The Council met on the above -mentioned date with the following members present: exiting
Mayor Gabriel Jabbour and Council Member Charles Kelley, Mayor Barbara Peterson,
Council Members Jim White, Jay Nygard, Richard Flint, and Bob Sansevere. Representing
staff were City Administrator Ron Moorse, Planning Director Michael GaRron, Zoning
Administrator Paul Weinberger, City Engineer Tom Kellogg, Public Services Director Greg
Gappa, and Recorder Alissa Wintemheimer. City Attorney Tom Barrett was absent.
Mayor Jabbour called the meeting to order at 7:00 p.m.
Mayor Jabbour thanked everyone who attended the reception and publicly thanked Mr.
Carlson for his gift of land to the City of Orono. Kelley stated that he had been involved in
city government for 20 years and was looking forward to continued involvement with the
City.
Mayor Jabbour passed the gavel to Mayor -elect Barbara Peterson
OATH OF OFFICE
Moorse administered the Oath of Office to Mayor -elect Peterson, Council members -elect
Jay Nygard, and Jim White.
RECOGNITION
Mayor Peterson welcomed the new council members and thanked Mayor Jabbour and
Council Member Kelley for their dedicated service to the City. She also thanked their
spouses for supporting them through all of the late meetings and other obligations of their
positions. She then invited comments from members of the community and members of the
Ccuncil.
Tom Crosby stated that he was impressed with the knowledge and attention Gabriel Jabbour
gave both small and large items as the Mayor of Orono. He also stated that Mayor Jabbour
was willing to tackle issues for the good of the City with which other politicians might not
have bothered such as the Dakota Line and the Highway 12 bypass.
Lyle Kasprick thanked Mayor Jabbour for the time and effort he devoted to the community.
Andrew McDermott thanked Mayor Jabbour for his leadership in helping the City obtain a
19 acre natural area in Saga Hill, a 9 acre park in Saga Hill, and increasing their parkland in

Navarre, Crystal Bay, and other areas.
Alan Carlson stated that Mayor Jabbour was tireless in his devotion to the City
Richard Flint stated that serving on the Council with Mayor Jabbour was a privilege
because of the cooperative and respectful nature he fostered in the Council. He stated he
had never met a person who believed in democracy and people's ability to work together
more than Gabriel Jabbour.
Bob Sansevere stated that he was glad he had the opportunity to work with Mayor Jabbour
because of his welcoming and helpful nature, and his devotion to the City.
Jim White stated that Mayor Jabbour was responsible for forging a strong working
relationship with Hennepin Parks, and thanked him for his contributions to the City.

Mayor Peterson read the resolution recognizing Gabriel Jabbour for distinguished service
and outstanding leadership as Mayor and City Council Member, and presented Jabbour with
the resolution and a plaque.
Flint moved, and Sansevere seconded, to adopt Resolution No. 4594 recognizing
Gabriel Jabbour for distinguished service and outstanding leadership as Mayor and
City Council Member.

2. Council Member Charles Kelley —Resolution No. 4595
Mayor Peterson read the resolution recognizing Charles Kelley for his distinguished service
as City Council Member, and presented Kelley with the resolution and a plaque. She also
acknowledged Kelley's 10 years of service on the Planning Commission, 8 years as Chair,
which together with his service on the Council add up to 20 years of dedicated service to the
City.
Flint moved, and Sansevem seconded, to adopt Resolution No. 4595 recognizing
Charles Kelley for distinguished service as City Council Member.

PARK COMMISSION COMMENTS—ANDREW MCDERMOTT,
REPRESENTATIVE
Mr. McDermott stated that the Park Commission was looking at the Lurton property
donation and some surrounding properties that Mn/DOT is taking. They would like the
Council to consider the property at the northeast comer of Highway 12 and County Road 6
that would be acquired by Mn/DOT for the new interchange. A corridor for a trail
connection between the Lorton property and County Road 6 should be preserved across the
eastern portion of this property. They also discussed the possibility of a pedestrian overpass
from Stubbs Bay Road to the Lurton property. This would provide a link for a possible trail
linking the Luce Line to Baker Park through the Luton property and the Highway
12/County Road 6 intersection property to be acquired by Mn/DOT for the new Highway
12/County Road 6 interchange. The possibility of an ISTEA grant to fund construction of
this bridge could be pursued.

