Owens (nereinaiter "i:ne ap�i;car.t"� is u�z :,W:,�r �f:.�:e property located at 1700 Bohn's Point Road within the City of Orono and legally described as follows: refer to Exhibit A attached (hereinafter "the property"); and VVHEREAS, the applicant has applied to the Ciry for a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit the construction of a third stall to the existing attached garage, a 52.6 s.f. addition to the kitchen and a 23 s.f. stair leadin; from main level patio doors. These improvements will result in 7,187.6 s.f. or 32.3% hardcover in the 7�- ?50' setback area where 7,308 s.f. or 32.9% exists and where onl}� 2590 is allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1839. 2. The property is located in the LR-1B Lakeshore Residential Zonin� District requiring one acre in area. This pro�,e�� � consists of �3.U1G s.f. or .76 acres. 3. The Orono Planning Commission reviewed this application on June 21, 1993 and recommended approval of the proposed variance based upon the followin� findings: A. The residence was installed prior to cunent zoning standards and lal:eshore setback requirements. B. The remo��al of some 448 s.f. of a biruminous drive will minimize negative irr.�pact of extensive paved drive in street yard. Proposed improvcments will not result in additional hardcover within the 75-250' setback area and will be maintained at 32.3%. D. The comprehensive improvement of the property will be consistent with the improvements of existing residences within the neighborhood. The comprehensive improvements wi11 not require any other variances. 4. The City Council fmds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect tra�c conditions, light, air nor pose a fire hazard or other danger to neighbori.ng property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial properry � right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The Ciry Council has considered this application including the findings and recommendations of the Planning Commission, reports by Ciry staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDTTIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit the construction of additions to the existing residence as noted above. Approval of the hardcover variance within the 75-250' setback area is subject to the following conditions: 1. All hardcover improvements scheduled for removal shall be completed prior to the footing inspection for the new construction. Hardcover removals shall be completed as shown on Page 5 of this resolution. 2. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (July 12, 1994). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors a:�d assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
