The Planning Commission recommended approval with a number of conditions: 1. Grading plans must illustrate proposed contours between house and street, 2. Plans should show the proposed driveway location and grades that do not exceed 10%, 3. It was subsequently determined that the foundation above which the kitchen addition was proposed, had no footing. Because that foundation needed to be replaced, and due to its being only 1' from the side lot line forcing drainage onto the adjoining property, Planning Commission recommended that the south side setback variance be avoided by meeting the 1 O' setback requirement. Planning Commission Recommendation: Planning Commission recommended approval on a vote of 7-0 with following conditions: 1. Proposed additions must meet 10' side yard setbacks. 2. Hardcover in 75-250' setback zone to be limited to no more than the existing 4,998 s.f. 3. Revisions to plans to meet the above shall not go further into the average lakeshore setback (i.e. no closer to lake). The application has been revised since the Planning Commission meeting to meet the conditions recommended by the Planning Commission. The City Engineer will be reviewing the revised drainage and grading plan to confirm that drainage concerns have been resolved. The adjacent neighbor has granted a temporary easement for erosion #03-2881 May 8, 2003 Page2 control fencing to manage storm.water on the site during construction process. The proposed plans show a hardcover reduction in the 75-250' zone from 31.7% to 29 .1 % which more than meets the "equal removals" goal of the Planning Commission for this site. The addition along the south lot line will be 11 '+ from the lot line, meeting the 10' minimum setback and allowing adequate room for grading a drainageway within the property boundaries. Staff Recommendation Staff recommends approval of the hardcover and average setback variances per the revised plans. A resolution for approval is attached. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 10.22 SUBDIVISION l(B), 10.22 SUBDIVISION 2, 10.56 SUBDIVISION 16 (C)(6) AND 10.56 SUBDIVISION 16 (L)(2) FILE NO. 03-2881 WHEREAS, Curtis 0. Midthun and Kathleen A. Midthun (hereinafter "the applicants") are the owners of the property located at 2941 Casco Point Road within the City of Orono (hereinafter the "City") and legally described as follows: Lot 92 and that part of Lot 93 lying southeasterly of a line running parallel with and 30 feet distant from the southeasterly line of said Lot 92; that part of lot 104 lying southeasterly of a line running parallel with and 30 feet distant from the southeasterly line of said Lot 104, including that part of vacated Lake Shore Avenue lying across the above Lot 92 and the above part of Lot 93, all in Spring Park, according to the plat thereof on file or of record in the Office of the County Recorder, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Sections 10.22 Subdivision 2 and 10.56 Subdivision 16(L)(2) to allow hardcover in the 75-250' zone in excess of the 25% allowed by code for the construction of additions to the existing residence on the property, and a variance to Municipal Zoning Code Sections 10.22 Subdivision l(B) and 10.56 Subdivision 16 C(6) to allow encroachment of the average lakeshore setback where no such encroachment is normally allowed. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #03-2881. 2. The property is located in the LR-1 C Lakeshore Residential Zoning District, which requires minimum lot area of 0.50 acre and minimum lot width of 100'. The lot contains 0.63 acre and has a defined width of 90'. Page 1 of 6 3. The property contains an existing residence structure and detached garage, comprising 'lot coverage by structures' of 9.3 % where up to 15 % is normally allowed. The existing residence, garage, decks, sidewalks, driveways, and other calculable hardcover on the property totals 354.1 s.f. or 5.2 % in the 0-75' lakeshore setback zone where no hardcover is normally allowed; 4,998 s.f. or 31.7% in the 75-250' lakeshore setback zone where only 25% hardcover is normally allowed; and 293 s.f. or 5.9 % in the 250-500' zone where up to 30% hardcover is normally allowed. 4. Hardcover on the property after proposed additions and equivalent concurrent removals will not change from the existing numbers and percentages in the 0-75' and 250-500' zones but will decrease to 4,601 s.f. or 29 .1 % in the 75-250' zone. Proposed lot coverage by structures will be approximatelyl 1.3 %, well below the 15% maximum allowed. 5. The applicants had initially requested a side setback variance to allow the construction of a first story kitchen addition above an existing basement office room located 1 foot from the side lot line where a 1 0' side setback is normally required. 6. The Orono Planning Commission reviewed this application on April 21, 2003 and recommended approval of the requested hardcover and average setback variances on a vote of 7-0, conditioned upon revision of plans to remove the basement setback encroachment and construct additions meeting the required 1 0' side setback, limiting 75-250' hardcover to no more than the existing level of 4,998 s.f., and encroaching no further into the average lakeshore setback, based on the following findings: a) The additions when constructed per the recommended conditions will result in no loss of existing views of the lake enjoyed by the affected property owner directly to the south, due to the increased side setback from the existing situation and existing topography and vegetation. b) The proposal concurrent removals in existing hardcover will result in no net increase in hardcover on the site. c) The existing basement in the area of the proposed kitchen addition is 1 foot from the side lot line where a 1 0' setback is required, and is not structurally sufficient to support a story above it. This basement must be removed and replaced in order for such addition to occur. There is no hardship justification Page 2 of 6 to allow construction of a first story above a new basement located so close to the side lot line, as such new construction would result in continued drainage and access concerns, would increase the longevity of a nonconforming situation, and would have potential negative impacts on the adjacent property. 7. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicants and applicants' agents, and the effect of the proposed variances on the health, safety and welfare of the community. 8. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Sections 10.22 Subdivision 2 and 10.56 Subdivision 16(L)(2) to allow hardcover in the 75-250' zone in excess of the 25% allowed by code for the construction of additions to the existing residence on the property, and a variance to Municipal Zoning Code Sections 10 .22 Subdivision 1 (B) and 10. 5 6 Subdivision 16 C( 6) to allow encroachment of the average lakeshore setback where no such encroachment is normally allowed. subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant and attached to this Resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. 2. Hardcover on the property is approved at 354.1 s.f or 5.2% in the 0-75' zone; 4,601 s.f. or 29.1 % in the 75-250' zone; and 293 s.f. or 5.9% in the 250-500' zone. Page 3 of 6 3. In order to meet the hardcover levels approved by this resolution, the applicants shall remove hardcover as indicated on the approved site plan attached to this Resolution as Exhibit A. 4. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (May 12, 2004). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. The total encroachment is approximately 84'. Discussion: The applicants have met with staff several times regarding the proposed project. The plan reviewed for this report is the latest submittal by the applicant's. Because the applicants have made changes to the proposal, the survey included in this report does not reflect the changes. Only the elevation views and floor plans reflect the changes to the project. The existing residence was built in 1934. There have not been any additions just upgrades to the existing residence. A new roof has been put on the residence and a detached garage was built in 1986. There have not been any variances granted for this property. The applicants are proposing two different additions, changing the roof and cantilevering a wall on the lakeside to the existing residence. 1. An attached garage/mudroom/bedroom addition to the north side of the residence. 2. Enlarging the kitchen on the south side of the residence. 3. Cantilevering the wall by 2' on the lakeside of the master bedroom. 4. Raising the roof to accommodate a new patio door on the second level with a deck and to connect the additions. Garage/ Mudroom/Bedroom Addition: The addition on the north side of the residence meets the required 10' setback. The original #03-2881 Curtis/Kathleen Midthun 2941 Casco Point Road 4/18/2003 Page 2 of6 design had the garage setback 8.5' from the side lot line. The applicants have redesigned and the garage meets the 10' setback. (The survey does not indicate the change). Kitchen Addition: The existing residence is located 1.3' from the side property line. As is the existing basement room. The original proposal was to add a story (kitchen addition) over the basement room which would also be located 1.3' from the property line. It has been determined that the existing foundation needs to be demolished and a new one constructed. The new foundation and story above it (kitchen addition) will be located 5' from the side property line. (The survey does not indicate the change). Drainage: The eaves on the south side of the residence are shown at 1' leaving a 4' setback from the lot line. Drainage and excess runoff is a concern. With the construction of the addition so close to the property line there is not room to build a swale to direct the drainage/runoff around the side of residence to the lake side. Rain gutters will be required on this side of the residence. The rain gutters need to discharge at a location on the property where excessive runoff is not added to neighboring properties. The street side of the property is graded such that the drainage will be going directly onto the adjacent neighbor's property. The swale should be extended around the residence towards the lake. A revised drainage plan should be submitted and approved before building permit is issued. City Engineer, Torn Kellogg, reviewed the initial plan and his comments are attached as Exhibit F. Due to the changes in the proposed plan, staff suggests the applicant's builder work with the City engineer to work out drainage issues. Hardcover in 75-250' setback zone: The existing residence and proposed additions are located in the 75-250' hardcover zone. The existing residence is currently at 4,694.8 s.f. plus a 303 .2 s.f. decorative fountain which will be removed. Existing 75-250' hardcover is 4,998 s.f. (31.7%). The proposed additions and removals result in a net decreasel 04 s.f., final hardcover will be 4,894 s.f. (31 %). Decks: The applicants are proposing to replace the existing deck on the lakeside of the residence. The square footage and placement of the deck is not changing. It is starting to deteriorate and the applicants want to update it at the same time as the additions. However, the deck is shown in the plans with a railing, therefore is included in the lot coverage by structures calculations. #03-2881 Curtis/Kathleen Midthun 2941 Casco Point Road 4/18/2003 Page 3 of6 The upper level new deck/patio door is over hardcover, therefore does not increase the amount of hardcover. Cantilevered walls: The cantilevered wall on the north side to the bedroom addition (Lakeside) is new and not over hardcover, therefore the amount of hardcover has a net increase