permit shall be submitted prior to the refund of the escrow.

4. Applicants shall remove all plastic or fabric liner material from the decorative landscape
beds on the property to ensure their permeability as non-hardcover surfaces.
5. Required removals of sJructure and hardcover to be removed shall be completed prior to
the issuance of the building permit.
6. Authorities granted by this resolution run with the property not with the applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (March 8, 2011).

7. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
8. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.

Application Summary: The applicant is requesting variances in order to construct a
replacement deck approximately 28 feet from the lake where a 75' setback is normally
required. Hardcover, side setback, lake setback, and average lake setback variances
are requested.
Staff Recommendation: Planning Department Staff recommends should Planning

(6) Average lakeshore setback. No principal or accessory structure shall be located
closer to the lakeshore than the average distance from the shoreline of existing
residence buildings on adjacent lots; except that this does not apply to stairways, lifts,
landings and lockboxes. Further, the average lakeshore setback shall apply only to
classified lakes and shall not apply to tributaries. The average lakeshore setback line
shall be a straight line connecting the most lakeward protrusions of the residence
buildings on the immediately adjacent lakeshore lots.

The applicants are requesting a hardcover variance within the 0-75' zone to allow 240
square feet (14%) hardcover where only 112 square feet (6%) is permitted for the lake
access stair. The proposed deck would be set back only 28 feet from the OHWL where
a 75-foot structural setback is required.
Side Yard Setback Variances
The applicants' property is very narrow at the lake until approximately 200 feet landward.
The 14 foot wide deck encroaches on both side lot lines. There is a proposed O foot
setback on the north and an 8-foot setback from the south property line.
Average Lakeshore Setback Variance
The proposed deck will be located significantly ahead of the average lakeshore setback
line. It is proposed as grade-level and should not interfere with views of the lake from
adjacent properties.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider the
effect of the proposed variance upon the health, safety and welfare of the community,
existing and anticipated traffic conditions, light and air, danger of fire, risk to the public
safety, and the effect on values of property in the surrounding area. The Planning
Commission shall consider recommending approval for variances from the literal
provisions of the Zoning Code in instances where their strict enforcement would cause
undue hardship because of circumstances unique to the individual property under
consideration, and shall recommend approval only when it is demonstrated that such
actions will be in keeping with the spirit and intent of the Orono Zoning Code.
Staff finds the grade drop off in the lake yard necessitates the lake access staircase.
The applicants' proposed deck will be at-grade and the deck itself will not interfere with
the views of the lake enjoyed from neighboring properties. However, patio furniture or
other appurtenances may block views. Both of the immediate neighboring properties
have significantly larger lakeside decks or structures than the applicants are requesting.
The proposed deck appears to function as a large stair landing; perhaps a smaller
landing area centered on the stair would be more appropriate. The 128 square feet of
hardcover associated with the deck accounts for approximately 7.5% of the hardcover
within the 0-75' setback zone. However at 20 feet wide, the zone itself is extremely
small in comparison to the adjacent properties. The narrowness of the property at the

lake presents the additional challenge of meeting the 10 foot side setback requirement.
Issues for Consideration

Variance Request
Public Hearing
The applicant is requesting variances in order to construct a replacement deck
approximately 28 feet from the lake where a 75 ' setback is normally required.
Hardcover, side setback, lake setback , and average lake setback variances are
requested. A grade-level , lakeshore deck previously existed on the property exactly in
the proposed location . It is estimated to have been constructed sometime in the 1980s.
There was no permit issued for the deck . In 2009, the property owners removed the
deck and constructed a new, slightly different deck in its place . Upon notification of the
requirement for variance approval the property owners chose to revert back to the
previous deck configuration rather than what was constructed in 2009 .
Variance
The applicants are requesting a hardcover variance to allow 240 square feet (14%)
hardcover within the 0-75 ' zone where only 112 square feet (6%) is permitted for the
lake access stair. The proposed deck would be set back 28 feet from the OHWL where
a 75-foot structural setback is required .
The property is quite narrow at the lake until approximately 200 feet landward . The 14
proposed foot wide deck will encroach on both side lot lines -with a O foot setback on
the north and an 8-foot setback from the south property line.
The proposed deck will be located significantly ahead of the average lakeshore setback
line, however it is proposed as grade-level and should not interfere with views of the lake
from adjacent properties.
Staff finds the grade drop off in the lake yard necessitates the lake access staircase.
The applicants ' proposed deck will be at-grade and the deck itself will not interfere with
the views of the lake enjoyed from neighboring properties.
The proposed deck appears to function as a large stair landing; perhaps a smaller
landing area centered on the stair would be more appropriate. If Planning Commission
determines that a landing is necessary , Staff recommends approval of a landing 4 feet
wide maximum , centered on the stair in order to offer a greater setback from each side

The Planning Commission will hold public hearings in the Orono Council Chambers at 2780
Kelley Parkway on Tuesday, February 16, 2010, beginning at 6:30 p.m. on the matter of
reviewing the following land use applications :
09-3436 Lori Gherardi, 2700 Ethel Avenue, LR-1 C zoning district , requests a variance to
construct a second garage stall with a 19.1 setback from the right of way of Ethel
Avenue (the same setback as the existing garage) when a 30 foot setback is
required .
10-3442 Dirk Miller of The Emily Program , 2180 North Shore Drive , RR-1 B zoning district,
requests approval of a conditional use permit in addition to side , street side , and rear

3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs .
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW F_IJNDS. Contemporaneously with the execution of this Escrow
Agreement , the Owner shall deposit $ ']@ t:!E-with the City . All accrued interest , if any , shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering , or legal consultant review) or w ill
incur in meeting with the Owner, r~!:?: the plans, and preparing agenda packet material for City Council
review of application # ( O --~-~--· Eligible expenses shall be consistent with expenses the Owner
would be responsible for under a zoning and subdivision application .
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs , the City will in turn
send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt
of bill .
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make
payment to the City within the timeframe outlined in #3 above , the City may draw from the escrow account without
further approval of the Owner to reimburse the City for eligible ex penses the City has incurred . The City shall
notify the Owner of such draw and the nature of the e x pense for which the reimbursement is being made . If the

directed by the City , or the City shall discontinue all review.
5. CLOSING ESCROW. The Balance on deposit in the escrow , if any , shall be returned to the
Owner when the review has been completed .
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible ex penses
incurred by the City exceed the amount in escrow , the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn . Stat.§§ 415.01 and 366 .012 .