10. Annual Appointments Resolution No. 4598
Moorse stated that his memo covered all of the appointments before the Council, except
the appointment of Secretary for the HRA. Mayor Peterson asked if Sansevere would
accept the position of Secretary for the HRA. He stated he would.
Mayor Peterson moved, and White seconded, that Mr. Sansevere be appointed to
the position of Secretary for the HRA for the upcoming year.
Vote: Ayes, 4, Nays 0 (Sansevere refrained from voting).
Mayor Peterson stated that Flint would be the Acting Mayor in her absence.
Flint asked if the new Chief of Police would take over Gary Cheswick's appointments
when she arrives. Moorse stated that she would.

Application Summary: The applicants o%%m the subject property and are requesting a lot area

early 1960's and an accessory building were removed per a demolition permit in June, 2000. The
lot is approximately 4.89 acres and the minimum lot area requirement is 5 acres. A lot area variance

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 10.27, SUBDIVISION 5 (B),
FILE NO.2646
WHE"nS, John H. Adams and Clea T. Altman, (hereinafter "the applicants") are
the owners of the property located at 4245 Chippewa Lane within the City of Orono (hereinafter "the
City") and legally described as follows:
The east Quarter of South Half of northwest Quarter of southeast Quarter of Section
31, Township 118, Range 23, Except the railroad rightaway, together with an
Easement for passage and travel over the north 1 rod of south half of northwest
Quarter of southeast Quarter of said Section 31, according tot he U. S. Government
Survey thereof, Hennepin County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.27, Subdivision 5 (B) to permit new residential construction on a 4.89 acre
lot where 5 acres is required.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on January 17, 2001, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
FINDINGS
This application was reviewed as Zoning File #2646.
2. The property is located in the RR-1 A Zoning District, where 5 acres is the minimum
required lot area. The property consists of approximately 4.89 acres.
3. The Orono Planning Commission reviewed this application on January 17, 2001 and
recommended approval by a vote of 4 to 0.

4. The Planning Commission made the following findings of fact:
A. There is no additional land to combine with the property.
B. The lot was platted prior to current zoning requirements.
C. The lot can be developed without the need for further variances.
D. The property has been developed with a residential use since at least 1965.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to allow new residential
construction on a 4.89 acre lot where 5 acres is required. Approval is subject to the following
conditions:
1. Council approval is based on the site plan submitted by the applicant attached to this
resolution as Exhibit A. Any amendments to the site plan may require furthe.
Planning Commission and City Council review.

2. It is the intent of the City Council that any additional variances to develop the lot
would not be looked upon favorably.
3. Authorities granted by this variance run with the property not with the applicants,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (January 22, 2002).
4. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, Minnesota at a regular meeting held on
the 22nd day of January, 2001.

Application Summary: The applicant is proposing to construct an attached two stall garage (21'
x 33') with a second story. The first floor will be a two stall garage. The second floor will be
additional living space. The existing garage will also be turned into living space. Floor plans for
second floor living space over the garage were not submitted by the applicant.
The existing residence was built in the 1960's and no additions have been constructed to the
residence. The new garage location will allow the existing floor plan to continue and will maintain
the existing front entry.
The property is unusual in it is surrounded on three sides by road: Rest Paint Road and Rest Point
Circle. Structural lot coverage and hardcover is not a problem with this application.
1. Section 10.24, Subdivision 5 (B): Side Yard Adjacent Street Setback: The minimum
requirement shall be observed for side yard adjacent street setback: 35 feet. To permit a residential
addition to be 22' from the side yard adjacent street property line where 35' is required.

