Kelley asked if the existing house on the north will provide for an easement for access to
the southern lot. Gaffron informed him that the access easement could be abandoned and
a driveway built instead. Kelley asked if this would be allowed. Gaffron said yes, but it
would be dependent on the hardcover. Kelley questioned whether this Council would .
make that approval. Gaffi-on indicated the driveway relocation could be accomplished
without a variance but not if the northern house is expanded. Kelley questioned whether
the property owner would use the driveway as a hardship. He said he was attempting to
visualize what might occur in the property in the future .
Hurr reiterated that the lots are two separate parcels. She also indicated that the
applicant is granting a drainage easement, for facilities which were built at their expense.
The application will result in a 15' easement and tie together some loose ends.
(Flint arrived at this time, 8:15 p.m.)
Goetten said the subdivision is an improvement for the property.
Jabbour asked that the record note to future ownership that this approval might self
impose a future hardship if it does not have utilization of the driveway. Gaffron clarified
for the record that if a long driveway is created, it may create a self-imposed hardship.
Peterson moved, Goetten seconded, to approve Resolution No. 3948 per subdivision of a
lot line rearrangement . Vote: Ayes 4, Nays 0.
Peterson moved, Goetten seconded, to approve lot area, lot v.-idth, and .hardcover
variances for Wyatt and Nancy Moe at 1220 Loma Linda Avenue and 1230 Spruce Place.

Peterson moved, Goetten seconded, to approve Resolution No. 3950, a vacation of

northern lot questioning whether this needs to be determined at this time. Hurr responded
that the applicant currently owns both properties and could grant an easement or use

Mdvfillan questioned whether the driveway to Loma Linda would create hardcover
oroblems . Gaffron said it would entail hardcover in the 75-250' setback. The drivewav
while contributable to the property would increase the hardcover but most likely not
problematic. He indicated the applicant has the right to a driveway and could have an
easement. He felt if the property was sold, it may be in the best interest to have a separate
driveway. He would suooort the ootions for the future.
McMillan moved, Berg seconded, to approve Application #2272/2277 per Staff

Van Zomeren reported that the .355 acre lot is in the LR-lC 1/2 Zoning District. The
application is a request to add a 10'9"x4' bay window in the side yard. It would result in
replacing non-structural hardcover over existing rock with structural hardcover. The 0-75' ·
setback includes 147 s.f. of hardcover and no changes are proposed. Reolacing of rock
with structure in the 75-250' setback would result in 60.05% hardcover.
Van Zomeren said she has spoken with Building Official,Lyle Oman, and Building
Inspector, Bruce Vang, regarding drainage, which flows into the side yard. The applicant
has worked with their neighbor in redirecting the drainage, which has contributed to the
hardcover amount. Van Zomeren said she asked Vang an<l Oman if aY of the hardcover
was necessary for drainage and was infonned that some of it could be removed but no
spec-ific direction was given.

An anonymous fax was sent to Van Zomeren regarding the application where it was
StU?gested that oermits were not received for all orevious work done at that address.
Lindquist read the fax into the minutes, and a copy is included in the packet.
Schroeder asked if the letter could be verified. Van Zomeren said she did not receive any

that the proper permits were obtained for remodeling in 1986.
Bryce Peterson said he has spoken with bis next-door neighbor who supported the project.
Peterson said their lot is small and has a modest home. He eniovs the neimiborhood and
would like to have a bayed area for sitting as there is no formal dining room. Peterson
indicated that the rock area drains away from the lake. He proposed the suggestion for
removal of hardcover near the garage area.
There were no public comments.
Lindquist noted the presence of a large amount of plastic under landscaping. He
questioned the drainage flow direction and whether plastic could be removed. Van
Zomeren indicated that while some plastic could be removed, she did not know the
location where the hardcover was necessarv.
Lindquist questioned whether the necessary hardcover was on the east side of the
orooertv. Brvce Peterson said he is a landscaoe architect and could answer that ouestion.
He noted where it was possible to remove hardcover by the garage. Peterson said the plan
is to cover the rock area which cannot be removed due to drainage concems on the west
side of the residence.
Schroeder asked about the shed by the lake. Peterson said he uses it as a boathouse. It is
made of block with wood and the block retains the soil.
McMillan moved, Lindquist seconded, to approve Application #2274 with removal of
hardcover as indicated bv the !!arruze in an amount of even exchan!!e for additional
structure, 43 s.f. Vote: Ayes 7, Nays 0.

