Application: The applicants have proposed to remove old rotting steps on the front of the
residence. They will be replaced with maintenance free steps and a covered porch entry . The new
steps and covered entry decreases the amount of hardcover in the 75'-250' setback area. Also, the
applicant has removed landscape plastic on the west and south sides of the house decreasing the
amount of hardcover in the 75'-250' area. The requested variances are for:
1. Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L)(2): Lakeshore Hardcover
Requirements: Within 75'-250' of the shoreline there shall be no greater than 25% hardcover. To
pe1mit a hardcover variance to allow 3,919.76 s.f. (45.4%), where 4,701.76 s.f. (54 .5%) exists, and
1,725 .2 s.f. (25%) is allowed in the 75'-250' setback area.
PLANNING COMMISSION RECOMMENDATION:

MUNICIPAL ZONING CODE
SECTION 10.22, SUBDIVISION 2 AND
SECTION 10.56, SUBDIVISION 16 (L) (2)

WHEREAS, David J. Yorks and Patricia Yorks (hereinafter "the applicants") are
owners of the property located at 2825 Casco Point Road within the City of Orono (hereinafter
"City") and legally described as follows:
Lot 117, Spring Park, including that part of Lake Shore A venue, vacated, and that part
of the land between said vacated avenue and the shore of Lake Minnetonka lying
between the sidelines of said Lot 117 extended to the shore of Lake Minnetonka,
Hennepin County, Minnesota (herein after "the property");
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on October 18, 1999, at which times all persons desiring
to be heard concerning this application were given the opportunity to speak thereon; and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2) to allow
3,919 s.f. (45.4%) hardcover in the 75-250' lakeshore setback where 4,701.76 s.f. (54.5%)
exists, and 1,725.2 s.f (25%) is allowed to permit constuction of steps and a covered porch
entry to replace existing steps on the front of the residence.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:

FINDINGS
1. This application was reviewed as Zoning File #2528.
2. The property is located in the LR-IC Zoning District, where .5 acres or 21,700
s.f. is the minimum lot area. The property consists of .34 acres or 14,835 s.f.
3. The Planning Commission reviewed this application on October 18, 1999 and
recommended approval on a vote of 7 to O.
4. The Planning Commission made the following findings of fact:
A. The amount of hardcover in the 75-250' lakeshore setback would be
reduced from 54.5% to 45.4%.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56,
Subdivision 16 (L) (2) to allow 3,919 s.f (45.4%) hardcover in the 75-250' lakeshore setback
where 4,701.76 s.f. (54.5%) exists and 1,725.2 s.f. (25%) is allowed to permit construction of
new steps and a covered porch entry on the front of the residence. Approval was subject to
the following conditions:
1. Council approval is based on the site plan submitted by the applicants attached
to this resolution as Exhibit A. Any amendments to the site plan and/or
hardcover may require further Planning Commission and City Council review.
2. Authorities granted by this variance run with the property not with the
applicants, but are permissive only and must be exercised by application for a
building permit within one year of the date of Council approval, or this variance
will expire on that date (November 8, 2000).
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of
the property.

Bottenberg stated that the Applicant is proposing to remove old rotting steps on the rear of
the residence and replacing them with maintenance free steps and a covered porch entry. This
proposal will decrease the amount of hardcover in the 75-250' setback area . Bottenberg noted
that the Applicant has previously removed some landscape plastic on the west and south sides
of the house decreasing the amount of hardcover in the 75-250' area.
Bottenberg stated a variance for hardcover in the 75-250' setback area is required to permit
45.4 percent hardcover where currently 25 percent is allowed.
Yorks indicated that the steps to be replaced are located at the main entryway to the house and
not at the rear of the residence . Yorks stated that they are proposing to replace the steps due to
their deteriorating condition.
Smith inquired whether there currently is a covered porch entry .
Yorks stated that the covered porch entry is new.
Lindquist noted that the structural coverage will not change, with the hardcover being decreased
in the 75-250' setback.
There were no public comments regarding this application .
Motion by Smith, second by Berg, to recommend approval of Application #2528, 2825 Casco
Point Road, to grant a variance to hardcover in the 75-250' setback to permit removal of
the existing steps to be replaced with maintenance free steps and a covered porch entry.

HARDCOVER ORDINANCE -In 1975, the Orono City Council adopted an ordinance
limiting the percentage of lot area that can be covered with impervious surface ("hardcover")
such as roofs, driveways, sidewalks, etc. on properties located within 1,000 feet of a lake.
Studies have shown that sediments, oils, and debris carried into the lake from highly urbanized
areas have a detrimental impact on the quality of water in the lake. The intent of Orono's
ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or
vegetated yard areas before entering the lake.

-Paved or gravel driveways
-Patios & decks (includes slatted decks)
-Tops of retaining walls & rock walls
-Decorative landscape areas underlain by plastic sheeting or fabric
-Any other surface that does not allow direct absorption of rainfall into
the ground
INSTRUCTIONS FOR COMPLETING HARDCOVER CALCULATION WORKSHEET
1. Circle which setback zone (0-75', 75-250', etc.) the calculation is for.
2. For each item of hardcover within that zone, enter the length and width, and multiply
to get square footage (s.f.).
3. Add up-all the square footages to get total square footage of hardcover.
4. Divide by the total area of property within the zone and multiply by 100 to get
percentage of hardcover in the zone.
5. If changes in hardcoyer are proposed, you should do a "before" worksheet and "after
worksheet. If either results in percentages greater than those allowed, contact City staff
before proceeding with your project planning!

SignatureSec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or
to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individual. An individual asked to supply
private or· confidential data concerning himself shall be informed of: (a) the purpose and
intended use of the requested data within the collecting state agency, political subdivision, or
statewide system; (b) whether he may refuse or is legally required to supply the requested data;
(c) any known consequence arising from his supplying or refusing to supply private or
confidential data; and ( d) the identity of other persons or entities authorized by state or federal
law to receive the data. This requirement shall not apply when an individual is asked to supply
investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue may place the notice required under this subdivision in
the individual income tax or property tax refund instructions instead of on those forms ..
Subd. 3. Access to data by individual. Upon request to a responsible authority, an
individual shall be informed whether he is the subject of stored. data on individuals, and
whether it is classified as public, private or confidential. Upon his further request, an
individual who is the subject of stored private or public data on individuals shall be shown the
data without any charge to him. and, if he desires, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning,
the data need not be disclosed to him for six months thereafter unless a dispute or action
pursuant to this section is pending or additional data on the individual has been collected or
created. The responsible authority shall provide copies of the private or public data upon
request by the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the copies.
The responsible authority shall comply immediately, if possible, with any request made
pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays,
Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request within that time, he shall so inform the individual, and may have an additional five
days within which to comply with the request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individual may
contest the accuracy or completeness of public or private data concerning himself. To exercise
this right, an individual shall notify in writing the responsible authority describing the nature
of the disagreement. The responsible authority shall within 30 days either: (a) correct the data
found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or
incomplete data, including recipients named by the individual; or (b) notify the individual that
he believes the data to be correct. Data in. dispute shall be disclosed only if the individual's
statement of disagreement is included with the disclosed data.
. The determination of the responsible authority may be appealed pursuant to the
provisions of the administrative procedure act relating to contested cases.
