COMIV�RCIAL SITE PLAN FOR SAILORS WORLD, INC. FILE NO. 1874 WHEREAS, Gary DeSantis of Sailors World Marina and Yacht Club, Inc., a Mi.nnesota•corporation (hereinafter "the applicant") has an interest in the property located at 1955 Shoreline Drive within the City of Orono (hereinafter "the City") and legally described as follows: Exhibit A, attached (hereinafter "the property"); and • • WHEREAS, the applicant proposes the installation of an 8' x 8' x 20' accessory storage module on the property, which module constitutes structural hardcover, an encroachment in the required street yard, and which will reduce the number of parking spaces on the properry, and therefore has applied to the City for variances to Municipal Zoning Code Section 10.22, Subdivision 2, Section 10.56, Subdivision 16 (L) and Section 10.41, Subdivision 10 (D) to permit a change in the nature of existing hardcover in the 75-250' zone which contains 5,100 s.f. or 83.6% hardcover as approved in Resolution No. 2891 of the City Council, where only 1,525 s.f. or 25% hardcover would normally be allowed, and for a variance to Section 10.41, Subdivision 5 (A) to allow reduction of one parking sta.11 from the 42 stalls approved in Resolution No. 2891 which granted a variance to the 48 stall requirement for this site, and for a variance to Section 10.41, Subdivision 9 (B) to allow a 28' street yard setback for a storage structure where a 30' street setback would normally be required; and per Section 10.41, Subdivision 2 seeks approval of an amended commercial site plan to allow the installation of said � storage module. � NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. The Orono City Council granted variances and approval for a commercial site plan review for Smith's Bay Marina and Yacht Club, Inc. (Zoning Application #1592) per Resolution No. 2891 on October 22, 1990. Pursuant to that , resolution, the current property owners constructed a marina clubhouse and have completed the majority of the site improvements required with that approval. . 3. The applicant has requested approval for installation of an 8' x 8' x 20' removable storage module on the properry, based on the following stated hardships: A. A hardship exists due to lack of equipment storage for marina related activities to effectively run the niarina business. This lack of storage results in an inability to accommodate customers demands for facilities to store personal boating equipment. • B. The amount and type of items proposed to be stored in this module are . enumerated in the applicant's letter to the Orono Planning Commission dated November 1, 1993 and incorporated herein by reference. C. A small extension to the existing building could be of dimension no more than 6' x 6' in area without encroaching on existing windows, doorways, or extending into the site parking area. � 4. The site layout makes it very difficult to relocate the single parking space which will be el'uninated by placement of the storage module without a significant reconf'iguration of the parking layout or encroachment into the designated non- hardcover landscape areas. To compensate for loss of this space, which reduces the number of spaces to 41 where 42 were approved via Resolution 2891 and 48 would normally be required, the applicant has provided a letter of agreement with the Minnetonka Art Center approximately 1/4 mile west of the marina, for � overflow parking. . 5. The proposed location of the storage module located 28' from the County Road 15 right-of-way where a 30' street yard is normally required, is a location that is � extremely visible from said road, and therefore visual screening of the module by use of evergreen type vegetation is imperative to reduce the negative visual impacts. 7. It is the clear intent of Municipal Code Section 10.41, Subdivision 7 (b) that required landscape areas not be used for the storage of boats, equipment, or materials. The proposed storage module will provide storage such that none of the landscape areas per the approved site plan need be encumbered with storage of any kind. 8. This property cunently consists of two tax parcels. The boundary line between the two parcels abuts parking stall #34. This leaves virtually no setback between the parcel side lot line and the module. Technically this requires a side setback • variance unless the two properties are legally combined. The properties should therefore be combined. . 9. The City Council has considered this application including the fmdings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 10. The City'Council fmds that the conditions existing on this properry are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property . right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. One 8' x 8' x 20' storage module may be located in parking stall #34 per the site plan attached to this resolution as Exhibit B. The City Council reserves the right to reconsider and revise this approval at a future time if the storage module becomes a nuisance. 2. The storage module shall be free standing and shall have no foundation in order � to preserve its mobility. . 3. Per City Council discussion of 12-13-93, storage module may have doors facing County Road 15 subject to adequate screening as noted in Condition 4 below. >� � ,' 4. The storage module shall be screened from street view by an integrated landscape • plan that shall include evergreen plantings of a size and spacing to provide at least a 50% screening of the module in the first year, with potential in three years to � be 100% screened along the County Road 15 side and the south end. Screening � shall not be allowed to interfere with vehicle site distance for vehicles exiting the . site. Further, the storage module shall be painted the same color as the clubhouse building. 5. The module shall remain on the site only as long as an off-site parking agreement . with the Art Center or other entity remains in effect. 6. In conjunction with the approval of this storage module, no storage of materials, equipment, or boats shall occur in any of the non-hardcover landscape areas indicated on the site plan. 7. For zoning purposes, applicant shall obtain a permit from the City prior to installation of the storage module. 8. Prior to issuance of the above noted permit, applicant shall legally combine the two tax parcels. _ 9. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 11. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