There is a shed, sidewalk, and a portion of the patio located within the 0'-75' setback which consists
of 147.5 sq. ft. (3.12%) of hardcover. No changes are proposed for the 0'-75' setback. In the 75'-250'
setback, the applicant proposes to construct a 10'9" by 4' bay window over non-structural hardcover.
The amount of hardcover on the subject lot is due to the rock mulch and plastic that is located in the
yard to direct runoff away from the house. The Building staff have reviewed this application and
believe that the hardcover in the west yard should remain. However, they feel that rock mulch
elsewhere on the site could be eliminated.
STATEMENT OF HARDSHIP
The applicants have noted on their application that their lot is narrow and that the rock and plastic
is to prevent water from damaging their basement.
Criteria for Determining Undue Hardship
1. The property in question cannot be put to a reasonable use if used under conditions
allowed by the official controls.
The residence can continue to be used for residential purposes without the addition of a bay
window.
2. The plight of the landowner is due to circumstances unique to his property not created
by the landowner.

The percentage of hardcover on the lot is due to the lot size not meeting the minimum
lot size or width and the need to prevent water in the basement.
3. The variance, if granted, will not alter the essential character of the locality.
The bay window will not change the architectural style or character of the residence or
neighborhood.
4. Economic considerations alone shall not constitute an undue hardship if reasonable
use for the property exists under the terms of this chapter.
Economic factors are not a consideration with this application.
5. Undue hardship also includes, but is not limited to, inadequate access to direct sunlight
for solar energy systems.
Solar access is not a consideration.
6. The Board of Appeals and Adjustments or the Council may not permit as a variance
for any use that is not permitted under this Chapter for the property in the zone where
the affected person's land is located.
The bay window is an allowed architectural feature in residential districts.
7. The Board or Council may permit as a variance the temporary use of a one-family
dwelling as a two-family dwelling.
Not applicable.
8. The special conditions applying to the structure of land in question are peculiar
to such property or immediately adjoining property.
The applicant worked with his neighbor to put rock and plastic in the side yard to prevent
water from entering their basements.
9. The conditions do not apply generally to other land or structures in the district
in which said land is located.
Other properties in the neighborhood are also zoned LR-IC and subject to the same

hardcover requirements. Many of the lots in this area do not meet the 1/2 acre lot size
requirements which contributes to the total amount of hardcover in the 75'-250' setback being
more than the 25% of the total lot area.
10. The granting of the application is necessary for the preservation and enjoyment
of a substantial property right of the applicant.
The applicant will need to provide testimony regarding their need and desire for the bay
window.
11. The granting of the proposed variance will not in any way impair health, safety,
comfort, morals, or in any other respect be contrary to the intent of the Zoning Code.
The variance will not impair health, safety, comfort or morals.
12. The granting of such variance will not merely serve as a convenience to the applicant,
but is necessary to alleviate demonstrable hardship or difficulty.
The amount of hardcover on this lot exceeds the 25% requirement because of the small lot
size and the rock and plastic between the applicant's property and the neighbor's to redirect
water flow across the property. Drainage on this property is a problem due to topography.
1. The subject property does not meet minimum lot area or lot width requirements.
2. The topography of the subject property is steep in the 0'-75' setback. The property to the west
is higher than the applicant's property. Without redirection, water would run from the
northwest corner to the southeast corner of the subject property.
3. The proposal is to install structural hardcover over non-structural hardcover.
4. The permit record shows that the building was renovated in 1986. It was re-sided in 1993
and a permit for a porch was issued in 1994.

STAFF RECOMMENDATION
To amend or approve a variance to allow a 10' 9" x 4' bay window (structural hardcover) to be
installed over non-structural hardcover and to discuss with applicant opportunities to remove
hardcover elsewhere on the lot that is not needed to redirect drainage.
