NOTICE
The Planning Commission will hold public hearings in the Council Chambers
at 1275 South Brown Road on Monday, July 20th, 1987, on the matter of the
following land use applications:
1. 11165 Steven Pay, 3045 Casco Point Road - seeks front yard
setback variance to construct a detached garage partially within the
defined front yard area.
2. 11166 Hartmut Ginnow-Merkert, 1840 Lakeview Terrace - seek■ front
yard setback variance to construct a 2nd story deck.

The applicants are requesting a renewal of variances in order to
construct an addition to the west side of their home. There are no
changes in the plans from the variance resolution granted on the 9th
day of June, 1986.
Staff recommends approval of the variance application subject to
the findings and conditions set forth in the enclosed resolution.

The Affidavit of Publication and Certificate of Mailing
was noted.
Zoning Administrator Mabusth explained the request for a
front yard setback variance to construct a second story
deck. Staff recommends approval if applicant can
resolve why the deck cannot be placed on the back and
east sides of the house avoiding the need for a
variance. She noted the locations of the well, septic
system and existing patio which limits the placement of
the deck.
Hartmut Ginnow-Merkert was present for this matter and
stated the main reason for not placing the deck in the
back is the noise from County Road 6. In addition, he
noted that the bedrooms were located along the east side
of the house.
Zoning Aide Knott stated that she talked to both the
adjacent neighbors and neither objected to the proposal.
Staff noted Planning Commission member Hanson's written
comments as follows:
"I would consider approval of this deck only if the
projection would be no further than the actual
setback of residences on either side and with no
objection from the said neighbors. However, I do
not agree it is the best choice and recommend
redesign."
There were no comments from the public regarding this
matter and the public hearing was closed.
It was moved by Bellows, seconded by Cohen, to recommend
approval per staff recommendation subject to no
additional front yard variances be granted. Motion,
Ayes 5, Hays 0.

Chairman Kelley read into the record a letter received
this day from J.K. Bowers, 2905 Casco Point Road, asking
the Planning Commission to consider his property
in relation to the average lakeshore setback proposed by
applicant, so that he is not deprived of lake views and
lake breeze.
Assistant Zoning Administrator Gaffron explained the
request for hardcover and average lakeshore setback
variances to construct a 2nd story three -season porch
and deck as follows:
-Hardcover 75-250' - Existing - 45.3%
- Proposed - 45.7%
-Average Lakeshore Setback Encroachment
- Existing - 0'
- Proposed - 25'
Applicant proposes to construct a 2nd story three -season
porch and deck where only a ground -level loose concrete
block patio now exists. The three -season porch is
approximately 16'x 20' surrounded on two sides by a 9'
deck.
Bellows felt that, based on the drawings submitted, it
should be considered an 'addition' to the house, not an
average opaque porch structure.
Richard Helstrom was present for this matter and stated
he did not feel the addition would obstruct Mr. Bowers'
view, and there would be a minimal view obstruction, if
any, from Elson's (2879 Casco !'oint Rd.) yard. He noted
that the addition would be 110 from the lakeshore.
Dick Kail, 2915 Casco Point Rd., stated applicant's
house is downhill from his, therefore, the addition
would not obstruct his view.

WHEREAS, Len Bachkes (hereinafter "the applicant") is the
owner of the property located at 2813 Casco Point Road within the City
of Orono (hereinafter "City") and legally descril,ed as follows:
Lot 121, Spring Park, Hennepin County, Minnesota, and all the
unplatted land and that part of Lake Shore Avenue vacated lying
between the side lines of said lot projected to Lake Minnetonka
according to the plat thereof on file or of record in the office
of the Registrar of Deeds in and for said County, (hereinafter
"the property"); and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.22, Subdivision 2 to
permit the construction of an addition which will increase hardcover
from 26.0% to 29.7% in the 75-250' setback zone where only 25% hard-
cover is normally allowed; and a variance to Section 10.25,
Subdivision 6 (8) in order to construct the additions within 9.5 feet
of the side lot line where a 10 foot setback is normally required.
NOW, THEREFORE, 8E IT RESOLVED by the City Council of Orono,
Minnesota,
FINDINGS
1. This application was reviewed as Zoning File M1167.
2. The property is located in the LR-IC Single Family :.akeshore
Residential Zoning District.
3. The Orono Planning Commission reviewed this application on
July 20, 1987 and recommended approval of the proposed variance
based upon the following findings:
A) The side setback variance of 0.5' is necessary only for
a small portion of the addition because the house side line
of the existing house is not parallel with the lot line.
B) No items of existing hardcover are readily feasible for
removal as a hardcover tradeoff.

4. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by City staff, comments by the applicant and the effect
of the proposed variance on the health, safety and welfare of the
community.
5. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance
would not :.dversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would
not merely serve as a convenience to the applicant, but is
necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the
applicant; and would be in keeping with the spirit and intent of
the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDRRR AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Section 10.22,
Subdivision 2 and Section 10.25, Subdivision 6 IBI to permit the
construction of an addition which will increase hardcover in the 75-
250' setback zone from 26.0% to 29.7% where only 25% hardcover is
normally allowed and which will be constructed 9.5 feet from the side
lot line where a 10 foot setback is normally required, subject to the
following conditions:
1. The hardcover on this property in the 75-250' setback zone
shall not exceed 2,696 s.f. or 29.7%, and the applicant is placed
on notice that any future improvements to the property which
constitute additional hardcover will not be approved, and might
be approved only with concurrent removals of existing hardcover.
2. Applicant is advised that the boathouse structure at the
lakeshore is a non -conforming structure and is subject to the
pertinent ordinances. Applicant is further advised that the
existing hardcover in the 0-75' setback zone is about 300 square
feet or 61, and no additional structures or hardcover are allowed
in the 0-75' setback zone without approval of the City Council.
3. Authorities granted by this variance run with the property
not with the applicant, but are permissive only and must be
exercised by application for a build ng permit within one year of
the date of Council appprove 1, or tiis variance will expire on
that date IJuly 27, IM).

4. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of the
zoning code, shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
5. The undersigned applicant has read, understood and hereby
agrees to the terms of this resolution and on behalf of himself,
his heirs, successors and assigns, hereby agrees to the recording
of this resolution in the chain of title of the property.

Staff felt it this was the case, Mr. Perl may no longer
need a Home Occupation License.
It was moved by Mayor Grabek, seconded by Councilmember

application, return the fee paid by applicant, and
citations will be issued if any further complaints are
received. Further, staff will monitor the situation and
if no violation occur within 3 months, the pending legal

Variance Approval is limited to i o extent shown on approved plan and
as noted in the approval resolution. Changes in approved plans are subject
to further review by the City. Variance approval expiris one year after
data of approval. Permit application must be submitted no later than
July 27, 1988.
