HomeMy WebLinkAbout#1847 Resolution 3326- - - CITY ~f ORONO RESOLUTION OF THE CITY COUNCIL NO. 3 3 2 6 A RESOLUTION APPROVING A METES AND BOUNDS SUBDIVISION OF A LOT LINE REARRANGEMENT FOR PROPERTIES LOCATED AT 2912 AND 2918 CASCO POINT ROAD FILE NO. 1847 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision of a lot line rearrangement by Michael and Dana Barrett and James and Molly Wheeler (hereinafter "the? subdividers 11 ) of properties legally described on the survey attached to this resolution as Parcels A a_nd C (hereinafter "the property 11 ); and · WHEREAS, the subdividers have completed all requirements of the City for a metes and bounds subdivision of a lot line rearrangement for division and combination purposes. . - NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the metes and bounds subdivision of a lot line rearrangement for Michael and Dana Barrett and James and Molly Wheeler as shown on the Certificate of Survey by Advance Surveying & Engineering Co. dated July 14, 1993, and attached to this resolution, subject to the following conditions: 1. Upon approval of this subdivision,. the subdividers shall apply to the City for the legal combination of Tract I, Registered Land Survey No. 461, Files of Registrar of Titles, Hennepin County, Minnesota with that part of Tract J, Registered Land Survey No. 461, Files of Registrar of Titles, Hennepin County, Minnesota which lies southwesterly of a line and its extensions drawn from the most southerly corner of said Tract J, to a point in the northwesterly line of said Tract J, 16 feet northeasterly from the most westerly corner of said Tract J. The aforesaid division shown on the attached Certificate of Survey shall be flied by the City of Orono with the Registrar of Titles Office on or before March 27, 1994 together with a certified original copy of this resolution. · 3. The. subdividers are hereby advised that in order to fulfill the intent of this subdivision, that additional documentation must be created to provide for the legal transfer of fee title. 4. The approval granted by this resolution shall expire if the division has not been filed by the date specified above. In that event it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City. Council of Orono, Minnesota this 27th day of September, 1993.