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 10.24, SUBDIVISION 5 (B),
FILE NO.2647
WHEREAS, Robert M. Zaun and Kimberly A. Zaun, (hereinafter "the applicants")
are the owners of the property located at 1337 Rest Point Circle within the City of Orono (hereinafter
"the City") and legally described as follows:
All that part of Lot 4, Rest Point Park, Lake Minnetonka, Hennepin Co., Minn., lying
Northeasterly of a line described as follows: Beginning at a point on the
Northwesterly line of said Lot 4, distant 104 feet Northeasterly from the most
Westerly comer thereof; thence Southeasterly to the angle point on the Southeasterly
line thereof, distant 114.4 feet from the most Southerly comer thereof and there
ending, Hennepin County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.24, Subdivision 5 (B) to allow a side yard adjacent street setback of 22'
where 35' is required to permit a residential addition to the existing residence.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on January 17, 2001, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
FINDINGS
This application was reviewed as Zoning File #2647.
2. The property is located in the LR-t B Zoning District, where 1 acre or 43,560 s.f. is
the minimum required lot area. The property consists of approximately 24,067 s.f.
or .55 acres.

3. The Orono Planning Commission reviewed this application on January 17, 2001 and
recommended approval by a vote of 4 to 0.
4. The Planning Commission made the following findings of fact:
A. The structural coverage on the lot and hardcover are both conforming.
B. The residence was built prior to current zoning standards.
C. Granting of the variance will have no impact on neighboring residences.
D. Due to the location of the house and its interior layout, there is no practical
way to locate the proposed garage space and additional living space addition
in a conforming location.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety. and
welfare of the community.
CONCLOSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to allow a side yard adjacent
street setback of 22' where 35' is required to permit a residential addition to the existing residence.
Approval is subject to the following conditions:

1. Council approval is based on the site plan submitted by the applicant attached to this
resclution as Exhibit A. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. Authorities granted by this variance run with the property not with the applicants,
but are permissive only and must be exercised by application for a building permit
within one year of the date of Council approval, or these variances will expire on that
date (January 22, 2002).
3. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code, shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, Minnesota at a regular meeting held on
the 22nd day of January, 2001.

Application Summary: The applicants own the subject property and are requesting a lot width
variance and an accessory building variance to construct a new residence on the lot. The existing
residence that was built in 1950 was removed per a demolition permit in December, 2000.
A lot width variance is required due to the lot being 90 feet wide where 140' is required in the LR-1 B

WHEREAS, Timothy D. Landon and Amy E. Landon, (hereinafter "the applicants')
are the owners of the property located at 1360 Vine Place within the City of Orono (hereinafter "the
City") and legally described as follows:
See Exhibit A
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.24, Subdivision 5 (B) to permit new residential construction on a lot that
is 90 feet wide where 140 feet is required and Section 10.03, Subdivision 9 to permit an accessory
structure on a lot without a principal structure.
WHEREAS, after due put. &shed notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on January 17, 2001, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
FINDINGS
This application was reviewed as Zoning File #2658.
The property is located in the LR-1 B Zoning District, where 43,560 s.f. or I acre is
the minimum required lot area. The property consists of approximately 69,150 s.f.
or 1.587 acres.
The Orono Planning Commission reviewed this application on January 17, 2001 and
recommended approval of the proposed variances based upon the following findings:

A. The property has been developed with a residential use since at least 1950.
B. The site plan indicates the proposed setbacks 10' to the side property lines
and the house would be outside of the 75' lakeshore setback. The entire
house wouM be located approximately 112' from the lakeshore, which meets
the intent of the Comprehensive Plan for ne%v structures.
C. The lot can be developed without the need for further variances.
D. The detached accessory building is in good structural condition.
E. Variance approval was granted for the oversized accessory building in 1976.
5. The City Council finds that the conditions emsting on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property: would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Comndssion, reports by City Staff, comments by
the applicants and the effect of the proposed variances on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings. the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to allow new residential
construction on a lot that is 90 feet wide and 140 feet is required and Section 10.03, Subdivision 9
to allow an accessory structure on a lot without a principal structure. Approval is subject to the
following conditions:

I. Council approval is based on the site plan submitted by the applicant attached to this
resolution as Exhibit B. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. It is the intent of the City Council that variances to develop the lot would not be
looked upon favorably.
3. Authorities granted by these variances run with the property not with the applicants,
but are permissive only and must be exercised by application for a building permit
within one year ofthe date of Council approval, or these variances will expire on that
date (January 22, 2002).
4. Violation of or non-compliance with any of the terms and conditions of these
variances shall constitute a violation ofthe zoning code, shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terns of
this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, Minncsota at a regular meeting held on
the 22nd day of January, 2001.

proposed Dire Trail project funded by the State
does follow the sa.:,e criteria as the F.A.U. rrant

agencies, would require some City funding. F.A.U.

