Stockdale, Pres. of Edgework Builders Inc. dated 1/16/95 Brief Review of Application Applicant contacted the City in November of 1994 to advise of an immediate need to replace a retaining wall that was in a serious state of disrepair and if not replaced before spring rains would more than likely collapse into their lakeshore. Staff advised applicant of the abbreviated holiday schedule for the Planning Commission noting that the City would be unable to process a conditional use permit application to allow the installation of the wall before a January meeting. It would be impossible to install the wall during the months of January and February because of the condition of the soil. The applicant advised of an immediate emergency and need to proceed in early November to replace wall. Before staff would allow construction to begin, th -~ applicant was advised that the City Engineer must inspect the site to confirm if there was a potential for collapse of the wall and the bank and if he concurred then applicant would provide all the necessary engineering plans and specs for his review and recommendation. The inspection was completed by both the Zoning Administrator and Mr. Gustafson at which time he confirmed that wall was in serious disrepair with potential for collapse. Staff also remembered that properties to the immediate west located on the same bank sustained major damage when older retaining walls collapsed during the 1987 storm. The applicant was required to file a conditional use permit before the work could commence. The original wall is constructed of timbers and was approximately 6-7' in height. The current wall installed with Allan Block extends from · the east side at approximately 5 ½' to the west at Request for Council Action continued February 6, 1995 Page 2 of 2 #1986 David Yorks, 2825 Casco Point Road approximately 8' in height. The City was not contacted for inspections during the period of the installation of the wall so it is impossible for the Engineer to confirm that all directives of the engineering plans for the Allan Block design wall or the City Engineer's recommendations were adhered to. The Engineer recommended that the contractor provide a letter confirming that all required steps were fulfilled in the construction of the 8' high wall. Review Exhibit L. David A. Stockdale of Edgework Builders, Inc. confirms that the installation was installed per the manufacturer's guidelines and the Bonestroo approval. Planning Commission Action The Planning Commission recommended unanimous approval of the after-the-fact application as proposed and recommended that a building permit for the construction of the wall should not have an additional penalty fee. The Planning Commission specifically noted that staff followed an appropriate procedure in the case of the after-the-fact application. Staff would also ask Council to comment on the procedures adopted by the City staff in dealing with an apparent emergency situation. The enclosed resolution has been drafted per the findings and conditions of the Planning Commission recommendation. COUNCIL ACTION REQUESTED: To adopt or amend the approval resolution. ch A RESOLUTION GRANTING A CONDITIONAL USE PERMIT PER MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVISION 19 AND A VARIANCE TO SECTION 10.55, SUBDIVISION 8, AND SECTION 10.22, SUBDIVISION 1 (B) FILE NO. 1986 WHEREAS, David J. Yorks (hereinafter the "applicant") is owner of the property located at 2825 Casco Point Road within the City of Orono (hereinafter "City") and legally described as follows: Lot 117, Spring Park, including that part of Lakeshore A venue, vacated, and that part of the land between said vacated avenue and the shore of Lake Minnetonka lying between the sidelines of said Lot 117 extending to the shore of Lake Minnetonka, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicant has applied to the City for an after-the-fact conditional use permit and variance that would allow the reconstruction of a retaining wall within the lakeshore yard per Municipal Code Section 10.03, Subdivision 19, a conditional use permit is required for the installation of retaining walls and per Section 10.55, Subdivision 8, and 10.22, Subdivision 1 (B) the wall is located within the lakeshore protected area installed at a 25' setback from the shoreline where no such structures are allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1986. 2. The property is located in the LR-lC Single Family Lakeshore Residential Zoning District requiring 21,780 s.f. or one-half acre in area. The property consists of 14,835 s.f. or .34 acres. 3. The Orono Planning Commission reviewed this application on January 17, 1995 and recommended approval of the after-the-fact variances and conditional use Page 1 of 5 permit per Zoning Code Sections 10.03, Subdivision 19, 10.55, Subdivision 8 and 10.22, Subdivision 1 (B) to permit the 5-8' high replacement retaining wall on the property, based on the following findings: a. The lakeshore lot has a steep sloping lakeshore bank and at the top or ridge of the bank an old timber retaining wall had been installed sometime in the 1950's. b. At the site inspection in November of 1994, the City staff and City Engineer confirmed that the former wall was in a serious state of disrepair and needed to be replaced prior to the spring thaw and rains of 1995. c. The wall could not be replaced in the winter months because of the condition of the soils. d. If the wall was to fail, this would involve the major collapse of the applicant's lakeshore bank and the loss of several mature plantings. e. Existing mature plantings have been saved during the reinstallation of the second retaining wall providing screening from the shoreline. f. The wall has been installed per the standards set forth by the manufacturer and under the directives of the City Engineer. 