The larger packet is for new construction and major additions. In both packets, it indicates that a certificate of survey is required. Typically, a survey is required for the variance application that shows the existing and proposed plans. Your plans for your addition have changed since the City Council reviewed the variance, the amount of structure has increased. In the finding granting the variance, 3A indicates that no structural lot coverage or hardcover variances were needed. Your shoreland setback was not shown on the survey, but the worksheets indicated that you were in the 25Q,.,S00' setback where the maximum hardcover amount is 30%. The structural lot coverage is 15% for all lots under 2 acres. I did not calculate your lot coverage for the variance because it did not appear to be a problem. Since this addition has been enlarged, you may have a lot coverage problem. You may want to consider applying for a lot coverage variance. The applicant had requested preliminary approval by the Council prior to the Park Commission's review. Council members were concerned about the wording of the park fees to be paid by the applicant. . . Van Zomeren reviewed the application stating the applicant was requesting a height variance and an average lakeshore setback variance in order to construct a new residence on a vacant lot. It was noted the applicant has reduced the original height of the proposed observatory by using a different construction method which lowers the proposed height. Van Zomeren explained how the definition of building height is addressed in the code. Council had concerns regarding the height of the building and the impact it would have as viewed from the lake. Peterson asked if there was someway to eliminate the need for a 1'4" height variance. The relocated garage would be 30' from the street, however the property line is 1 O' from the street setback across part of the east half of the front lot line. Because of the unusual shape of the front property line relative to the street, the relocation of the garage requires a 1 O' front yard setback. 2. Section I 0. 03, General Provisions, Subd. 9, Accessory Buildings, D. Location No detached garages or other accessory buildings shall be located nearer the front or street lot line than the principal building on that lot except on lots which have frontage on a lake and rear yard adjacent to a street.. .. The proposed relocation of the garage places the garage closer to the street and front property line than the principal structure. The relocated garage encroaches approximately 3' into the required front yard based on the location of the principal structure. 3. Section 10.03, General Provisions, Subd. 12, Crowding Principal Buildings. No accessory building or structure, unless an integral part of the principal building, shall be erected, altered, or moved within ten feet of the principal building, nor within ten feet of another accessory building. The sketch plan for the relocation of the garage indicates that the principal structure and the garage would be separated by 1 O'. The applicant needs to verify on the building plans that the garage will be located at least 1 O' from the house. 4. Driveways It is a City policy that each residence have no more than one driveway unless traffic and safety conditions warrant a second curb cut for ingress and egress. The applicant has asked for approval to have a second curb cut to allow for improved visibility due to the limited sight lines along the curve on Casco Point Road. The Director of Public Services has reviewed the request with the City Planner/Zoning Administrator and recommends approval of the second curb cut. Issues 1. The lot area is 14,686 sq. ft. or .337 acres, the minimum for the LR-IC district is .5 acres. 2. The proposed design does not require a lot coverage or hardcover variance. 3. The garage is proposed to be located 20' from the front lot line and to encroach 3' into the required front yard setback based on the location of the principal residence. 4. The applicant has stated that she designed the addition and patio area to preserve lake views down the driveway and to allow for light 5. The applicant has stated that the natural area to the east of her property often smells like decaying leaves and she would like to relocate the garage and build an addition that allows air to circulate through the patio area. 6. The Public Services Director has recommended approval of the driveway to provide safe ingress/egress. 7. The applicant will need to verify on building plans that the principal structure and the garage are separated by at least 1 O'. Statement of Hardship The lot does not meet the minimum lot area requirements for the LR-1 C district. The front lot line is unusual. Part of the front lot line extends to the middle of the street on the west half of the property and on the east part of the property the front lot line is 10' away from the roadway. The front lot line configuration impacts the relocation of the existing garage. Planning Commission Recommendation The Planning Commission recommended approval as submitted. Studies have shown that sediments, oils, and debris carried into the lake from highly urbanized areas have a detrimental impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake. Per Section 10.03, Subdivision 9, to permit the relocated garage to be located approximately 3' forward of the principal structure where no accessory building is allowed to be located nearer to the front or street lot line than the principal structure. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2219. 2. The property is located in the LR-lC Single Family Lakeshore Residential Zoning District requiring one-half acre in area. The property consists of 14,686 s.f. or .337 acres. 3. The Orono Planning Commission reviewed this application on March 17, 1997, and recommended approval of the proposed variances based upon the following findings: Page 1 of 4 A. The proposed design does not require structural lot coverage or hardcover variances. B. The applicant shall verify on building plans that the principal structure and the garage are separated by at least 1 O'. C. The proposed design preserves light and lake views and allows for air circulation on the property. D. The Public Services Director has approved the proposed driveway with two curb cuts. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.25, Subdivision 6 and Section 10.03, Subdivision 9 to permit the relocation of an existing garage to be located 20' from the front property line, 30' from the street, and 3' into the front yard forward of the principal structure, including a driveway with two curb cuts. Approval was subject to the following conditions: 1. The relocated garage shall be located at least 1 O' from the principal structure. Page 2 of 4 2. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (March 24, 1998). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of herself, her heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; ( c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subd. 4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