Background Summary:

PLAT OF BILL KELLEYS LAND
THIRD ADDITION

WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Mires and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS, the City Council has considered the application for a subdivision of a
two (2) lot residential plat by James R. Johnson and Helen L. Johnson, husband and wife
(hereinafter "the subdividers'); and
WHEREAS, the subdivision has been found to meet all standards of the RR-1B, 2
Acre Single Family Rural Residential Zoning District finding that each lot is of a size and
configuration that would allow its use for a single family residence to be fully developed; and
WHEREAS, the subdividers have completed or have agreed to complete all
requirements of the platting regulations of the City, including:
1. Completion of all the requirements of Resolution No. 4561, the resolution granting
preliminary approval of the subdivision.
2. Dedication on the plat of standard perimeter drainage and utility easements.
3. Outlot A has been platted for driveway purposes to serve only Lot 1. Outlot A will
be legally combined and remain in ownership with Lot 1.
4. Covenants will be filed in the chain of title for each lot as an advisory to future
property owners that primary and secondary drainfield sites exist on the property and
are protected.

5. The MCWD has approved the wetland mitigation plan to allow for a driveway access
to Lot 1.
6. Revised Flowage and Conservation Easements over all wetlands, to reflect the new
wetland boundaries following full mitigation, will be provided and recorded
simultaneously with the vacation of underlying easements.
7. Payment to the City for the final plat review fee and fee for legal review and filing
of the plat, easements and covenants in the amount of $400.00.
g. Payment to the City for park dedication fees for the creation of one (1) new lot in the
amount of S5,300.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of Bill Kelleys Land Third Addition, Hennepin County, Minnesota, copy
attached hereto as Exhibit A, subject to the following conditions:
Prior to City release of the plat for filing, applicant shall provide evidence of fee
ownership of the property in a form acceptable to the City Attorney, and applicant
shall meet any other title requirements and requirements of Preliminary Plat approval
as may be required by the City Attorney.
2. Applicant shall provide all documents noted in this resolution in a format acceptable
to the City Attomey prior to release of the plat for filing, and shall complete all
conditions to the satisfaction of City staff, prior to release of the plat for filing.
The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorders Office or Registrar of Titles Office on or before July 22, 2001
together with a certified original copy of this resolution and executed copies of the
easements and covenants noted above.

specified above. In that event, it will be necessary to file a new application with the City of Orono

WHEREAS, James R. Johnson, (hereinafter "the subilhider") on May 17,2000,filed
an application with the City of Orono (hereinafter "the City") requesting subdivision of property
located at 2240 Fox Street within the City of Orono and legally described as follows:
Lot 4, Block 1, BILL KELLEY'S LAND, Hennepin County, Minnesota (hereinafter
"the property"); and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Subdivision Codes, the Orono Planning
Commission held a public hearing on June 19, 2000, at which time all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
WHEREAS, at their regular meeting held on November 13, 2000 the Orono City
Council considered the subdivisioe application of the subdivider noting the following findings of
fact:
FINDINGS
The property is located within the RR-1B Single Family Rural Residential Zoning
District requiring a minimum of 2 acres of contiguous dry buildable land within each
newly created lot.
2. The property contains a total of S.1 acres of land.
3. Lots 1 and 2 each meet the minimum size requirements for lots in the RR -I B zoning
district. Lot 1 meets the 3-acre minimum area requirement for a back lot per zoning
code Section 11.31 Subd. 5.