4. The Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring properties, would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council finds that granting a conditional use permit to allow the installation of a retaining wall will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire Page 2 of 5 hazard or other danger to neighboring property, nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Sections 10.22, Subdivision 1 (B), and 10.55, Subdivision 8, and grants a conditional use permit per Section 10.03, Subdivision 19 for the installation of a 5-8' retaining wall that replaces a former timber wall at the lakeshore bank, subject to the following conditions: 1. Authorities granted by this resolution mn with the property not with the owner, but are permissive only and must be exercised by application for a building permit within one week of the date of Council's approval, or the special conditions of this resolution will expire on that date (Febmary 20, 1995). 2. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 3. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. She was advised by her contractor of the need to replace existing retaining wall prior to the spring thaw and rains. Mrs. Yorks was advised that there were no future meetings of the Planning Commission for '94 and that the first meeting of the year in 1995 would not be until January when it would be impossible for the contractor to proceed with retaining wall replacement. Staff advised that the City Engineer would make an inspection of her lakeshore yard to determine if there was a potential for serious collapse of the lakeshore bank based on the condition of the wall. Upon the City Engineer's inspection of the Yorks' property, he determined that there was indeed a great potential for the collapse of both wall and the steep bank. Mrs. Yorks was then advised that the City could issue no building permits until a conditional use permit review was completed, but that if she had to proceed that it would be advisable that she submit a conditional use permit application and provide all the necessary information for the Engineer to complete his review of the new construction. Gustafson approved the final specs and plans submitted by the Allan Block Corporation, review Exhibits C, E, F and G. Applicant was advised of the need to first complete the filing of a conditional use permit application and to also await the final review comments of the City Engineer before construction of the wall could begin. The wall was constructed sometime in late November or early December. Unfortunately, the contractor failed to ask for inspections of the project as it was being installed. The Engineer recommended that if the wall was to be installed at a height greater than 4', additional layers and depth of geo-grid were to be used. The Engineer also notes in his letter of January 11th, Exhibit D, the following should have been implemented: 1. Bond beam or bridged construction in front of existing trees. 2. Granular backfill in the bridged areas. 3. 14 inches of buried block (18 inches required at increased height) Gustafson contacted the contractor who advised he was not aware that he had to call for the inspections but noted that photos were taken during the construction of the walls and that to his knowledge, based on field notes, that all of the requirements set forth in the City Engineer's review were carried out. As Gustafson has no way of confirming that these were achieved, he Zoning File #1896 January 11, 1995 Page 3 advises that the City should require a written statement from contractor confirming that all of these had been completed as a result of the increase in height. The Building staff confirms that the contractor did provide the required erosion control during construction. It was observed from another property when completing another inspection. The Building staff was not involved in the inspection of the retaining walls as building permits were not issued nor do they routinely complete such inspections when the Engineer completes the structural/engineering review. The City Engineer will complete inspection involving land alterations proposed under a conditional use permit. Upon your inspection you will note that the landscaping beneath the steep banks of this wall have been protected. The wall, although close to 7' in height at the western edge, will not be observed because of the plantings within the steep bank and also the color of the stone used is neutral gray. Staff would caution members that if you proceed to step down the stairs to observe the wall at the base to be most cautious as the steps were slippery and difficult to descend because of the storage of portions of dock on stair structure. Issues for Consideration 1. Staff is placed smack in the middle ( or our Mayor Butler would say " between a rock and a hard place") when dealing with emergency situations in the late fall of the year such as in this case. There is no way to provide the necessary land use review to meet the winter deadline. If this applicant was delayed to the end of January, there would be no way to ensure against the collapse of the wall and bank this spring. Staff could have advised the person to proceed on their own and deal with the penalties as they come but we feel it imperative that the City Engineer provide his review and guidance for the reconstruction of walls where there is potential for a serious collapse which was the case for this property. How would the Planning Commission advise staff to proceed with these matters? 