A RESOLUTION TO APPROVE CONNECTION
TO MUNICIPAL SEWER OF THE PROPERTY LOCATED
AT 1940 SHORELINE DRIVE .
WHEREAS, Alan Nettles (hereinafter the property owner) is owner of the
property, including single family residence, located at 1940 Shoreline Drive within the City of
Orono and legally described as follows:
The southwesterly 121.12 feet of Lot 5, Elbridge S. Barnes First
Addition, in Section 10, Township 117, Range 23, according to
� the recorded plat thereof on file and of record in the office of the
Registrar of Titles, Hennepin County, Minnesota (hereinafter the
• property); and
WIi�REAS, on June 4, 1993 the applicant submitted a letter to the City
requesting that his properry be allowed to connect to the municipal sewer which is located in the
right-of-way of County Road 15 approximately 20 feet from his southeasterly property corner;
and
WHEREAS, said municipal sewer line is part of the City's 1985-LS-1 Crystal
Bay sewer lateral project, for which properties bene�tting by such system were assessed for the
costs of said system; and .
WI�REAS, the properry at 1940 Shoreline Drive was not provided with a sewer
stub as part of Project 1985-LS-1, it was not assessed for that project, and was not incorporated
within the MUSA boundary created for said project; and
WHEREAS, the applicant has made formal application to� the City for a
Comprehensive Plan amendment to relocate the MUSA boundary to include his properry, which
amendment was approved by the City Council in Resolution #3348 on October 25, 1993, and
approved by the Metropolitan Council on November 4, 1993; and
WHEREAS, the properiy is located on the °lakeshore of Lake Minnetonka and
<. contains a single family residence with a failing septic system. The properry�is approximately
� • 2.2 acres in area and includes wetlands, and therefore is not further subdividable under ti�e lot

requirements of the LR-lA zoning district. A municipal sewer lateral exists approximately 20
feet from the properry, requiring no extension of the municipal sewer. The costs of replacing
the existing failing septic system with a fully conforming septic system approximate the costs
of the connection charge for the 1985-LS-1 project plus the SAC charge and connection costs
to be borne by the property owner; and � .
WHEREAS, allowing the property to connect to the municipal sewer will not be
in conflict with the goals and policies of the Orono Community Management Plan, in that no
extension of municipal sewer is required, no new high density development will occur as a result
of the MUSA boundary expansion, and Lake Minnetonka will be further protected by the
elimination of a failing septic system located on a lakeshore lot; and
WHEREAS, the applicant has requested that the current connection charge of
$11,218.00 be split into a portion to be paid prior to connection and a portion to be levied as
a special assessment, in proportions approxunating those paid and remaining assessments of the
• properties in the Crystal Bay project; and
. WI�REAS, the City wishes to establish an easement for possible future sewer
construction which may occur on or in the right-of-way adjacent to the property.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Orono,
Minnesota that the property at 1940 Shoreline Drive shall be allowed to make connection to the
municipal sewer subject to the following conditions:
1. Prior to making the connection, applicant shall pay to the City 8/15th's of the
$11,218.00 connection charge or $5,982.91. The remaining $5,235.09 shall be
levied as a special assessment for a period of seven (7) years at an interest rate
of 9.20%. The effective date of this levy shall be November 22, 1993. �
2. Applicant shall pay the current sewer availability charge and applicant's
contractor shall obtain a connection permit prior to connecting to the municipal
sewer.
3. The method and location of the connection, which will likely require installation
of a new stub into the existing sewer line, shall be approved by the Public Works
Department prior to making such connection. The applicant shall bear all costs
of making said connection and restoration of City right-of-ways, if required.

4. Prior to connection, applicant shall �grant to the City a permanent easement for
sanitary sewer and utility purposes for future sewer construction across or
adjacent to applicant's property, such easement to meet with the approval of the
Public Works Director.