of 32 s.f. The cantilevered wall on the street side of the kitchen addition is under the eave, therefore will not increase the amount of hardcover. Lot Coverage by Structures: The subject property is 26,616.8 s.f. in size and is allowed 4,142.4 s.f. oflot coverage by structures. Currently, the property has 2,578 s.f. (9.3%) oflot coverage by structures. The proposed additions and lake side deck increase the amount to 3,572.8 s.f. (12.9%). Foundation: The applicant's builder, Tom Bricko, checked the foundation prior to submittal of the proposed addition plans to assure the foundation could handle the additional load of another story above it. Initially, it appeared to be sound. Building Inspector, Bruce Vang, visited the site and had some concerns regarding the foundation and if frost footings existed. Staff forwarded those concerns to the applicant's builder. The builder then dug down 4 ½' to verify if there were frost footings. There were no frost footings. The existing foundation will be removed and a new one constructed. The set of plans of which this report was written indicate the existing foundation will be removed, however the new foundation has slightly increased in size. The increase is approximately 20 s.f. Average Lakeshore Setback: A portion of the proposed addition on the north side of the residence, all of the proposed additions to the south side, and the cantilevered wall on the lakeside of the residence lie within the average lakeshore setback. The property to the south, 2967 Casco Point Road, had a main residence and caretaker's house on it until 1977. In 1977, the caretaker's house was subdivided off from the property. The property with the caretaker's house is addressed 2965 Casco Point Road. When the property at 2965 Casco Point Road was subdivided off, it became unusually shaped and significantly changed the average lakeshore setback for the two adjacent properties. (See survey). #03-2881 Curtis/Kathleen Midthun 2941 Casco Point Road 4/18/2003 Page 4 of6 The property at 2965 Casco Point Road is the adjacent lakeshore property, and the home at 2965 Casco Point Road is located slightly behind the subject property. Attached to 2965 Casco Point Road is a strip ofland approximately 20' X 230' that goes to the lake. Because 2965 Casco Point Road has lake frontage it is the adjacent property which is used to determine average lakeshore setback. Currently, 2965 Casco Point Road views of the lake are straight ahead, almost a tunnel. The additions to the subject property will minimally if at all obscure existing views of the lake enjoyed by 2965 Casco Point Road. The addition on the south side of the residence will raise the height of the residence significantly higher than currently exists. The additions will have little impact on 2965 Casco Point Road's view of the lake. Statement of Hardship: The applicants have included their statement of hardship in Exhibit A. The applicants should also be asked for their testimony regarding this issue. Issues for Consideration: I. The existing residence was built in 1934. 2. The property is in the LR-IC zoning district and is a conforming lot. 3. The hardcover in the 75-250' setback zone is being reduced slightly to 30%, but above the allowed 25%. 4. Is there any additional existing hardcover that can be removed to make the property more conforming? Should the shed near the driveway be required to be removed? 5. Should the 1st story addition on the south side of the residence, which is proposed to be 5' from the property line, which is better than the existing 1.3 ', be required to meet the 10' setback? 6. The proposed addition will minimally if at all obstruct the view of the adjacent neighbor. The subdivision which occurred in 1977 drastically changed the average lakeshore setback for this property. The proposed additions, except for the 2' cantilevered wall, are not any closer to the lake than the existing residence. 7. We have the following comments with regards to engineering matters: • The proposed silt fence immediately north and south of the home is shown running up the hill. This silt fence configuration will concentrate flows draining towards the lake and increase erosion potential adjacent to the home . The silt fence north and south of the home should be eliminated and the silt fence shown lakeside from the home should be extended at least 10-feet on to the adjacent properties. All silt fence should be heavy duty with steel t-posts. All erosion control should be installed, inspected and approved by the City prior to any work on the site. • The drawings show the existing home and a proposed addition within 7-feet of the south lot line . It appears temporary easements will be necessary from the property owner to the south to complete the construction and install the proposed draintile . • The proposed swale shown on the street side of the home drains southerly and appears to discharge onto the neighb01ing property. The swale should be extended around the home and towards the lake to convey flows away from the neighboring property. A temporary construction easement will be required to complete this work. • Rain gutters should be installed on the home to direct water away from adjacent properties , particularly along the south side of the property. • The driveway shown to the property is mostly on the adjacent lot. (#5) #03-2881 CUTRIS AND KATHLEEN MIDTHUN, 2941 CASCO POINT ROAD, VARIANCES 6:46 -7:25 P.M. Curtis and Kathleen Midthun, Applicants, and Tom Bricko, the General Contractor, were present. Bottenberg explained that the applicants had requested side yard setback, average lakeshore setback, and hardcover in 75'-250' setback variances to construct a three stall garage and additional living space to the residence. After several meetings with staff, Bottenberg pointed out that two different additions were proposed, first, changing the roof and cantilevering a wall on the lakeside to the existing residence: 1. An attached mudroom/garage/bedroom addition to the north side. 2. Enlarging the kitchen on the south side of the residence. 