The Tor­ rens office will be calling me with the document numbers once they have been assigned and I will, of course, pass this in­ formation on to you. Ann, I am returning Universal's original file which now in­ cludes the following: 1. Certified copy of the resolution 3326 approving the subject lot line rearrangement; and, 2. Original request for a combined reassessment with the transfer enter approval from the Department of Property Tax and Public Records. I called up the old property identification numbers on the County's computer and the legal description screen verifies that a division is in process for 1994. That screen further indicates the new identification numbers are as follows: 20-117-23-31-0029, the Barrett property has become 20-117-23- 31-0072; 20-117-23-31-0030, the Wheeler property has become 20-117-23-31-0073. It is probably a good idea for someone at Universal to check the actual tax statements legals next year just to make sure that everything tracks. Mss. Specifically, paragraph one of the resolutions suggests that once the resolution is approved, the property owners will ap­ ply to the city for the rearrangement. I am under the im­ pression that that is what the process has been all about, however, if there are further specifics that are required, please advise me. Paragraph two indicates that the city will be filing the di­ vision with the Registrar of Title Office together with a certified copy of the resolutions. As you know, the cer­ tificates of title for these properties already reflect the rearrangement, however, the county's tax records do not. I assume, therefore, that the resolution will be provided to the taxing authorities which will then make changes in their office to reflect the rearrangement. I would appreciate it if you would provide me with information verifying that the appropriate steps have been taken and the tax records have been changed, as well as any and all information concerning recording at the Registrar of Titles Office. In the alterna­ tive, if you prefer to send the survey and a certified copy of the resolution to my office, I will undertake to ensure that proper steps are taken with the county. With respect to paragraph three of the resolutions, I am pre­ suming that the resolution refers to the exchange of deeds that ordinarily would be necessary after a lot line rear- Ms. Jean Mavis September 28, 1993 Page 2 rangement, but is unnecessary in this case, since the subject certificates of title already reflect the lot line rearrange­ ment. Mabusth, Building & Zoning Administrator September 16, 1993 #1847 Michael and Dana Barrett/James and Molly Wheeler, 2912/2918 Casco Point Road -Subdivision of a Lot Line Rearrangement -Resolution Additional Exhibit H -Minutes of August 16, 1993 Planning Commission Meeting Brief Review of Application In 1983, the owners of the two parcels completed a lot line rearrangement without the approval of the City of Orono. The properties are torrens and Certificates of Title were amended reflecting the lot line changes. As City did not approve the subdivision, taxes have never been adjusted nor has the official map of the County recorded the lot line change. Mark Green of Standke, Green & Greenstein Ltd. has been hired by Universal Title Insurance Company to complete the necessary steps so that lot line rearrangement is officially recognized by City. Refer to Exhibit G, Parcel B consists of approximately 1400 s.f. and will be combined with Tract I. Tract I, currently at 15,000 s.f., will now total 16,489 s.f. upon the completion of the lot line rearrangement. Tract J will contain 18,579 s.f. The attorney representing the applicants was asked to consider at this time a 10' setback from the newly proposed lot line rather than the 8' 4" setback agreed to by owners in 1983. The applicant advised that as properties are torrens, the change in descriptions would require additional title amendment. The attorney also advised that the owner of Tract J was hesitant to grant more area feeling that the proposed lot line reflects the current usage pattern for the properties. The attorney asked the Planning Commission to consider the lot line rearrangement as created in 1983. Please review the enclosed packet of information prepared for Planning Commission review and minutes of that meeting (Exhibit H). Planning Commission Recommendation The Planning Commission recommended unanimous approval of the lot line rearrangement as proposed and approved the substandard setback of 8' 4" noting that the current structure is located 2' from the shared l9t line. Approval was subject to the applicants legally combining Parcel B with Parcel C or Tract I. MINUTES OF THE ORONO PLANNING COMMISSION 1\-IEETING HELD AUGUST 16, 1993 ZONING FILE #1844 -CONT. Hopkins said that lot line rearrangement will help save a large tree that would otherwise have been in the middle of a driveway. He is in agreement with the engineer's report. It was moved by Nolan, seconded by Smith, to recommend approval of Application #1844 for Ken Hopkins, 65/75 Ferndale Green, subject to five conditions as outlined by the City Engineer and further recommendation regarding the slope, seeding and the use of a fiber blanket. Vote: Ayes 4, nays 0. Hopkins reported there is a dangerous situation in pulling out of Ferndale Green onto Ferndale Road because of low trees hanging onto the road . The Affidavit of Publication and Certificate of Mailing were noted . Michael Barrett and Mark Greene, an attorney representing Universal Title Insurance, were present . Mabusth explained that in 1983 the property owners completed a lot rearrangement without the approval of the City which provided for .an 8'4 11 setback to the new division line. The City did not have an opportunity to review it. The City would have asked for a 10' setback from the corner of the residence. The owners are asked to consider the issue at this time. Universal Title Insurance Company has hired Mark Green to complete the lot line rearrangements . Greene stated this is to remedy a discrepancy between the legal descriptions that appear on the Certificates of Title for the properties, tax records and City records. A fence has existed between the properties for some time. The purpose is not to create any new lot but just to change the configurations to coincide at the City and County. The parcel was split off before the City actually approved it. Chair Schroeder suggested 10 ' problem be corrected . He had spoken to Wheeler who had seeme_d supportive of altering the line. In the early '70s, an attorney was hired to correct the legai descriptions by adding the 15' piece of land to Parcel C. Parcel A, where the Wheelers are now living, was first sold in 1976. His father passed away in 1980 and nothing has been done with the fence. It seemed apparent that the City did not require approval back in 1971. He does not have a problem with the either the present proposal or the addition of 1 1/2' · to the line. Smith questioned if the two mature oak trees would be affected. Barrett stated that the trees would not be impacted. Some time in 1983 the owners of both properties agreed to lot line change whereby triangular parcel (review Exhibit F) of Tract J (2918) was to be combined with Tract I (2912). Greene stated this is to remedy a discrepancy between the legal descriptions that appear on the Certificates of Title for the properties, tax records and City records. A fence has existed between the properties for some time. The purpose is not to create any new lot but just to change the configurations to coincide at the City and County. The parcel was split off before the City actually approved it. Chair Schroeder suggested 10' problem be corrected. He had spoken to Wheeler who had seemed supportive of altering the line.