4. Both lots have been found to have adequate and suitable soils and approved sites for
on -site szptic treatment facilities.
5. Driveway access for Lot I is via Outlot A with an opening from Fox Street. Lot 2
has a separate opening from Fox Street.
6. The driveway serving Lot I will cross a designated wetland. Applicant has gained
the necessary agency approvals for such crossing. The City Council finds that the
wetland rill to create a driveway is necessary to preserve a property right of the
applicant, and that the crossing will have minimal impact on the wetland and
floodplain when properly constructed and mitigated as proposed.
9. The existing Flowage and Conservation Easements over wetlands in Lots 1 and 2
should be revised to reflect the recent wetland delineations and intended mitigation
but should continue to exclude the driveway corridor.
8. A single family residence can be constructed on Lot I without the need for further
variances. The existing residence on Lot 2 meets all required setbacks of the RR-IB
district.
NOW, THEREFORE BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves the preliminary plat for
James R. Johnson per preliminary plat drawings by Mark Gronberg, Land Surveyor, Coffin &
Gronberg, Inc., Land Surveyors dated 5/16/00, revised 10-18-2000, subject to the following
conditions:
Subdivider shall pay the standard Park Dedication Fee per City ordinance for one
additional building lot.
2. Dedication of drainage and utility easements 5' along interior lines and 10' along the
perimeter boundaries.
Prior to residential construction on Lot 1, all preliminary and alternate septic sites
must be fenced off prior to any construction activities.

4. The City will grant the necessary variance and CUP for the wetland crossing for the
driveway to serve Lot 1, subject to mitigation of wetland fill on site and buffer

applicant dated October 27, 2000.
5. The existing Flowage and Conservation Easements over wetlands in Lots 1 and 2
shall be revised to reflect the recent wetland delineations and intended mitigation but
shall continue to exclude the driveway corridor.
6. Outlot A is intended merely as a corridor for driveway serving Lot 1 and shall contain
no primary or accessory structures.
7. Suudivider is hereby advised that preliminary subdivision approval will expire one
year from the date of Council preliminary plat approval. Should the subdivider fail
to complete the filing of the final plat application within the year deadline, it shall be
necessary for the subdivider to file a new preliminary subdivision application with
the City.
Final Plat Submittals:
The following list of final submittals must be submitted to the Zoning Administrator two
weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the
month. These submittals are as follows:
1. Record plat drawings in the form of two (2) mylar copies (one copy for the City's
records and one for filing with Hennepin County) and one (1) copy reduced to l" _
200'. Drawing to include:
A. Lot lines platted net preliminary survey by Coffin & Gronberg, Inc. dated
September 29, 2000, on file with the City of Orono.
Dedication of drainage and utility easements 10' wide along the exterior
boundaries of property and 5' along the internal lot lines, per the attached

to create a driveway to Lot 1 is requested. The CUP is subject to the standards for work in the "Flood
Fringe" per section 10.55 Subd. 10. When the existing 8 acre parcel was created in 1977, the City
accepted a Conservation and Flowage Easement that left a corridor through the wetland for this
future purpose. In April, 2000, the Building Official granted applicant a permit to construct the
driveway to the back lot, based on that easement and based on the fill being less than the 500 cubic
yard threshold for requiring a land alteration CUP. It was later noted during review of the 1977
subdivision file that no formal approvals had been granted for the wetland crossing; therefore, a
request for such approval has been added to this subdivision application.
The new driveway serving the back lot crosses the delineated wetland at a width of 20-30'. While
the driveway crossing is not subject to the existing easement conditions, it is still subject to Orono's
wetland ordinances, MC WD and Wetland Conservation Act (WCA) regulations, and this is a DNR
protected wetland.

A condition of the approval motion by the Planning Commission was to obtain the necessary
approvals (or waivers) from each of the affected agencies with wetlandjurisdiction. On October 26,
2000 the MC WD approved the applicant's after -the -fact permit application (Exhibit B) for wetland
fill to construct the driveway for access to Lot 1, subject to 2:1 mitigation on site. The fill and
mitigation areas are shown on the preliminary plat drawing. The DNR has waivedjurisdiction over
this specific wetland per the letter attached as Exhibit C.
PLANNING COMMISSION RECOMMENDATION:
On June 19, 2000 the Planning Commission voted 6 to 0 on a motion to recommend preliminary plat
approval for the two -lot subdivision, subject to applicant gaining the necessary agency approvals
relating to the wetland fill for driveway purposes, prior to City Council approval of the application.
All necessary agency approval have been obtained.
STAFF RECOMMENDATION:
Staff recommends approval of the preliminary plat and wetland fill variance/CUP subject to the
conditions of the attached resolution.