2. Other issues raised by Planning Commission. Planning Commission Recommendation Your recommendation to approve must include the following conditions required by staff: 1. Applicant's contractor to submit for both City and applicant a letter confirming that all additional improvements as set forth by the City Engineer in his report of January 11, 1995 have been fulfilled as a result of the increase in height of the retaining wall that is in excess of a height of 4' . 2. ' , We have reviewed the revised proposal submitted today to replace the existing timber retaining wall on the Yorks residence at 2825 Casco Point Road. We understand the urgency to do the work soon to prevent additional damage to the property. The revised plans are acceptable from an engineering standpoint and we would recommend approval. If the height of the wall changes at any time during construction, additional geogrid must be included for support of the wall . Prior to starting the work, silt fence must be installed along the shoreline for erosion control. Please contact me at this office if you have any questions regarding this matter . Dear Mr. Stockdale, November 15, 1994 Our in-house engineering staff has reviewed the proposed segmental retaining wall which is to replace an existing treated timber retaining wall. While it is true that no failure has occurred and your proposed walls do not substantially change the current wall geometry, this does not assure future success as this assumes a static condition and future conditions could change. Furthermore the construction of said wall(s) is on an overall slope and any design can address internal and external wall stability but not overall slope stability. For these reasons we suggest the following to insure that the replacement wall not exacerbate the current stable condition. 1. All walls should be geogrid reinforced to insure internal and external stability. 2. Geogrid reinforcement will necessarily require "benching" of the reinforced zone into the existing slope geometry. 3. To insure no future changes in the soil in the reinforced zone: a. use free draining material (limited to 5% fines) in backfill/reinforced zone and leveling pad. b. place drainage tile behind the base course of block and also at base of the reinforced zone where it meets the retained soil -all tile draining to daylight. c. backfill the top 6" (below top soil) with impermeable clay soil to prevent surface drainage into reinforced zone. d. grade to prevent surface ponding above walls. 4. Because of the slope at the toe of the wall(s) it is recommended that a minimum of 2 courses of block be buried or H'/7 embedment depth which ever is greater. One course buried block for the top 2'wall is adequate. Your proposed construction procedures are appropriate. I recommend excelsior netting be dormant seeded for Spring germination of appropriate vegetation. 6. All block and grid installation in accordance with the specifications in the Allan Block Design Manual. 7. I have included the engineered wall details for the a 6'wall which represents your major ·wall including buried block. In summary; said walls can be constructed as designed with the understanding that design parameters are for internal and external stability only and no provision for overall slope stability. As you noted, the slope has been stable and it is reasonable to assume it will remain so if conditions do not substantially change; the most critical condition being ground water. For this reason we have recommended the above procedures which we feel will insure that no hydrostatic pressures develop and selected backfill will insure soil uniformity and performance. Said construction neither improves or diminishes the global stability of the slope but given that you will be eliminating the most probably failure scenario, your approach is entirely appropriate with the disclaimer that should the total slope fail, sail failure would likely include the retaining walls. Mr. Gustafson of Bonestroo and Associates has apparently expressed concern over the effect of the "weight" of the soils on the slope. This is a legitimate concern. I feel the existing walls suggest adequate bearing capacity and slope stability and the proposed design parameters above will improved the current situation and reduce the prospect of future failure. If the height of the wall changes at any time during construction, additional geogrid must be included for support of the wall. Engelhardt We have reviewed the proposal to replace the existing timber retaining wall and riprap along the shoreline of Spring Park Bay on the Yorks residence at 2825 Casco Point Road. We understand the urgency to do the work soon to prevent additional damage to the property. However, the information submitted is incomplete . A grading plan or cross sections along the wall should be provided that shows the existing and proposed grades and elevations. This same information should be provide d for the grading and riprap work immediately adjacent to the shoreline . The existing slopes between the shoreline and retaining wall are too steep and should be improved at this time . We would recommend a maximum slope of 3 to 1 (horizontal to vertical) to prevent erosion until a suitable ground cover has been established. These flatter slopes would require a two or more tier wall be constructed to step up the bluff. If the additional walls are not used , more information should be provided to explain how the steep slopes will be stabilized, which of the existing trees will be saved and a description of the construction technique proposed for working around the mature trees and root systems in the area. The wall design submitted which includes modular blocks, geogrid and draintile is acceptable. Prior to starting the work, silt fence must be installed along the shoreline for erosion control. The rights of individual on whom the data is s·tored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data.
