A RESOLUTION APPROVING
A METES AND BOUNDS
SUBDIVISION OF A LOT LINE REARRANGEMENT FOR
THE PROPERTIES LOCATED AT
65/75 FERNDALE GREEN �
FILE NO. 1844
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter "City Council")
has adopted subdivision regulations for the orderly, economic and safe development of land
within the City; and
• WHEREAS, the City Council has considered the application for a subdivision by
Kenneth R. Hopkins (hereinafter "the subdivider") of properties legally described as follows:
Outlot A and Lot 2, Block 1, Fairway Hills Addition, Hennepin County, '
Minnesota (hereinafter "the property"); and
WHEREAS, the subdivider has completed all requirements of the City for metes
and bounds subdivision of a lot line rearrangement for division and combination purposes.
NOW, THEREFORE, BE IT RESOLVED, that the Ciry Council of the City
of Orono hereby approves the metes and bounds division of a lot line rearrangement for Kenneth
R. Hopkins as shown on the Certificate of Survey by Raymond Prasch of Lot Surveys Company,
Inc. dated August 27, 1993 and attached to this resolution, subject to the following conditions:
. � 1. The purpose of the lot line rearrangement is to create adequate room for an
access drive and landscape berm. The City Engineer recommends the following
guidelines for completion of project:
a. The west and north side of the berm must be regraded to 3:1 slope. If
slopes exceed 3:1, wood fiber blanket shall be installed over the seeding
to prevent erosion until adequate vegetation is established.

b. The existing location of the driveway and toe of slope should be
maintained during the final grading. Slope should be covered with topsoil
. seeded with mixture of 500 seed and covered with mulch material prior
to September 20, 1993.
c. Driveway shall be constructed with the 3% cross slope toward the berm
from west to east and along the north side of the berm a four inch shoe
formed integral bituminous curb shall be constructed to control the
drainage.
d. A silt fence or other appropriate erosion control must be installed at the
low area to the east during the final grading stages.
2. Upon approval of this subdivision by the City Council of Orono, the subdivider
shall apply for the following legal combinations for tax purposes:
• a. Parcel A as described on the survey noted above shall be combined with
' Outlot A, Fairway Hills Addition. �
b. Parcel B as described on the survey noted above shall be legally combined
with Lot 2, Block 1, Fairway Hills Addition.
3. The aforesaid division as shown on the attached Certificate of Survey shall be
filed by the City of Orono with either the Hennepin Counry Recorder's Office or
Registrar of Titles Office on or before March 13, 1994 together with a certified
original copy of this resolution.
The subdivider is hereby advised that in order to fulfill the intent of this subdivision that
additional documentation must be created by subdivider to provide for the legal transfer of fee
title of these newly created parcels.

The approval granted by this resolution shall expire if the division has not been filed by
the date specified above. In that event it will be necessary to file a new application with the
City of Orono for subdivision review. Adopted by the Orono City Council on this 13th day of
September, 1993. :