Background:
The applicant is requesting an after -the -fad permit for wetland fill to construct a driveway for
access to a single-family home. The City of Orono, in 1977, allowed a 50-foot wide corridor
through a wetland area for access to Mr. Johnson's property. The City took a conservation
easement over the remaining wetland area. Access to this site is only available through the
corridor. An on site inspection by the DNR found that the driveway impact is outside of the
DNR wetland and is therefore covered under WCA rules.

Dear Ms. Bottenberg;
Thank you for meeting with me today at the James R. Johnson property at 2240 Fos Street. After
viewing the site, I determined that the new driveway fill site is located above the Ordinary High
Water mark of Unnamed Wetland #27-862w. Therefore, there is no longer any need to request a
waiver to DNR permit authority, as in your August 10, 2000-letter to me. The fill for this driveway
was not placed in the public water wetland basin and no DNR permits or waivers are required.
I estimated that the edge of Wetland #27-862w is about 95 feet west and about 45 feet east of the
centerline of the driveway. The edge of the basin is approximately the edge of the cattail stands on
both sides of the driveway. The driveway sits on a slightly higher wetland area that is dominated by
reed canary grass.
As was discussed, the driveway fill placement was subject to the terms and conditions of the
Wetlands Conservation Act. Minnehaha Creek Watershed District administers the Act within the
City of Orono. Mr. Johnson will need to contact the District to determine how to approach this
problem.

WHEREAS, James R. Johnson, (hereinafter "the subdivider") on May 17, 2000, filed
an application with the City of Orono (hereinafter "the City") requesting subdivision of property
located at 2240 Fox Street within the City of Orono and legally described as follows:
Lot 4, Block 1, BILL KELLEY'S LAND, Hennepin County, Minnesota (hereinafter
"the property"); and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Subdivision Codes, the Orono Planning
Commission held a public hearing on June 19, 2000. at which time all persons desiring to be heard
concerning this application were given the oppommity to speak thereon.
WHEREAS, at their regular meeting held on November 13, 2000 the Orono City
Council considered the subdivision application of the subdivider noting the following findings of
fact:
FINDINGS
The property is located within the RR-lB Single Family Rural Residential Zoning
District requiring a minimum of 2 acres of contiguous dry buildable land within each
newly created lot.
2. The property contains a total of 8.1 acres of land.
Lots 1 and 2 each meet the minimum size requirements for lots in the RR-1 B zoning
district. Lot 1 meets the 3-acre minimum area requirement for a back lot per zoning
code Section 11.31 Subd. 5

4. Both lots have been found to have adequate and suitable soils and approved sites for
on -site septic treatment facilities.
5. Driveway access for Lot I is via Outlot A with an opening from Fox Street. Lot 2
has a separate opening from Fox Street.
6. The driveway serving Lot I will cross a designated wetland. Applicant has gained
the necessary agency approvals for such crossing. The City Council finds that the
wetland fill to create a driveway is necessary to preserve a property right of the
applicant, and that the crossing will have minimal impact on the wetland and
floodplain when properly constructed and mitigated as proposed.
7. The existing Flowage and Conservation Easements over wetlands in Lots 1 and 2
should he revised to reflect the recent wetland delineations and intended mitigation
but should continue to exclude the driveway corridor.
8. A single family residence can be constructed on Lot I without the need for further
variances. The existing residence on Lot 2 meets all required setbacks of the RR-1 B
district.
NOW, THEREFORE BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves the preliminary plat for
James R. Johnson per preliminary plat drawings by Mark Gronberg, Land Surveyor, Coffin &
Gronberg, Inc., Land Surveyors dated 5/16/00, revised 10-18-2000, subject to the following
conditions:
Subdivider shall pay the standard Park Dedication Fee per City ordinance for one
additional building lot.
Dedication of drainage and utility easements 5' along interior lines and I0' along the
perimeter boundaries.
Prior to residential construction on Lot 1, all preliminary and alternate septic sites
most be fenced off prior to any construction activities.

