ORONO CITY COUNCIL MEETING �^ NAINUTES FOR JANUARY S, 2001 ucFTIN JAN 2 2 2000 ROLL. t;ii r ur vnvrvV The Council met on the above -mentioned date with the following members present: exiting Mayor Gabriel Jabbour and Council Member Charles Kelley, Mayor Barbara Peterson, Council Members Jim White, Jay Nygard, Richard Flint, and Bob Sansevere. Representing staff were City Administrator Ron Moorse, Planning Director Michael GaRron, Zoning Administrator Paul Weinberger, City Engineer Tom Kellogg, Public Services Director Greg Gappa, and Recorder Alissa Wintemheimer. City Attorney Tom Barrett was absent. Mayor Jabbour called the meeting to order at 7:00 p.m. Mayor Jabbour thanked everyone who attended the reception and publicly thanked Mr. Carlson for his gift of land to the City of Orono. Kelley stated that he had been involved in city government for 20 years and was looking forward to continued involvement with the City. Mayor Jabbour passed the gavel to Mayor -elect Barbara Peterson OATH OF OFFICE Moorse administered the Oath of Office to Mayor -elect Peterson, Council members -elect Jay Nygard, and Jim White. RECOGNITION Mayor Peterson welcomed the new council members and thanked Mayor Jabbour and Council Member Kelley for their dedicated service to the City. She also thanked their spouses for supporting them through all of the late meetings and other obligations of their positions. She then invited comments from members of the community and members of the Ccuncil. Tom Crosby stated that he was impressed with the knowledge and attention Gabriel Jabbour gave both small and large items as the Mayor of Orono. He also stated that Mayor Jabbour was willing to tackle issues for the good of the City with which other politicians might not have bothered such as the Dakota Line and the Highway 12 bypass. Lyle Kasprick thanked Mayor Jabbour for the time and effort he devoted to the community. Andrew McDermott thanked Mayor Jabbour for his leadership in helping the City obtain a 19 acre natural area in Saga Hill, a 9 acre park in Saga Hill, and increasing their parkland in ORONO CITY COUNCIL MEETING MINUTES FOR JANUARY 8, 2001 RECOGNITION —Continued Navarre, Crystal Bay, and other areas. Alan Carlson stated that Mayor Jabbour was tireless in his devotion to the City Richard Flint stated that serving on the Council with Mayor Jabbour was a privilege because of the cooperative and respectful nature he fostered in the Council. He stated he had never met a person who believed in democracy and people's ability to work together more than Gabriel Jabbour. Bob Sansevere stated that he was glad he had the opportunity to work with Mayor Jabbour because of his welcoming and helpful nature, and his devotion to the City. Jim White stated that Mayor Jabbour was responsible for forging a strong working relationship with Hennepin Parks, and thanked him for his contributions to the City. 1. Mayor Gabriel Jabbour—Resolution No. 4594 Mayor Peterson read the resolution recognizing Gabriel Jabbour for distinguished service and outstanding leadership as Mayor and City Council Member, and presented Jabbour with the resolution and a plaque. Flint moved, and Sansevere seconded, to adopt Resolution No. 4594 recognizing Gabriel Jabbour for distinguished service and outstanding leadership as Mayor and City Council Member. Council Member Charles Kelley —Resolution No. 4595 Mayor Peterson read the resolution recognizing Charles Kelley for his distinguished service as City Council Member, and presented Kelley with the resolution and a plaque. She also acknowledged Kelley's 10 years of service on the Planning Commission, 8 years as Chair, which together with his service on the Council add up to 20 years of dedicated service to the City. ORONO CITY COUNCIL MEETING MINUTES FOR JANUARY 8, 2001 PARK COMMISSION COMMENTS—ANDREW MCDERMOTT, REPRESENTATIVE Mr. McDermott stated that the Park Commission was looking at the Lurton property donation and some surrounding properties that Mn/DOT is taking. They would like the Council to consider the property at the northeast comer of Highway 12 and County Road 6 that would be acquired by Mn/DOT for the new interchange. A corridor for a trail connection between the Lorton property and County Road 6 should be preserved across the eastern portion of this property. They also discussed the possibility of a pedestrian overpass from Stubbs Bay Road to the Lurton property. This would provide a link for a possible trail linking the Luce Line to Baker Park through the Luton property and the Highway 12/County Road 6 intersection property to be acquired by Mn/DOT for the new Highway 12/County Road 6 interchange. The possibility of an ISTEA grant to fund construction of this bridge could be pursued. PLANNING COMMISSION COMMENTS None. PUBLIC COMMENTS None. ZONING ADMINISTRATOR'S REPORT None. Mayor Peterson asked if Sansevere would accept the position of Secretary for the HRA. He stated he would. Mayor Peterson moved, and White seconded, that Mr. Sansevere be appointed to the position of Secretary for the HRA for the upcoming year. Vote: Ayes, 4, Nays 0 (Sansevere refrained from voting). Mayor Peterson stated that Flint would be the Acting Mayor in her absence. Flint asked if the new Chief of Police would take over Gary Cheswick's appointments when she arrives. The existing residence that was constructed in the early 1960's and an accessory building were removed per a demolition permit in June, 2000. COUNCIL ACTION REQUESTED: To adopt or amend the enclosed resolution. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.27, SUBDIVISION 5 (B), FILE NO.2646 WHE"nS, John H. Adams and Clea T. Altman, (hereinafter "the applicants") are the owners of the property located at 4245 Chippewa Lane within the City of Orono (hereinafter "the City") and legally described as follows: The east Quarter of South Half of northwest Quarter of southeast Quarter of Section 31, Township 118, Range 23, Except the railroad rightaway, together with an Easement for passage and travel over the north 1 rod of south half of northwest Quarter of southeast Quarter of said Section 31, according tot he U. S. Government Survey thereof, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicants have applied to the City for variances to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to permit new residential construction on a 4.89 acre lot where 5 acres is required. WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on January 17, 2001, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Minnesota: NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, FINDINGS This application was reviewed as Zoning File #2646. 2. The property is located in the RR-1 A Zoning District, where 5 acres is the minimum required lot area. The property consists of approximately 4.89 acres. 3. The Orono Planning Commission reviewed this application on January 17, 2001 and recommended approval by a vote of 4 to 0. Page 1 of 5 4. The Planning Commission made the following findings of fact: A. There is no additional land to combine with the property. B. The lot was platted prior to current zoning requirements. C. The lot can be developed without the need for further variances. D. The property has been developed with a residential use since at least 1965. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to allow new residential construction on a 4.89 acre lot where 5 acres is required. Approval is subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require furthe. Planning Commission and City Council review. Page 2 of 5 2. It is the intent of the City Council that any additional variances to develop the lot would not be looked upon favorably. 3. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (January 22, 2002). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. Wetland Variance/CUP for Driveway As part of this application, a variance to Section 10.55 Subd. 8 and a CUP for minor wetland filling to create a driveway to Lot 1 is requested. The CUP is subject to the standards for work in the "Flood Fringe" per section 10.55 Subd. 10. When the existing 8 acre parcel was created in 1977, the City accepted a Conservation and Flowage Easement that left a corridor through the wetland for this future purpose. In April, 2000, the Building Official granted applicant a permit to construct the driveway to the back lot, based on that easement and based on the fill being less than the 500 cubic yard threshold for requiring a land alteration CUP. It was later noted during review of the 1977 subdivision file that no formal approvals had been granted for the wetland crossing; therefore, a request for such approval has been added to this subdivision application. The new driveway serving the back lot crosses the delineated wetland at a width of 20-30'. Johnson property at 2240 Fos Street. After viewing the site, I determined that the new driveway fill site is located above the Ordinary High Water mark of Unnamed Wetland #27-862w. Therefore, there is no longer any need to request a waiver to DNR permit authority, as in your August 10, 2000-letter to me. The fill for this driveway was not placed in the public water wetland basin and no DNR permits or waivers are required. I estimated that the edge of Wetland #27-862w is about 95 feet west and about 45 feet east of the centerline of the driveway. The edge of the basin is approximately the edge of the cattail stands on both sides of the driveway. The driveway sits on a slightly higher wetland area that is dominated by reed canary grass. As was discussed, the driveway fill placement was subject to the terms and conditions of the Wetlands Conservation Act. Minnehaha Creek Watershed District administers the Act within the City of Orono. Mr. Johnson will need to contact the District to determine how to approach this problem. The existing Flowage and Conservation Easements over wetlands in Lots 1 and 2 should he revised to reflect the recent wetland delineations and intended mitigation but should continue to exclude the driveway corridor. 8. A single family residence can be constructed on Lot I without the need for further variances. The existing residence on Lot 2 meets all required setbacks of the RR-1 B district. It is anticipated that the WHRC will be able to provide recycling bins at no charge to the cities until at least the year 2004. The bins are larger than the old style stackable bin and contain a recycling logo. The City of Maple Plain would ask that the City of Orono notify any residents of the closing. There will be a general closing notice published in the Laker newspaper next week. The attached drawing indicates the location of signs that will be placed to alert road users and residents of the closing. It is anticipated that the contractor will place the signs the week of January 20. The turn around on Town Line road will be located north of the Kearin's existing driveway as shown on the attached plan and discussed at the December 4, 2000 meeting on site. Permanent signing and the placement of an embankment under the bridge will be completed next spring. The City of Independence expressed concerns for protecting Town Line Road when construction of the frontage road on the Kearin's property takes place. We have talked with Tom O'Keefe about using the private drive to the Rudd property or temporarily opening up the underpass at Town Line Road when this construction takes place.
