Following the public hearing the Commission voted 6 to Oona motion in favor of approving the variance. Planning Staff Recommendation Staff recommends approval of the variances as requested. Draft Resolution Proposed Survey Proposed Plans & Elevations PC Staff Report & Exhibits 09/17 /15 Draft PC Minutes 09/21/15 A RESOLUTION GRANTING VARIANCES FROM MUNICIPAL ZONING CODE SECTIONS 78-1288, 78-1680 & 78-1700 FILE NO. 15-3778 Council Exhibit A WHEREAS, Todd Michael Balan, a single person (hereinafter "the Owner") is the owner of the property located at 2905 Casco Point Ro~d within the City of Orono (hereinafter the "City") and legally described as: Lot 98 and 109; also that part of vacated Lake Shore Avenue, and that part of the tract of land between said vacated Avenue and the shore of Lake Minnetonka, lying between extension across if of the side lines of said Lot 98, all in Spring Park, Hennepin County, Minnesota (Certificate of Title No. 1386168) (hereinafter the "Property"); and WHEREAS, the Owner has made application to the City of Orono for variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow construction of a new detached garage partially over existing hardcover resulting in 29. 79% hardcover where 29. 79% exists and 25% hardcover is permitted; and WHEREAS, after due published notice and .mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on September 21, 2015 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NO'W, THEREFORE BE IT RESOLVl;D by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 15-3778. 2. The Property is located in the LR-1C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 0.5 acres and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on September 21, 2015 and voted 6 for and 0 against on a motion to approve the conditional use permit and variance. The Planning Commission finds that the following factors support the granting of the request: Page 1 of 5 a. The Property has 24,136 square feet or 0.55 acres in area and 61 feet at the OHWL and 61' at the 75-foot setback. b. The variance is in harmony with the general intent and purpose of the Ordinance. The Owner proposes to construct a new detached garage resulting in no net increase of hardcover over existing levels. The construction of a garage in a residentially zoned property is consistent with the Ordinance. c. The variance is in harmony with the general intent and purpose of the Ordinance. The Comp Plan has directives which are put in place to protect the lake, limit massing and hardcover. While the overall mass on the Property may increase, the proposed plan results in neither an increase in structural coverage (over the permitted 15% level) nor.hardcover. d. The proposed garage will be located in a compliant location. e. The Owner has established that there are practical difficulties. f. The Owner proposes to use the Property in a reasonable manner not permitted by the official controls. g. The Property is long and relatively narrow. There is approximately 4,000 square feet of driveway needed to access the home and allow for on site parking. These are circumstances unique to the Property not created by the Owner; h. The varianceWIII not alter the essential character of the locality. The proposed garage does not appear to result in a negative impact on the character of the neighborhood. i. The home and attached garage are approximately 200 feet from Casco Point Road, resulting in a significant amount of hardcover to serve the Property via a lengthy driveway. Other lots in the area have similar configuration; the proposed level of hardcover is not out of conformance with the general neighborhood. j. There does not appear to be superfluous hardcover to remove to result in a functional and conforming level of hardcover on the Property. The existing level and site constraints serve as a practical difficulty. Page 2 of 5 4. The Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Owner and the public, and the effect of the proposed variance and conditional use permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property.in this zoning district; that granting the variance and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS,ORDER AND CONDITIONS Based upon one or more of the above findings, the .Orono City Council grants: a CUP pursuant to Orono Municipal Zoning Code Sections 78-1288: 78-1680 and 78-1700 to allow construction of a new detached garage partially over existing hardcover resulting in 29.79% hardcover where 29.79% exists and 25% hardcover is permitted; subject to the following conditions: 1. Council approval is .based on the survey and. plans submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A & 8. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed overall hardcover !eve.ls shall not exceed the existing level of 29.79%. 3. Compliance with ~U permitting requirements of the Minnehaha Creek Watershed District. 4. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining permits and commencing construction of said project within one year of the date of Council approval, or the approvals granted by this Reso.lution will expire on that date (October 12, 2016). 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owners' heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property. Governing Regulation: Variance (Section 78-123) In reviewing applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances #15-3778 17 Sept2015 Page 3 of 4 where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with this chapter. The board or the council may not permit as a variance any use that is not permitted under this chapter for property in the zone where the affected person's land is located. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. According to MN §462.537 Subd. 6(2) variances shall only be permitted when: 1. The variance is in harmony with the general intent and purpose of the Ordinance. The applicant proposes to construct a new detached garage resulting in no net increase of hardcover over existing levels. The construction of a garage in a residentially zoned property is consistent with the Ordinance. 2. The variance is consistent with the comprehensive plan. The Comp Plan has directives which are put in place to protect the lake, limit massing and hardcover. While the mass on the property may increase, the proposed plan results in neither an increase in structural coverage {over the permitted 15% level) nor hardcover. 3. The applicant establishes that there are practical difficulties. a. The property owner proposes to use the property in a reasonable manner not permitted by the official controls; the proposed garage will be located in a compliant location. In staff's opinion, this criterion is met; b. There are circumstances unique to the property not created by the landowner; The property is long and relatively narrow. There is approximately 4000 square feet of driveway needed to access the home and allow for on site parking. In staff's opinion, this criterion is met; and c. The variance will not alter the essential character of the locality. The proposed garage does not appear to result in a negative impact on the character of the neighborhood. In staff's opinion, this criterion is met. Additionally City Code 78-123 provides additional parameters within which a variance may be granted as follows: 4. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The home and attached garage are approximately 200 feet from Casco Point Road, resulting in a significant amount of hardcover to serve the property. Other lots in the area have similar configuration; the proposed level of hardcover is not out of conformance with the general neighborhood. 5. The conditions do not apply generally to other land or structures in the district in which the land is located. The applicant's property is unique in that the home is located nearly 200 feet from the road resulting a lengthy driveway. 6. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant. The applicant indicates that this is true. 7. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. In staff's opinion, this criterion is met. 8. The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty. There does not appear to be #15-3778 17 Sept 2015 Page 4 of 4 enough excess available hardcover to remove to result in a functional and conforming level of hardcover. The existing level and site constraints serve as a practical difficulty. The Commission may recommend or Council may impose conditions in granting of variances. Any conditions imposed must be directly related to and must bear a rough proportionality to the impact created by the variance. No variance shall be granted or changed beyond the use permitted in this chapter in the district where such land is located. Practical Difficulties Statement Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Practical Difficulties Analysis Staff finds that the existing hardcover level and home location combined with the length and width of the property create practical difficulties for expanding the home or constructing a detached garage without variances. The applicant has provided a plan which results in no additional hardcover and is below the permitted structural coverage limitations. The Certificate of Survey should be revised to indicate perimeter erosion control measures (siltfence, biologs, etc.) down gradient from proposed work. Measures must be installed by the Contractor and inspected by the City prior to any work. Contractor must provide a minimum 24 hour notice prior to inspection. 2. The excess impervious surface should be mitigated with runoff volume reduction measures to minimize hardcover impact. The Survey should be revised to indicate location of proposed measures and how runoff is to be routed to them. Details/ typical sections should be submitted for review, along with calculations verifying required volume reduction is provided. 3.