4. The City will grant the necessary variance and CUP for the wetland crossing for the
driveway to serve Lot 1, subject to mitigation of wetland fill on site and buffer
preservation per the MCWD's permit requirements in the letter from MCWD to
applicant dated October 27, 2000.
5. The existing Flowage and Conservation Easements over wetlands in Lots I and 2
shall be revised to reflect the recent wetland delineations and intended mitigation but
shall continue to exclude the driveway corridor.
6. Outlot A is intended merely as a corridor for driveway serving Lot I and shall contain
no primary or accessory structures.
7. Subdivider is hereby advised that preliminary subdivision approval will expire one
year from the date of Council preliminary plat approval. Should the subdivider fail
to complete the filing of the final plat application within the year deadline, it shall be
necessary for the subdivider to file a new preliminary subdivision application with
the City.
Final Plat Submittals:
The following list of final submittals must be submitted to the Zoning Administrator two
weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the
month. These submittals are as follows:
Record plat drawings in the form of two (2) mylar copies (one copy for the City's
records and one for filing with Hennepin County) and one (1) copy reduced to 1" _
200'. Drawing to include:
A. Lot lines platted per preliminary survey by Coffin & Gronberg, Inc. dated
September 29, 2000, on file with the City of Orono.
B. Dedication of drainage and utility easements 10' wide along the exterior
boundaries of property and 5' along the internal lot lines, per the attached
drawing.

C. Revised wetland boundaries as noted above, shown as drainage easements or
wetlands on the plat.
D. Naming of plat.
2. Legal documents required:
a. Title opinion addressed to the City. All owners, mortgage holders or others
with property interest indicated therein shall sign the plat and all other
documents affected by such interest.
b. The applicant must provide certified copies of all recorded easements
currently affecting the property.
C. Revised and executed Conservation and Flowage Easement reflecting legal
description changes as noted above.
3. Fees to be paid.
a. Final plat fee = $200.00
b. Legal review and filing fees for subdivision and associated documents =
$200.00
C. *Park Dedication Fee: amount shall be determined as soon as City Assessor
has placed a fair market value on the undeveloped land at the time of
preliminary plat approval. The subdivider shall be advised as soon as
Assessors report has been filed with City. Park dedication fee shall be based
on 8% of the fair market value of the land.

Matthew Boltemtan. Matthew has worked as a septic inspector for Pierce County, Wisconsin and

• There were two Salvation Army collection events for all WHRC cities that collected a total of 53 tons.
• It was determined by the WHRC that reserves which have accrued over the past six years would be used to
purchase recycling bins at no direct charge to the cities. It is anticipated that the WHRC will be able to
provide recycling bins at no charge to the cities until at least the year 2004. The bins are larger than the old
style stackable bin and contain a recycling logo. They have a 30% recycled plastic content.

Obiectives for she Year 2001 include:
• Issue a Request for Proposal (go out for bids) for curbside collection service.
• Begin a two sort (one all paper, one all cans & bottles) comingled curbside collection process to begin
January 2002.
• Update 'The Recyclopedia' waste reduction guide to be delivered to curbside recyclers in conjunction with
America Recycles events in November 2001.
• Host two Salvation Army collections.

The City of Maple Plain has changed the scheduled closing date for Town Line Road at T.H. 12
from January 19, 2001 to Febrimy 15, 2001. The City of Maple Plain would ask that the City of
Orono notify any residents of the closing. There will be a general closing notice published in the
Laker newspaper next week.
The attached drawing indicates the location of signs that will be placed to alert road users and
residents of the closing. It is anticipated that the contractor will place the signs the week of
January 20.
The turn around on Town Line road will be located north of the Kearin's existing driveway as
shown on the attached plan and discussed at the December 4, 2000 meeting on site. Permanent
signing and the placement of an embankment under the bridge will be completed next spring.
The City of Independence expressed concerns for protecting Town Line Road when construction
of the frontage road on the Kearin's property takes place. We have talked with Tom O'Keefe
about using the private drive to the Rudd property or temporarily opening up the underpass at
Town Line Road when this construction takes place.

Dear Area Residents;
The City of Maple Plain has announced that the Townline Road/ TH 12 intersection will be
permanently closed on February 15, 2001. Advance warning signs will be installed by February
10 to notify motorists of the closing. A "Dead End" sign will be installed at the County Road 6
entrance to Townline Road. A cul-de-sac will be constructed at the north end of Townline Road
to allow for a vehicle turnaround.