3. Cantilevering the wall by 2' on the lakeside of the master bedroom. 4. Raising the roof to accommodate a new patio door on the second level with a deck and to connect the additions. Bottenberg noted that the existing residence is located 1.3' from the side property line. The original proposal was to add a story (kitchen addition) above the basement room which would also be located 1.3' from the property line. It has since been determined that the existing foundation needs to be demolished and a new one constructed. The new foundation and story above it will be located 5' from the side property line. With regard to drainage, Bottenberg noted that the eaves on the south side of the residence are shown at 1 ', leaving a 4' setback from the lot line. Drainage and excess runoff is a concern. Bottenberg pointed out that rain gutters would be required on the side of the home to direct excessive runoff away from neighbors. Bottenberg indicated that a revised drainage plan should be submitted and approved before building permits would be issued. Bottenberg reported that the proposed additions and removals result in a net decrease of 104 s.f., final hardcover would be 4,894 s.f. (31 %). She noted that the applicants had also proposed to replace an existing deck on the lakeside of the residence that has begun to deteriorate. However, the deck was shown in the plans with a railing, therefore would be included in the lot coverage by structures calculations. The cantilevered wall on the north side to the bedroom addition would be new and not over hardcover, therefore, the amount of hardcover has a net increase of 32 s.f. On the other hand, the cantilevered wall on the street side of the kitchen addition would be under the eave, therefore would not increase the amount of hardcover. In reference to the average lakeshore setback, Bottenberg noted that the property to the south, 2967 Casco Point Road, had a main residence and caretaker's house on it until 1977 when the caretaker's house was subdivided off the property. When this was subdivided, it became an unusually shaped and significantly changed the average lakeshore setback for the two adjacent properties. It was felt that the proposed additions would have little impact on the views enjoyed by 2965 Casco Point Road. After several meetings with staff, Bottenberg pointed out that two different additions were proposed, first, changing the roof and cantilevering a wall on the lakeside to the existing residence: 1. An attached mudroom/garage/bedroom addition to the north side. 2. Enlarging the kitchen on the south side of the residence. 3. Cantilevering the wall by 2' on the lakeside of the master bedroom. 4. Raising the roof to accommodate a new patio door on the second level with a deck and to connect the additions. Bottenberg noted that the existing residence is located 1.3' from the side property line. The original proposal was to add a story (kitchen addition) above the basement room which would also be located 1.3' from the property line. It has since been determined that the existing foundation needs to be demolished and a new one constructed. The new foundation and story above it will be located 5' from the side property line. With regard to drainage, Bottenberg noted that the eaves on the south side of the residence are shown at l ', leaving a 4' setback from the lot line. Drainage and excess runoff is a concern. With construction so close to the side property line, there is not room to build a swale to direct runof£'drainage around the side of the residence to the lake side. Bottenberg pointed out that rain gutters would be required on the side of the home to direct excessive runoff away from neighbors. Bottenberg indicated that a revised drainage plan should be submitted and approved before building permits would be issued. Dennis Meyer, the Applicant, was present. Gaffron indicated that the applicant was requesting approval for a lot line rearrangement between these two developed residential lots. The applicant owns both properties, and each contains an existing single family residence. Both lots are substandard in the LR-1 B 1-acre zone; the lot line rearrangement would make the larger lot slightly larger (nearer conformity) and the smaller lot slightly smaller (reduced degree of conformity). Gaffron explained that the applicant proposes to move the boundary between his two developed residential lots to reflect the visual lines of occupation as delineated by an existing tree line. The easterly lot (4655) has contained a residence since the early 1900's, which encroaches into the street right-of-way. The westerly lot ( 4685) has a relatively new home constructed in 1998 pursuant to. a lot area variance granted in 1997. No other variances were granted for this lot, which met the 80% standard for lot width. Although each existing lot is substandard as compared to the 1-acre LR-lB zoning district requirement, these lots have remained uncombined and each contains a single family residence. Therefore Gaffron noted, the two lots are each considered as 'lots ofrecord' and stand alone in terms of their zoning status. Gaffron continued, pointing out that for many substandard lots in the past, the City has approached lot line rearrangements from the perspective that the lot areas should remain the same, neither gaining nor losing area but doing an equal trade. However, that scenario would not accomplish this applicant's goal of having the lot line match the perceived visual yard boundary. These are rules of thumb; some are clearly supported in the code, others are more obscure. I like to hand gutter questions off to Bruce when it gets down to an individual property situation ...
